A communication from the Director of the Livonia Housing Commission , dated February 20, 1987, re Livonia Housing Commission McNamara Towers Fiscal Year End Reports was received and placed on file for the information of the Council . #245-87 RESOLVED, that having considered a communication from the Personnel Director dated February 25, 1987 which bears the signature of the Finance Director, is approved for submission im. by the Mayor Pro Tem and transmits a resolution adopted on February 19, 1987 by the Civil Service Commission wherein a request is submitted for an additional appropriation for the Personnel Selection/Testing Supplies Account, the Council does 23242 hereby appropriate the sum of $7,370.00 from the Unexpended Fund Balance Account to be transferred to the Personnel Selection/ Testing Supplies Account 101-236-765 000 for this purpose. A communication from the Mayor Pro Tem, dated March 4, 1987, re CR 85-87 and CR 128-87 - Truck Traffic Problems in Osmus/Parker/Norfolk Area was received and placed on file for the information of the Council . #246-87 RESOLVED, that having considered a communication from the Traffic Commission dated March 4, 1987 which transmits its resolution 11-87 submitted pursuant to Council Resolution 122-87 in connection with traffic problems in the area of Laurel/Pinetree, the Council does hereby refer this item to the Streets, Roads and Plats Committee for its report and recommendation. #247-87 RESOLVED, that having considered the report and recommendation of the City Engineer dated February 23, 1987 which bears the signature of the Finance Director and is approved for submission by the Mayor Pro Tem and which submits final imp information with regard to Cavell (Five Mile to Oakley) and Oakley (Cavell to Inkster) Street Paving Project, S.A.D 271 , the Council does hereby refer this item to the Committee of the Whole for its report and recommendation #248-87 RESOLVED, that having considered the report and recommendation of the City Engineer dated February 27, 1987, approved for submission by the Mayor Pro Tem, the Council does hereby authorize the release to Villanova Construction, Inc , 20764 Hugo, Farmington Hills, Michigan 48024, the proprietor of the Gill Woods Subdivision, located in the Southwest 1/4 of Section 4, the financial assurances previously deposited with respect to general improvements in the sum of $42,000 00 pursuant to Council Resolution 1084-86 adopted on November 10, 1986, and all other financial assurances on deposit with the City, including the Sidewalk Improvement Bond and a $35,000 00 bond requirement for the future paving of Gill Road shall remain the same and unchanged, and the action herein being taken is for the reasons indicated in the aforesaid report of the City Engineer that all these improvements have been satisfactorily installed in accordance with the rules and regulations and ordinances of the City of Livonia #249-87 RESOLVED, that having considered a communication from the City Clerk dated March 16, 1987, which indicates that Villanova Construction, Inc , 20764 Hugo, Farmington Hills, Michigan 48024, proprietor of Gill Woods Subdivision, situated in the Southwest 1/4 of Section 4, has delivered final true 23243 plats to the City Clerk and requested that said plat be presented to Council for final approval , and the Council having received a communication from the City Planning Commission dated March 5, 1987, wherein said Commission approves the final plat for the said subdivision in its resolution 2-40-87, adopted on February 24, 1987, and the Council having considered a report from the City Engineer dated February 24, 1987 recommending approval of the final plat of said subdivision, the preliminary plat of which was approved by the Council in its resolution 1084-86 adopted on November 10, 1986, said preliminary plat having been recommended for approval by the City Planning Commission on June 3, 1986 in its resolution 6-145-86, now, therefore, the Council does hereby determine to grant its approval to the final plat of Gill Woods Subdivision, located in the Southwest 1/4 of Section 4, City of Livonia, Wayne County, Michigan, as submitted by the proprietor thereof, which proprietor is also hereby required to do all things necessary to obtain full compliance with the Subdivision Control Act of Michigan of 1967, as amended, and the ordinances of the City of Livonia; and further, the City Clerk is hereby requested to do all things necessary or incidental to the full performance of this resolution. 1250-87 RESOLVED, that having considered the report and recommendation of the City Engineer dated March 3, 1987 which bears the signature of the Finance Director and is approved for submission by the Mayor Pro Tem wherein certain adjustments are recommended with reference to S A D.s 256 and 263, the Council does hereby determine as follows A. To reduce the total final special assessment cost in S.A.D. 256 in the amount of $1 ,408.50 and increase the City's share in this special assessment district by the same amount. B. To reduce the final additional work requested by homeowners cost in S A D 263 in the amount of $533.06 and increase the City's share in this special assessment district by the same amount, C. To authorize an additional expenditure in the amount of $1 ,941 . 56 from the Motor Vehicle Highway Fund, and D To direct the City Treasurer to mail adjusted bills to the affected homeowners 1251-87 RESOLVED, that having considered the communication from the Planning Commission dated February 24, 1987 which low transmits its resolution 2-35-87 adopted on February 10, 1987 wherein the Commission did amend Part VII of the Master Plan, the Future Land Use Plan, by changing the designation of property located on the north side of Seven Mile Road between I-275 and 23244 Newburgh Road from medium density residential to office, the Council does hereby certify and acknowledge the receipt of such action. 1252-87 RESOLVED, that having considered Petition 87-3-3-3 submitted by John Mahn, Agent for S E M M. Co. , 15510 Farmington Road, Livonia, Michigan 48154 received in the City Clerk's office on March 5, 1987 and submitted in behalf of Lidia and Donato Veri , so indicated in a letter dated 3-18-87, wherein request is submitted for the vacating of an undeveloped portion of Stamford Avenue right-of-way, the Council does hereby refer the same to the City Planning Commission for action and recommendation in accordance with provisions of law and City ordinance. 1253-87 RESOLVED, that the City Council hereby requests the Chief of Police to provide a report and update on the status of the Police Department' s Crime Prevention Program including the development of "neighborhood watch" programs and staffing of same and to submit said report to the Council 's Committee of the Whole for discussion. 1254-87 RESOLVED, that in accordance with the provisions set forth in Section 4 of Act 207 of the Public Acts of Michigan of 1921 , as amended, the City Zoning Act (MSA 5.2934, MCLA 125. 584) , as well as Article XXIII of Ordinance 543, as amended, the Zoning Ordinance of the City of Livonia , the Council does hereby determine that a public hearing will take place before the City Council of the City of Livonia on Wednesday, April 29, 1987, at 8.00 P M at the City Hall , 33000 Civic Center Drive, Livonia, Michigan, with respect to the following item. Petition 86-12-1-49, submitted by Truman A. Strong for a change of zoning of property located on the southeast corner of Middlebelt and Grandon Roads in the Southwest 1/4 of Section 36, from P.S to C-1 , the City Planning Commission in its resolution 1-11-87 having recommended to the City Council that Petition 86-12-1- 49 be denied, Further, the City Clerk is hereby requested to, no less than fifteen (15) days prior to the aforesaid date of said public hearing, cause to have a statement indicating the (a) nature of the proposed amendment to the Zoning Ordinance, and/or (b) location of the proposed change(s) of zoning as set forth above, first to be published in the official newspaper of the City or a newspaper of general circulation in the City of Livonia 23245 Iwo as well as to, not less than fifteen (15) days prior to said public hearing, cause to have notice to be given by registered mail to each public utility company and to each railroad company owning or operating any public utility company and to each railroad company owning or operating any public utility or railroad within the districts or zones affected, and further, the City Clerk is requested to do all things necessary or incidental to the full performance of this resolution. #255-87 WHEREAS, pursuant to the direction of the City Council in its resolution 419-86 adopted on April 23, 1986 and in accordance with Section 3 08.100 of the Livonia Code of Ordinances, as amended, the City Assessor of the City of Livonia has prepared, reported and certified to the Council under date of February 27, 1987 an assessment roll dated February 27, 1987 for the improvement of Melvin Avenue (Seven Mile Road to Curtis) consisting of 28 foot wide full-depth asphalt pavement with mountable asphalt curbs (Alternate III ) containing the special assessments to be assessed and levied, respectively, in the proposed special assessment district heretofore established for the construction and operation of the proposed improvement in said district as designated in Council Resolution 419-86. Therefore, be it resolved, that the said roll is hereby accepted ifts by the City Council , that it is hereby ordered to be filed in the office of the City Clerk for public examination; that the City Clerk be and hereby is directed to give notice as required by the provisions of Section 3.08.110 of the Livonia Code of Ordinances, as amended, to wit. that the assessment roll has been made and filed in the office of the City Clerk for public examination and that the City Council of the City of Livonia will meet in the City Hall , 33000 Civic Center Drive, Livonia, Michigan, on Wednesday, April 29, 1987, at 8 00 P M. to review the said special assessment roll at which time and place opportunity will be given to all interested persons to be heard, It is further resolved, that the City Clerk be and hereby is directed to publish a notice of said public hearing at least once in the official newspaper of the City of Livonia which is published and circulated generally in and throughout the said City, at least ten (10) days prior to the aforesaid date of Wednesday, April 29, 1987, at 8 00 P.M , the City Clerk is also directed to give notice of said hearing by sending written notice thereof by first class mail to each and every property owner in the proposed assessment district as their respective names and addresses appear on the most current assessment roll in the City Assessor' s office 1256-87 WHEREAS, pursuant to the direction of the City Council Lin its resolution 695-86 adopted on July 9, 1986 and in accordance with Section 3 08 100 of the Livonia Code of Ordinances, as amended, the City Assessor of the City of Livonia has prepared, 23246 im. reported and certified to the Council under date of February 27, 1987 an assessment roll dated February 27, 1987 for the improvement of Richland Avenue (West of Farmington Road) consisting of 28-foot wide full-depth asphalt pavement with mountable asphalt curbs (Alternate III ) containing the special assessments to be assessed and levied, respectively, in the proposed special assessment district heretofore established for the construction and operation of the proposed improvement in said district as designated in Council Resolution 695-86. Therefore, be it resolved, that the said roll is hereby accepted by the City Council , that it is hereby ordered to be filed in the office of the City Clerk for public examination; that the City Clerk be and hereby is directed to give notice as required by the provisions of Section 3 08 110 of the Livonia Code of Ordinances, as amended, to wit that the assessment roll has been made and filed in the office of the City Clerk for public examination and that the City Council of the City of Livonia will meet in the City Hall , 33000 Civic Center Drive, Livonia , Michigan, on Wednesday, April 29, 1987, at 8:00 P M to review the said special assessment roll at which time and place opportunity will be given to all interested persons to be heard, It is further resolved, that the City Clerk be and hereby is directed to publish a notice of said public hearing at least Lonce in the official newspaper of the City of Livonia which is published and circulated generally in and throughout the said City, at least ten (10) days prior to the aforesaid date of Wednesday, April 29, 1987, at 8:00 P.M ; the City Clerk is also directed to give notice of said hearing by sending written notice thereof by first class mail to each and every property owner in the proposed assessment district as their respective names and addresses appear on the most current assessment roll in the City Assessor's office #257-87 RESOLVED, that having considered the communication from the City Engineer dated March 9, 1987, approved for submission by the Mayor Pro Tem and submitted pursuant to Council Resolution 1116-86 adopted on November 19, 1986, and the City Engineer having ascertained the assessed valuation of all property affected by the proposed street lighting project in Fairway Farms Subdivision located in the Southeast 1/4 of Section 17 and such report having indicated the number of parcels which show tax delinquencies, the number of parcels which are vacant, and having prepared and caused to be prepared plans and specifications therefor and an estimate for the cost thereof, and to file the same with the City Clerk together with his recommendation as to what proportion of the cost should be paid by special assessment and what part, if any, should be a general ibe obligation of the City, the number of installments in which assessments may be paid and the lands which should be included in the proposed special assessment district, and it appearing 23247 tbilk to the Council that all of such information, estimate, plans, specifications and recommendations have been properly filed by the City Engineer with the City Clerk under date of March 9, 1987, and that there has been a full compliance with all of the provisions of Section 3 08 060 of the Livonia Code of Ordinances, as amended, the Council does hereby set Wednesday, April 29, 1987, at 8 00 P.M as the date and time for a public hearing on the Necessity for such proposed improvement which public hearing shall be held before the Council in the Livonia City Hall , 33000 Civic Center Drive, Livonia, Michigan, pursuant to Section 3.08 070 of said Livonia Code of Ordinances, as amended, and the City Clerk is hereby authorized to give notice and publication of such hearing as is required by Section 3 08.070 of said Code A roll call vote was taken on the foregoing resolutions with the following result AYES Taylor, Bennett, Ochala, McCotter, Feenstra, Bishop, McCann. NAYS None. A communication from the Committee of the Whole regarding their meeting of Monday, March 9, 1987 and the proposed revision to Petition 86-8-8-47 submitted by Lidia and Donato Veri to construct a commercial building on the North side of Seven Mile between Farmington and Merriman Roads in Section 3 was received and placed on file for the information of the Council On a motion by Councilman Taylor, seconded by Councilman Bennett, and unanimously adopted, it was #258-87 RESOLVED, that having considered the report and recommendation of the Committee of the Whole dated March 9, 1987 submitted pursuant to CR 1160-86 in connection with a communication from the City Planning Commission, dated October 29, 1986, which transmits its resolution 10-282-86 adopted on October 21 , 1986, with regard to Petition 86-3-8-13 submitted by Robert Roland Bryce, requesting site plan approval in connection with a proposal to construct multi-family dwellings and housing for the elderly on the North side of Seven Mile 23248 Road, East of Shadyside in Section 3, pursuant to the provisions set forth in Sections 8.02 and 29.02 of Ordinance No. 543, as amended, the Council does hereby concur in the recommendation of the Planning Commission and Petition 86-3-8-13 is hereby approved and granted based upon a new revised site plan dated October 2, 1986 which provides for a new proposed road location opposite Mayfield as well as such approval being based upon the same conditions as those set forth in the aforesaid recommendation of the Planning Commission. On a motion by Councilman Bennett, seconded by Councilman Taylor, it was #259-87 RESOLVED, that having considered the report and recommendation of the Committee of the Whole dated March 9, 1987 and submitted pursuant to Council Resolution 129-87 in connection with a letter from Charles Tangora of the law firm of Brashear, Tangora and Spence dated February 2, 1987 to which is attached a proposed amendment No 4 to the lease of the Golden Lantern Restaurant, the Council does hereby determine to approve the proposed amendment No 4 and authorize the Mayor Pro Tem and City Clerk for and on behalf of the City of Livonia to execute the same, subject to the inclusion of an additional clause which provides for the City's right of annual review of State and Federal tax returns A roll call vote was taken on the foregoing resolution with the following result AYES Taylor, Bennett, McCotter, Feenstra, Bishop, McCann NAYS.
