HomeMy WebLinkAboutCOUNCIL MINUTES 1963-05-08 Page 6029 MINUTES OF THE FOUR HUNDRED EIGHTH REGULAR MEETING OF THE COUNCIL OF THE CITY OF LIVONIA On May 8, 1963, the above meeting was held at the City Hall, 33001 Five Mile Road, Livonia, Michigan, and was called to order by the President of the Council at approximately 8:16 P. M. Councilman Daugherty delivered the invocation. Roll was called with the following result: Present-- Sydney B. Bagnall, %*John T. Daugherty, William E. Parks, Rudolf R. Kleinert, John F.Dooley, Edward H. McNamara and James R. McCann. Absent-- None. Elected and appointed City officials present: Juanita Hillas, Deputy City Clerk; Charles J. Pinto, first Assistant City Attorney; Thomas Griffiths, Jr., Chief Accountant; Robert A. Shaw, Director of Public Works; Addison W. Bacon, Director of Public Safety; David L. Jones, Water and Sewer Commissioner; Victor C. Phillips, Budget Director; Robert Girardin, Superintendent of Parks and Recreation; and Ed Siemert, representing the Engineering Division. By Councilman Dooley, seconded by Councilman Kleinert and unanimously adopted, it was #332-63 RESOLVED that, the minutes of the 407th regular meeting of the Council of the City of Livonia held May 1, 1963, are hereby approved. The Deputy City Clerk informed the Council of a veto message dated May 8, 1963, from the Mayor, of resolution #310-63, adopted by the Council at the regular meeting held May 1, 1963. By Councilman Kleinert, seconded by Councilman Daugherty, it was #333-63 RESOLVED that, having considered all references in the Mayor's letter of May 8, 1963, wherein Council resolution #310-63 is vetoed, and having reconsidered the report and recommendation of the Water and Sewer Commissioner advising that the previously purchased Burroughs Style F 5301 Water Billing Machine has exceeded all predicted results as to production, accuracy and dependability, the Council does hereby authorize the purchase of a second machine of like specifications from the Burroughs Corporation at the submitted bid price of $6,366.40, it being the determination of the Council that in comparison with bid offers of other manufacturers, such equipment provides the greatest amount of productivity for each dollar spent for equipment,operation personnel and supplies. Page 6030 The President relinquished the Chair to the Vice President at 8:35 P. M., to speak on the motion. A roll call vote was taken on the foregoing resolution with the following result: AYES: Daugherty, Parks, Kle ine rt and Dooley. NAYS: McCann,Bagnall and McNamara. The Vice President declared the resolution adopted. The President resumed the Chair at 8:46 P. M. Councilman Dooley offered the following resolution, supported by Councilman McCann, and unanimously adopted: #334-63 WHEREAS, the laws are the framework of society men live by, but the intricate weave of the pattern of the law is woven by the peace officers of the nation who daily risk their lives that the weave is not mutilated and torn by those who would disregard both the structure and weave; and WHEREAS, men devoted to courage, integrity and honor, the peace officers of this country from the hamlet constable to the metropolitan captain, are a unified team of outstanding men and women who are dedicated to the preservation and enforcement of the laws of this nation and to the peace and tranquility of its citizens; and WHEREAS, the week of May 15th of each year has been proclaimed as Police week and May 15 of each year, as Peace Officers Memorial Day; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Livonia that all the citizens of the City of Livonia join with the people of this nation in honoring the peace officers of this nation, to thank each one in his own way for the outstanding men and women of the profession who are dedicated to their safeguard at all times and, in particular, to remember each officer who has given his life in the pursuit of his noble profession that you, as we, can be secure in our homes, in our property, in our society and in the pursuit of happiness under law. *Councilman John T. Daugherty was excused at 8:14.9 P. M., for the balarc e of the meeting. By Councilman Dooley, seconded by Councilman Kleinert and unanimously adopted, it was #335-63 RESOLVED that, the communication dated April 29, 1963, from the Director of Public Safety, regarding the proposed compensation plan for classified employees is hereby referred to the Committee of the Whole meeting Monday, May 13, 1963. Page 6031 By Councilman Dooley, seconded by Councilman Kleinert and unanimously adopted, it was #336-63 RESOLVED that, the City Council does hereby amend its resolution #195-63, so as to add thereto the following language: "Which fence shall be constructed to the following specifications or shall substantially conform to such specifications: Cyclone Fence 6 feet high - No. 9 Ga. wire Preach test gal. Knuckle Edge down 3" Terminal Posts 2" line posts Line posts 10 feet apart 1-1/4" top runner Top runner to be standard iron pipe (no fence tubing) All posts to be cemented in, level with ground"; and the Director of Public Works is hereby requested to do all things neces- sary or incidental to the full performance of this resolution upon notification from the Department of Law that Mr. Gracent Eidt has deeded to the City of Livonia for street purposes the westerly thirty (30) feet of his property as previously agreed. By Councilman McNamara, seconded by Councilman Kleinert and unanimously adopted, it was #337-63 RESOLVED that, having considered a communication from the Director of Public Safety, dated May 8, 1963, and the letter from the Michigan Liquor Control Commission, dated April 2, 1963, the Council does hereby deny a re- quest from Lawrence Cohen and Carl Goldstein for a new Dance Permit to be held in conjunction with existing 1962 Class C license at 28001 W. Seven Mile Road, Livonia, Michigan, and the City Clerk is requested to send a certified copy of this resolution to the Liquor Control Commission. By Councilman Dooley, seconded by Councilman McNamara and unanimously adopted, it was #338-63 RESOLVED that, the City of Livonia Council does hereby acknowledge receipt of the letter from the Wayne County Road Commissioners, dated May 2, 1963, wherein they deny the request of this City for the improvement of a cross-over between the North and South lanes of Schoolcraft Road at Brook- field Avenue, notwithstanding the fact that this Council disagrees with the reasons set forth by the Commissioners for their denial. The letter dated May 2, 1963, from the Michigan State Highway Department regarding the proposed I-96 freeway, in answer to resolution #278-63, was received and placed on file for the information of the Council. Page 6032 By Councilman McNamara, seconded by Councilman Kleinert, it was #339-63 RESOLVED that, having considered the letter dated April 30, 1963, from the Director of Public Safety, approved by the Mayor, requesting an appropriation covering expenses to be incurred in connection with the observance of Mayor's Exchange Day to be held on Monday, May 20, 1963, the Council does hereby authorize the expenditure of $200.00 from the Public Relations Account of the Legislative Division (102-22) for this purpose. A roll call vote was taken on the foregoing resolution with the following result: AYES: Parks, Kleinert, Dooley, McNamara, McCann and Bagnall. NAYS: None. By Councilman Kleinert, seconded by Councilman McNamara and unanimously adopted, it was #340-63 RESOLVED that, having considered the report and recommendation of the Planning Commission,dated May 8, 1963, in connection with Petition No. Z-591, submitted by George R. Klein, Jack Shenkman and Sears, Roebuck and Company, for change of zoning in the Southeast 1/4 of Section 2 from RUFB to P, the Council does hereby agree with the aforesaid reconnnendatio}i and Petition Z-591 is hereby granted; and does hereby acknowledge receipt of the map for publication from the City Planner, and the amendatory Ordinance submitted by the Department of Law is hereby acknowledged. Councilman Kleinert introduced the following emergency Ordinance: No. 432 AN ORDINANCE AMENDING SECTION 2 OF THE ZONING MAP CF THE CITY OF LIVONIA AND AMENDING ARTICLE 3.00 OF THE ZONING ORDINANCE, ORDINANCE NO. 60, AS AMENDED, OF THE CITY OF LIVONIA, BY ADDING THERETO SECTION 3.34 . THE CITY CF LIVONIA ORDAINS: Section 1. The report and recommendation of the City Planning Commission dated May 8, 1963, on Petition No. Z-591, having been considered by the Council, the Council hereby adopts said petition to amend the Zoning Ordinance and the Zoning Map of the City of Livonia and all proceedings heretofore conducted on said petition are hereby approved. Section 2. Article 3.00 of the Zoning Ordinance, Ordinance No. 60, as amended, of the City of Livonia, is hereby amended by adding thereto the following section. Section 3.348. Petition No. Z-591, submitted by George R. Klein, Jack Shenkman and Sears, Roebuck and Company, is hereby granted and the zoning classification of the premises hereinafter described is hereby changed from RUFB to P as requested in said petition: Page 6033 Lots 499, 500, 501a, 501b, 502, 503a1, 503a2, 503b1, and 503b2 of the Supervisor's Livonia Plat No. 8 located in the North 1/2 of the Southeast 1/4 of Section 2, T. 1 S., R. 9 E., City of Livonia, Wayne County, Michigan; and the north 1/2 of the southeast i/4 of Section 2 of the Zoning Map is hereby amended to conform to the change made in this section. Section 3. The attached map designaged "Amendment No. 105 of the Zoning Map of the City of Livonia," showing all of the amendments and changes made in the fore- going Section 2 of this ordinance is hereby approved, established and made a part hereof. Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed only to the extent necessary to give this ordinance full force and effect. Section 5. Should any portion of this ordinance be held invalid for any reason,such holding shall not be construed as affecting the validity of any of the remaining portions of this ordinance. Section 6. This Ordinance is hereby declared to be an emergency ordinance, necessary for the protection of the public health, safety and welfare and shall take effect immediately on publication. A roll call vote was conducted on the foregoing Ordinance with the following result: AYES: Parks, Kleinert, Dooley, McNamara, McCann and Bagnall. NAYS: None. The President declared the foregoing Ordinance duly adopted and would become effective on publication. By Councilman Dooley, seconded by Councilman McCann, it was #341-63 RESOLVED that, having considered the communication dated April 19, 1963, from the Chief City Engineer regarding the City's pending application for Urban Planning assistance for a flood plain study (Federal 701 Program), the Council does hereby refer the same to the Finance Committee for report and recommendation. A roll call vote was taken on the foregoing resolution with the following result: AYES: Kleinert, Dooley, McNamara, McCann and Bagnall. NAYS: Parks. The President declared the resolutioh adopted. By Councilman Parks, seconded by Councilman Kleinert and unanimously adopted, it was Page 6034 #342-63 RESOLVED that, the communication dated April 15, 1963,from the Chief City Engineer, approved by the Director of Public works, regarding an additional plan review in connection with plats, the approval of which have been extended by Council, is hereby referred to the Streets, Roads and Plats Committee for its report and recommendation. By Councilman Kleinert, seconded by Councilman Parks and unanimously adopted, it was #343-63 RESOLVED that, the letter dated May 1, 1963, from the weingarden Investment Company, regarding the vacating of a certain alley (or easement) is hereby referred to the Planning Commission for its consideration, a public hearing and a report and recommendation to the Council in accordance with Ordinance No. 29, as amended. By Councilman Kleinert, seconded by Councilman McNamara and unanimously adopted, it was #344-63 RESOLVED that, Petition V-74 received from Mr. John E. Pakkala for the vacating of a certain portion of Pembroke Street, Livonia, Michigan, is hereby referred to the Planning Commission for public hearing and recom-. mendation, pursuant to Ordinance No. 29, as amended. On motion of Councilman Dooley, seconded by Councilman McNamara and unanimously adopted, this 408th regular meeting of the Council of the City of Livonia was duly adjourned at 9:13 P.
