MINUTES OF THE ADJOURNED ONE HUNDRED TWENTY-SEVENTH REGULAR
MEETING OF THE ODUNCIL OF THE CITY OF LIVONIA
On October 4, 1954, the above meeting was held at 33001 Five Mile Road,
Livonia, Michigan, and was called to order at approximately 8.21 P M , by the
President of the Council , John T Daugherty Councilman Kleinert delivered the
invocation Roll was called with the following result• Present-- John T Daugherty,
David L Jones, Harry R Killam, Rudolf R Kleinert, John W. White head, Nettie
Carey and Wilson W Edgar Absent None
By Councilman Carey, seconded by Councilman Whitehead, it was
#1784 RESOLVED, that the letter from the Traffic Commission dated
August 19, 1954, regarding channeling traffic on Plymouth and Ann Arbor
Roads be tabled for further study with representatives of the Traffic
Commission
A roll call vote was taken on the foregoing resolution with the following result:
AYES: Jones, Killam, Whitehead, Carey, Edgar and Daugherty
NAYS. Kleinert.

AN ORDINANCE AMENDING SECTE)NS 6.03 AND 7.02
OF THE RETIREMENT PLAN ORDINAN CE, ORDINAN CE
NO 77 OF THE CITY OF LIVONIA
THE CITY OF LIVONIA ORDAINS:
Section 1 Sections 6.03 and 7 02 of the Retirement Plan Ordinance,
Ordinance No. 77, of the City of Livonia, adopted December 17, 1953, is hereby
amended to read as follows•
Section 6.03. Service Retirement Pension Upon his retirement
from service a member, who has attained his voluntary retirement age and
has ten (10) or more years of total service credited to his service account,
shall receive a service retirement pension equal to one (1) per cent of his
average final compensation multiplied by the number of years, and fraction
of a year, of total service credited to his service account, provided, that
no more than fifteen (15) years of prior service credit shall be used in com-
puting a service retirement pension. Upon his retirement, the said member
shall have the right to elect an option provided for in Section 6.05.
In the event a retirant dies before he has received in payment of

his service retirement pension an aggregate amount equal to his accumulated
contributions standing to his credit in the pension savings fund at the time
lij of his retirement, the difference between his said accumulated contributions
and the said aggregate amount of service retirement pensions received by him
shall be paid from the pension reserve fund to such person or persons as he
shall have nominated by written designation duly executed and filed with the
Board. If there be no such designated person or persons surviving the said
retirant, then said difference, if any, shall be paid to his legal representa-
tive This section shall not apply in the case of a retirant who elected
either option (a) or (b) provided for in Section 6 05
Section 7.02 Disability Pension - Ten or More Years of Total
Service Any member with ten (10) or more years of total service credited
in Section 7 01, shall receive a disability pension equal to one (1) per cent
of his average final compensation multiplied by the number of years, and
fraction of a year of total service credited to his service account, rEo-
vided, that no more than fifteen (15) years of prior service credit shall
be used in computing a disability pension, provided further, that the said
pension shall be subject to Sections 5 04 and 7 04 Upon his said retire-
ment or attainment of his voluntary retirement age, whichever is later, he
shall have the right to elect an option provided for in Section 6.05
Section 2 All ordinances or parts of ordinances in conflict or inconsistent
with the provisions of this ordinance are hereby repealed.
Section 3. If any part or parts of this ordinance are for any reason held
to be invalid, such decision shall not affect the validity of the remaining portions
of this ordinance
The foregoing ordinance was placed on the table for consideration at the
next regular meeting of the Council

#1785 RESOLVED, that Mr. George Haller be directed to confer with
the Zoning Board of Appeals to determine whether or not he can have
sufficient time to answer their questions and if not, this Council be
advised

be referred to the City Planning Commission for action according to
law and Ordinance No 29

The City Clerk, Marie W Clark, read letter from the Bureau of Inspection
dated September 30, 1954, Mr Wood and Mr. Nagel appeared before the Council
By Councilman Jones, seconded by Councilman Kleinert, and unanimously
adopted, it was
#1787 RESOLVED, that the recommendations of the Plumbing Inspector of
the Bureau of Inspection be referred to the Building Code Board of Appeals
for their report and recommendation to the Council.
By Councilman Kleinert, seconded by CouncilmanCarey, it was
#1788 RESOLVED, that the City Clerk be and hereby is authorized to
prepare a voucher for the payment of 3 50 to the Lawyers Cooperative
PublisilLng Company for the Department of Law
A roll call vote was taken on thefore going resolution with the following result:
AYES. Jones, Killam, Kldnert, Whitehead, Carey, Edgar and Daugherty
NAYS• None
A recess was called at 9.24 P M , after which the meeting resumed with
all members present who were named as present in the original roll call of this
meeting
The City Clerk read letters from the following. City Planning Commission
dated September 29, 1954, J H Lacy dated March 19, 1952; Fire Department dated
July 2, 19 54, and Donald Wilson, former Chief Inspector, dated February 16, 1954.
Mr. Coyle, attorney for Mr Robert Labadie, appeared before the Council in this
matter
By Coureilmai Jones, seconded by Cou:dcilman Killam and unanimously
adopted, it was
#1789 RESOLVED, that the recommendation of the City Planning Commission
dated September 29, 1954 regarding the petition of Robert Labadie for re-
zoning be tabled pending the cut come of the law suit of Robert Labadie vs
City of Livonia, Case No 524-040, in Circuit Court.
By Councilman Whitehead, seconded by Councilman Edgar and unanimously
adopted, it was
#1790 RESOLVED, that the Boam Company Contract No. 3 for the installa-

tion of water line be extended to December 31, 1954, to enable the State
