MINUTES OF THE FOUR HUNDRED NINETY-SIXTH REGULAR MEETING
OF THE COUNCIL OF THE CITY OF LIVONIA
On May 26, 1965, the above meeting was held at the City Hall, 33001 Five
Mile Road, Livonia, Michigan, and was called to order by the President of the Council
at approximately 8.23 P. M. . Councilman Ventura delivered the invocation Roll was
called with the following result- Present--Rudolf R Kleinert, Peter A Ventura,
Charles J. Pinto, Daniel C Allen, John F Dooley, Edward H McNamara and James R
McCann. Absent--None.
Elected and appointed officials present Addison W Bacon, City Clerk,
Steve Polgar, City Attorney, Milton Firestone, Assistant City Attorney, Robert A
Shaw, Director of Public Works, David L Jones, Water and Sewer Commissioner, William
J. Strasser, Chief City Engineer, Thomas J Griffiths, Jr , Chief Accountant, Victor
Beale, Executive Secretary to the Mayor, Don Hull, City Planner, Victor C Phillips,
Budget Director, John Dufour, Superintendent, Parks and Recreation, Daniel R Andrew,
Industrial Coordinator, James Miller, Personnel Director, and Joel LaBo, Director of
Public Safety.
By Councilman Dooley, seconded by Councilman McNamara and unanimously
adopted, it was
#527-65 RESOLVED that, the minutes of the 495th regular meeting of the
Council of the City of Livonia, held May 19, 1965, are hereby approved
By Councilman McNamara, seconded by Councilman Pinto, it was
RESOLVED that, having considered a communication from the Director
of Public Works, dated March 12, 1965, referred to this meeting on March 24,
1965, requesting the establishment of the Water and Sewer Commissioner's
salary, the Council does hereby establish an annual salary for the position
of Water and Sewer Commissioner at the rate of $11,000 00, payable monthly
and effective as of March 1, 1965, provided that for this purpose the sum
of $5,750 00 is authorized to be expended from the Water Department Budget
and for this purpose the Council does hereby amend the Refuse Fund Budget
to the amount of $5,250.00 for such salary and further, all prior resolu-
tions are hereby rescinded only to the extent that they are inconsistent
herewith
A roll call vote was taken onthe foregoing resolution with the following result-
AYES- Pinto, Allen and McNamara.
NAYS- Ventura, Dooley, McCann and Kleinert.

The President declared the resolution denied
The President of the Council announced that the Council had received three
veto messages from the Mayor, the first on resolution #497-65, adopted on May 19,
1965, regarding Stark Gardens Subdivision
By Councilman McNamara, seconded by Councilman Ventura, it was
#528-65 RESOLVED that, having considered the veto by the Mayor, dated
May 26, 1965, of resolution #497-65, adopted by the Council on May 19, 1965,
the Council does hereby readopt said resolution #497-65, the same as if it
were word for word repeated herein
A roll call vote was taken on the foregoing resolution with the following result
AYES: Ventura, Pinto, Dooley, McNamara, McCann and Kleinert
NAYS: Allen.
The President declared the resolution adopted and the Mayor's veto over-ruled
The other veto messages dated May 26, 1965, from the Mayor were on resolu-
tion #499-65, adopted by the Council on May 19, 1965, regarding Alexander Subdivision,
and the Ordinance amending Ordinance No 60, containing Petition Z-661, for change of
zoning in Section 31 of the City of Livonia. No action was taken by the Council on
these two messages, therefore the vetoes of the Mayor are sustained.
By Councilman Dooley, seconded by Councilman Allen and unanimously
adopted, it was
#529-65 RESOLVED that, having considered a communication dated May 21,
1965, from the Mayor submitting a proposed ordinance amendment to Section
3 8(d) of Ordinance No 21, as amended, the Council does hereby refer the
same to the Legislative Committee for report and recommendation.
By Councilman McNamara, seconded by Councilman Allen, it was
#530-65 RESOLVED that, having considered a communication dated May 21,
1965, from the City Clerk, regarding payment in the amount of $17,800.00
by the American Manufacturers Mutual Insurance Company, on a claim made in
behalf of the City of Livonia for the loss incurred by a fire on April 25,
1965, to City-owned property located at Eight Mile Road and Newburgh Road,
the City Council does hereby authorize the City Clerk to execute in behalf
of the City of Livonia a sworn statement in proof of such loss and a sub-
rogation in connection therewith, on forms approved by the Department of
Law, upon receipt of $17,800.00 from the American Manufacturers Mutual
Insurance Company, pursuant to Policy No TE-633-508, as complete payment
on such claim and, further, the receipt of the $17,800.00 hereinablve
mentioned is acknowledged by amendment of the budget as pertains to
anticipated revenue and that such revenues be deposited to Account No 362-3,

known as Capital Improvement for Recreational Purposes, in the amount of
$17,800.00
A roll call vote was taken on the foregoing resolution with the following result-
AYES: Ventura, Pinto, Allen, Dooley, McNamara, McCann and Kleinert
NAYS: None
The report dated May 21, 1965, from the City Assessor and the list of the
1965 City of Livonia Taxpayer's Appeals, attached thereto, was received and filed
An Ordinance Amending Section 2 of Ordinance No. 173 of the City of Livonia,
Entitled, "An Ordinance to Provide for the Removal, Storage and Disposition of
Abandoned and Unclaimed Automobiles, Bicycles or other Personal Property and Provid-
ing also for the Confiscation and Disposition of Inherently Dangerous Articles",
introduced on May 19, 1965, by Councilman McCann, was taken from the table and a
roll call vote conducted thereon with the following result
AYES• Ventura, Pinto, Allen, Dooley, McNamara, McCann and Kleinert
NAYS. None
The President declared the foregoing Ordinance duly adopted and would become effective
on publication.
By Councilman Ventura, seconded by Councilman McCann, it was
#531-65 RESOLVED that, having considered an application for refund by
letter dated May 4, 1965, from Nicholas George of Nicholas George Theatres,
6621 Allen Road, Allen Park, Michigan, 48101, and a letter dated May 4, 1965,
from Lewis N George, indicating that a request for a refund had been
mistakenly made in the name of Jeffrey Lauren Land Company (resolution
#396-65) , the Council does hereby authorize the refund in the amount of
$3,400.00 for the following items to the aforesaid Nicholas George

By Councilman Dooley, seconded by Councilman McNamara, it was
#533-65 RESOLVED that, having considered the report and recoimnendation
dated May 10, 1965, from the Chief City Engineer, approved by the Director
of Public Works and Water and Sewer Coumiissioner, and the attached final
construction estimate, dated May 10, 1965, the Council does hereby authorize

final payment in the amount of $5,000 00 to E. S. Mather, Inc. 30777
Shiawassee, Farmington, Michigan, which sum includes the full and complete
amount due on a contract dated March 11, 1965, with the aforesaid company
in connection with earth moving in the Municipal Dump Site, it being the
understanding of the Council that all work under the said contract has been
completed in accordance with City standards and specifications, and that the
contractor has filed his declaration and affidavit that there is no money
owing for any labor or material in connection with the work performed under
the said contract, and the City Clerk and City Treasurer are hereby authorized
to do all things necessary or incidental to the full performance of this
resolution

By Councilman Allen, seconded by Councilman Ventura and unanimously
adopted, it was
#534-65 RESOLVED that, having considered a petition from Diore Building
Company, 31401 Stonewood Ct W , Farmington, Michigan, received by the City
Clerk on May 17, 1965, and in accordance with the provisions of Act 73 of the
Public Acts of 1959, as amended, the Council does hereby approve of a
division of Lot 129 of Sunningdale Subdivision of part of the N E. 1/4 of
Section 12, T 1 S. , R 9 E , City of Livonia, Wayne County, Michigan, for
addition to other lots so as to result in the following descriptions
Parcel 1 Lot 130 and the south 20 feet of Lot 129 of Sunningdale
Subdivision of part of the N E 1/4 of Section 12, T 1 S ,
R. 9 E , City of Livonia, Wayne County, Michigan, and
Parcel 2 Lot 128 and the north 20 feet of Lot 129 of Sunningdale
Subdivision of part of the N E. 1/4 of Section 12, T 1 S ,
R 9 E , City of Livonia, Wayne County, Michigan,
as shown on the map attached to the aforesaid petition which is made a
part hereof by this reference, and the City Clerk is hereby requested to
cause a certified copy of this resolution to be recorded in the office of
the Wayne County Register of Deeds
Councilman Ventura introduced the following Ordinance.
AN ORDINANCE AMENDING SECTION 22 OF THE ZONING MAP OF THE
CITY OF LIVONIA AND AMENDING ARTICLE 3 00 OF THE ZONING OR-
DINANCE, ORDINANCE NO. 60, AS AMENDED, OF THE CITY OF LIVONIA
BY ADDING THERETO SECTION (Pet Z-680)
The foregoing Ordinance, when adopted, is filed in the Journal of Ordinances in the
office of the City Clerk and is the same as if word for word repeated herein.
The above Ordinance was placed on the table for consideration at the next regular
meeting of the Council

the vacation of an easement across the south four feet of Lot 1748 of
Rosedale Gardens No 9 Subdivision, being a part of the Northwest 1/4 of
Section 34, T 1 S , R 9 E. , City of Livonia, Wayne County, Michigan, is
hereby referred to the City Planning Commission for action and recommenda-
tion according to law and Ordinance No 29, as amended
The letter dated May 25, 1965, from the City Assessor regarding a meeting
of the State Board of Equalization on Monday, March 24, 1965, in Lansing, Michigan,
was received and filed
