MINUTES OF THE ONE THOUSAND AND TWENTY-SECOND REGULAR MEETING
OF THE COUNCIL OF THE CITY OF LIVONIA
On January 11 , 1984, the above meeting was held at the City Hall ,
33000 Civic Center Drive, Livonia , Michigan, and was called to order by the
President of the Council at approximately 8 04 p m Councilman McCann delivered
the invocation Roll was called with the following result Present Robert

By Councilman Feenstra, seconded by Councilman Taylor, and unanimously
adopted, it was
#1-84 RESOLVED, that the minutes of the 1 ,0215t Regular
Meeting of the Council of the City of Livonia , held December
19, 1983, are hereby approved
The Communication received from the Office of the Mayor, dated December
29, 1483, transmitting the Annual Report for the Fiscal Year 1982-83, was
received and placed on file for the information of the Council
The following resolutions were offered by Councilman Feenstra and
seconded by Councilman Taylor
#2-84 RESOLVED, that having considered the report and
recommendation of the Superintendent of Public Service
dated December 7 , 1983, approved by the Director of Public
Works and the Director of Finance and approved for submission

by the Mayor, the Council does hereby accept the bid of
W F Miller Co , 1593 S Woodward, Birmingham, Michigan
48011 , for supplying the Public Service Division (Golf
�—
Course Section) with one (1 ) 3-Reel Riding Greensmower
for a net price of $6,800, based on a total price of $10,838
less trade-in of $4,038, the same having been in fact the
lowest bid received and meets all specifications
#3-84 RESOLVED, that having considered the report and
recommendation of the Superintendent of Public Service
dated December 7 , 1983, approved by the Director of Public
Works and the Director of Finance and approved for submission
by the Mayor, the Council does hereby accept the bid of
Commercial Lawnmower, Inc , 34955 Plymouth Road, Livonia ,
Michigan 48150, for supplying the Public Service Division
(Park Maintenance Section) with one (1 ) lawn and garden
tractor with attachments for a net price of $5,500, based
on a total price of $8,000 less trade-in of $500, the same
having been in fact the lowest bid received and meets all
specifications
#4-84 RESOLVED, that having considered the report and
recommendation of the Director of Public Works dated November
29, 1983, which bears the signature of the Director of
Finance and is approved for submission by the Mayor, and
the attached final estimate dated November 29, 1983, the
Council does hereby authorize final payment in the amount

of $1 ,056 33 to Torre and Bruglio Landscape Contractors,
Inc , 20401 Hall Road, Mt Clemens, Michigan 48044, which
sum includes the full and complete balance due on a contract
dated February 9, 1983 in the amount of $10,451 , the actual
contract amount completed to date being $10,563 30, in
connection with the 1983 Street Tree Planting Program,
it appearing from the aforementioned report that all work
under the said contract has been completed in accordance
with City standards and specifications, and that the
necessary contractor' s affidavit, maintenance and guarantee
bond have been filed
#5-84 RESOLVED, that having considered the report and
recommendation of the City Engineer dated December 6, 1983,
approved by the Director of Public Works and approved for
submission by the Mayor, the Council does hereby amend
Item #8 of Council Resolution 613-80 adopted on June 18,
1980, as amended by Council Resolution 303-81 adopted on
April 8 , 1981 , so as to reduce the financial assurances
now on deposit with the City for general improvements in
the Laurel Park Professional Center Subdivision located
in the N E 1/4 of Section 18 to $5,500, of which $2,500
shall be in cash, the sidewalk improvement bond requirement
remaining unchanged at this time , and the financial
assurances now on deposit with the City, if any, to be
reduced accordingly, further the Council does hereby
authorize the release to Greenfield Construction Company,

Inc , P 0 Box 2185, 13040 Merriman Road, Livonia, Michigan
48151 , the proprietor of the Laurel Park Professional Center
Subdivision of the financial assurances previously deposited
�mm with respect to the soil erosion and sedimentation bond
and the monuments and markers , the action herein being
taken for the reasons indicated in the aforementioned report
of the City Engineer that all these improvements have been
satisfactorily installed in accordance with the rules and
regulations and ordinances of the City of Livonia , and
all other financial assurances now on deposit with the
City, if any, with respect to remaining improvements in
said subdivision shall remain the same and unchanged
#6-84 RESOLVED, that having considered the report and
recommendation of the City Engineer dated November 29,
1983, which bears the signature of the Director of Finance ,
is approved by the Director of Public Works and is approved
for submission by the Mayor, the Council does hereby
authorize retaining the services of Canton Analytical
Laboratory, 153 Elder Street, Ypsilanti , Michigan 48197 ,
for supplying the City with sampling and analysis services
at the the City' s landfill site for the price of $2,077 50
for a period of 15 months , samples and tests to be provided
for each of the three monitoring wells on a three months
interval , which services are required in order for the
City to comply with the requirements of 1978 PA 641 , further,
the Council does hereby appropriate the sum of $2,077 50
� from the unexpended fund balance account of the Municipal
Refuse Fund for this purpose, and the Council does hereby
authorize the aforesaid item without competitive bidding
for the reasons indicated in the aforesaid communication,
and such action is taken in accordance with the provisions
set forth in Section 3 04 140 D 2 of the Livonia Code
of Ordinances , as amended
#7-84 RESOLVED, that having considered a communication
from the Mayor dated December 6, 1983, to which is attached
a letter from the Director of Out-Wayne County Area Agency
on Aging dated November 28, 1983, wherein it is requested
that the City contribute $3,144 as the City' s share in
community matching funding for this organization for FY
84 which began October 1 , 1983, the Council does hereby
appropriate and authorize the expenditure of the sum of
$3,144 from the unexpended fund balance account for this
purpose
A communication from the Division of Police , dated December 14, 1983,
regarding a request to provide central dispatch center for the Redford Township
Police Department, was received and placed on file for the information of the

#8-84 RESOLVED, that having considered a communication
from the City Treasurer, dated December 5, 1983, with regard
to the proposed cancellation of certain 1977 personal

property taxes, the Council does hereby authorize the City
Treasurer to petition the Circuit Court for the County
of Wayne to cancel the attached 1977 personal property
taxes in accordance with provisions of state statute, and
the Department of Law is hereby requested to institute
the aforesaid litigation in the manner and form herein
authorized
#9-84 RESOLVED, that having considered a communication
from the Fire Chief dated December 9, 1983, which also
bears the signatures of the Director of Public Safety,
the Director of Finance and the Mayor, the Council does
hereby determine, for and on behalf of the City of Livonia ,
to accept a cash contribution from the Livonia Heart Fund
in the amount of $3,000, which money is intended to be
utilized in the purchase of a Lukas Extrication Tool for
use in automobile and industrial accidents in which people
are trapped, and the Council does hereby determine that
the aforesaid $3,000 be deposited in the 1968 Fire Department
General Obligation Bond Issue for this purpose
#10-84 RESOLVED, that having considered a communication
from the Director of Community Resources dated December
1 , 1983, approved by the Director of Finance and approved
for submission by the Mayor, the Council does hereby, for

#11-84 RESOLVED, that having considered a communication
from the Director of Community Resources , dated December
16, 1983, approved by the Director of Finance and approved
for submission by the Mayor, the Council does hereby
determine, for and on behalf of the City of Livonia , to
accept a cash donation in the amount of $1 ,000 from the
Livonia Heart Fund for the Youth Assistance Program, further,
the Council does hereby determine that the aforesaid sum

recommendation of the Committee of the Whole dated December
19, 1983 and submitted pursuant to Council Resolution 832-83
in connection with the application of the provisions of
the Open Meetings Act to all Council meetings, the Council
does hereby request that the City Clerk do all things
necessary or incidental to fulfilling the requirements
Of the Open Meetings Act with regard to Study Sessions
of the City Council , including the taking of minutes and
notes
On a motion by Councilman Taylor, seconded by Councilman McCann,
and unanimously adopted, it was
#13-84 RESOLVED, that having considered the report and
recommendation of the Committee of the Whole dated December
19, 1983 and submitted pursuant to Council Resolution 832-83
Nm� in connection with the application of the provisions of
the Open Meetings Act to all Council meetings, the Council
does hereby refer to the Committee of the Whole, for its
report and recommendation , the subject of taping and/Or
recording of all meetings and the method of recording,
whether cable or other type of recording
On a motion by Councilman Taylor, seconded by Councilwoman Gundersen,
and unanimously adopted, it was
#14-84 RESOLVED, that having considered the report and
recommendation of the Committee of the Whole dated December
19, 1983 and submitted pursuant to Council Resolution 832-83
in connection with the application of the provisions of
the Open Meetings Act to all Council meetings , the Council
does hereby request that the Cable Television Commission
Submit its report and recommendation with regard to the
feasibility and capability of providing minutes of Council
meetings by the use of cable television

#15-84 RESOLVED, that having considered the report and
recommendation of the Committee of the Whole dated December
19, 1983 and submitted pursuant to Council Resolution 832-83
� in connection with the application of the provisions of
the Open Meetings Act to all Council meetings, the Council
does hereby request that the Legislative Committee submit
its report and recommendation with regard to its establishing
rules for the public to speak at regular meetings of the
City Council
Councilwoman Gundersen gave first reading to the following

herein The above Ordinance was placed on the table for consideration at the
next regular meeting of the Council
Councilman Taylor gave first reading to the following Ordinance

Mary E Hirvela , 19227 Parkville , Livonia , Michigan 48152,
dated December 7 , 1983, to which is attached a petition
from certain residents on Parkville requesting the
improvement of Parkville between Seven Mile and Morlock,
the Council does hereby refer this item to the Engineering
Division for its report and recommendation
On a motion by Councilman Ventura , seconded by Councilwoman Gundersen,

RESOLVED, that having considered a letter from
the Michigan Liquor Control Commission dated August 25,
1983, and the report and recommendation of the Chief of
Police dated December 8, 1983 in connection therewith,

the Council does hereby approve of the request of Ronald
Lenard for a transfer of ownership of 1983 Class C licensed
business with dance permit from E. Gary Veltman, which
is located at 28121 Plymouth Road, Livonia , Michigan 48150,
and the City Clerk is hereby requested to forward a certified
copy of this resolution to the Michigan Liquor Control
Commission
On a substitute motion by Councilman Taylor, seconded by Councilman
Feenstra , it was

the Michigan Liquor Control Commission dated August 25,
1983, and the report and recommendation of the Chief of
Police dated December 8, 1983 in connection therewith,
with regard to a request of Ronald Lenard for a transfer
of ownership of 1983 Class C licensed business with dance
permit from E Gary Veltman, which is located at 28121
Plymouth Road, Livonia , Michigan 48150, the Council does
hereby refer this item to the Committee of the Whole for
its report and recommendation

recommendation of the Planning Director dated December
14, 1983, which bears the signature of the Finance Director
and is approved for submission by the Mayor, wherein it
is recommended that the City acquire a vacant home located
at 27545 Long Avenue for a purchase price of $10,000, plus
$200 in closing costs in connection with the 1983-84
Community Development Block Grant Program, the legal
description of which is as follows
Lot #122, the Argonne Subdivision of part of
the N E 1/4 of Section #1 , T l 3 , R 9 E
the Council does hereby appropriate and authorize the
expenditure of the sum of $10,200 from Community Development
Block Grant funds for this purpose, and the Department
of Law is requested to prepare the necessary documents
required to implement this transaction, as well as to do
all other things necessary or incidental to the full
performance of this resolution

*Councilman Ventura stated that he is opposed to the City being in the
residential rental business.
On a motion by Councilman McCann, seconded by Councilman Feenstra,
it was
#20-84 RESOLVED, that having considered the report and
recommendation of the Planning Director dated December
13, 1983, which bears the signature of the Finance Director
and is approved for submission by the Mayor, wherein it
is recommended that the City acquire a vacant home located
at 12411 Arcola Avenue for a purchase price of $20,000,
plus $200 in closing costs in connection with the 1983-84
Community Development Block Grant Program, the legal
description of which is as follows
Lot 246, also 1/2 of adjacent vacated alley,
Schanhite's Marquette Manor Subdivision of part
of the S [ 1/4 of Section 25, T l 5 , R 9 E
the Council does hereby appropriate and authorize the
expenditure of the sum of $20,200 from Community Development
Block Grant Funds for this purpose, and the Department
of Law is requested to prepare the necessary documents
required to implement this transaction, as well as to do
all other things necessary or incidental to the full
performance of this resolution

from the Michigan Liquor Control Commission dated December
13, 1983, and the report and recommendation of the Chief
of Police dated December 27 , 1983 in connection therewith,
the Council does hereby approve of a request for an
additional bar from GiVlin' s Chalet, Inc , Class C licensed
business with Dance Permit located at 39305 Plymouth Road,
Livonia, Michigan 48150, and the City Clerk is hereby
requested to forward a certified copy of this resolution

On a motion by Councilman Taylor, seconded by Councilman McCann,

from the Chief of Police dated December 16, 1983, which
bears the signature of the Director of Public Safety and
is approved for submission by the Mayor, the Council does,
for and on behalf of the City of Livonia, accept the gift
of a standard-type bulletproof vest for use by the Livonia
Police Department from the Second Chance Company in Central
Lake, Michigan through Shooters Service, 29419 West Six
Mile Road, Livonia , MI 48152, the serial number of the
Second Chance Body Armor Vest being 1230299
On a motion by Councilman Feenstra , seconded by Councilman Ventura ,
it was
RESOLVED, that having considered a communication
from the Secretary of the Board of Education of the Wayne
County Intermediate School District dated December 22,
1983, which transmits a resolution adopted by the Board
of Education of the Wayne County Intermediate School District
on January 26, 1983, which requests summer tax collection
of certified school taxes beginning July 1 , 1984, and in
accordance with the provisions set forth in Section 16 11
of 1982 PA 333, the Council does hereby determine to approve
the levy and collection, commencing July 1 , 1984, of 1/2
of the school taxes on the taxable property situated in
the City of Livonia portion of the Wayne County Intermediate
School District, as certified by the Wayne County
Intermediate School District in the amount of the total
levy of school taxes due, further, the action herein is
conditioned upon agreement being reached between the Wayne
County Intermediate School District and the City of Livonia
on the question of cost and billing for expenses incurred
by the City in assessing and collecting the said school
taxes, and the matter of preparing an agreement between
the City of Livonia and the said school district is hereby
referred to the Department of Law for the preparation of
same, which shall thereafter be submitted to the City Council
and the Board of Education of the Wayne County Intermediate
School District

RESOLVED, that having considered a communication
from the Secretary of the Board of Education of the Wayne
County Intermediate School District dated December 22,
1983, which transmits a resolution adopted by the Board
of Education of the Wayne County Intermediate School District
on January 26, 1983, which requests summer tax collection
of certified school taxes beginning July 1 , 1984, and in
accordance with the provisions set forth in Section 16. 11
of 1982 PA 333, the Council does hereby determine to approve
the Levy and Collection, commencing July 1 , 1984, of the
school taxes on the taxable property situated in the City
of Livonia portion of the Wayne County Intermediate School
District, as certified by the Wayne County Intermediate
School District in the amount of the total levy of school
taxes due , further, the action herein is conditioned upon
agreement being reached between the Wayne County Intermediate
School District and the City of Livonia on the question
of cost and billing for expenses incurred by the City in
assessing and collecting the said school taxes, and the
matter of preparing an agreement between the City of Livonia
and the said school district is hereby referred to the

#24-84 RESOLVED, that having considered a communication
from the Secretary of the Board of Education of the Wayne
County Intermediate School District dated December 22,

1883, which transmits a resolution adopted by the Board
of Education of the Wayne County Intermediate School District
on January 26, 1983, which requests summer tax collection

from the City Planning Commission dated December 29, 1983,
which transmits its resolution 12-229-83 adopted on December
13, 1983, with regard to Petition 83-11-8-29, submitted
by Smith & Schurman Associates, Inc , requesting site plan
approval in connection with a proposal to develop
multi-family dwellings on the west side of Newburgh Road
between Laurel Park Drive and Seven Mile Road in Section
7 , pursuant to the provisions set forth in Section 8 02
of Ordinance No 543, as amended, the Council does hereby
refer this item to the Committee of the Whole for its report
and recommendation
On a motion by Councilman Ventura , seconded by Councilman Taylor,
and unanimously adopted it was,

their rules for procedure as outlined in Council Resolution
#574-82 so as to permit consideration of several items
