MINUTES OF THE ONE THOUSAND TWO HUNDRED AND SIXTIETH
REGULAR MEETING OF THE COUNCIL OF THE CITY OF LIVONIA
On November 8, 1993, the above meeting was held at the City Hall,
33000 Civic Center Drive, Livonia, Michigan, and was called to order by the
President of the Council at 8 03 p m Councilmember McGee delivered the
invocation
Roll was called with the following result Michael P McGee, Ron
Ochala, Laura M Toy, Dale A Jurcisin, and Gerald Taylor. Absent: Sean
P Kavanagh and Fernon P Feenstra (representing the City in another
capacity)
Elected and appointed officials present Robert D Bennett,
Mayor; Raul Galindo, City Engineer; John Nagy, City Planner; Harry
Tatigian, City Attorney; Joan McCotter, City Clerk, Karen A. Szymula,
Director of Legislative Affairs; Robert J Beckley, Director of Public
Works; and James Andres, Chief Accountant
On a motion by McGee, seconded by Toy, and unanimously adopted,
it was:
#887-93 RESOLVED, that the minutes of the 1,259th Regular
Meeting of the Council of the City of Livonia, held October 25,
1993, are hereby approved as submitted.
On a motion unanimously introduced, seconded and adopted, it was:
#888-93 WHEREAS, the City of Livonia recognizes the importance
of drug abuse education for our children, and
WHEREAS, the D A R.E Program, Drug Abuse Resistance Education,
through the Livonia Police Department and Livonia Public Schools
has been extremely successful in helping our children not only
avoid the hazards and dangers of drug use but also in building
the self-esteem of each student in the D A R E. classes, and
WHEREAS, the D.A.R.E. Program is conducting a bottle and can
drive at each grocery store in the City of Livonia from December
3rd through December 12th to help fund this needed and successful
program in our schools, and

WHEREAS, each of us urges you to return your bottles and cans
December 3rd through December 12th to your local Livonia grocer
Farmer Jack' s, Kroger's, Danny's, Larry's Foodland, Food
Emporium, Stan's and LaRose' s, and drop your receipts for your
deposits in the DAR E box to help our kids
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Council
hereby resolve and declare December 3rd through December 12th as
D A R.E Days in the City of Livonia and urge the cooperation and
participation of all Livonia' s citizens to help continue the work
of our DAR E Program by donating the receipts from your bottle
and can returns at your local grocer during DAR E Days
On a motion unanimously introduced, seconded and adopted, it was
#889-93 WHEREAS, after having served the Livonia Public Schools
for 27 years, as a Classroom Teacher for 4 years, as an
Elementary School Principal for 15 years, and since 1985 as
Director of Community Services and Director of Governmental
Affairs and Director of Educational Partnerships, Jack E Kirksey
is retiring on December 31, 1993; and
WHEREAS, he did also serve the citizens of this community as a
State Representative (35th District) in the State Legislature for
a period of eight years (4 terms), including service on the
following committees Education, Labor (Vice Chair) , Judiciary,
Military and Veterans' Affairs; and
WHEREAS, Jack E Kirksey did also serve this community as
Director of Probation of the 16th District Court where he
supervised and coordinated full-time and volunteer probation
officers, conducted training classes, and cooperatively
established policies with presiding district judges; and
WHEREAS, Jack E Kirksey during the course of his public service
has served on various other committees and organizations, such as
President of the Schoolcraft Board of Governors, Trustee of the
Schoolcraft College Board of Trustees, Member of the State
Department of Education Early Childhood Commission, President of
the Livonia Chamber of Commerce, President of the Board of
Directors of Livonia Family "Y", Chairperson of the Livonia Heart
Fund, President of the Livonia Educational Administrators and
Supervisors, President of the Kimberly Oaks Civic Association; as
well as on various other political, professional and civic
committees; and
WHEREAS, Jack E Kirksey, his wife, Patricia, and their
children, Amy, Matthew, and Jay, have been long-time residents of
the City of Livonia
NOW, THEREFORE, BE IT RESOLVED that Mayor Robert D Bennett and
the members of the Livonia City Council do hereby take this means
to join with the teachers, staff and administration of the
Livonia Public Schools to extend the best wishes and appreciation

of the people of the City of Livonia to Jack E Kirksey as he
retires with the hope he will continue in his endeavors for the
betterment of this community as well as enjoy continued success
in the future
During the audience communication portion at the beginning of the
meeting, Ralph Williams, 18630 Foch, addressed the subject of an ethics
panel made up of three (3) clerics
A communication from the Department of Finance, dated October 25,
1993, re: various financial statements of the City of Livonia for the
month ending September 30, 1993, was received and placed on file for the
information of the Council
On a motion by Jurcisin, seconded by McGee, it was:
A communication from the Office of the City Clerk, dated October
15, 1993, re the Clarenceville School District' s tax levy rates per their
recent millage election was received and placed on file for the information
of the Council
A communication from the Department of Law, dated October 18,
1993, re a possible ordinance amendment prohibiting the housing of exotic
animals, snakes, etc , on residential property was received and placed on
file for the information of the Council (CR 759-93)
11890-93 RESOLVED, that the Council does hereby request that
Professor Roger Sutherland, 5488 Warren Road, Ann Arbor, MI
48105, submit a report and recommendation with regard to the
provisions set forth in Section 8 24 050 of the Livonia Code of
Ordinances, as amended, which makes it "unlawful to keep, harbor,
have in possession or keep in confinement on any premises any . .
bees or creatures the nature of which, inherently when not
confined, do constitute a danger, hazard or nuisance to the
public health, safety and comfort "
1/891-93 RESOLVED, that having considered a communication from
the City Planning Commission, dated October 20, 1993, which
transmits its resolution 10-195-93, adopted on October 12, 1993,
with regard to a Sign Permit Application submitted by Jan Signs,
requesting approval for a ground sign for property located at
28760 Plymouth Road in Section 25, the Council does hereby concur
in the recommendation of the Planning Commission and approve the
said Sign Permit Application, subject to the following
conditions

1) That the Sign Package by Jan Signs, received by the Livonia
Planning Commission on 9/29/93, is hereby approved and shall
be adhered to; and
2) That the window signage shall not exceed 20% of the window
area
#892-93 RESOLVED, that having considered a communication from
the City Planning Commission, dated October 20, 1993, which
transmits its resolution 10-196-93, adopted on October 12, 1993,
with regard to a Sign Permit Application submitted by American
Signs requesting approval for one wall sign for the building
located at 11500 Middlebelt Road in Section 36, the Council does
hereby concur in the recommendation of the Planning Commission
and approve the said Sign Permit Application, subject to the
following condition
That the Sign Package by American Signs & Design, received
by the Livonia Planning Commission on 9/28/93, is hereby
approved and shall be adhered to
A roll call vote was taken on the foregoing resolutions with the following
result

Toy gave first reading to the following Ordinance
AN ORDINANCE AMENDING SECTION 18 OF THE ZONING MAP
OF THE CITY OF LIVONIA AND AMENDING ARTICLE III OF
ORDINANCE NO 543, AS AMENDED, KNOWN AND CITED AS
"THE CITY OF LIVONIA ZONING ORDINANCE" BY ADDING
SECTION 3. THERETO (Petition 93-6-1-9)
The foregoing Ordinance, when adopted, is filed in the Journal of
Ordinances in the office of the City Clerk and is the same as if word for
word repeated herein. The above Ordinance was placed on the table for
consideration at the next regular meeting

7 13 TO ARTICLE VII OF ORDINANCE NO 543, AS AMENDED,

AN ORDINANCE AMENDING SECTIONS 14 02 AND 14 03
OF ARTICLE XIV OF ORDINANCE NO. 543, AS AMENDED,
KNOWN AND CITED AS "THE CITY OF LIVONIA ZONING
ORDINANCE " (Petition 93-6-6-5)
The foregoing Ordinance, when adopted, is filed in the Journal of
Ordinances in the office of the City Clerk and is the same as if word for
word repeated herein The above Ordinance was placed on the table for
consideration at the next regular meeting
On a motion by Ochala, seconded by Toy, and unanimously adopted,
it was
#893-93 RESOLVED, that having considered a letter from Mrs
Diane Kearns, 15702 Springhill, Romulus, Michigan, dated October
19, 1993, wherein a request is submitted for installation of left
turn green arrows at the intersection of Six Mile and Haggerty,
and to which is attached a copy of a communication from the
Assistant Engineer of Traffic Operations, Division of Roads,
Wayne County Department of Public Services, dated September 20,
1993, which indicates that left turn green arrows are scheduled
to be installed at the intersections of Six Mile and Haggerty and
also Seven Mile and Haggerty as part of a resurfacing and partial
reconstruction project for Haggerty between Six Mile and Seven
Mile in 1994, the Council does hereby take this means to urge the
Wayne County Department of Public Services to complete the
aforesaid installations in an expeditious manner and with all due
haste; and the City Clerk is hereby requested to transmit a copy
of this resolution to the attention of the Engineer of Traffic
Operations, Division of Roads, Wayne County Department of Public
Services, 29900 Goddard Road, Detroit, MI 48242
A communication from Hurley J Coleman, Jr , Director of Parks,
Wayne County Department of Public Services, dated September 29, 1993, re
first annual "Festival of Lights" to be held from November 22, 1993 through
January 9, 1994 with the close of Hines Park Drive from 6 30 p m until

10 30 p.m. to accommodate the three-hour show was received and placed on
file for the information of the Council
On a motion by Jurcisin, seconded by McGee, and unanimously
adopted, it was
#894-93 RESOLVED, that having considered the report and
recommendation of the Finance Department, dated October 18, 1993,
as well as the report and recommendation of Mr. Lawrence F.
Drummy, dated October 19, 1993, with regard to proposals received
from insurance carriers in connection with the City's
self-insurance program for workers' compensation, the Council
does hereby authorize the Mayor and City Clerk to enter into a
contract for the period December 1, 1993 through November 30,
1994 with the Aetna Casualty and Surety Company, Hartford, CT
06156, to provide the City with reinsurance-excess insurance
coverage when losses from any one accident reach $300,000, for a
total premium cost of $121 ,271; and FURTHER, the Council does
hereby authorize a service contract with Alexsis (formerly
Corporate Service, Inc ), 17187 N Laurel Park Drive, Suite 434,
Livonia, MI 48152, in connection with this item, the cost of
which is included in the aforesaid total premium cost; and the
action herein is being taken without competitive bidding in
accordance with the provisions set forth in Section 3 04 140D2
and 5 of the Livonia Code of Ordinances, as amended
On a motion by Ochala, seconded by Jurcisin, and unanimously
adopted, it was
#895-93 RESOLVED, that having considered the report and
recommendation of the Director of Public Works, dated October 19,
1993, approved by the Department of Finance and approved for
submission by the Mayor, the Council does hereby reject all bids
for foul weather garments received on June 24, 1993 for the
reasons indicated in the aforesaid communication; FURTHER, the
Council does hereby authorize the purchase of foul weather
garments for employees in the Department of Public Works from
Allie Brothers of Livonia, Inc , 20295 Middlebelt Road, Livonia,
MI 48152, for the unit prices set forth in the attachment, and
for a total estimated price of $9,118.25; and in the event the
aforesaid items are not available from Allie Brothers of Livonia,
Inc. , the Council does hereby authorize as an alternate source
for the purchase of foul weather garments for employees in the
Department of Public Works, Douglas the Tailor, 28561 Gratiot,
Roseville, MI 48066, for the unit prices set forth in the
attachment, and for a total estimated price of $10,898.00; and
the Council does hereby authorize the action herein without
competitive bidding in accordance with Section 3 04 140D5 of the
Livonia Code of Ordinances, as amended

On a motion by Toy, seconded by Jurcisin, and unanimously
adopted, it was:
#896-93 RESOLVED, that having considered a communication from
the City Planning Commission, dated October 20, 1993, which
transmits its resolution 10-192-93, adopted on October 12, 1993,
wherein it is recommended that condition number 2 of City Council
Resolution 518-93 in connection with Petition 93-2-2-7 be
modified as follows: (new language is underlined)
2) That the total number of trucks to be parked or stored on
the subject site at any one time shall not exceed 18 trucks;
provided, however, that no more than four (4) such trucks
may be affixed with the Ryder Truck Rental logo with the
remaining trucks being affixed with the Modern Moving Co.
logo; and provided further that such Ryder Trucks shall not
exceed 24 feet in length;
and subject to the following condition:
That the Ryder Truck logo shall not be displayed elsewhere
on the premises;
the Council does hereby concur in and approve of the aforesaid
action.
On a motion by McGee, seconded by Ochala, and unanimously
adopted, it was:
#897-93 RESOLVED, that having considered a communication from
the City Planning Commission, dated August 31, 1993, which sets
forth its resolution 8-158-93, adopted on August 24, 1993, with
regard to Petition 93-7-1-11, submitted by the City Planning
Commission, pursuant to Council Resolution 446-93, for a change
of zoning on property located on the north side of Seven Mile
Road between Bicentennial Drive and Fitzgerald Avenue in the
Southwest 1/4 of Section 5, from RUFA and PL to R-3, and the
Council having conducted a public hearing with regard to this
matter on October 27, 1993, pursuant to Council Resolution
760-93, the Council does hereby concur in the recommendation of
the Planning Commission and the said Petition 93-7-1-11 is hereby
approved and granted, as modified, so as to rezone this property
to R-3B; and the City Planner is hereby instructed to cause the
necessary map for publication to be prepared indicating the
zoning change herein approved and to furnish the same to the
Department of Law and, upon receipt of such map, the Department
of Law is requested to prepare an ordinance amending Ordinance
543, as amended, in accordance with this resolution.
On a motion by McGee, seconded by Jurcisin, and unanimously
adopted, it was

#898-93 RESOLVED, that the Council does hereby suspend their
rules for procedure as outlined in Council Resolution 574-82 so
as to permit consideration of items that do not appear on the
agenda
On a motion by Toy, seconded by Ochala, and unanimously adopted,
it was:
#899-93 RESOLVED, that having considered a letter from the
Committee Chairperson of the Church of Jesus Christ of Latter-day
Saints, dated November 3, 1993, with regard to the 6th Annual
Christmas Creche Exhibit (nativity scenes) to be displayed in the
church building on the corner of Six Mile and Merriman, and
wherein permission is requested to place signs at the following
locations throughout the City from November 22, 1993 to December
6, 1993
1) (1) 4x5 wooden sign on the lawn of the church directly in
front of the building, set back at least 10 feet from the
sidewalk on the south side of the property;
2) (2) 3x4 two-sided sandwich board signs located on the lawn
of the church at each driveway (one off of Six Mile and one
off of Merriman) set back at least 10 feet from the
sidewalk,
