MINUTES OF THE ONE THOUSAND SEVEN HUNDRED AND SEVENTY-NINTH
REGULAR MEETING OF JUNE 15, 2015
On June 15, 2015 the above meeting was held at the City Hall, 33000
Civic Center Drive, Livonia, Michigan, and was called to order by President Brosnan
at 7 00 p m Vice President Meakin led the meeting in the Pledge
Roll was called with the following result: Brian Meakin, Laura Toy,
Lynda Scheel, Susan Nash, Brandon Kritzman, John Pastor and Maureen Miller
Brosnan Absent: None
Elected and appointed officials present- Mark Taormina, Director of
Planning and Economic Development, Todd Zilincik, City Engineer; Don Knapp,
City Attorney; Judy Priebe, Director of Legislative Affairs, and Mayor Jack Kirksey
On a motion by Pastor, supported by Kritzman, it was
#175-15 RESOLVED, that the Minutes of the 1,778th Regular Meeting
of the Council held June 1, 2015 are hereby approved

Toy reminded everyone that the Livonia Spree will start Tuesday, June 23,d
and end with a fantastic fireworks display on Sunday, June 28th
President Brosnan announced there is new data on Items 16, 17, 18 and 19
She also stated that there is an event coming up on June 17th from 6 00 to
8 00 p m at the Civic Center Library regarding a Bike/Walk Plan where residents
can provide input as to what they would like to see as far as connectivity in
establishing biking and walking paths throughout the City She also indicated you
can provide feedback via the City's website

Mayor Kirksey congratulated all who participated in the Relay for Life over
the weekend He stated this annual event is used to promote awareness of all
concerned when they are going through cancer treatment.
He also commented on the huge turnout at the "School's out, Safety's in"
event held at the Police Station on Saturday, where there was a Jaws of Life
demonstration and also a bike helmet giveaway
During Audience Communication Ron Riggio, 37204 Bretton, provided
Council with some pictures in support of his complaints regarding parents parking
at the entrance to the Willow Woods subdivision to pick their children up at the bus
stop and also parking in general in front of his house blocking part of his driveway
Vice President Meakin addressed this item by informing Mr Riggio there is
a Traffic Commission that is in charge of looking into matters such as his

On a motion by Meakin, supported by Pastor, and unanimously adopted, it
#176-15 RESOLVED, that the Council does hereby refer the subject of
parking at the entrance and along the streets in the Willow Woods
Subdivision, and the necessity for "No Parking" signs, to the Traffic
Commission for its report and recommendation
During Audience Communication Katie Campbell, Staff Assistant to
Congressman David Trott and a Livonia resident herself, invited the citizens of
Livonia to contact their office with any issues or concerns as they are proud to serve
the people of their district.
On a motion by Toy, supported by Scheel, it was

Rev Fr Tony Massad, Pastor, dated May 7, 2015, which requests
permission to waive Section 8 32 070 (Noise Control) of the Livonia Code of
Ordinances, as amended, to hold a cultural festival with music played by a
DJ and live band at Saint Rafka Maronite Catholic Church, located at 32765
Lyndon, scheduled for Saturday, August 1, 2015 from 4 00 p m to 11 00
p m and Sunday, August 2, 2015 from 1 00 p m to 8 00 p m , the Council
does hereby grant and approve this request in the manner and form herein
submitted
#178-15 RESOLVED, that pursuant to Section 21 02 of the Zoning
Ordinance of the City of Livonia, Ordinance No 543, as amended, and
Section 601 of Act 110 of the Public Acts of Michigan of 2006, as amended,
Gregory G Coppola, 17268 McNamara, Livonia, Michigan 48152, is hereby
reappointed to the Zoning Board of Appeals for a three-year term expiring

July 12, 2018, with all the authority and duties as set forth in the said Zoning
Ordinance and Act 110
#179-15 RESOLVED, that pursuant to Section 21 02 of the Zoning
Ordinance of the City of Livonia, Ordinance No 543, as amended, and
Section 601 of Act 110 of the Public Acts of Michigan of 2006, as amended,
Matthew Henzi, 14314 Barbara, Livonia, Michigan 48154, is hereby
reappointed to the Zoning Board of Appeals for a three-year term expiring
July 12, 2018, with all the authority and duties as set forth in the said Zoning
Ordinance and Act 110
A communication from Susan A. Hoff, City Clerk, dated May 15, 2015, re
forwarding a communication from Michael Slater, dated May 8, 2015, regarding the
Tax Rate Request for the Plymouth Road Development Authority for 2015, was
received and placed on file for the information of the Council
#180-15 RESOLVED, that having considered a communication from the
Director of Community Resources and the Chairperson of the Historical
Commission, dated May 12, 2015, and is approved for submission by the
Mayor, to which is attached a letter from Peg Dunlop, Games Chair, on
behalf of St. Andrew's Society of Detroit, requesting permission to hold the
166th, 167th and 168th Annual Highland Games at Greenmead, with the
events to be held on Friday, July 31, 2015, Saturday, August 1, 2015, Friday,
August 5, 2016, Saturday, August 6, 2016, Friday, August 4, 2017 and
Saturday, August 5, 2017, respectively, THE COUNCIL DOES HEREBY
GRANT PERMISSION AS REQUESTED, THE ACTION TAKEN HEREIN
BEING SUBJECT TO THE FOLLOWING CONDITIONS
That the St. Andrew's Society of Detroit and all equipment operators
shall provide the City of Livonia with appropriate insurance policies
naming the City of Livonia as additional insured with liability coverage
of $1 million, and all certificates of insurance shall be submitted to the
Department of Law for approval by the City prior to each event,
2 That the St. Andrew's Society of Detroit and any vendors involved in
the sale of beer or wine on Greenmead property shall provide the City
of Livonia with an insurance policy naming the City of Livonia as
additional insured with liquor liability coverage in the amount of $1
million, such certificate to be submitted to the Department of Law for
approval by the City prior to each event,
3 That the St. Andrew's Society of Detroit shall execute a hold harmless
agreement in favor of the City of Livonia in substance and form
acceptable to the Department of Law;

4 That all vendors must obtain transient merchant licenses from the City
of Livonia prior to the event, and all necessary licenses and permits
from state and county agencies prior to each event,
5 That the St. Andrew's Society of Detroit shall pay the police fee as
stated on the City of Livonia FeesMaivers IV Category Grid as
established in Council Resolution 660-03, adopted on December 17,
2003,
FURTHER, the events shall be operated as set forth in the attachment to the
aforementioned correspondence, including an annual payment from the St.
Andrew's Society of Detroit for use of the property in the amount of $8,000,
plus a share of the net revenues (profits) derived from the Games as follows

#181-15 RESOLVED, that having considered the report and
recommendation of the Interim Superintendent of Parks and Recreation,
dated May 13, 2015, which bears the signature of the Director of Finance
and is approved for submission by the Mayor, and which sets forth Parks
and Recreation Commission resolution #3433-15, adopted on May 6, 2015,
wherein revisions in Membership Fees at the Livonia Community Recreation
Center are recommended, the Council does hereby concur in the
recommendation of the Parks and Recreation Commission as set forth in its
Resolution #3433-15, adopted on May 6, 2015, and does hereby approve
the fee increases for annual passes, summer passes and EFT membership
fees for the Livonia Community Recreation Center as set forth in the
attachment to Parks and Recreation Commission Resolution 3433-15
#182-15 RESOLVED, that having considered the report and
recommendation of the Superintendent -Operations and the Director of
Public Works, dated May 21, 2015, which bears the signature of the Director
of Finance and is approved for submission by the Mayor, the Council does
hereby accept the bid as presented of RW Mead & Sons, 33795 Riviera,
Fraser, MI 48026, for completing all work necessary in connection with the
Livonia Community Recreational Center HVAC Maintenance Service
Contract for a period of three years in an amount not to exceed $183,732 00
($60,132 00 for year 1, $61,200 00 for year 2 and $62,400 00 for year 3), the
same having been the lowest bid received and meets all specifications and
such amount is hereby authorized to be expended from funds already

budgeted in Account No 208-755-818-020 for this purpose, and the Director
of Public Works is hereby authorized to approve any minor adjustments in
the work as it becomes necessary; and the Mayor and City Clerk are hereby
authorized, for and on behalf of the City of Livonia, to execute a contract with
the aforesaid company and to do all other things necessary or incidental to
the full performance of this resolution
#183-15 RESOLVED, that having considered a communication from the
Department of Law, dated May 26, 2015, approved for submission by the
Mayor, regarding Act 563 of 2014, the Council does hereby adopt the City of
Livonia Freedom of Information Act Procedures and Guidelines, together
with the attachments thereto attached to said letter, and the City's pre-
existing Freedom of Information Act Cost Recovery Policy is hereby declared
to be null and void All resolutions or parts of resolutions in conflict herewith
are repealed to the extent necessary to give this resolution full force and
effect.

Pictures received from the Public Service Division at the Capital
Improvement, Natural Resources and Waste Management Committee Meeting
held on May 27, 2015, re the proposed DPW Water and Sewer Building, were
received and placed on file for the information of the Council
A set of drawings depicting the site of the new building (Sheet A-002) and a
tentative first floor plan (Sheet A-101) received from OHM Advisors, re the
proposed DPW Water and Sewer Building, were received and placed on file for the
information of the Council
As chair of the Capital Improvement, Natural Resources and Waste
Management Committee, Vice President Meakin reported that the May 27, 2015
meeting was held off site at the DPW facility and that all members were present as
well as Mayor Kirksey, Attorney Knapp, many department heads and

Councilwoman Nash They were given a tour of many of the facilities and it was an
eye opening experience as to the state of disrepair the buildings were in This was
followed with a two hour discussion where they received good input on the topic

On a motion by Meakin, supported by Nash, and unanimously adopted, it
#184-15 RESOLVED, that having considered the report and
recommendation of the Capital Improvement, Natural Resources and Waste
Management Committee, dated May 27, 2015, submitted pursuant to
Council Resolution 152-15, with regard to the subject of the conceptual
planning and design of the proposed Department of Public Works Water and
Sewer Building, the Council does hereby approve a request for proposal for
retaining an architect to design a building and recommend placement on the
site based upon a Master Plan Study for the DPS -DPW Campus suggested
by the architect and determined to be the best location for a new building in
order to meet the needs of the Department of Public Works

DIFFERS FROM WATER METER

Larry Massa, 35558 Ann Arbor Trail, and Treasurer of the Arbor Woods
Condo Association, commented on the water bill and the large user variable rate
which is tied into the meter size He spoke on the condos being classified as
large user and felt that was not fair and asked Council to take that into
consideration in the future when dealing with rate structures

Kritzman asked if exceptions can be made in classifications and Coline
Coleman, Chief Accountant, responded that it is based on meter size and
availability and capacity usage
President Brosnan asked Attorney Knapp for clarification on this ordinance
After discussion, the second reading of the Ordinance was postponed until the
July 8th meeting

On a motion by Toy, supported by Scheel, and unanimously adopted, it was
#185-15 RESOLVED, that having considered a communication from the
City Treasurer dated May 29, 2015, regarding the replacement of sidewalks
in the City of Livonia on the following parcels in the following amounts
Parcels of property and assessment, as outlined in the
Treasurer's letter, dated May 29, 2015, is included herein by
reference,
which work was done pursuant to Council Resolution 151-14 and in
accordance with the provisions of Section 12 04 340 of the Livonia Code of
Ordinances, Title 12, Chapter 4, and the City Treasurer having thereafter
sent a statement of charges by first class mail to the owners of property to
be assessed wherein notice of the meeting by the City Council on this date
was given and at least 30 days having expired since the giving of such notice
with such charges remaining unpaid, the Council does hereby, pursuant to
the provisions of Section 3 08 150 of the Livonia Code of Ordinances, Title
3, Chapter 8, adopt this resolution wherein a special assessment is placed
upon such property for said charges, FURTHER, the Council does hereby
authorize installment payments in the number of three (3) installments at 6%
interest where assessments exceed $400 and the property owner has
requested such installments, FURTHER, the Council does hereby request
that the City Treasurer shall give notice of the amounts herein determined to
the persons chargeable therewith, such notice to be sent by first class mail
to the last known address of such persons as shown on the most current
assessment roll of the City, and where payments herein authorized are not
made within the specified time this fact shall be reported by the City

as amended, this Council has the authority to establish industrial
development districts within the boundaries of the City of Livonia, and
WHEREAS, a proposal was made regarding the establishment of an
industrial development district encompassing land situated in the City of
Livonia and comprised of an area of approximately 11 95 acres lying in the
Southwest % of Section 7, more particularly described in Exhibit A, attached
hereto and incorporated by reference herein, which area is hereinafter
referred to as "City of Livonia Industrial Development District No 117", and

WHEREAS, written notice has been given by certified mail to Schoolcraft
College of the Council's pending action on this resolution and of its right to a
hearing on the establishment of proposed City of Livonia Industrial
Development District No 117, and
WHEREAS, notice has been given to all interested owners, residents and
taxpayers in the Livonia area of a public hearing on the establishment of the
proposed City of Livonia Industrial Development District No 117, and
WHEREAS, on June 3, 2015, a public hearing was held on the establishment
of proposed City of Livonia Industrial Development District No 117, at which
time Schoolcraft College and other taxpayers and residents of the City of
Livonia had an opportunity to be heard (a copy of the statements both written
and oral made at such hearing being on file with this City Council), and a

On a motion by Toy, supported by Scheel, and unanimously adopted, it was
#187-15 RESOLVED, that having considered an application from
Derrick Rodriguez, 32421 Allen Ct., dated June 2, 2015, requesting
permission to close Allen Court on Sunday, June 28, 2015, from 12 00 p m
to 10 00 p m , for the purpose of conducting a block party, the Council does
hereby grant permission as requested, the action taken herein being made
subject to the approval of the Police Department.
On a motion by Toy, supported by Pastor, and unanimously adopted, it was

Ordinance of the City of Livonia, Ordinance No 543, as amended, and
Section 601 of Act 110 of the Public Acts of Michigan of 2006, as amended,
James Baringhaus, 37594 Southampton, Livonia, Michigan 48154, is hereby
appointed to the Zoning Board of Appeals for a three-year term that expires
on July 12, 2018, with all the authority and duties as set forth in the said
Zoning Ordinance and Act 110, and further provided that Mr Baringhaus
takes the Oath of Office as required in Chapter X, Section 2 of the City
Charter, to be administered by the Office of the City Clerk.
During Audience Communication, Christopher Martin, 11037 Hubbard, cited
a Detroit News article regarding the replacement of street lights and stated there
were fifteen of them out in a row on Plymouth Road
