MINUTES OF THE ELEVENTH REGULAR MEETING
OF THE COUNCIL OF THE CITY OF LIVONIA
August 7, 1950
The eleventh regular meeting of the Council of the City of Livonia
was held on August 7, 1950, at 33110 Five Mile Road, Livonia, Michigan The
meeting was called to order at approximately 8:02 P M by the President of the
Council, Harry S Wolfe Roll was called with the following result: Present--
Harry S Wolfe, Wilson W Edgar, Raymond E Grimm, Harvey Jahn, Nettie Carey,
William Taylor and John Whitehead Absent--none
The minutes of the tenth regular meeting of the Council held on July 31,
1950 were read and approved.
The minutes of the First Special meeting of the Council were read On
motion of Wilson W. Edgar, seconded by Raymond E Grimm and unanimously carried,
it was
q /A/ RESOLVED, that the minutes of the First Special meeting of the
Council of the City of Livonia, held August I , 1950 at 33110 Five Mile
Road, Livonia, Michigan be and hereby are approved in all respects
John Miller, elected Constable, attended the meeting upon the request
of the Council and stated the facts briefly about the serving of summons for the
Justice Court.
Communication from Mr L E Devers, President, Heat Engineering and
Stoker Service, Inc , Detroit, Michigan was read In his letter, Mr Devers brought
forth some pertinent facts on the electrical and plumbing codes, this communication
was turned over to the Committee serving on that board
Report from the Planning Coimnission was read, with their action therein
stated on rezoning of certain parcels of land

The Council then, by the unanimous affirmative vote of all of the
members listed as present at the roll call, fully approved and adopted the
following recommendations of the City Planning Commission.
Petition #1 of Walter Wilson and Lucy Wilson is denied
Petition #2 of David Newman and Sarah Newman is denied.
Petition #3 of Asa E Wilson and his children is granted.
Petition #It of Hans A Hartman and Bertha Hartman is granted

Petition #5 of William A. Rutenbar is granted
Petition #6 of Bernice Lehn is granted
Petition #7 of Anne B Slapinska is denied
Pursuant to the foregoing action, Councilman Wilson WY Edgar introduced the
following ordinance.

AN ORDINANCE TO AMEND A PORTION OF SECTION 24 OF THE ZONING
MAP OF THE CITY OF LIVONIA OF ORDINANCE NO 7, ENTITLED:
411 "AN ORDINANCE TO ESTABLISH DISTRICTS IN THE CITY OF LIVONIA;
TO REGULATE THE USE OF LAND AND STRUCTURES THEREIN; TO
REGULATE AND LIMIT THE HEIGHT, THE AREA, THE BULK AND LO-
CATION OF BUILDINGS; TO REGULATE AND RESTRICT THE LOCATION
OF TRADES AND INDUSTRIES AND THE LOCATION OF BUILDINGS
DESIGNED FOR SPECIFIC USES; TO REGULATE AND DETERMINE THE
AREA OF YARDS, COURTS AND OTHER OPEN SPACES, TO REGULATE
THE DENSITY OF POPULATION; TO PROVIDE FOR THE A1INISTRATION
AND ENFORCEMENT OF THIS ORDINANCE; TO PROVIDE FOR A BOARD
OF APPEALS, AND ITS POWERS An D DUTIES, TO PROVIDE A PENALTY
FOR THE VIOLATION OF THE TERMS THEREOF, AND TO ADOPT THE
ZONING ORD-NANCE OF THE TOWNSHIP OF LIVONIA, AMENDMENTS
THERETO AND ZONING MAP "
THE CITY OF LIVONIA ORDAINS.
Section 1. A portion of Section 2I of the Zoning Map of the City
of Livonia of Ordinance No 7, entitled: "An Ordinance To Establish Districts

In The City of Livonia; To Regulate The Use of Land and Structures Therein,
To Regulate and i•imit The Height, The Area, The Bulk and Location of Buildings;
To Regulate and Restrict The Location of Trades and Industries and The Location
of Buildings Designed For Specific Uses, To Regulate and Determine The Area of
Yards, Courts and Other Open Spaces, To Regulate The Density of Population;
To Provide For The Administration and Enforcement Of This Ordinance; To Provide
For A Board of Appeals, and Its Powers and Duties; To Provide A Penalty For The
Violation of the Terms Thereof; And To Adopt The Zoning Ordinance of The
Township of Livonia, Amendments Thereto and Zoning Map " is hereby amended as
46, follows
(a) A new section is hereby added to said Ordinance No 7, entitled
"Section 3(A) Amendments To Zoned Districts and Classifications," which
new section shall immediately follow Section 3 of said ordinance and shall
include all classification and district changes hereafter made together
with those provided by the present ordinance
(b) Petitions to change zoning classifications heretofore filed
and numbered 3, L, 5 and 6, are hereby granted, and the zoning
classification of the premises described in said petitions is hereby
changed from R-U-F-B to C-1
(c) That portion of Section 2L of said Zoning Map which includes
property fronting on and lying immediately north of Schoolcraft Road,
410 having a depth of 300 feet from the center of said road, and being more
particularly described in said petitions numbered 3, 4, 5 and 6, is
hereby amended to conform to the changes made in the foregoing paragraph
(b), and the attached Amended Zoning Map No. 1., showing such changes
and amendment, is hereby approved and made a part hereof
Section 2 All ordinances or parts of ordinances in conflict
herewith are hereby repealed only to the extent necessary to give this
ordinance full force and effect
A roll call vote was taken with the following result•
YEAS: Harry S Wolfe, Wilson W Edgar, Raymond E Grimm,
Harvey Jahn, Nettie Carey, William Taylor, and John
Whitehead,
NAYS: None.
The President declared the above ordinance passed and effective as of the date
of publication

Communication from W B Frantz was read, in which Mr Frantz asked
the permission of the City Council to operate his Diamond Taxi Co in the City
The Clerk thereupon was instructed to write Mr Frantz and invite him
to attend the Council Meeting of August 21, 1950
Mr L. E Devers was then asked to speak with the Council on his
communication which was read earlier in the Minutes of the Meeting
Mr Dayton Creedon spoke on behalf of the Special Traffic Police
Division Officers who were released from duty as of midnight August 5, 1950. Mr
Creedon made the suggestion that the officers should have had one weeks notice
and therefore should be entitled to an additional weeks pay
On motion of William Taylor, seconded by John Whitehead , and unanimously
carried, it was

/-1,2 RESOLVED, that the following men, William Aaron, Dayton Creedon,
Thomas Mullaney, Moore Salon, Cardie Nelson, Max Koehler and Alfred
Wonnacatt be forwarded the sum of $45.00 each for one weeks wages - and
the Council of the City of Livonia appropriates the sum of $315.00 to
meet said payroll, and the Treasurer is hereby ordered to issue same
after payroll has been duly drawn by the City Clerk
The Honorable Charles Oakman, Councilman of the City of Detroit was
introduced to the Livonia City Council by Mayor Jesse Ziegler
Mr James L Hagen, Director of Public Safety was asked to investigate
the residence requirements of the Special and regular police officers.
Communication was read from Board of Wayne County Road Commissioners
acknowledging the receipt of termination on agreement
Communication from Clifford C Brown was read and referred to the
Planning Commission
Report of Justice Leo 0 Nye was read and ordered placed on file.
Councilman Wilson W Edgar reported to the Council that the two pick-up
trucks were still entitled to the Livonia Township Board and the two pick-ups and
any other motor vehicle should be charged to the City of Livonia

Mr Edgar also reported that Compensation Insurance of Water Department Clerical
Help and all Water Board employees should be under the City of Livonia Insurance
Plan
On motion of Wilson W Edgar, seconded by John Whitehead, and unanimously
carried, it was
A-la-3 RESOLVED, that any and all motor vehicles previously entitled
to the Livonia Township Board, be and hereby are ordered to be entitled
to the City of Livonia and that the Water Department Employees be insured
under the City of Livonia Compensation plan and that the Water Board
be billed their proportionate share of Insurance cost
The Clerk presented current operating bills for payment On motion of
Harvey Jahn, seconded by William Taylor and unanimously carried, it was
fl-1 a'f RESOLVED, that these bills as presented by the Clerk, be
and hereby are ordered paid by the City Treasurer
Jesse Ziegler, Mayor of the City of Livonia, made his report to the
Council of his finding on property for purchase by the City
On motion of Wilson W. Edgar, seconded by Nettie Carey, and unanimously
carried, it was
l- !a✓ RESOLVED, that the City make the offer of $25 00 per foot for
216 feet of property adjoining the present site of the City Hall
On motion of William Taylor, seconded by Harvey Jahn, and unanimously
carried, it was
A-/oto. RESOLVED, that the Mayor be authorized to make a deposit of
$500.00 to William Heyman 1785 Seward Street, Detroit, Michigan on a
regular offer to purchase said property under the terms of above
resolution.
Wilson W Edgar introduced the following ordinance:

AN ORDINANCE PROVIDING :OR THE APPOINTMENT OF TWO
ADDITIONAL CONSTABLES

THE CITY OF LIVONIA ORDAINS:
Section 1 In accordance with Section 2, Chapter V, of the Charter
and the laws of the State of Michigan, the Council may appoint not more than
two constables in addition to the two constables selected by election.
Section 2 Argy constable appointed pursuant to the provisions of this
Ordinance shall hold office at the pleasure of the Council
Section 3. No person shall be eligible for appointment to the office of
constable unless he is a duly qualified and registered elector of the City and has
continuously resided in the City for at least two years immediately prior to his
appointment
Section 14 All constables appointed pursuant to the provisions of this
Ordinance shall have such powers and duties as may be provided by the laws of
Michigan, the Charter and Ordinances of the City of Livonia, and any resolutions of
the Council All such constables may be required by the Justice Court of the City
of Livonia to serve process, civil and criminal, issued by that Court. The Council
may appoint as such constable a police officer who may likewise serve as court
officer
Section 5 Constables appointed pursuant to this Ordinance shall receive
such compensation as may be fixed by resolution of the Council, provided, however,
that no compensation shall be paid to a constable who is also a police officer
except such as he may be entitled to as a police officer
Section 6 All ordinances or parts of ordinances in conflict or
inconsistent herewith are hereby repealed
Section 7 In the event any portion of this Ordinance is held invalid for
ar{y reason, such holding shall not effect the validity of the remaining portion of
this Ordinance

Section 8 This Ordinance is hereby declared to be an emergency Ordinance
necessary for the protection of the public health, welfare and safety and shall
take effect immediately upon publication
A roll call vote was taken with the following result•
YEAS: Wilson W Edgar, Raymond E. Grimm, John Whitehead, Nettie Carey,
Harvey Jahn, William Taylor and Harry S Wolfe;
NAYS: None
The President declared the above Ordinance passed and effective as of the date of
publication, August 18, 1950.
On motion of John Whitehead, seconded by Raymond E Grimm and unanimously
carried, the meeting was adjourned, time of adjournment being 10:38 P M August 7,
