MINUTES OF THE SIXTY—NINTH REGULAR MEETING
OF THE COUNCIL OF THE CITY OF LIVONIA

On April 28, 1952, above meeting was held at 33211 W Seven Mile Road,
Livonia, Michigan, and was called to order at approximately 8:04 P M by the
President of the Council, Harry S Wolfe Roll was called with the following
result Present-- Harry S. Wolfe, Wilson W. Edgar Harvey Jahn, Nettie Carey,
William Taylor and John Whitehead Absent-- ?aymond E Grimm
Minutes of the 68th regular meeting of the Council held April 21, 1952,
were read and approved
Mayor Ziegler made a report on the assessed valuation of the City of
Livonia for 1952, which is $42,953,300 00 or an increase of $14,143,400.00 over
the 1951 assessment Of this increase the sum of $8,039,080 00 represents 656
111 new buildings, and the balance of the increase consists mainly of additional
personal property brought into the City Mayor Ziegler stated that only a small
portion of the additional valuation represents an increase in property assessments
and that this increase is not applicable to homes, but merely is a slight addition
to the valuation of acreage consistent with a general policy throughout the county
and state
LaVerne Theisen, Chairman of the Civil Service Commission, appeared before
the Council and discussed the advisability of amending the existing salary schedule
By Councilman Whitehead, seconded by Councilman Taylor and unanimously adopted as
follows, it was.
#38 RESOLVED that, on recommendation of the Civil Service Commission,
the salary schedule as heretofore submitted by the Civil Service Commission
and approved by the Council, effective December 2, 1951, be amended in the
following respect: the position of bookkeeper junior grade, as presently
held, shall be entitled to an increase in wages at the end of a six month
period instead of one year as heretofore provided for in the present
position; provided, however, that this amendment shall apply only to the
position as held April 15, 1952.

A roll call vote was taken on the foregoing resolution with the following result-

Mayor Ziegler presented to the Council Mr. Kaiser of the Wayne County
Library Commission who submitted certain information as to a library for the City
of Livonia, including cost of construction, maintenance, capital outlay on books
and other matters He stated that the initial cost of the books would be $8,000 00,
that a building for the library should be at least 2400 sq feet and that the
estimated total outla, for uhe first year would be approximately $20,000 00 This
matter was held for further consideration
Communication from City Planning Commission dated April 26, 1952, pertaining
to Petition #52 was received and placed on file. The foregoing letter contained a
copy of the following resolution
i n RESOLVED: that a public hearing having been held this 23rd
day of April, 1952, on Petitior #52 of the Sheldon Land Company and the
Planning Commission having considered statements made by Mr. Lowell Jacobs,
President of the Rosedale Gardens Civic Association and other Taxpayers
from Rosedale Gardens Subdivision and Messrs Sheldon, Maxwell Fead and
Reaume, representing the Sheldon Land Company, and having also considered
a certain letter dated April 15, 1952, addressed to Mr. Lowell Jacobs,
signed by the Sheldon Land Company and approved by Lowell Jacobs, Robert
Hayes, Richard R. Goetz, Eleanor Curle and James Valrance, the said
petition as to Parcels #2 and #3 is hereby tabled for further consideration,
and, as to Parcel #1 the Planning Commission does hereby recommend to the
Council that the petition be granted and the zoning classification of said
parcel #1 be changed to C-2• and the Planning Commission does further recommend
to the Council than said petition be granted as to the closing of Roseland
and Woodring Avenues and that said streets be closed commencing at the South
boundry of Plymouth Road and running South for a distance of 1200 feet;
provided however, that these recommendations are made on the condition that the
plot plan showing the proposed dimensions and locations of buildings as well
as parking area as filed with the Planning Commission and identified by the
signature of the Secretary of such Commission be substantially adhered to and
following on all future developments of Parcel #1, and that the ratio of
parking area to floor area of buildings as shown on such plan be maintained

Councilman Jahn introduced the following ordinance.

AN ORDINANCE TO AMEND PORTION OF SECTION 34 OF THE ZONING
MAP OF THE CITY OF LIVONIA OF ORDINANCE NO. 7 ENTITLED:
"AN ORDINANCE TO ESTABLISH DISTRICTS IN THE CITY OF LIVONIA,
TO REGULATE THE USE OF LAND AND STRUCTURES THEREIN, TO
REGULATE AND LIMIT THE HEIGHT, THE AREA, THE BULK AND LOCATION
OF BUILDINGS, TO REGULATE AND RESTRICT THE LOCATION OF TRADES
AND INDUSTRIES AND THE LOCATION OF BUILDINGS DESIGNED FOR
SPECIFIC USES, TO REGULATE AND DETERMINE THE AREA OF YARDS,
COURTS AND OTHER OPEN SPACES, TO REGULATE THE DENSITY OF
POPULATION; TO PROVIDE FOR THE ADMINISTRATION AND ENFORCEMENT
OF THIS ORDINANCE, TO PROVIDE FOR A BOARD OF APPEALS, AND ITS
POWERS AND DUTIES, TO PROVIDE A PENALTY FOR THE VIOLATION OF
THE TERMS THEREOF; AND TO ADOPT THE ZONING ORDINANCE OF THE
TOWNSHIP OF LIVONIA, AMENDMENTS THERETO AND ZONING MAP," AND
SECTION 3(A) OF SAID ORDINANCE NO 7
IIITHE CITY OF LIVONIA ORDAINS:
Section 1 The following definitions are herebyadopted:
(a) Zoning Ordinance, as hereinafter used in this ordinance, is
defined as Ordinance No 7 of the City of Livonia entitled, "An Ordinance
to Establish Districts in the City of Livonia, to Regulate the Use of
Land and Structures Therein; to Regulate and Limit the Height, the Area,
the Bulk and Location of Buildings; to Regulate and Restrict the Location
of Trades and Industries and the Location of Buildings Designed for
Specific Uses• to Regulate and Determine the Area of Yards, Courts and
Other Open Spaces; to regulate the Density of Population, to Provide for
the Administration and Enforcement of this Ordinance, to Provide for a
Board of Appeals, and its Powers and Duties, to Provide a Penalty
for the Violation of the Terms Thereof; and to Adopt the Zoning Ordinance
of the Township of Livonia, Amendments Thereto and Zoning Map," as
amended
(b) The term Zoning Map, as used in this ordinance, is hereby defined
to mean the Zoning Map adopted in Section 3 of said Zoning Ordinance.
(c) The term Petition or Petitions, as used in this ordinance is
defined to mean petitions to amend said Zoning Ordinance filed with the
IECouncil and referred to the City Planning Commission for report and

Section 2 The report and recommendations of the City Planning Commission
on Petition No 52 to amend said Zoning Ordinance are hereby accepted and adopted
Section 3 A portion of Section 34 of the Zoning Map of the City of Livonia
of said Zoning Ordinance, as amended, and Section 3 (A) of said Zoning Ordinance, is
hereby amended as follows
(a) Petition No 52 is granted as to the following described premises:
1 Land and premises described as beginning at a point 60
feet southerly and 60 feet easterly of the N W corner of
Section 34, T. 1 S., R. 9 E., said point being the southeast
corner of Plymouth and Farmington Roads, Citj of Livonia,
Wayne County, Michigan; thence proceeding easterly 1377 10
feet along the south line of Plymouth Road to the west line of
Loveland Avenue, thence southerly 560 feet along the west line
of Loveland Avenue; thence westerly 112 feet on a line parallel
to Plymouth Road, thence southerly 640 feet along the center line
of the easement west of Loveland Avenue, thence westerly 1256 56
feet along a line parallel to Plymouth Road; thence northerly along
a line parallel to and 60 feet easterly of west line of said
Section 34 a distance of 1200 feet to the point of beginning,
except that portion of the foregoing described land which is
already zoned C-2 with a frontage of 700 feet along Plymouth Road
and 680 feet along Farmington Road
and the zoning classification of said premises is hereby changed to C-2
(b) The classification and district change made ty granting Petitior
No. 52, to the extent above indicated, is hereby included in Section 3 (A)
of said Zoning Ordinance, as emended.
(c) That portion of Section 34 of said Zoning Map, which includes
the above described premises, is hereby amended to conform to the change
made in the foregoing sub-paragraph (a) of this section; and the attached
amended Zoning Map No 7 showing such change and amendment, is hereby
approved and made a part hereof
(d) The foregoing change and amendment is made on the condition
tha+ the owner of the above described premises shall establish and
maintain, in a healthy, growing condition according to regulations of
the Departmert of Parks and Recreation, a greenbelt of not less than
eight (8) fee+ in width along and immediately within such boundaries
of the above described premises as ma; be adjacent to residential property.
Section 4. All proceedings on said Petition No. 52 are hereby approved, a
public hearing thereon having been duly held as provided by law and proper notice of
such hearing, including full description of the premises described in said petition,
having been duly published
Section 5 All ordinances or parts of ordinances in conflict herewith are
hereby repealed only to the extent necessary to give this ordinance full force and

Section 6 Should any portion of this ordinance be held invalid for any
reason, such holding shall not be construed as affecting the validity of any of the
remaining portion of this ordinance

The foregoing ordinance was placed on the table for consideration at the
next regular meeting of the Council
Councilman Edgar introduced the following ordinance:

AN ORDINANCE VACATING PORTIONS OF ROSE-
LAND AVENUE AND W00DRING AVENUE
THE CITY OF LIVONIA ORDAINS
Section 1 The report and recommendations of the City Planning Commission
on Petition No 52, for vacating certain streets, is hereby accepted and adopted;
and the Council does hereby approve all proceedings on said petition, it appearing
that a public hearing thereon was duly held as provided by law and that proper
III notice of such hearing was given
Section 2 Pursuant to Ordinance No 29 of the City of Livonia entitled,
"An Ordinance Providing the Procedure for Vacating of Streets, Alleys and Public
Ground", the following portions of streets within the City of Livonia are hereby
vacated Roseland Avenue and Woodring Avenue commencing at the South boundary
of Plymouth Road and running south for a distance of 1200 feet; said portions being
within Rosedale Gardens No 9 Subdivision of part of the N W 1/4 of Section 34, T
1 S , R 9 E , City of Livonia, Wayne County, Michigan, according to the plat thereof
recorded in the office of the Wayne County Register of Deeds in Liber ?3 on Page 41
Section 3. All ordinances or parts of ordinances in conflict herewith are
hereby repealed only to the extent necessary to give this ordinance full force and
effect.
Section 4 Should any portion of this ordinance be held invalid for any
reason, such holding shall not be construed as affecting the validity of the remaining
portion of this ordinance

A ten minute recess was called, following which the meeting was reconvened
with all members of the Council present, who were named as present in the original
roll call of this meeting
The following members of the Livonia Township School Board, George Bentley,
Max Bowen, C T Cook, Ward ?'cCain, Clyde Rickert, Superintendent of Schools Harry 0
Johnson, City Engineer Herald F Hamill, Mayor Jesse Ziegler, the City Attorney and
members of the Council met together informally to discuss the correction of the
drainage problem at Wilcox School This meeting was concluded and the regular order
of business continued
By Councilman Edgar, Seconded by Councilman Whitehead and unanimously adopted
as follows, it was:
#39 RESOLVED, that the City Engineer prepare plans and specifications
for the drainage, grading and paving of Munger Avenue from Wilcox School to
Middlebelt Road, and for the drainage and grading of area around Wilcox
School, that bids be requested on such plans pursuant to the provisions of
the Financial Ordinance, and that all bids be opened and considered on
May 26, 1952, at 8 30 P M
B3 Councilman Taylor, seconded by Councilman Jahn and unanimously adopted
as follows, it was:
#40 RESOLVED that, pursuant to request of Chief of Police dated
April 28, 1952, the sum of $700 00 is hereby appropriated from the
unallocated fund to tha Police Department to purchase uniforms for the
special police
A roll call vote was taken on the foregoing resolution with the following result:

Mr Clarence Bucknell and others presented a petition asking that an ordinance
be passed prohibiting the sale of any automobiles on Sunday. Mr. Bucknell appeared
personally and made a statement on this subject By Councilman Carey, seconded by
Councilman Jahn and unanimously adopted as follows, it was.

#41 RESOLVED, that the City Attorney prepare an ordinance
prohibiting the sale of automobiles on Sunday and that the proposed
ordinance be presented to the next meeting of the Committee of the
Whole.
By Councilman Jahn, seconded by Councilman Carey and unanimously adopted
as follows, it was.
#42 RESOLVED, that the report and recommendations of the Superintendent
of Public Works dated April 23, 1952, pertaining to the travelled surface
of certain roads in Sections 2 and 4 of Sewage Disposal System No. 1 and
containing a detailed survey of such roads, be and hereby are accepted
and approved; and the Department of Public Works is authorized to negotiate
an agreement with contractors on the basis set forth in such report;
provided, however, that such agreement will not release or discharge
any claims of private individuals or concerns and will affect only such
work as is detailed in said report

as follows, it was.
#43 RESOLVED, that Petition No 54 of Joseph S. Klein, Jr and
Margaret S Klein, for change of zoning classification be referred to
111 the City Planning Commission for holding public hearing thereon and
making their recommendations and report according to law
By Councilman Jahn, seconded by Councilman Taylor and unanimously adopted
as follows, it was:
#44 RESOLVED, that the sum of -. 1,072 64 be appropriated from
the unallocated fund to the new city hall fund to pay for maps,
legal descriptions and other work on the new city hall building
A roll call vote was taken on the foregoing resolution with the following result.
AYES. Carey, Jahn, Taylor, Edgar, Whitehead and Wolfe
NAYS• None.

as follows, it was.
RESOLVED, that this meeting be adjourned to Monday, May
5, 1952, at 8 30 P.M.
