M., by the President of the Council, John T. Daugherty. Councilman Kleinert delivered the invocation. Roll was called with the following result: Present-- John T. Daugherty, David L. Jones, Harry R. Killam, Rudolf R. Kleinert, John W. Whitehead, Nettie Carey and Wilson W. Edgar. Absent-- None. The City Clerk, Marie W. Clark, read a letter dated May 26, 1955, from Civil Service Commission relative to change of rate for swimming instructors. By Councilman Kleinert, seconded by Councilman Jones and unanimously adopted, it was #277-55 RESOLVED, that the request of Civil Service Commission dated May 26, 1955, for the following change of rate for swimming instructors: Boys' Instructor From $75.00 per week to $55.00 per week Girls' Instructor From $65.00 per week to $55.00 per week be and hereby is approved. The City Clerk presented to the Council Wayne County Circuit Court Case No. 532,972, Stanley T. Edwards vs. City of Livonia. By Councilman Whitehead, seconded by Councilman Jones and unanimously adopted, it was #278-55 RESOLVED that, Circuit Court Case No. 532,972, Stanley T. Edwards vs. City of Livonia, filed in the City Clerk's office May 31, 1955, be and hereby is referred to the City Attorney for necessary action according to law, with a report to be submitted to the Council. By Councilman Jones, seconded by Councilman Killam and unanimously adopted, it was #279-55 RESOLVED, that the letter dated May 27, 1955 from the Police Department and letter dated May 31, 1955 from the Mayor regarding a possible strike at the Ford Transmission Plant, be placed on the table indefinitely. Page 1894 By Councilman Jones, seconded by Councilman Whitehead, it was imp #280-55 RESOLVED, that Councilmen Whitehead and Edgar and such other members of the Council who desire to attend, be authorized to represent the Council at a meeting with the hichigan State Department of Health June 3, 1955 in Lansing, Michigan, as suggested in the letter from W.R. Shephard, Director of Division of Lngineering, dated May 24, 1955. A roll call vote was taken on the foregoing resolution with the following result: AYES: Jones, Killam, Whitehead, Edgar and Daugherty. NAYS: Kleinert and Carey. The President declared the resolution adopted. The City Clerk read a letter dated May 24, 1955 from the Mayor to the Zoning Board of Appeals, which was received and placed on file. By Councilman Kleinert, seconded by Councilman Killam and unanimously adopted, it was #281-55 RESOLVED, that the recommendation of the Michigan State Highway 110 Department regarding the traffic light at the corner of Plymouth and Farmington Roads be approved, and the Council agrees that the City will assume its proportionate share of the cost of this installation. The City Clerk read a letter dated May 23, 1955, from A. R. Lemke, relative to a traffic ticket. By Councilman Kleinert, seconded by Councilman Carey and unanimously adopted, it was #282-55 RESOLVED, that the letter dated May 23, 1955 from A. R. Lemke be referred to the Police Department for a report to the Council at the next regular meeting, June 13, 1955. Councilman Edgar, as Chairman of the Transportation Committee, gave a brief verbal report regarding proposed bus service. An Ordinance entitled, "An Ordinance Amending Sections 2.04 of 4.03 of Ordinance No. 51 of the City of Livonia entitled, 'An Ordinance Relgulating the Erection, Construction, Enlargement, Alteration, Repair, Moving, Demolition, Con- version, Occupancy, Equipment, Height, Area, Location and Maintenance of all Build- ings, Collection of Fees, Making of Rules and Establishment of Fire Limits; Pro- Page 1895 viding for the Repeal of Prior Ordinances; and Providing Penalties for Violation Hereof' ," introduced by Councilman Whitehead May 9, 1955, was taken from the table and a roll call vote conducted thereon with the following result: AYES: Killam, Kleinert, Whitehead, Carey, Edgar and Daugherty. NAYS: Jones. The President declared the foregoing ordinance duly adopted and would be- come effective on date of publication, June 16, 1955. The City Clerk read a letter dated May 23, 1955 from W. R. McCary„ De- partment of Public Works, regarding street signs in Greenbrier Estates. Councilman Whitehead was excused at 9:35 P. M. By Councilman Kleinert, seconded by Councilman Killam, it was #283-55 RESOLVED, that the reouest from Greenbrier Estates Subdivision for lighted street signs be tabled pending a report from the City Plan- ning Commission. A roll call vote was taken on the foregoing resolution with the following result: AYES: Jones, Killam, Kleinert, Carey, Edgar and Daugherty. LEINAYS: None, Councilman Whitehead returned at 9:40 P. M. The City Clerk read a letter dated May 21, 1955 from the City Attorney as to the statement of John T. Lynch. By Councilman Jones, seconded by Councilman Killam, it was RESOLVED, that the Council honor the bill of John T. Lynch and the amount of $422.35 be appropriated from the Unallocated Fund for this purpose. A roll call vote was taken on the foregoing resolution with the following result: AYES: Jones, Killam and Carey. NAYS: Kleinert, Whitehead, Edgar and Daugherty. The President declarA the resolution denied and made the following statement: I feel the City Attorney is in violation of Ordinance No. 35, Sections 7, 8, 10, 12 and 15 and I charge the Mayor with the responsibility of upholding this Ordinance of the City of Livonia. A recess was called at 9:57 F. M., after which the meeting resumed with Page 1896 all members present who were named as present in the original roll call of this Imo meeting. The City Clerk read a letter dated May 18, 1955 from W. R. McCary, City Engineer and letter dated May 6, 1955, from the Detroit Edison Company. By Councilman Killam, seconded by Councilman Kleinert and unanimously adopted, it was #284-55 RESOLVED, that the request of Detroit Edison Company dated May 6, 1955, for right of way be granted, subject to the recommendations made by the Department of Public Works dated May 18, 1955. The City Clerk read a letter dated May 2, 1955 from St. Paul's Evangelical Lutheran Church relative to installing signs. By Councilman Edgar, seconded by Councilman Whitehead and unanimously adopted, it was #285-55 RESOLVED, that the request of St. Paul 's Evangelical Lutheran Church dated May 2, 1955, for permission to post signs at certain locations in Livonia is hereby granted. The City Clerk read a letter dated May 16, 1955 from the Livonia Public Schools addressed to John T. Daugherty, regarding building permits. By Councilman Jones, seconded by Councilman Killam, it was #286-55 RESOLVED that, pursuant to an agreement between the Livonia Public Schools and the City of Livonia, the Council does he refund the following moneys, which were paid under protest far building permits: Permit #B 11814, Wilson School Addition $162.00 Permit #B 13215, Livonia Center School 98.00 Permit #B 13519, Section 35 School00 Total -77t515; and the City Clerk and City Treasurer are hereby authorized to do all things reasonably necessary to the full performance of this resolutioh. A roll call vote was taken on the foregoing resolution with the following result: AYES: Jones, Killam, Kleinert, Whitehead, Carey, Edgar and Daugherty. L. NAYS: None. The City Clerk read a letter dated May 16, 1955 from Warner and Warner, Page 1897 relative to tentative approval of plans of Westrail Subdivision. lis By Councilman Kleinert, seconded by Councilman Whitehead and unanimously adopted, it was #287-55 RESOLVED, that the City Clerk is authorized to advise the owner by letter that the Council has reviewed the plans for Westrail Subdivision and sees no objection to them at this time. By Councilman Kleinert, seconded by Councilman Jones and unanimously adopted, it was #288-55 RESOLVED, that the Sewage Disposal Agreement between the Board of County Road Commissioners of the County of Wayne, Michig an, a public body corporate, acting for and on behalf of the County of Wayne, a municipal corporation of the State of Michigan, and the City of Livonia, a municipal corporation of the County of Wayne, State of Michigan, be and hereby is approved in all respects; and that E.M. Hartom, its Mayor, and Marie W. Clark, its City Clerk are hereby authorized to affix their signatures to such Sewage Disposal Agreement on this 31st day of May, A. D. 1955, on behalf of the City of Livonia, County of Wayne, State of Michig an. The City Clerk, Marie W. Clark, read a letter dated May 27, 1955 from the Seyburn Building Company and letter dated May 26, 1955 from Rose Hill Builders, re- questing refunds on sewer pemits. By Councilman Kleinert, seconded by Councilman Carey, it was #289-55 RESOLVED that, pursuant to Ordinance No. 100, the Council does hereby refund the following moneys: Sewer Permit Receipt #3487, dated April 25, 1955, 32033 W. Chic ago, Section 3.4 $200.00 Sewer Permit Receipt #3560, Lot #557, 8849 Merriman, Rosedale Meadows Subdivision #2, Section 34, $200.00; and the City Clerk and City Treasurer are hereby authorized to do all things reasonably necessary to the full performance of this resolution. A roll call vote was taken on the foregoing resolution with the following result: AYES: Jones, Killam, Kleinert, Whit ehe ad, Carey, Edgar and Daugherty. A roll call vote was taken on the foregoing resolution with the following result: AYES: Killam, Kleinert, Whitehead, Carey, Edgar and Daugherty. NAYS: Jones. The President declared the resolution adopted. The City Clerk read a letter dated May 23, 1955 from Edward Wild of Civil Service Commission regarding expenses. By Councilman Kleinert, seconded by Councilman Killam, it was #291-55 RESOLVED, that the request of Edward Wild dated May 23, 1955, for expenses in the amount of $118.57 be approved and such amount trans- ferred from the Unallocated Fund to the proper budget account for this purpose. A roll call vote was taken on the foregoing resolution with the following result: AYES: Jones, Killam, Kleinert, Whitehead, Carey, Edgar and Daugherty. Imo NAYS: None. The City Clerk read the petition of J. A. Lynch, et al, received May 26, 1955, to pave Merriman Road. By Councilman Jones, seconded by Councilman Whitehead and unanimously adopted, it was #292-55 RESOLVED, that the petition of J. A. Lynch, et al, for the paving of Merriman Road be referred to the Streets and Roads Committee for report and recommendation. The City Clerk read a letter dated May 20, 1955 from Mrs. Richard H. Stevens, 9931 Oporto, regarding a street dance. By Councilman Kleinert, seconded by Councilman Jones and unanimously adopted, it was #293-55 RESOLVED, that the request of Mrs. Richard H.Stevens, 9931 Oporto, for permission to hold a street dance be granted, subject to the approval of the Department of Public Safety. By Councilman Edgar, seconded by Councilman Whitehead and unanimously Page 1899 adopted, it was imw #294-55 RESOLVED, that the request of James Cleveland, Local #262, UAW-CIO to place a tent or voting booth on the easement of Amrhein Road for the purpose of conducting an election June 8, 1955 is hereby approved, provided that the Union will assume any and all liabilities incurred. The City Clerk read a letter dated May 28, 1955 from the Department of Public Works regarding Saturday closing. By Councilman Kleinert, seconded by Councilman Killam and unanimously adopted, it was #295-55 RESOLVED, that the Department of Public Works is authorized to change office hours to conform with the hours established at the City Hall. By Councilman Carey, seconded by Councilman Kleinert and unanimously adopted, it was #296-55 RESOLVED, that the request of the Police Department dated May 12, 1Q55, for additional funds, be taken from the table f cr reconsideration. Councilman Carey proposed a resolution to grant the request of the Police Department for additional funds, which was lost for lack of support. By Councilman Kleinert, seconded by Councilman Edgar, it was #297-55 RESOLVED, that building permits for construction of the West Chicago Road Reservoir be issued without charge to the Wayne County Road Commission if and when all legal technicalities are cleared, in accordance with the request dated February 23, 1955. A roll call vote was taken on the foregoing resolution with the following result: AYES: KiLlam, Kleinert, Whitehead, Carey, Ti'dgar and Daugherty. NAYS: Jones. The President declared the resolution adopted.
