MINUTES OF THE ONE THOUSAND ONE HUNDRED AND EIGHTY SECOND REGULAR MEETING
OF THE COUNCIL OF THE CITY OF LIVONIA
On August 15, 1990, the above meeting was held at the City Hall, 33000
Civic Center Drive, Livonia, Michigan and was called to order by the President
of the Council at 8.00 P.M. Councilman Jurcisin delivered the invocation.
Roll was called with the following result• Present. Laura Toy, Robert
R. Bishop, Gerald Taylor, Dale Jurcisin, Ron Ochala, Fernon P. Feenstra and Joan
McCotter, Absent None.
Elected and appointed officials present Robert F. Nash, City Clerk,
Harry Tatigian, City Attorney, Robert D Bennett, Mayor, John Nagy, Planning
Director, Raul Galindo, City Engineer, David Preston, Director of Finance, Suzanne
Wisler, Director of Community Resources, Karen Szmula, Director of Legislative
Affairs, Karen Burskey, Assistant Superintendent of the Department of Parks and
Recreation and Ray Tent, Planning Commission.
On a motion by Councilwoman Toy, seconded by Councilman Feenstra,
and unanimously adopted, it was

Meeting of the Council of the City of Livonia, held July 25,
1990 are hereby approved
On a motion by Councilman Taylor, seconded by Councilman Jurcisin,
and unanimously adopted*, it was
#720-90 RESOLVED, that the minutes of the 209th Special Meeting
of the Council of the City of Livonia, held August 13, 1990
are hereby approved
*Councilwoman Toy abstained from voting which is recorded as a "yes" vote under
the provisions of Section 2.04 190B of the Livonia Code of Ordinances.
On a motion unanimously introduced, supported and approved, it was

#721-90 WHEREAS, PRENTICE WAYNE HAWKINS, who recently passed
away, has served the people of Livonia for seventeen years,
and
WHEREAS, PRENTICE WAYNE HAWKINS joined the Livonia
Junior Football League in 1973, and
WHEREAS, he served on the Board of Directors of the
Livonia Junior Football League from 1978 through 1987, and
WHEREAS, he served as coach to hundreds of youth on
basketball teams, football teams and baseball teams, and
WHEREAS, he served as soccer coach for two years with
the Livonia "Y"
NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the
City of Livonia and all the citizens of Livonia pause this
moment and reflect on the time, energy and leadership that
PRENTICE WAYNE HAWKINS gave to the youth of this City and
fittingly at this time, the beginning of a new Livonia Junior
Football League season, commend his spirit and pray with his
wife, Marian, and children, Kerri, James, Wayne, Jr. and David
for his soul and memory to rest in everlasting peace.
A communication from the Finance Director, dated July 20, 1990, re various
financial statements of the City of Livonia for the month ending June 30, 1990
was received and placed on file for the information of the Council.

On a motion by Councilman Bishop, seconded by Councilman Feenstra,
#722-90 RESOLVED, that having considered an application from
Clifford Lamberg, 14339 Hubbard, Livonia, Michigan 48154,
requesting permission to close Hubbard Avenue between Perth
and Allen on Saturday, September 15, 1990, from 3:00 p.m to
7 00 p.m. for the purpose of conducting a block party, the
Council does hereby grant permission as requested, including
therein permission to conduct the said affair on Sunday,
September 16, 1990 in the event of inclement weather, the action
taken herein being made subject to approval of the Police
Department.
#723-90 RESOLVED, that having considered an application from
Art Smith, 36007 Barkley, Livonia, Michigan 48154, requesting
permission to close Barkley Street between Levan and Golfview
on Saturday, September 15, 1990, from 3:00 p.m. to 12:00 midnight

for the purpose of conducting a block party, the Council does
hereby grant permission as requested, including therein
permission to conduct the said affair on Sunday, September
16, 1990 in the event of inclement weather, the action taken
herein being made subject to approval of the Police Department.
A communication from the Arrangements Chairperson of the Livonia CROP
Committee re the seventh "Livonia CROP Walk for the Hungry" to be held Sunday,
September 30, 1990 was received and placed on file for the information of the
Council.
#724-90 RESOLVED, that having considered a letter from the
Project Manager of Kirco Realty and Development, LTD., Columbia
Center, 201 W. Big Beaver Road, Troy, Michigan 48084 dated
July 16, 1990, wherein permission is requested to place a sign
in the right-of-way on Tech Center Drive, north of Plymouth
Road, the Council does hereby approve and authorize this request
in the manner and form herein submitted, subject to Kirco Realty
executing and submitting to the City of Livonia a Hold Harmless
Agreement subject to approval as to form by the Department
of Law.
#725-90 RESOLVED, that having considered the report and
recommendation of the Director of Public Works dated July 12,
1990, approved by the Director of Finance and approved for
submission by the Mayor, wherein authorization is requested
to sell used Public Service Division passenger cars, pickups
and vans using a private auto auction facility, Midwest Auto
Auction & Service, Inc , 14666 Telegraph Road, Detroit, Michigan
48239, wherein a minimum bid would be established by the
Department and thereafter an auction would be conducted and
the high bid would be either accepted or refused with the company
charging a $10.00 registration fee and a $35.00 seller's fee,
for a total cost of $45 00 per vehicle, the Council does hereby
approve and authorize the aforesaid procedure as a method for
disposal of used Public Service Division vehicles, and the
Director of Public Works is hereby authorized to do all things
necessary or incidental to the full performance of this
resolution.
#726-90 RESOLVED, that having considered the report and
recommendation of the Chief of Police dated July 23, 1990,
which bears the signature of the Finance Director and is approved
for submission by the Mayor, the Council does hereby authorize
the rental of a small copier machine for use in the Intelligence
Division from A.B. Dick Company, 25330 Telegraph Road, Suite
110, Southfield, Michigan 48034, for a one-year period for

a price of $85.60 per month (installation charge of $30.00),
and the Chief of Police is hereby authorized to execute a
contract for this purpose.
#727-90 RESOLVED, that having considered the report and
recommendation of the Chief of Police dated July 25, 1990,
which bears the signature of the Finance Director and the City
Attorney and is approved for submission by the Mayor, to which
is attached an agreement between the City of Livonia and the
Township of Redford for joint participation in a computer aided
dispatch system for the Police and Fire Departments, for a
period of one year commencing December 1, 1990, through November
30, 1991, at a cost of $3.16 per run, the Council does hereby
authorize the Mayor and City Clerk, for and on behalf of the
City of Livonia, to execute the said agreement in the manner
and form herein submitted
#728-90 RESOLVED, that having considered a communication from
the Chief of Police dated July 19, 1990, approved by the Finance
Director and approved for submission by the Mayor, the Council
does for and on behalf of the City of Livonia accept cash
donations in the total amount of $24,964 00 from the
contributors set forth in the attachment, the purpose of which
donations is to purchase supplies for use in the Drug Abuse
Resistance Education Program and to sponsor the Second Annual
D A.R E Golf Outing, and the Council does hereby authorize
the deposit of the aforesaid sum in Account 702-000-285-211
for use in the D A R E Program
#729-90 RESOLVED, that having considered the report and
recommendation of the City Engineer dated July 18, 1990, which
bears the signature of the Finance Director and is approved
for submission by the Mayor, the Council does hereby accept
the unit price bid of Holloway Construction Company, 29250
Wixom Road, Wixom, Michigan 48393, for the improvement of
Pershing and Hillcrest Streets (Contract 90-M) with the placement
of 4" of asphalt over existing roadway (Alternate IV) for the
estimated total cost of $177,272 15, based upon the Engineering
Department's estimate of units involved, and subject to a final
payment based upon the actual units completed in accordance
with the unit prices accepted herein, said estimated cost and
unit prices having been in fact the lowest bid received for
this item, further, the Council does hereby appropriate a sum
not to exceed $177,272 15 from the $12 million General Obligation
Road Improvement Bond Issue with the provision that (1) the
Bond Issue be reimbursed from that portion of the project which
is to be financed by special assessment at such time as funds
are available from a future Special Assessment Bond Issue,
and (2) the Bond Issue be reimbursed for the City's portion
of the project at such time as funds may be available from
the Michigan Transportation Fund (Local Road Account), and
the City Engineer is hereby authorized to approve minor

adjustments in the work as completed, and the Mayor and City
Clerk are hereby authorized to execute a contract for and on
behalf of the City of Livonia with the aforesaid bidder and
to do all other things necessary or incidental to the full
performance of this resolution.
1730-90 RESOLVED, that having considered a communication from
the Director of Finance dated July 19, 1990, to which is attached
an invoice from the National League of Cities dated July 2,
1990, in the amount of $5,203.00 for annual membership dues
for the period of October 1, 1990 through September 30, 1991,
the Council does hereby approve and authorize the payment of
same
#731-90 RESOLVED, that having considered the report and
recommendation of the City Engineer dated July 12, 1990, which
bears the signature of the Finance Director and is approved
for submission by the Mayor, and which submits certain
recommendations with regard to the acquisition of rights-of-way
for the improvement of Seven Mile Road between Inkster Road
and Newburgh Road, the Council does hereby request that the
Department of Law submit a report and recommendation with regard
to the cost of appraisals and appropriate title work in
connection with the aforesaid right-of-way acquisitions, further,
the Council does hereby take this means to indicate its approval
and acceptance of the prioritization plan set forth in the
communication with regard to the aforementioned right-of-way
acquisition program
#732-90 RESOLVED, that having considered the report and
recommendation of the City Engineer dated July 17, 1990, approved
for submission by the Mayor, the Council does hereby authorize
the release to Biltmore Property, 2025 West Long Lake Road,
Suite 104, Troy, Michigan 48098, the proprietor of Windridge
Village Subdivision No. 6, located in the Northwest 1/4 of
Section 4, of the financial assurances previously deposited
with respect to the sidewalk improvements in the sum of
$21,000 00, of which $2,000 00 is to be in cash, and the Soil
Improvement Bond in the amount of $7,000 00, of which $2,000.00
is to be in cash, pursuant to Council Resolution 345-86 adopted
on April 9, 1986, and subsequently amended in Council Resolution
771-87, further, all other financial assurance now on deposit
with the City, if any, with respect to this subdivision shall
remain the same and unchanged, and the action herein being
taken is for the reasons indicated in the aforementioned report
of the City Engineer that all these improvements have been
satisfactorily installed in accordance with the rules and
regulations and ordinances of the City of Livonia
#733-90 RESOLVED, that having considered a communication from
the City Planning Commission dated July 31, 1990, which transmits
its resolution 7-398-90 adopted on July 17, 1990, with regard

to Petition 90-6-2-16, submitted by Merritt McCallum Cieslak,
P.C., requesting waiver use approval to construct an addition
to the existing Christ Our Savior Lutheran Church located on
the west side of Farmington Road between Lyndon Avenue and
Schoolcraft Road in the Southeast 1/4 of Section 21, which
property is zoned R-2, the Council does hereby concur in the
recommendation made by the City Planning Commission and Petition
90-6-2-16 is hereby approved and granted, such approval to
be based upon the same conditions as those set forth in the
aforesaid recommendation of the Planning Commission.
1734-90 RESOLVED, that having considered the report and
recommendation of the Planning Director dated July 10, 1990,
approved for submission by the Mayor Pro Tem, and to which
is attached a Holdharmless Contract between the City of Livonia
and the Community Commission on Drug Abuse (CCODA) for the
period August 1, 1990 through July 31, 1991, the Council does
hereby authorize the Mayor and City Clerk for and on behalf
of the City of Livonia to execute the proposed Holdharmless
Contract in the manner and form herein submitted, as well as
to do all other things necessary and incidental to the full
performance of this resolution
#735-90 RESOLVED, that having considered the report and
recommendation of the Planning Director dated July 10, 1990,
approved for submission by the Mayor Pro Tem, and to which
is attached a Holdharmless Contract between the City of Livonia
and First Step for the period August 1, 1990 through July 31,
1991, the Council does hereby authorize the Mayor and City
Clerk for and on behalf of the City of Livonia to execute the
proposed Holdharmless Contract in the manner and form herein
submitted, as well as to do all other things necessary and
incidental to the full performance of this resolution.
#736-90 RESOLVED, that having considered the report and
recommendation of the Director of Public Works dated July 26,
1990, approved by the Director of Finance and the City Attorney,
and approved for submission by the Mayor, and to which is
attached a copy of the Wayne County Solid Waste Management
Plan Update, as adopted by the Wayne County Commission on June
27, 1990, which five-year plan update is required by Act 641
of 1978, as amended, and procedurally required submission to
Wayne County's 43 municipalities, the Council does hereby take
this means to indicate that it approves the said Wayne County
Solid Waste Management Update as approved by the Wayne County
Commission on June 27, 1990
#737-90 RESOLVED, that having considered a resolution adopted
by the City Council of the City of Riverview which supports
the adoption of legislation which would require a deposit on
the sale of batteries and tires to encourage recycling rather
than landfilling of these items, the Council does hereby refer

this item to the Water Supply, Drainage, Sewage and Waste
Disposal Study Committee and to the Legislative Committee for
their reports and recommendations
#738-90 WHEREAS, the City Clerk has received an Application
for Industrial Facilities Exemption Certificate from General
Motors Corporation - General Motors Engine Division, dated
July 17, 1990, covering new industrial facilities to be located
within City of Livonia Industrial Development District No.
2,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LIVONIA
that it determines as follows
1. The City Clerk shall provide copies of the said
Application to the legislative bodies of the governmental
units deriving property taxes from the property which
will be affected, as required by Act 198, P.A. 1974,
as amended.
2. The City Clerk shall contact each of the affected taxing
units and, (i) indicate the Council's interest in this
matter, and (ii) assist these taxing units in collecting
such information as may be necessary to determine their
respective opinions on this Application and (iii) advise
the said taxing units of this Council's desire to hold
a hearing on this Application on Wednesday, September
19, 1990, at 7 00 P M. at the Livonia City Hall, 33000
Civic Center Drive, Livonia, Michigan
3. The Council hereby sets Wednesday, September 19, 1990,
at 7 00 P.M at the Livonia City Hall, 33000 Civic
Center Drive, Livonia, Michigan, as the date, time
and place for conducting a hearing on this Application.
#739-90 WHEREAS, pursuant to the direction of the City Council
in its resolution 616-90, adopted on June 25, 1990, and in
accordance with Section 3 08 140 of the Livonia Code of
Ordinances, as amended, the City Assessor of the City of Livonia
has prepared, reported and certified to the Council under date
of July 10, 1990 an assessment roll dated July 10, 1990 for
the proposed installation of 100 watt high pressure sodium
lights on davitt poles with underground wiring in Arbor Park
View Subdivision located in the Southeast 1/4 of Section 33,
City of Livonia, Wayne County, Michigan, containing the special
assessments to be assessed and levied, respectively, in the
proposed special assessment district heretofore established
for the construction and operation of the proposed improvement
in said district as designated in Council Resolution 616-90,
THEREFORE, BE IT RESOLVED, that the said roll is hereby accepted
by the City Council, that it is hereby ordered to be filed
in the office of the City Clerk for public examination; that

the City Clerk be and hereby is directed to give notice as
required by the provisions of Section 3.08.110 of the Livonia
Code of Ordinances, as amended, to wit that the assessment
roll has been made and filed in the office of the City Clerk
for public examination and that the City Council of the City
of Livonia .will meet in the City Hall, 33000 Civic Center Drive,
Livonia, Michigan, on Wednesday, September 19, 1990 at 7:00
p.m. to review the said Special Assessment Roll at which time
and place opportunity will be given to all interested persons
to be heard,
IT IS FURTHER RESOLVED, that the City Clerk be and hereby is
directed to publish a notice of said public hearing at least
once in the official newspaper of the City of Livonia which
is published and circulated generally in and throughout the
said City, at least ten (10) days prior to the aforesaid date
of September 19, 1990, the City Clerk is also directed to give
notice of said hearing by sending written notice thereof by
first class mail to each and every property owner in the proposed
assessment district as their respective names and addresses
appear on the most current assessment roll in the City Assessor's
office
with all of the provisions of Section 3.08.060 of the Livonia
Code of Ordinances, as amended, the Council does hereby set
Wednesday, September 19, 1990 at 7 00 P.M. as the date and

approved for submission by the Mayor and submitted pursuant
to the requirements set forth in Section 16 24.310 of the Livonia
Code of Ordinances, as amended, wherein it is required that
ornamental street lighting with underground wiring shall be
provided in all subdivisions in conformity with the standards
prescribed, and the City Engineer having ascertained the assessed
valuation of all property affected by the proposed improvement
with regard to the Caliburn Estates Subdivision No 1, located
in the Northwest 1/4 of Section 8, City of Livonia, Wayne County,
Michigan, and such report having indicated the number of parcels
which show tax delinquencies, the number of parcels owned by
public authorities, the number of parcels which are vacant,
and having prepared and caused to be prepared plans and
specifications therefor and an estimate for the cost thereof,
and to file the same with the City Clerk together with his
recommendation as to what proportion of the cost should be
paid by special assessment and what part, if any, should be
a general obligation of the City, the number of installments
in which assessments may be paid and the lands which should
be included in the proposed special assessment district, and
it appearing to the Council that all of such information,
estimate, plans, specifications and recommendations have been
properly filed by the City Engineer with the City Clerk under
date of July 17, 1990, and that there has been a full compliance
with all of the provisions of Section 3.08.060 of the Livonia
Code of Ordinances, as amended, the Council does hereby set

time for a public hearing on the Necessity for such proposed
improvement which public hearing shall be held before the Council
in the Livonia City Hall, 33000 Civic Center Drive, Livonia,
Michigan, pursuant to Section 3.08.070 of said Livonia Code
of Ordinances, as amended, and the City Clerk is hereby
authorized to give notice and publication of such hearing as
is required by Section 3.08.070 of said Code.
#741-90 RESOLVED, that the Council having considered a
communication from the City Engineer, dated July 18, 1990,
approved by the Director of Public Works and approved for
submission by the Mayor and submitted pursuant to the
requirements set forth in Section 16.24.310 of the Livonia
Code of Ordinances, as amended, wherein it is required that

is required by Section 3.08 070 of said Code
#742-90 RESOLVED, that in accordance with the provisions set
forth in Section 4 of Act 207 of the Public Acts of Michigan
of 1921, as amended, the City Zoning Act (MSA 5.2934, MCLA
125.584), as well as Article XXIII of Ordinance 543, as amended,
the Zoning Ordinance of the City of Livonia, the Council does
hereby determine that a public hearing will take place before
the City Council of the City of Livonia on

Petition 90-6-6-4, submitted by the City Planning
Commission, pursuant to Council Resolution 85-90, to
determine whether to amend Zoning Ordinance 543 so as
to provide for the regulation of restaurant uses as waiver
uses when located in department stores, supermarkets
or other developments (in lieu of allowing such uses
as accessory uses), the City Planning Commission in its
resolution 7-404-90 having recommended to the City Council
that Petition 90-6-6-4 be denied,
FURTHER, THE City Clerk is hereby requested to, no less than
fifteen (15) days prior to the aforesaid date of said public
hearing, cause to have a statement indicating the (a) nature
of the proposed amendment to the Zoning Ordinance, and/or (b)
location of the proposed change of zoning as set forth above,
first to be published in the official newspaper of the City
or a newspaper of general circulation in the City of Livonia
as well as to, not less than fifteen (15) days prior to said
public hearing, cause to have notice to be given by registered
mail to each public utility company and to each railroad company
owning or operating any public utility or railroad within the
districts or zones affected, and further, the City Clerk is
requested to do all other things necessary or incidental to
the full performance of this resolution.
A roll call vote was taken on the foregoing resolutions with the following result -
AYES Jurcisin, Ochala, Feenstra, Toy, Bishop, Taylor and McCotter.
NAYS None.
On a motion by Councilman Ochala, seconded by Councilman Taylor,
and unanimously adopted, it was
#743-90 RESOLVED, that having considered the report and
recommendation of the Streets, Roads and Plats Committee dated
July 25, 1990, and submitted pursuant to Council Resolution
524-87, in connection with a letter from the City Engineer
which was filed with the City Clerk dated March 20, 1987, on
all matters required by Sections 3.08 060 and 3.08 140 of the
Livonia Code of Ordinances, as amended, and a first public
hearing having been held thereon on May 18, 1987, after due
notice as required by Section 3.08 070 of said Code, and careful
consideration having been given to all such matters, the Council
does hereby, pursuant to Section 3 08.080 of said Code:

(1) accept and approve said statement in all respects,
(2) determine to make the improvement consisting of the
installation of 100 watt high pressure sodium ornamental
street lighting system on colonial post tops with
underground wiring on the north side of Curtis only
in the Sheffield Estates Subdivision No. 2 located
in the west 1/2 of Section 9, City of Livonia, Wayne
County, Michigan, as described in said statement,
and to defray the cost of such improvement by special
assessment upon the property especially benefited
in proportion to the benefits derived or to be derived,
(3) approve the plans and specifications for said
improvement as set forth in said statement dated March
20, 1987,
(4) determine that the cost of such improvement shall
be paid by special assessment upon the property
especially benefited,
(5) determine that the assessment made for such improvement
shall be paid in annual installments, according to
said statement,
(6) designate the assessment district, describing the
land and premises upon which special assessments shall
be levied as follows
A Special Assessment District in the West 1/2 of Section
9, T 1 S , R 9 E., City of Livonia, Wayne County,
Michigan, described as containing the property shown
on the Special Assessment Plan and the Special
Assessment Roll.
(7) direct the City Assessor to prepare a special assessment
roll in accordance with the Council's determineation
on said statements as prepared by the City Engineer
dated March 20, 1987, and
(8) that upon completion of said roll, the City Assessor
shall attach thereto the certificate required by the
provisions of Section 3 08 100 of the Livonia Code
of Ordinances, as amended, and file the same with
the City Clerk, who thereupon is directed to present
the same to the City Council prior to the holding
of the second public hearing thereon pursuant to Title
3, Chapter 8 of the Livonia Code of Ordinances
On a motion by Councilman Feenstra, seconded by Councilman Jurcisin,
and unanimously adopted, it was
#744-90 RESOLVED, that having considered the report and
recommendation of the Legislative Committee dated July 26, 1990,
and submitted pursuant to Council Resolution 358-89, in connection

with a letter from Cindy Oakes, 34025 West Six Mile Road, Livonia,
Michigan 48152, received by the office of the City Clerk on
April 3, 1989, wherein it is requested that the ordinance
governing garage sales (Section 5.33 060) be revised so as to
permit garage sales to be conducted more than once every six
months, the Council does hereby determine to take no further
action.
On a motion by Councilman Feenstra, seconded by Councilman Jurcisin,
and unanimously adopted, it was
#745-90 RESOLVED, that having considered the report and

FURTHER, the Council does hereby request the Planning Commission
for their report on whether the Livonia Zoning Ordinance should
be amended with reference to outdoor sales of plants and garden
supplies.
On a motion by Councilwoman Toy, seconded by Councilman Feenstra,
and unanimously adopted, it was
#764-90 RESOLVED, that having considered a communication from
the City Planning Commission dated July 31, 1990, which transmits
its resolution 7-403-90 adopted on July 17, 1990 with regard
to Petition 90-6-2-21, submitted by Nancy Barile requesting
waiver use approval to operate a sit-down restaurant within
an existing building located on the north side of Plymouth Road,
west of Merriman Road, in the Southeast 1/4 of Section 27, which
property is zoned C-2, the Council does hereby concur in the
recommendation made by the City Planning Commission and Petition
90-6-2-21 is hereby approved and granted, such approval to be
based upon the same conditions as those set forth in the aforesaid
recommendation of the Planning Commission
On a motion by Councilman Jurcisin, seconded by Councilman Bishop,
and unanimously adopted, it was
#765-90 RESOLVED, that having considered a communication from
the City Librarian dated July 27, 1990, approved by the Finance
Director and approved for submission by the Mayor, the Council
does, for and on behalf of the City of Livonia, accept a
Metropolitan Library Grant from the Library of Michigan in the
amount of $12,500.00, the purpose of which is to strengthen
the collection of materials on the non-western cultures with
the focus on Africa, Asia and Pacific Basin

On a motion by Councilman Taylor, seconded by Councilman Feenstra,
and unanimously adopted, it was

#766-90 RESOLVED, that the Council does hereby suspend their
rules for procedure as outlined in Council Resolution 574-82
so as to permit consideration of several items that do not appear
on the agenda.
On a motion by Councilman Jurcisin, seconded by Councilman Taylor,
#767-90 RESOLVED, that the City Engineer having filed with
the City Clerk a statement dated June 11, 1990 on all matters
required by Sections 3.08 060 and 3 08 140 of the Livonia Code
of Ordinances, as amended, and a first public hearing having
been held thereon on August 13, 1990, after due notice as required
by Section 3.08.070 of said Code, and careful consideration
having been given to all such matters, the Council does hereby,
pursuant to Section 3.08.080 of said Code
accept and approve said statement in all respects,
(2) determine to make the improvement consisting of the
installation of 100 watt high pressure sodium ornamental
street lighting system on davitt poles with underground
wiring in Levan Court Subdivision located in the
Northeast 1/4 of Section 32, City of Livonia, Wayne
County, Michigan, as described in said statement,
and to defray the cost of such improvement by special
assessment upon the property especially benefited
in proportion to the benefits derived or to be derived,
(3) approve the plans and specifications for said
improvement as set forth in said statement dated June
ill 1990,
(4) determine that the cost of such improvement shall
be paid by special assessment upon the property
especially benefited,
(5) determine that the assessment made for such improvement
shall be paid in annual installments, according to
said statement,
(6) designate the assessment district, describing the
land and premises upon which special assessments shall
be levied as follows
A Special Assessment District in the N E 1/4 of Section

32, T.1S., R. 9E , City of Livonia, Wayne County,
Michigan, described as containing the property shown
on the Special Assessment Plan and the Special
Assessment Roll.
(7) direct the City Assessor to prepare a special assessment
roll in accordance with the Council's determination
on said statements as prepared by the City Engineer
dated June 11, 1990, and
(8) that upon completion of said roll, the City Assessor
shall attach thereto the certificate required by the
provisions of Section 3 08 100 of the Livonia Code
of Ordinances, as amended, and file the same with
the City Clerk, who thereupon is directed to present
the same to the City Council prior to the holding
of the second public hearing thereon pursuant to Title
3, Chapter 8 of the Livonia Code of Ordinances.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: Jurcisin, Ochala, Bishop, Taylor and McCotter.

the City Planning Commission dated June 26, 1990, which transmits
its resolution 6-387-90 adopted June 12, 1990, with regard to
a sign permit application submitted by National Bank of Detroit
to erect five wall signs at Six Mile and Newburgh, and the Council
having conducted a public hearing with regard to this matter
on August 13, 1990, pursuant to Council Resolution 633-90, the
Council does hereby reject the recommendation of the Planning
Commission and approve the said Sign Permit Application for
five wall signs
