MINUTES OF THE ONE THOUSAND, TWO HUNDRED AND ELEVENTH REGULAR MEETING
L OF THE COUNCIL OF THE CITY OF LIVONIA
On October 23, 1991 , the above meeting was held at the City Hall , 33000
Civic Center Drive, Livonia, Michigan and was called to order by the President
of the Council at 8 01 P.M Councilman Ochala delivered the invocation.
Roll was called with the following result. Present Laura Toy, Robert
R. Bishop, Gerald Taylor, Dale Jurcisin, Ron Ochala, Fernon P Feenstra and Joan
McCotter, Absent. None

On a motion by Councilman Taylor, seconded by Councilwoman Toy,
and unanimously adopted, it was
#811-91 RESOLVED, that the minutes of the 1 ,210th Regular
Meeting of the Council of the City of Livonia, held October
9, 1991 are hereby approVed.
A communication from the Vice President for Business Services of
Schoolcraft College, dated October 4, 1991 re Schoolcraft College 1991 Tax Levy
revised millage rate was received and placed on file for the information of the
Council .
A communication from the Department of Law, dated October 11 , 1991 re

A communication from the Department of Law, dated October 15, 1991 re
Susanne Brown v City of Livonia and Livonia Employees Retirement System Wayne County
Circuit Court Case No 90-032578-AV Court of Appeals Case No 141927 was received
and placed on file for the information of the Council
On a motion by Councilman Bishop, seconded by Councilwoman Toy,
it was
#812-91 RESOLVED, that having considered a communication from
the City Assessor, dated September 13, 1991 , approved for
submission by the Mayor, with regard to a request from Mr
Clarence Coveney, 19283 Newburgh, Livonia, Michigan 48152,
which request was subsequently withdrawn by a letter dated
October 7, 1991 , and in accordance with the provisions of 1967
PA 288, as amended, as well as Section 18 46 of Ordinance 543,
as amended, the Council does hereby determine to deny the request
for dividing Tax Item No 46 024 99 0084 001 into two parcels
since the same would be in violation of the City' s Zoning
Ordinance and Law, as well as for the reason that the proposed
lot split would not he consistent with good planning and zoning

#813-91 RESOLVED, that having considered an application from
Michael Barry, 37174 Turnburry, Livonia, Michigan, dated October
7, 1991 , requesting permission to close Augusta Court in the
Fox Creek Meadows Subdivision on October 27, 1991 , from 1 00
p.m. to midnight, for the purpose of conducting a block party,
the Council does hereby grant permission as requested, the
action taken herein being made subject to the approval of the
Police Department.
#814-91 RESOLVED, that having considered a letter from Mr
Joseph Crenshaw, 26911 Santa Maria, Redford, Michigan 48240,
received by the office of the City Clerk on October 8, 1991 ,
wherein Mr Crenshaw has offered to donate lots 54, 55 and
56 in the Garden Farms Subdivision to the City of Livonia in
1991 , and lots 57, 58 and 91 in 1992, the Council does hereby
refer this matter to the Law Department and the Engineering
Department for their respective reports and recommendations.
#815-91 RESOLVED, that having considered a letter from the
Livonia Family "Y", dated September 26, 1991 , with regard to
the All American Craft Show to be conducted at the Livonia
Family "Y" on November 2, 1991 , and wherein permission is
requested to place one 6 feet tall by 2 feet wide sandwich
board sign at Lyndon and Farmington, and one six feet tall
by two feet wide sandwich board sign in front of the Livonia

"Y" during the period of October 19 through November 2, 1991 ,
the Council does hereby concur in and approve this request
#816-91 RESOLVED, that having considered a letter from the
Livonia Family "Y", received by the office of the City Clerk
on October 10, 1991 , with regard to the sale of Silwik plants
at a fundraiser for the "Invest in Youth" campaign to be
conducted on November 4, 1991 , and wherein permission is
requested to place a lawn sign (on a wire frame approximately
12 by 15 inches) at Lyndon and Farmington Road in front of
the existing YMCA sign, and a second similar sign at the
northwest corner of Stark and Schoolcraft, which signs would
be placed in each location for the period of one day, on November
4, 1991 , from 9 00 a m to 4 00 p m , the Council does hereby
approve of and concur in such action
#817-91 RESOLVED, that having considered a communication from
the Livonia Arts Commission, dated October 7, 1991 , approved
by the Finance Director and approved for submission by the
Mayor, the Council does hereby authorize the appropriation
and expenditure of the sum of $3,000 00 from the Arts Commission
Trust Fund Account 724-000-969-050 as a matching challenge
grant for the Livonia Symphony Orchestra, as well as the
appropriation and expenditure of $5,000 00 from Account 724-000-
969-050 to help defray costs as a co-sponsor of the 1991/92
season of the Livonia Symphony Orchestra
#818-91 RESOLVED, that having considered the report and
recommendation of the Director of Community Resources, dated
October 1 , 1991 , approved by the Finance Director and approved
for submission by the Mayor, the Council does hereby accept
the bid of Kimcraft Printers, Inc. , 11705 Levan, Livonia,
Michigan 48150, for printing 37,000 copies of the City' s
newsletter, black with one other color, 12 pages and 16 pages,
for the unit prices indicated in the attachment, the same having
been in fact the lowest bid received and meets all
specifications.
#819-91 RESOLVED, that Rotondo Corporation, 20400 Parker,
Livonia, MI 48152, as proprietor, having requested the City
Council to approve the proposed preliminary plat of the following
subdivision Parkside Villas Subdivision, located in the
Northeast 1/4 of Section 8, the said proposed preliminary plat
being dated September 6, 1991 (revised) , and it further appearing
that tentative approval of such preliminary plat was given
by the City Planning Commission, after due notice and a public
hearing on August 20, 1991 , and it further appearing that such
preliminary plat, together with development plans and
specifications for improvements therein have been examined
and approved by the Engineering Department as is set forth
in the report of that department dated October 4, 1991 ;
therefore, the City Council does hereby approve of the said
preliminary plat on the following conditions

(1 ) All of the improvements, utilities and grading shall be
constructed, installed and accomplished in conformity with
the provisions of the ordinances of the City of Livonia,
including the Subdivision Control Ordinance, being Title 16,
Chapters 16 04 through 16 24 of the Livonia Code of Ordinances,
as amended, the Subdivision Regulations of the Planning
Commission, the regulations and specifications of the Engineering
Department and the Development Plans submitted by the proprietor
and approved by such department, all such improvements to be
constructed, installed, accomplished and completed within a
period of two (2) years from the effective date of this
resolution, failing this, the approval contained herein shall
be considered null , void and of no effect whatsoever,
(2) That all inspection fees and other charges due to the
City of Livonia shall be fully paid at the time and in the
manner provided in the said Subdivision Control Ordinance,
as amended,
(3) That the installation of all such improvements shall be
subject at all times to the supervision and inspection and
final approval of the Engineering Department, and such
improvements shall not be considered as having been
satisfactorily and completely installed until there is filed
with the City Council the certificate as provided in Section
16 24 370 of the said Subdivision Control Ordinance, as amended,
(4) That the proprietor enter into an agreement with the City
IL, of Livonia agreeing to construct, within the prescribed period
of time and in the prescribed manner, all improvements required
to the extent required by the City of Livonia and as shown
on the approved development plans,
(5) That the final true record plat of the aforesaid subdivision
shall be submitted and must receive the final approval of the
City Planning Commission as evidence that such plat is in
compliance with existing Subdivision Regulations,
(6) That the final true plat of the aforesaid subdivision
shall be submitted and must receive the final approval of the
City Council within two (2) years from the effective date of
this resolution, the City Council shall approve final plats
of the aforesaid proposed subdivision if drawn in substantial
conformity with the proposed plat as approved herein, and
provided there has been compliance with all other requirements
of State Statute, the Subdivision Control Act, the Subdivision
Control Ordinance and this resolution,
(7) That, for the purpose of obtaining approval of final plats
prior to the completion of all required improvements the
proprietor may file with the City of Livonia a corporate surety
bond, certified check, cash bond, irrevocable letter of credit,
or other financial assurance in such form as may be approved
by the Department of Law guaranteeing the satisfactory
installation of all such improvements, utilities and grading
by the proprietor within the prescribed period, that in the
event the proprietor elects to deposit such financial assurances
the same shall be in the following amounts

A. General Improvement Bond $25,000.00, of which at least
$ 3,000.00 shall be in cash.
B. Sidewalk Bond $ 3,300 00 of which at least
$ 1 ,000.00 shall be in cash
C Grading & Soil Erosion $ 2,000 00 (cash).
D Greenbelt Landscaping $ 3,800 00 of which at least
$ 1 ,000.00 shall be in cash
E Monuments and Lot Markers $ 290 00 (cash)
and require cash payments in the total amount of $3,030 00
In addition, distribution lines for telephone and electric
services are to be placed underground and street lights along
Wayne Road (a continuation of existing lighting on wood poles)
are to be provided
#820-91 RESOLVED, that having considered the report and
recommendation of the City Engineer, dated September 25, 1991 ,
which bears the signature of the Finance Director, and is
approved for submission by the Mayor, the Council does hereby
authorize the purchase of an ALR Computer CAD Station including
processor, floppy disk drive, hard disk drive, math coprocessor
and related software from Instrument Sales & Service, Inc ,
12911 Farmington, Livonia, Michigan 48150, for a sum not to
exceed $11 ,600, the same to be appropriated and expended from
Account 101-441-702-000 for this purpose, FURTHER, the Council
does hereby authorize the said item without competitive bidding
in accordance with Section 3.04 140 D5 of the Livonia Code
of Ordinances, as amended
#821-91 RESOLVED, that having considered a communication from
the City Engineer dated October 2, 1991 , approved for submission
by the Mayor, wherein it is recommended that Dearnan Avenue,
Pershing Avenue, Foch Avenue, Twelfth Street, Graham Road,
Lakeview Avenue North, and Lakeview Avenue South, as originally
platted in the B E. Taylor' s Como Lake Subdivision" (Liber
60, Page 67, Wayne County Records) , be renamed to Inkster Road,
Arcola Avenue, Cavell Avenue, Five Mile Road, Howell Road,
Meadowbrook Avenue, and Oakley Avenue, respectively, the Council
does hereby concur in and approve of the aforesaid recommendation
and does hereby rename the said avenues, streets and roads,
and the Council requests that the Department of Public Works
do all things necessary to effectuate this resolution, FURTHER,
the Council does hereby request the City Clerk to forward a
certified copy of the same to the Michigan Auditor General
and to further have a certified copy of this resolution recorded
in the Office of the Wayne County Register of Deeds, together

with his certificate indicating the name or names of any plat,
subdivision or addition affected by this resolution, as well
as do all other things necessary or incidental to the full
performance of this resolution
#822-91 RESOLVED, that having considered a communication from
the Planning Director, dated October 4, 1991 , which transmits
the "Capital Improvement Program, 1992-1997" prepared by the
Planning Commission, the Council does hereby refer this item
to the Capital Improvement Committee for its report and
recommendation.
#823-91 RESOLVED, that having considered a letter from the
City Clerk, dated October 11 , 1991 , to which is attached a
letter from the County Clerk, dated October 8, 1991 , and in
accordance with the provisions of Section 30a of 1963 PA 65
(MCLA 168 30a) , as amended, the Council does hereby appoint
Ms Amy Juntunen, 32215 Meadowbrook Lane, Livonia, Michigan
48154, as the Democratic member of the Board of Canvassers
of the City of Livonia for a term expiring December 31 , 1995
#824-91 RESOLVED, that having considered a letter from the
City Clerk, dated October 11 , 1991 , to which is attached a
letter from the County Clerk, dated October 8, 1991 , and in
Iwo accordance with the provisions of Section 30a of 1963 PA 65
(MCLA 168 30a) , as amended, the Council does hereby appoint
J Carroll Kay, 36517 Sherwood, Livonia, Michigan 48154, as
the Republican member of the Board of Canvassers of the City
of Livonia for a term expiring December 31 , 1995
#825-91 RESOLVED, that having considered a communication from
the Court Administrator and District Court Judges, dated October
2, 1991 , which bears the signature of the Director of Finance
and is approved for submission by the Mayor, which requests
authorization to upgrade and enhance the computer operations
of the 16th District Court, the Council does hereby refer this
item to the Capital Improvement Committee for its report and
recommendation.
#826-91 RESOLVED, that having considered a communication from
the Court Administrator and District Court Judges, dated October
2, 1991 , which bears the signature of the Director of Finance
and is approved for submission by the Mayor, which requests
authorization to upgrade and enhance the computer operations
of the 16th District Court, the Council does hereby refer this
item to the Finance Director for his report and recommendation
#827-91 RESOLVED, that having considered a communication dated
October 3, 1991 from Chapman Sign Inc , which in accordance
lie with the provisions of Section 19 08 of Ordinance No 543,
as amended, the Zoning Ordinance, takes an appeal from a
determination made on October 1 , 1991 by the City Planning

lioCommission in its resolution 10-165-91 , with regard to a sign
permit application submitted by Chapman Sign Inc on behalf
of Winkelmans, for a new wall sign in the Laurel Park Place
Mall at Newburgh and Six Mile Roads, the Council does hereby
designate Monday, November 18, 1991 at 7.30 P M as the date
and time for conducting a public hearing with regard to this
matter, such hearing to be held at the City Hall , 33000 Civic
Center Drive, Livonia, Michigan, and the City Clerk is hereby
requested to do all things necessary in order to give proper
notice in writing, as well as by the publication of a notice
in the City' s official newspaper of such hearing and the date
and place thereof, in compliance with the requirements set
forth in Ordinance No 543, as amended, the Zoning Ordinance
of the City of Livonia
#828-91 RESOLVED, that the Council having considered a
communication from the City Engineer, dated September 25, 1991 ,
approved for submission by the Mayor and submitted pursuant
to the requirements set forth in Section 16 24 310 of the Livonia
Code of Ordinances, as amended, wherein it is required that
street lighting with underground wiring shall be provided in
all subdivisions in conformity with the standards prescribed,
wherein the City Engineer has ascertained the assessed valuation
of all property affected by the proposed improvement with regard
Ile to Western Golf Estates Subdivision, located in the Northeast
1/4 of Section 24, T 1S , R 9E. , City of Livonia, Wayne County,
Michigan, and such report having indicated the number of parcels
which show tax delinquencies, the number of parcels owned by
public authorities, the number of parcels which are vacant,
and having prepared and caused to be prepared plans and
specifications therefor and an estimate for the cost thereof,
and to file the same with the City Clerk together with his
recommendation as to what proportion of the cost should be
paid by special assessment and what part, if any, should be
a general obligation of the City, the number of installments
in which assessments may be paid and the lands which should
be included in the proposed special assessment district, and
it appearing to the Council that all of such information,
estimate, plans, specifications and recommendations have been
properly filed by the City Engineer with the City Clerk under
date of September 25, 1991 , and that there has been a full
compliance with all of the provisions of Section 3 08 060 of
the Livonia Code of Ordinances, as amended, the Council does
hereby set Monday, December 9, 1991 at 7 30 P.M. as the date
and time for a public hearing on the Necessity for such proposed
improvement which public hearing shall be held before the Council
in the Livonia City Hall , 33000 Civic Center Drive, Livonia,
Michigan, pursuant to Section 3 08 070 of said Livonia Code
of Ordinances, as amended, and the City Clerk is hereby
authorized to give notice and publication of such hearing as
is required by Section 3 08.070 of said Code.

Imp 1829-91 RESOLVED, that the Council having considered a
communication from the City Engineer, dated October 2, 1991 ,
approved for submission by the Mayor and submitted pursuant
to Council Resolution 645-91 , wherein the City Engineer has

imThe foregoing Ordinance, when adopted, is filed in the Journal of Ordinances
in the office of the City Clerk and is the same as if word for word repeated
herein. The above Ordinance was placed on the table for consideration at the
next regular meeting.
On a motion by Councilman Jurcisin, seconded by Councilman Taylor,
and unanimously adopted, it was

Michigan Liquor Control Commission, dated August 27, 1991 ,
and the report and recommendation of the Chief of Police, dated
October 7, 1991 , the Council does hereby dpprqve of the request
from Leather Bottle Investments, Inc, , to transfer ownership
of a 1991 Class C Licensed Business located at 20300 Farmington
Road, Livonia, Michigan 48152, Wayne County, from The Leather
Bottle Inn of Livonia, Inc. , with Sunday Sales, and Sale of
Food on Sundays, 7/00 A.M. to Noon, and the City Clerk is hereby
requested to forward a certified copy of this resolution to
the Michigan Liquor Control Commission.

On a motion by Councilman Jurcisin, seconded by Councilman Feenstra,

#831-91 RESOLVED, that having considered the report and
recommendation of the Director of Public Works and the Chief
of Police, dated October 4, 1991 , approved by the Director
of Finance and approved for submission by the Mayor, the Council
does hereby authorize Electrical Constructors, Inc , 34075
Autry, Livonia, Michigan 48150, to complete all work required
in connection with making proposed electrical improvements
at the Police Station as detailed in a proposal dated September
25, 1991 , for the sum of $13,800 00, FURTHER, the Council does
hereby appropriate and authorize the expenditure of the sum
Of $13°800.00 from the Unexpended Fund Balance Account of the
General Fund for this purpose, and the Council does hereby
authorize the said item without competitive bidding in accordance
with Section 3.04. l40D5 of the Livonia Code of Ordinances as
amended, and the Director of Public Works is hereby authorized
to approve minor adjustments in the work as it becomes necessary,
and the Mayor and City Clerk are hereby authorized to execute
a contract for and on behalf of the City of Livonia with the
aforesaid bidder and to do all other things necessary or
incidental to the full performance of this resolution

On a motion by Councilman Taylor, seconded by Councilman Feenstra,
and unanimously adopted, it was

recommendation of the Director of Public Works, dated October
7, 1991 , approved by the Director of Finance and approved for
submission by the Mayor, and to which is attached a proposal
dated October 3, 1991 from Goodwill Industries of Greater
Detroit, wherein Goodwill Industries would be permitted to
establish a collection facility at the Livonia Recycling
Center to receive donated clothing and small household items,
the Council does hereby authorize the Mayor and City Clerk
for and on behalf of the City of Livonia to execute a one-year
agreement with Goodwill Industries in accordance with the terms
and conditions set forth in its proposal dated October 3, 1991 ,
subject to approval as to form by the Department of Law.

and unanimously adopted, it was

7, 1991 , approved by the Director of Finance and approved for
submission by the Mayor, and to which is attached a proposal
dated October 3, 1991 from Goodwill Industries of Greater
Detroit, wherein Goodwill Industries would be permitted to

the Council does hereby refer this subject to the Water Supply,
Drainage, Sewage and Waste Disposal Study Committee for its

On a motion by Councilwoman Toy, seconded by Councilman Jurcisin,
and unanimously adopted, it was

recommendation of the Director of Public Works, dated October
8, 1991 , approved by the Director of Finance and approved for
submission by the Mayor, with regard to the proposed reroofing
of the Fire Station Headquarters, Youth Assistance Office and
the Livonia Aid Center, the Council does hereby accept the
following low bids which meet specifications with respect to
these projects
Ike 1 . Award a contract in the amount of $53,163 00 to
Cooperative Roofing Co , 6241 Jackson Road, P 0 Box
7031 , Ann Arbor, Michigan 48103, for replacement of

the roof at Fire Station Headquarters, 14910 Farmington

2. Award a contract in the amount of 810,561 .00 to
Cooperative Roofing Co. , 6241 Jackson Road, P.O. Box
7031 , Ann Arbor, Michigan 48103, for replacement of
the roof at the Youth Assistance Office, 33233 Five
Mile Road, and
3. Award a contract in the amount of $22,935 00 to Fisher
Roofing Co. , Inc. 5471 Sylvia Street, Dearborn Heights,
Michigan 48125, for replacement of the roof at the
Livonia Aid Center, 13325 Farmington Road,
FURTHER, the Council does hereby appropriate and authorize
the expenditure of the sum of $36°659 00 from the General Fund
Unexpended Fund Balance Account for the additional work herein
authorized; and the Director of Public Works is hereby authorized
to approve minor adjustments in the work as it becomes necessary;
and the Mayor and City Clerk are hereby authorized to execute
a contract for and on behalf of the City of Livonia with the
aforesaid bidder and to do all other things necessary or
incidental to the full performance of this resolution.
On a motion by Councilman Taylor, seconded by Councilman Bishop,
and unanimously adopted, it was
#835-91 RESOLVED, that having considered the report and
recommendation of the Director of Public Works, dated September
30, 1991 , approved by the Director of Finance and approved
for submission by the Mayor, the Council does hereby authorize
the use of B & V Construction, Inc , P.O Box 6070, Wixom,
Michigan 48096-0070 to provide snow removal services in snowfalls
Of over four inches in accumulation and as authorized by the
Mayor pursuant to the terms set forth in a letter dated September
19, 7991 ; FURTHER, the Council does hereby authorize the said
item without competitive bidding in accordance with Section
3.04.14OD5 of the Livonia Code of Ordinances, as amended.
On a motion by Councilman Bishop, seconded by Councilman Jurcisin,
and unanimously adopted, it was
#836-91 RESOLVED, that having considered the report and
recommendation of the City Engineer, dated October 1 , 1991 ,
which bears the signature of the Finance Director and is approved
for submission by Mayor, the Council does hereby authorize
J. R. Mathews, Inc' , P.O. Box 52334, Livonia, Michigan 48152,
L to raze the existing home located at 9116 Newburgh Road, Livonia,

Michigan, for the sum of $2,950.00, the same to be appropriated
and authorized to be expended from the $12 million Road Bond
Issue, FURTHER, the Council does hereby authorize the said
item without competitive bidding in accordance with Section
3.04 140D5 of the Livonia Code of Ordinances, as amended
On a motion by Councilman Jurcisin, seconded by Councilman Taylor,
and unanimously adopted, it was
#837-91 RESOLVED, that having considered the report and
recommendation of the City Engineer, dated October 4, 1991 ,
approved for submission by the Mayor, regarding replacement
and/or construction of new sidewalks in the City of Livonia
pursuant to the 1991 Sidewalk Program at the locations and
for the amounts indicated in the referenced communication,
which work was done pursuant to Council Resolution 164-91
and in accordance with the provisions of Section 12 04 340
of Chapter 4 of Title 12 of the Livonia Code of Ordinances,
as amended, the City Treasurer is hereby directed to send
a statement of charges to all property owners in the amounts
listed in accordance with Section 3 08 150 of Title 3, Chapter
8 of the Livonia Code of Ordinances, as amended, and the
Council does hereby establish the evening of January 15,
LIN1992 at 8 00 P M at the Livonia City Hall , 33000 Civic Center
Drive, Livonia, Michigan as the time and place when the Council
shall meet for the purpose of adopting a resolution placing
a special assessment upon said property for such charges
unless the same are paid prior to the date of such meeting,
and the City Clerk and City Treasurer are hereby requested
to do all things necessary or incidental to the full
performance of this resolution
On a motion by Councilman Feenstra, seconded by Councilman Ochala,
and unanimously adopted, it was
#838-91 RESOLVED, that the Council does hereby request that
the City Treasurer submit a report and recommendation with
regard to the form of notice to property owners used in
connection with single lot assessments insofar as whether the
same is "User Friendly"

and unanimously adopted, it was
#839-91 RESOLVED, that having considered a communication from
the City Planning Commission, dated September 30, 1991 , which

ime transmits its resolution 1-285-90 adopted on January 30, 1990
with regard to Petition 89-11-8-34 submitted by Architectural
Resource Associates, P C , requesting site plan approval in
connection with a proposal to renovate an existing office
building located on the north side of Five Mile Road between
Edington and Stamford in Section 16, pursuant to the provisions
set forth in Section 18.47 of Ordinance 543, as amended, the
Council does hereby concur in the recommendation of the Planning
Commission and Petition 89-11-8-34 is hereby approved and
granted, such approval to be based upon the same conditions
as those set forth in the aforesaid recommendation of the
Planning Commission, with the exception, however, that the
height limitation of the monument sign shall be revised from
8' to 10' , as well as the additional condition that the two narking
spaces on Edington shall be deleted and additional landscaping
shall be installed in lieu thereof.
On a motion by Councilman Jurcisin, seconded by Councilman Feenstra,
and unanimously adopted, it was
#840-91 RESOLVED, that having considered a communication from
the City Planning Commission, dated October 10, 1991 , which
transmits its resolution 8-147-91 , adopted on August 20, 1991 ,
lipwith regard to a sign permit application submitted by Cornell
Sign Co for a wall sign at 19330 Middlebelt Road, the Council
does hereby concur in the recommendation of the Planning
Commission and approve the said sign permit application, subject
to the compliance with the same conditions as those set forth
in the aforesaid action of the Planning Commission.
On a motion by Councilman Feenstra, seconded by Councilman Bishop,
and unanimously adopted, it was
#841-91 WHEREAS, the City of Livonia was established in 1950
based upon the fact that it would receive the prescribed
statutory local share of racetrack revenues, together with
the State of Michigan, and
WHEREAS, the City of Livonia is required in this statute
to provide police, fire and other City services in connection
with the operation of Ladbroke DRC, and
WHEREAS, the residents of the City of Livonia,
particularly those who reside in areas which are in close
proximity to the Ladbroke DRC, are subjected to additional
problems such as traffic, crime, littering and depreciation
of property values, and

WHEREAS, millions of dollars are derived by the State
of Michigan on an annual basis from the operation of the Ladbroke
DRC, and
WHEREAS, the property on which the Ladbroke DRC is
situated within the industrial corridor of the City of Livonia
and is zoned M-1 (light manufacturing) , which zoning
classification, if utilized, would produce substantial
predictable tax revenues; and
WHEREAS, the statutory entitlement for the City of
Livonia is $900,000, which sum has been relied upon in the
preparation of the City' s annual budget but rarely has this
amount been received, and
WHEREAS, the loss of this racetrack revenue entitlement
by reason of the Governor' s veto erodes the confidence of this
community with respect to the fairness of State government,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Livonia takes this means to urge that the said racetrack
revenue entitlement be restored to the City of Livonia, or
in the alternative, that the Ladbroke DRC be relocated from
Livonia to the State Fairgrounds in Detroit, or to such other
location as may be appropriate so that the property upon which
it is presently situated may be more properly developed in
its M-1 zoning classification, and the City Clerk is hereby
requested to forward a copy of this resolution to Governor
John Engler, State Senator R. Robert Geake, State Representatives
Lyn R Bankes and John Bennett, the governing bodies of the
other seven racetrack municipalities, the Mayor and Council
of the City of Detroit and the owners of Ladbroke DRC
On a motion by Councilwoman Toy, seconded by Councilman Feenstra,
and unanimously adopted, it was
#842-91 RESOLVED, that having considered a letter from Marilyn
Wheeler, 15643 Edgewood Drive, Livonia, MI 48154, with regard
to the need for the improvement of Ellen Drive north of Five
Mile in the Idyl Hill Estates Subdivision, the Council does
hereby refer this item to the City Engineer for his report
and recommendation.

to the Finance and Insurance Committee for its report and

rules for procedure as outlined in Council Resolution 574-82
so as to permit consideration of several items that do not
appear on the agenda
On a motion by Councilman Jurcisin, seconded by Councilman Taylor,
and unanimously adopted, it was
#845-91 RESOLVED, that the City Engineer having filed with
the City Clerk a statement dated August 22, 1991 , pursuant
to Council Resolution 955-90, adopted on October 24, 1990,
law and in accordance with the provisions of Scction 3.08.060 of
Title 3, Chapter 8 of the Livonia Code of Ordinances, as amended,
containing a report with regard to the proposed installation
of street lights on Gill Road between Seven and Eight Mile
Roads, City of Livonia, Wayne County, Michigan, and a public
hearing having been held thereon on October 21 , 1991 , pursuant
to Council Resolution 731-91 , after due notice as required
by Title 3, Chapter 8 of said Code, as amended, and after a
careful consideration having been given to all such matters
including the various objections, comments and observations
of individuals in attendance at such public hearing, the Council
does hereby determine to proceed no further with the special
assessment proceeding heretofore commenced for the proposed
improvement
On a motion by Councilman Feenstra, seconded by Councilman Ochala,
and unanimously adopted, it was

the Engineering Department submit a report and recommendation
with regard to such policy as it may have concerning the
installation of street lighting for intersections of collector
streets and half-mile roads
