low MINUTES OF THE ONE THOUSAND ONE HUNDRED AND FORTY-EIGHTH REGULAR MEETING
OF THE COUNCIL OF THE CITY OF LIVONIA
On March 8, 1989, the above meeting was held at the City Hall , 33000 Civic
Center Drive, Livonia, Michigan and was called to order by the President of the
Council at 8 00 P M Councilman Bishop delivered the invocation
Roll was called with the following result Present Fernon P Feenstra,

of the Council of the City of Livonia, held February 22, 1989
are hereby approved
A communication from the Finance Director, dated February 17, 1989
forwarding various financial statements of the City of Livonia for the month ending
December 31 , 1988 was received and placed on file for the information of the Council

ii• On a motion unanimously introduced, supported and adopted, it was

#195-89 WHEREAS, JAMES P CARLI , Superintendent of the Livonia
Public Schools School System, recently passed away at the age
of 48, and
WHEREAS, he served with great distinction as School
Superintendent from 1986 to the present, and from 1979 to 1986
as an Assistant Superintendent, and prior to that time as a
Principal , Assistant Principal and teacher in the Livonia Public
Schools from 1963 to 1979, and
WHEREAS, during the course of his service as an educator
and administrator, JAMES P CARLI was universally respected
and admired by those who came in contact with this kind and
gentle man, and
WHEREAS, JAMES P CARLI , in addition to the services
he rendered to the School District in his professional capacity,
did also unstintingly give of himself in the community by his
many civic activities, including having served as a member of
the Commission on Youth and Children, the Livonia Jaycees, the
CETA Planning Council , the Steering Committee of the Livonia
Prayer Breakfast, the Advisory Board of the Friends of the
Library, the Advisory Board for Family Services of Detroit and
Wayne County, and the Advisory Board of the Gemini District
imm Boy Scouts, and
WHEREAS, he will be sorely missed by his family, friends,
associates, students and staff of the School District and by
the Livonia community at large,
NOW, THEREFORE, BE IT RESOLVED THAT that the City Council of
the City of Livonia deems it fitting at this time to record
its deep sorrow upon the passing of a highly respected school
official and friend and to join with his family and the community
in mourning the loss of JAMES P CARLI
On a motion unanimously introduced, supported and adopted, it was
#196-89 WHEREAS, the community life of Livonia has been enobled
and enriched by the many and outstanding contributions of its
women since inception as a township and city, and
WHEREAS, LIVONIA WOMEN have played, and continue to
play, a crucial economic and social role in every aspect of
the City' s life by constituting a significant portion of the
labor force, working in the home and in the business community,
and
impWHEREAS, LIVONIA WOMEN created a unique role throughout
the City' s history by providing the majority of its voluntary
force in community, cultural , educational and religious groups,
and

WHEREAS, LIVONIA WOMEN, within their homes, schools
and religious institutions have initiated and nurtured character
and will to provide a climate wherein the fullness of human
aspirations could be realized, and
WHEREAS, LIVONIA WOMEN of courage and vision joined
with their sisters statewide, nationwide and worldwide to ensure
a society in which human beings, regardless of sex, could realize
their full creative and intellectual capacity, and
WHEREAS, LIVONIA WOMEN of public spirit and mind now
serve in growing numbers as the City' s elected and appointed
officials and have proven themselves dedicated and hardworking
public servants , and
WHEREAS, much remains to be done to maintain and continue
the significant progress women have made as entities, in and
of themselves , in areas such as child care and the elderly poor,
of which women constitute a majority,
NOW, THEREFORE, BE IT RESOLVED THAT the Council of the City
of Livonia, in recognition of the women of the City of Livonia,
hereby designates the month of March as "WOMENS HISTORY MONTH,"
joining in the national designation and celebration
limpOn a motion unanimously introduced, supported and adopted, it was
#197-89 WHEREAS, SUZANNE DANIEL is the 1989 Livonia First Citizen
and was selected because of unselfish dedication to the
preservation of Livonia history, and
WHEREAS, her history is rooted in Livonia and as a
Media Specialist with Livonia Schools she has worked to preserve
our buildings and their history in order that our residents,
and especially school children, can know how Livonians lived
in the past, and
WHEREAS, her interests have included membership in
the Livonia Historical Society and Chairperson of the Restoration
Committee, membership in the Livonia Historical Commission,
serving as President in 1981 and each year since 1984 and
membership in the Livonia Historic Preservation Commission, and
WHEREAS, she is the Livonia Historical Commission
designee for purchasing furniture and artifacts for Greenmead
and has continued to collect and catalogue materials for the
Historical Library and manuscript collection at Greenmead, and
WHEREAS, she has contributed to and edited several
Iwo books on Livonia History, such as "Big House on the Hill ," "Learn
About Livonia" , "The Ryders," and the "Heritage Cookbook" , and

ii• WHEREAS, SUE DANIEL is best known to all of us as the
lady who urges us all to preserve our past by saving and restoring
the buildings at Greenmead where she has given of her time,
effort and commitment and her particular devotion to the John
Shaw House, her research of the Shaw family and their place
in early Livonia,
NOW, THEREFORE, BE IT RESOLVED THAT the Mayor and the City Council
of the City of Livonia do hereby take this means to commend
SUZANNE DANIEL for the honor of being Livonia First Citizen
1989 and to gratefully acknowledge her enduring contribution
to the quality of life in Livonia and to the vision of the future
the understanding of our past provides to us all

Michigan 48174, which meets specifications, as an alternate
to supply cold patch asphaltic material at the unit price of
$31 50 per ton delivered through April 15, 1990

recommendation of the Director of Public Works, dated February
13, 1989, approved by the Director of Finance and approved for
submission by the Mayor, the Council does hereby accept the
bid of National Ready-Mix, Inc. , 39000 Ford Road, Westland,
Michigan 48185, for supplying the Public Service Division (Road
Maintenance Section) with readymix concrete at the unit prices
bid through April 1 , 1990, for a total estimated amount of
$32,000 00, the same having been in fact the lowest bid received
and meets all specifications, further, in the event the aforesaid
bidder is unable to furnish the material , the Council does hereby
accept the second low bid of Clawson Concrete Company, P 0.
Box 768, Novi , Michigan 48050, which meets specifications, as
an alternate to supply readymix concrete at the unit prices
bid through April 1 , 1990, for a total estimated amount of
$33,928 00
#201-89 RESOLVED, that having considered the report and
recommendation of the Director of Public Works, dated February
9, 1989, approved by the Director of Finance and approved for
submission by the Mayor, the Council does hereby accept the
bid of National Block Company, 39000 Ford Road, Westland, Michigan
48185, for supplying the Public Service Division (Road Maintenance
Section) with air entrained cement at the unit price bid through
1110 April 1 , 1990, for a total estimated amount of $6,750 00, the
same having been in fact the lowest bid received and meets all
specifications
#202-89 RESOLVED, that having considered the report and
recommendation of the Director of Public Works, dated February
9, 1989, approved by the Director of Finance and approved for
submission by the Mayor, the Council does hereby accept the
bid of Astro Oil Company, Inc , 27801 Cooke Street, Flat Rock,
Michigan 48134, for supplying the Public Service Division (Road
Maintenance Section) with liquid calcium chloride delivered
to the storage tank in the DPW Yard at the unit prices bid through
December 31 , 1989, for a total estimated amount of $37,275.00,
the same having been in fact the lowest bid received and meets
all specifications.
A communication from the Chairperson of the Livonia Historical Commission,
dated February 7, 1989 re Greenmead Five Year Plan For The Information Of The Council
was received and placed on file for the information of the Council
#203-89 RESOLVED, that having considered a communication from
the Livonia Arts Commission, dated February 3, 1989, approved
by the Finance Director and approved for submission by the Mayor,
the Council does hereby authorize the grant of $5,000 00 to
the Livonia Cultural League for the Blum Environmental Sculpture

lisProject, the same to be appropriated and expended from the Trust
Fund Account No 724-000-390 000 for this purpose
#204-89 RESOLVED, that having considered a letter from the
Co-Chair of the Project Concern ' s Walk for Mankind - '89, dated
February 14, 1989, and a communication from the Mayor, dated
January 23, 1989, in connection therewith, the Council does
hereby approve the use of the W W Edgar Ice Arena, use of the
Department of Parks and Recreation Showmobile, and Public Safety
(eight officers) on Walk Day, Saturday, May 20, 1989, further,
the Council does hereby request that the Mayor submit a report
and recommendation with regard to the cost and fees involved
in providing public safety assistance , and the Council does
hereby waive all other fees associated with this request, and
the Council does hereby request that the Finance Director submit
a report and recommendation regarding insurance compliance
pertaining to this request
#205-89 RESOLVED, that having considered the report and
recommendation of the Superintendent of Parks and Recreation,
dated January 31 , 1989, approved for submission by the Finance
Director and the Mayor, and which transmits a bid received for
the operation of the Eddie Edgar Ice Arena and Ford Field
concession stands, the Council does hereby refer this item to
Ibm the Finance and Insurance Committee for its report and
recommendation
#206-89 RESOLVED, that having considered the report and
recommendation of the Fire Chief, dated February 2, 1989, which
bears the signature of the Director of Finance and is approved
for submission by the Mayor, wherein authorization is requested
for the taking of competitive bids for the purchase of nozzles
and fittings for 1-3/4" hose, the Council does hereby approve
and authorize the preparation of competitive bids for the said
items in accordance with provisions of law and City ordinance
A communication from the Director of Inspection, dated February 7, 1989'
re Fencing Requirements For Homeowners Pools was received and placed on file for
the information of the Council
#207-89 RESOLVED, that having considered the report and
recommendation of the Director of Inspection, dated February
7, 1989, approved by the City Attorney and approved for submission
by the Mayor, with regard to fencing requirements for homeowners '
pools as set forth in Section 15 40 150 of the Livonia Code
of Ordinances , as amended, the Council does hereby refer this
item to the Legislative Committee for its report and
recommendation

#208-89 RESOLVED, that having considered a communication from
the Personnel Director, dated February 22, 1980, approved by
the Director of Finance and approved for submission by the Mayor,
and which transmits a resolution aoopted by the Civil Service
Commission on January 12, 7989, wherein it is recommended that
the Detroit Industrial Clinic be designated as the City physician,
the Council does hereby concur in and approve of such action
and does further authorize the written proposal submitted by
Detroit Industrial Clinic by total cost per employee occupational
group as follows

further, the Council does hereby authorize the said item in
the manner and form herein recommended without competitive bidding

#209-89 RESOLVED, that having considered the report and
recommendation of the City Engineer, dated February 8, 1989^
which bears the signature of the Finance Director and is approved
for submission by the Mayor, with regard to the selection of
an architectural firm for the proposed construction of the Fox
Creek Golf Course Clubhouse, the Council does hereby refer this
item to the Capital Improvement Committee for its report and
recommendation
#210-89 WHEREAS, Middlebelt Road in the City of Livonia, Wayne
County, Michigan , is a County road under the jurisdiction of
Wayne County, and
WHEREAS, the Wayne County Department of Public Services
is proposing projects to (1 ) resurface Middlebelt Road from
Five Mile to Six Mile, including renovation of a bridge over
the Bell Creek, and (2) resurface Six Mile Road east of
Farmington, and
WHEREAS, the Wayne County Internal Resurfacing Program
Guidelines , dated January 10, 1989, call for cities to contribute
one-third of the estimated cost for resurfacing projects, and
WHEREAS, the cost for the 1989 Internal Resurfacing Program
has been estimated at $98,000 per lane mile and the local city
share has been established at $32,000 per lane mile , and
WHEREAS, the total cost for the proposed resurfacing and
bridge renovation work has been estimated at $984,500 with the
City of Livonia share being $194,000,

NOW, THEREFORE, BE IT RESOLVED THAT, the Livonia City Council
does on this 8th day of March, 1989, take this means to express
its desire to join with Wayne County in proceeding with projects
to (1 ) resurface Middlebelt Road from Five Mile to Six Mile,
including renovation of a bridge over the Bell Creek, and (2)
resurface Six Mile Road east of Farmington and, furthermore,
does hereby approve and authorize payment of the City' s share
of $194,000 in the manner set forth in the Wayne County Internal
Resurfacing Program Guidelines, dated January 10, 1989, the
same being appropriated and authorized to be expended from
Michigan Transportation Funds (Major Road Account) for this
purpose
#211-89 RESOLVED, that the Council does hereby request that
the City Engineer submit his report and recommendation on the
Necessity for the installation of street lighting on Newburgh
Road between Five and Eight Mile Roads
#212-89 RESOLVED, that having considered the report and
recommendation of the City Engineer, dated February 10, 1989,
which bears the signature of the Finance Director and is approved
for submission by the Mayor, regarding the replacement and/or
construction of new sidewalks (and/or drive approaches) in the
City of Livonia, pursuant to the 1988 Sidewalk Repair Program
lis at the locations and in the amounts included herein by reference,
which work was done pursuant to Council Resolution 626-88 and
in accordance with the provisions of Section 12 04 340 of Chapter
4 of Title 12 of the Livonia Code of Ordinances, as amended,
the City Treasurer is hereby directed to send a statement of
charges to all property owners in the amounts listed above in
accordance with Section 3 08 150 of Title 3, Chapter 8 of the
Livonia Code of Ordinances , as amended, and the Council does
hereby establish the evening of Wednesday, June 7, 1989 at 8 00
P M at the Livonia City Hall , 33000 Civic Center Drive, Livonia,
Michigan, as the time and place when the Council shall meet
for the purpose of adopting a resolution placing a special
assessment upon said property for such charges unless the same
are paid prior to the date of such meeting, and the City Clerk
and City Treasurer are hereby requested to do all things necessary
or incidental to the full performance of this resolution
#213-89 RESOLVED, that having considered the report and
recommendation of the City Engineer, dated February 14, 1989,
which bears the signature of the Finance Director and is approved
for submission by the Mayor, the Council does hereby authorize
the razing of the existing home located at 9408 Newburgh Road
(City-owned property - Parcel No 15) by Stanson Wrecking Company,
6855 Haggerty Road, Belleville, Michigan 48111 , for a price
not to exceed $4,487 00, the same to be appropriated and
authorized to be expended from Act 51 Funds (Major Road Account)
for this purpose, further, the Council does hereby authorize
the said item without competitive bidding in accordance with

provisions set forth in Section 3 04 140D5 of the Livonia Code
of Ordinances , as amended
#214-89 RESOLVED, that having considered the report and
recommendation of the City Engineer, dated February 16, 1989,
which bears the signature of the Finance Director and is approved
for submission by the Mayor, the Council does hereby authorize
the purchase of an electronic distance measuring instrument
and accessories from Instrument Sales & Service, 33550 Schoolcraft
Road, Livonia, Michigan 48150, for the price of $6,300 00,
further, the Council does hereby authorize the transfer of
$6,300 00 from the Salaries and Wages Account No 101-441-702-000
to the Capital Outlay Account No 101-441-987-000 for this
purpose, and the Council does hereby authorize the said item
without competitive bidding in accordance with provisions set
forth in Section 3 04 140D5 of the Livonia Code of Ordinances,
as amended
#215-89 RESOLVED, that having considered a communication from
the City Planning Commission, dated February 13, 1989, which
transmits its resolution 1-6-89, adopted on January 31 , 1989,
with regard to Petition 88-10-3-10, submitted by the City Planning
Commission on its own motion, to vacate a portion of right-of-way
on Norfolk between Mayfield and Hubbard in the Northwest 1/4
of Section 3, the Council does hereby concur in the recommendation
of the City Planning Commission and does grant and approve
Petition 88-10-3-10, subject to the retention of a full width
easement to protect public utilities, and the Department of
Law is hereby requested to prepare the necessary vacating
ordinance in accordance with this resolution
#216-89 RESOLVED, that having considered a proposal submitted
by Councilman Ron Ochala, dated February 22, 1989, to adopt
a resolution opposing the rate increase established by MetroVision
for Tier II service from $12 25 to $13 95 per month for Livonia
subscribers, the Council does hereby refer this item to the
Finance and Insurance Committee for its report and recommendation
#217-89 RESOLVED, that in accordance with the provisions set
forth in Section 4 of Act 207 of the Public Acts of Michigan
of 1921 , as amended, the City Zoning Act (MSA 5 2934, MCLA
125 584) , as well as Article XXIII of Ordinance 543, as amended,
the Zoning Ordinance of the City of Livonia, the Council does
hereby determine that a public hearing will take place before
the City Council of the City of Livonia on Wednesday, April
19, 1989, at 8 00 P M at the City Hall , 33000 Civic Center
Drive, Livonia, Michigan, with respect to the following items
Petition 88-10-1-33, submitted by Kenneth Neumann
for Duke Associates, for a change of zoning on property
located on the east side of Haggerty Road, north of
Six Mile Road in the Southwest 1/4 of Section 7, from

the City Planning Commission in its resolution 2-30-89
having recommended to the City Council that Petition
88-10-1-33 be denied,
FURTHER, the City Clerk is hereby requested to, no less than
fifteen (15) days prior to the aforesaid date of said public
hearing, cause to have a statement indicating the (a) nature
of the proposed amendment to the Zoning Ordinance, and/or (b)
location of the proposed change of zoning as set forth above,
first to be published in the official newspaper of the City
or a newspaper of general circulation in the City of Livonia
as well as to, not less than fifteen (15) days prior to said
public hearing, cause to have notice to be given by registered
mail to each public utility company and to each railroad company
owning or operating any public utility or railroad within the
districts or zones affected, and further, the City Clerk is
requested to do all other things necessary or incidental to
the full performance of this resolution.
#218-89 RESOLVED, that in accordance with the provisions set
forth in Section 4 of Act 207 of the Public Acts of Michigan
of 1921 , as amended, the City Zoning Act (MSA 5 2934, MCLA
125 584) , as well as Article XXIII of Ordinance 543, as amended,
the Zoning Ordinance of the City of Livonia, the Council does
hereby determine that a public hearing will take place before
the City Council of the City of Livonia on Monday, May 1 , 1989,
at 7 00 P M at the City Hall , 33000 Civic Center Drive, Livonia,
Michigan, with respect to the following items
Petition 88-11-1-35, submitted by Charles G Tangora,
for a change of zoning on property located on the
east side of Farmington Road, north of Plymouth Road
in the Southwest 1/4 of Section 27, from M-1 to C-2,
the City Planning Commission in its resolution 2-19-89
having recommended to the City Council that Petition
88-11-1-35 be denied,
FURTHER, the City Clerk is hereby requested to, no less than
fifteen (15) days prior to the aforesaid date of said public
hearing, cause to have a statement indicating the (a) nature

Livonia, Michigan, with respect to the following items

hereby determine that a public hearing will take place before
the City Council of the City of Livonia on Monday, April 24,
1989, at 8 00 P M at the City Hall , 33000 Civic Center Drive,

Owen J Cummings for Associated Diversified Investors for
a change of zoning on property located on the west side
of Stark Road, north of Schoolcraft Road in the Southeast
1/4 of Section 21 , from R-2 to P , and the Council having
conducted a public hearing with regard to this matter on
February 15, 1989, pursuant to Council Resolution 7-89,
the Council does hereby concur in the recommendation of
the Planning Commission and the said Petition 88-10-1-32
is hereby approved and granted, and the City Planner is
hereby instructed to cause the necessary map for publication
to be prepared indicating the zoning change herein approved
and to furnish the same to the Department of Law and,upon

recommendation of the City Engineer, dated February 8, 1989,
which bears the signature of the Finance Director and is
approved for submission by the Mayor, the Council does hereby
accept the unit price bid of South Hill Construction Co ,
51490 Pontiac Trail , Wixom, Michigan 48096, for the
improvement of Antago, Floral , Fargo and Sunset Streets
(Contract 89-A) , for the estimated total cost of $769,110 47,
based upon the Engineering Department' s estimate of units
involved, and subject to a final payment based upon the
prices accepted herein, said estimated cost and unit prices
having been in fact the lowest bid received for this item,
further, the Council does hereby appropriate a sum not to
exceed $769,110 47 from the $7 9 and/or $9 8 million General
Obligation Road Improvement Bond Issue with the provision
that (1 ) the Bond Issue be reimbursed for that portion of
the project which is to be financed by special assessment
at such time as funds are available from the future special
assessment bond issue and (2) the Bond Issue be reimbursed
for the City' s portion of the project at such time as funds
may be available from the Michigan Transportation Funds
(Local Road Account) , and the City Engineer is hereby
authorized to approve minor adjustments in the work as
completed, and the Mayor and City Clerk are hereby authorized
to execute a contract for and on behalf of the City of Livonia
with the aforesaid bidder and to do all other things necessary
or incidental to the full performance of this resolution

from the Planning Director, dated February 14, 1989, in
connection with Petition 84-3-2-9, submitted by Louis
DesRosiers & Associates, and the action taken in Council
Resolution 360-84, adopted on May 2, 1984, wherein the Council
did approve and grant waiver use approval to construct office
buildings on the south side of Six Mile Road, west of Newburgh
Road in Section 18, and which approval required the internal
storage of trash and no outside storage being permitted,
the Council does hereby deny the request of the petitioner
to revise the site plan so as to provide for outside storage
of trash and other related items

that the proprietor of Ashley Estates Subdivision, situated
in the Southeast 1/4 of Section 4, has delivered final true
plats to the City Clerk and requested that said plat be
presented to Council for final approval , and the Council
having received a communication from the City Planning
Commission dated February 16, 1989, wherein said Commission
approves the final plat for the said subdivision in its
resolution 2-23-89, adopted on February 14, 1989, and the
Council having considered a report and recommendation from
the City Engineer dated February 8, 1989, recommending
approval of the final plat of said subdivision, the
preliminary plat of which was approved by the Council in
its resolution 825-88, adopted on August 29, 1988, said

Council in its resolution 1210-88, adopted on December 19,

Code of Ordinances, as amended, the City Assessor of the
City of Livonia has prepared, reported and certified to
the Council under date of February 28, 1989 an assessment
roll dated February 28, 1989 for the proposed improvement
consisting of placing approximately 4" of asphalt over the
existing roadway (Alternate IV) on Greenland, West of
Middlebelt and Henry Ruff, Greenland to Puritan in the North
1/2 of Section 14, containing the special assessments to
be assessed and levied, respectively, in the proposed special
assessment district heretofore established for the
construction and operation of the proposed improvement in
said district as designated in Council Resolution 1210-88.
THEREFORE, BE IT RESOLVED, that the said roll is hereby
accepted by the City Council , that it is hereby ordered
to be filed in the office of the City Clerk for public
examination; that the City Clerk be and hereby is directed
to give notice as required by the provisions of Section
3.08.110 of the Livonia Code of Ordinances, as amended,
to wit: that the assessment roll has been made and filed
in the office of the City Clerk for public examination and
that the City Council of the City of Livonia will meet in
the City Hall , 33000 Civic Center Drive, Livonia, Michigan,
on Monday, April 10, 1989 at 8:00 P M. to review the said

IT IS FURTHER RESOLVED, that the City Clerk be and hereby

attached a copy of specific line item recommendations from
Governor Blanchard' s 1989-90 Budget proposal wherein a
recommendation from the Department of Agriculture/Racetrack
Revenue Budget would represent a net decrease of approximately

$100,000.00 in annual revenues to the City of Livonia as
a result of the projected decline in race track revenues,
the Council does hereby refer this item to the Department
of Law for the preparation of an appropriate resolution
in opposition to such action.

from Karoub Associates, dated March 6, 1989, to which is
attached a copy of specific line item recommendations from
