MINUTES OF THE SEVENTY-FIFTH SPECIAL MEETING OF THE
COUNCIL OF THE CITY OF LIVONIA
Pursuant to the provisions of Section 8, Chapter IV of the City Charter,
the above meeting was held on January 28, 1963, at 33001 Five Mile Road, Livonia,
Michigan, and was called to order by the President of the Council at approximately
9:35 P. M. Roll was called with the following result: Present-- Sydney B. Bagnall,
John T. Daugherty, William E. Parks, Rudolf R. Kleinert, John F. Dooley, Edward H.
McNamara and James R. McCann. Absent-- None.
The President relinquished the chair to the Vice President at 9:40 P. M.,
who thereupon presided for the balance of the meeting.
By Councilman Bagnall, seconded by Councilman Kleinert, it was
#78-63 RESOLVED that, the City Council of the City of Livonia, by a
three-fifths (3/5) vote of the members-elect and pursuant to the provisions
of Section 21 of Act 279 of the Public Acts of 1909, as amended, does
hereby propose:
(1) That Section 16 (e) of Chapter V of the Charter of the City of Livonia
shall be amended to read as follows:

Section 16(e) Approval by Council of Commission's Actions.
The actions of the Civil Service Commission in establish-
ing a Classification of Positions Plan, a Compensation Plan,
an Insurance and Disability Plan, or Retirement Plan shall be
approved by the Council before any of such plans may become
effective. The Council may withhold its approval of any
insurance, disability or retirement plans until it decides
that circumstances justify such approval. When any plan
has been once approved, amendments thereto shall not became
effective until jointly approved by both the Civil Service
Commission and the Council.
The actions of the Civil Service Commission, on and after
April 2, 1963, in establishing rules and regulations governing
either, hours of service, work week, vacations, leaves or
time-off for employees in the Classified Service, shall not
become effective until jointly approved by both the Civil Service
Commission and City Council.
All Charter provisions in conflict herewith are hereby repealed or altered
accordingly.

(2) That the existing charter provision which would be altered or abrogated
by the foregoing amendment, if the same is adopted, is Section 16(e) of
Chapter V of the City Charter which presently reads as follows:
Section 16(e) Approval by Council of Commission's Actions.
The actions of the Civil Service Commission in establish-
ing a Classification of Positions Plan, a Compensation Plan,
an insurance and Disability Plan, or Retirement Plan shall be
approved by the Council before any of such plans may become
effective. The Council may withhold its approval of any
insurance, disability or retirement plans until it decides
that circumstances justify such approval. When any plan
has been once approved, amendments thereto shall not becane
effective until jointly approved by both the Civil Service
Commission and the Council.
(3) That the purpose of the proposed amendment shall be designated on the
ballot as follows:
STATEMENT OF PURPOSE
Shall Section 16(e) of Chapter V of the Charter of the
City of Livonia be amended to require, on and after April 2,
1963, Council approval of any rule or regulati on, adopte d
by the Civil Service Commission governing either hours of
service, work week, vacations, leaves or time-off for employees
in the Classified Civil Service of the City, before any such
rule or regulation shall be effective.
(4) That the City Clerk shall forthwith transmit a certified copy of the
proposed amendment and this resolution to the Governor of the State of
Michigan for his approval, and shall also transmit a certified copy of
the foregoing statement of purpose of such proposed amendment and this
resolution to the Attorney General of the State of Michigan for his
approval, as required by law.
(5) That the proposed charter amendment shall be, and the same is hereby
ordered to be, submitted to the qualified electors of this City at a
Special Election to be held in the City of Livonia on Monday, the first
day of April, 1963, said date being the same date as that on which a
Special Election has heretofore been called by the City Council in its
resolution No. 46-63, adopted on January 23, 1963.
(6) That the City Clerk is hereby directed to and shall promptly and
fully comply with all of the provisions of Section 21 of the said Act 279,
as amended, and shall do and perform all acts required by State law and
the Charter of the City of Livonia relative to the calling and holding of
such Special Election, including giving notice thereof, the registration
of electors and preparation of ballots therefor, the making of all
arrangements for such Special Election in the manner prescribed by law
and to do all things and to provide all supplies necessary to submit such
charter amendment to the vote of the electors as requi red by law.

(7) That blank paper ballots and voting machines shall be used at such
Special Election and the proposed charter amendment shall be submitted
to the electors in substantially the following form, to wit:

A cross (x) in the square _ before the word "Yes" is
in favor of the proposed amendment to the City Charter and
a cross (x) in the square before the word "No" is against
the proposed amendment.
Before leaving the booth, fold the ballot so that the
initials of the inspector may be seen on the outside.

(8) That the proposed amendment shall be published in full together with
the existing Charter provision altered or abrogated thereby as a part of
the minutes of the meeting at which time the resolution is adopted and
the said proposed amendment in full shall be posted in a conspicuous
place in each polling place.
(9) That the canvass and determination of the votes on said proposed amend-
ment shall be made in accordance with the laws of the State of Michigan.
(10) That the form of Election Notice to be published shall be in sub-

held in the City of Livonia, County of Wayne and State of Michigan
on the 1st day of April, 1963,E from 7:00 o'clock in the forenoon
until 8:00 o'clock in the afternoon E. S. T., there will be sub-
mitted the question of the amendment of Section 16(e) of Chapter V
of the Charter of said City, to wit:

Proposal No. 2, set out above, is approved by the electorate,
Section 16(e) of Chapter V will read as follows:

A roll call vote was taken on the foregoing resolution with the following result:
AYES: Bagnall„ McCann, Daugherty, Dooley, Kleinert, Parks and McNamara.
NAYS: None.
The Vice President declared the resolution adopted.
On motion of Councilman Kleinert, seconded by Councilman Bagnall and
unanimously adopted, this 75th special meeting of the Council of the City of Livonia
was duly adjourned at 9:50 P. M., January 28, 1963.
