The meeting was called to order at approximately 8 .09 P M by the President of the Council, Harry S Wolfe. Roll was called with the following result . Present--Harry S Wolfe, Wilson W. Edgar, Raymond E. Grimm, Harvey Jahn, lalliam Taylor and John Whitehead Absent--Nettie Carey. The minutes of the twenty-third regular meeting of the Council held November 8, 1950, were read and approved. Letter from Hubbell, Roth & Clark dated November 13, 1950, and reporting progress on the new sewer system in Sections 25, 26, 35 and 36 was read. The 111 Council also examined plans for the new sewer system identified under permit No 8717. On motion of Councilman Harvey Jahn, seconded by Councilman Raymond E Grimm and unanimously carried by the affirmative vote of all of the Councilmen named as present in theroll call of this meeting, it was : /9-02‘56") RESOLVED, that the foregoing communication be placedon file At the suggestion of Mr. Roth, of Hubbell, Roth & Clark, a meeting of the Committee of the Whole was set for December 6, 1950, at 8 :00 P M., at which time Mr Roth will present additional matters to the committee pertaining to the sewer project The clerk presented to the Council the proposed plat of Rosedale Gardens Subdivision No 10, which was carefully examined and considered. Council- man Harvey Jahn made a motion that the following resolution be adopted. Page 198 A ,255 RESOLVED, that the proposed plat of Rosedale Gardens Subdivision No 10 be and hereby is rejected by the Council for the 1 reason that it fails to comply with Ordinance No. 19 of the City of Livonia The foregoing motion was seconded by Councilman John Whitehead and a roll call vote was taken with the following result: YEAS. Harvey Jahn, William Taylor, John Whitehead, Harry S Wolfe, Raymond E Grimm and Wilson W Edgar. NAYS. None The President declared the foregoing resolution passed The clerk was instructed to notify Sheldon Land Co of the above action. The petition of G A Bakewell for vacation of Park Drive between Alois and Jarvis was next considered. The letter of Herald Hamill, City Engineer, dated November 21, 1950, addressed to Lester French, Director of Public Works, and recommending denial of the petition was read and placed on file Councilman Harvey Jahn made a motion that the following resolution be adopted. A A510 RESOLVED, that the petition of G A Bakewell for vacation of Park Drive between Alois and Jarvis be and hereby is denied The foregoing motion was seconded by Councilman Raymond E. Grimm and a roll call vote was taken with the following result: YEAS. Harvey Jahn, William Taylor, John Whitehead, Harry S Wolfe, Raymond E Grimm and Wilson Edgar. NAYS• None. The President declared the foregoing resolution passed Letter was read from Herald Hamill, City Engineer, to the Director of Public Works dated November 25, 1950, enclosing request of Detroit Edison Company for right-of-may agreement and recommending the granting of same. Councilman Raymond E Grimm made a motion that the following resolution be adopted. /9-457 RESOLVED, that Right-of-Way be granted to the Detroit Edison Company, as per their request in drawing #d-12L32R, said drawing to provide 40 KV Transmission to provide tap feeds from separate lines to Stark Substation in the City of Livonia. Harry S Wolfe, Acting Mayor, and Marie W Clark, City Clerk, will make all necessary steps to fulfill this resolution Page 199 The foregoing motion was seconded by Councilman William Taylor and a roll call vote was taken with the following result YEAS• Harvey Jahn, William Taylor, John Whitehead, Harry S Wolfe, Raymond E Grimm and Wilson W Edgar NAYS: None. The President declared the foregoing resolution passed Letter was read from Herald Hamill, City Engineer, dated November 24, 1950, addressed to Lester French, Director of Public Works, stating that the streets in Rosedale Gardens No 8 have been satisfactorily completed and recommending a release of a $20,000.00 bond furnished by Sheldon Land Co This letter was placed on file and Councilman John Whitehead made a motion that the following resolution be adopted• 1)-025P RESOLVED, that the $20,000 00 bond furnished to the City of Livonia by Sheldon Land Co., in connection with the construction of streets in Rosedale Gardens No 8 Subdivision be cancelled and terminated; that said $20,000 00 be released and returned to Sheldon Land Co.; and that the Mayor and Clerk of the City of Livonia be and hereby are authorized and directed to sign and deliver such instruments as may be necessary to the full performance of this resolution The foregoing motion was seconded by Councilman Harvey Jahn and a roll call vote was taken with the following result : YEAS. Harvey Jahn, William Taylor, John Whitehead, Harry S Wolfe, Raymond E Grimm and Wilson W Edgar NAYS• None The President declared the foregoing resolution passed The clerk read a letter to the Council from the City Planning Commission dated November 13, 1950, recommending that petition No 13 for change of zoning classification from R-1 to C-1 be granted This matter was discussed and Councilman Wilson W Edgar made a motion that following resolution be adopted: 1 Q75? RESOLVED, that the communication of the City Planning Commission in regard to petition No. 13 for change of zoning classification be xejected and that said petition be and hereby is denied The foregoing motion was seconded by Councilman John Whitehead and a roll call vote was taken with the following result: Page 200 YEAS: Harvey Jahn, John Whitehead, Harry S Wolfe, Raymond E Grimm and Wilson W Edgar. NAYS: William Taylor The President declared the foregoing resolution passed The application of Arthur Collins for approval of transfer of liquor license was next considered. Councilman Harvey Jahn made a motion that the following resolution be adopted: A a UD RESOLVED, that the Council does hereby approve the application of Arthur Collins of 33601 Plymouth Road, Livonia, Michigan, for transfer of omership of 1950 tavern license for sale of liquor at the last mentioned address. The foregoing motion was seconded by Councilman John Whitehead and a roll call vote was taken .with the following result. YEAS• Harvey Jahn, William Taylor, John Whitehead, Harry S Wolfe, Raymond E Grimm and Wilson W Edgar NAYS None. The President declared the foregoing resolution passed Mr. D. A. Pierce of 27620 Terrence made a statement to the Council as to control of traffic near schools. The plans and specificationss in Grandon Woods Subdivision as approved by Herald Hamill, City Engineer, were next considered by the Council On motion made by Councilman William Taylor, seconded by Councilman John Whitehead and • unanimously carried by the affirmative vote of all of the Councilmen named as present in the roll call of this meeting, it was : A-a&/ RESOLVED, that the sewer plans and specifications for Grandon Woods Subdivision be and hereby are ._approved. Communication from joint council of Electrical Contractors dated November 21, 1950, was read and placed on file Communication from Board of Wayne County Road Commissioners regarding $100 00 held in trust for improvement in plat recorded in Liber 69, page 3 in office of Wayne County Register of Deeds, was read and placed on file, and the clerk was instructed to acknowledge same Page 201 Letter from Clarenceville Public Schools concerning traffic light at Eight Mile and Middlebelt Roads was read and referred to James L Hagen, Director of Public Safety, for investigation and report. On motion of Councilman John Whitehead, seconded by Councilman Raymond E Grimm and unanimously carried by the affirmative vote of all of the Councilmen named as present in the roll call of this meeting, it was - A aha RESOLVED, that the Department of Public Safety do everything possible to have a traffic light installed at the intersection of Eight Mile Road and Middlebelt. Letter from Visiting Nurses Association dated November 9, 1950, was read and placed on file. Letter from Michigan State Highway Department dated November 6, 1950, and pertaining to a traffic survey on state trunk line highways, was read and placed on file III Current report of Leo 0 Nye was read and filed Report of Police Chief Harmon concerning conditions of alleys in rear of business houses on Plymouth Road was read and filed Communication from Viola W. Hancock dated October 1950, was read and referred to James L Hagen, Director of Public Safety, for investigation and report The Council next considered the matter of collection of taxes. Council- man Wilson Y Edgar made a motion that the following resolution be adopted: A-0?63 RESOLVED, that Carl J Wagenschutz, City Treasurer of the City of Livonia, is to open a special account in the First National Bank in Plymouth, for the purpose of depositing all moneys collected for taxes, both real estate and personal. The foregoing motion was seconded by Councilman John Whitehead and a roll call vote was taken with the following result: YEAS: Harvey Jahn, William Taylor, John Whitehead, Harry S Wolfe, Raymond E Grimm and Wilson W Edgar NAYS. None The President declared the foregoing resolution passed Page 202 Councilman Wilson 51 Edgar made a report on behalf of the Insurance i Committee Councilman Harvey Jahn made a motion that the following resolution be adopted. /4 0264 RESOLVED, that the report of the Insurance Committee be and hereby is approved as submitted, and it is FURTHER RESOLVED, that the following insurance writers be paid their proportionate share of the commissions . None The President declared the foregoing resolution passed The Council was advised of Dallas Hay's daaation of 500 feet of fire hose to the City Councilman John Whitehead made a motion that the following resolution be adopted: 0267 RESOLVED, that the offer of Mr Dallas Hay in donating 500 feet of fire hose to the City of Livonia be and hereby is accepted on the terms and conditions set forth in letter dated November 27, 1950 The foregoing motion was seconded by Councilman Harvey Jahn and a roll call vote was taken with the following result: YEAS. The President declared the foregoing resolution passed Petitions No. 19 and 20 for change of zoning classification were read and considered On motion of Councilman Raymond E Grimm, seconded by Councilman Harvey Jahn and unanimously carried by the affirmative vote of all of the Councilmen named as present in the roll call of this meeting, it was : A-01 RESOLVED, that Petitions No 19 of Lowrie Lumber Co. and 20 of Kenneth ri White, et al for change of zoning classification be and hereby are referred to the City Planning Commission for its report and recommendations The bill of the Civil Service Commission was presented to the Council and Councilman Wilson W Edgar made a motion that the following resolution be adopted: /9 0267 RESOLVED, that the following bills be and hereby are approved and payment thereof ordered to be made by the City Treasurer: Page 204 i harry C Burton, advanced expenditure of $25 24 LaVerne D Theisen, advance expenditure of $10 55 The foregoing motion was seconded by Councilman Willinm Taylor and a roll call vote vies taken with the following result YEAS: Hervey John, Williem Taylor, John Whitehead, Harry S Wolfe, Raymond E Grimm end Wilson Edgar NAYS None The President declered the foregoing resolution was passed The Council then commenced a study of e proposed traffic ordinance Councilman Raymond H Grimm introduced the following ordinance: Page 205 NO 21 III AN ORDINANCE REGULATING TRAFFIC AND THE USE AND OPERATION OF VEHICLES UPON THE PUBLIC STREETS AND THOROUGHFARES OF THE CITY OF LIVONIA, PROVIDING FOR THE DISPOSAL OF ABAN— DONED VEHICLES, PROVIDING A PENALTY FOR VIOLATION OF THIS ORDINANCE AND REPEALING ALL OTHER ORDINANCES AND SECTIONS CF ORDINANCES IN CONFLICT HEREWITH THE CITY OF LIVONIA ORDAINS• CHAPTER 1 0 TITLE AND DEFINITIONS sECTICN 1 1 SHORT TITLE This ordinance may be known and cited as the Traffic Ordinance SECTION 1 2 DEFINITIONS OF "WORDS AND PHRASES The following words and phrases when used in this ordinance shall, for the purpose of this ordinance, have the meanings respectively ascribed to them in this section, except in those cases where the context clearly indicctes a different meaning "ALLEY" Any dedicated public way providing secondary means of ingress or egress from a property "AUTHORIZED EMERGENCY VEHICLE" Vehicles of the fire department, police vehicles, and such ambulances and emergency vehicles of municipal departments, public service corporations, hospitals, and undertakers as are designated or authorized by the chief of the police department "BICYCLES" Every device propelled by hur.an power upon which any person may ride, having two tandem wheels either of which is over 20 inches in diameter, and including any device generally recognized as a bicycle; though equipped with two front or two rear wheels "BUSINESS DISTRICT" The territory contiguous to and including a roadway when within six hundred (600) feet along such roadway there are buildings in use for business or industrial purposes, including but not limited to hotels, banks, or office buildings, railroad stations, and public buildings which occupy at least three hundred (300) feet of frontage on one side or three hundred (300) feet collectively on both sides of the roadway "CROSS—WALK" (a) That part of a roadway At an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs, or in the absence of curbs from the edges to the traversable roadway (b) Any portion of a roadway at an intersecti' n or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface Page 206 "('URB LOADING ZONE" A space adjacent to a curb for the exclusive use of vehicles during the loading or unloading of passengers or materials "DRIVER" Every person who drives or is in actual physical control of a vehic "FIRE ROUTE" Any street so designated by the traffic commission "INTERSECTION" (a) The area embraced within the prolongation or connection of the lateral curb lines, or if none, then the lateral boundary lines of the roadways of two highways which join one another at or approximately at right angles, or the area within which vehicles traveling upon different highways joining at any other angle may come in conflict (h) Where a highway includes two (2) roadways thirty (30) feet or more apart, then every crossing of each roadway of such divided highway by an inter- secting highway shall be regarded as a separate intersection. In the event such intersecting highway also includes twc roadways thirty (30) feet or more apart, then every crossing of the two (2) roadways of such highways shall be regarded as a separate intersection "LANED ROADWAY" A roadway which is divided into two or more clearly marked lanes for vehicular traffic MOTORCYCLE" Every motor vehicle having a saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground, but excluding a tractor "MOTOR VEHICLE" Every vehicle which is self-propelled, and every vehicle which is propelled by electric power obtained from overhead trolley wires, except such vehicles which are operated upon stationary rails "OFFICIAL TRAFFIC-CONTROL DEVICES" All signs, signals, markings, and devices not inconsistent with this ordinance, placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning, or guiding traffic "OFFICIAL TI&:E STANDARD" `lhenever certain hours are named herein they shall mean Eastern Standard Time, or such other standard time as may be in current use in the city "OPERATOR" Every individual who shall operate a vehicle as the owner thereof, or es the agent, employee or permittee of the owner, or is in actual physical control of a vehicle "PARK" When prohibited means the standing of a vehicle, whether occupied or not, otherwise then temporarily for the purpose of and while actually engaged in loading or unloading "PEDESTRIAN" Any person afoot "PERSON" Every natural person, firm, corporation, association or co- partnership Page 207 "POLICE OFFICER" Every officer of the municipal police department or any officer authorized to direct or regulate traffic or to make arrests for vio- lations of traff,c regulations "PRIVATE ROAD OR DRIVEWAY" Every way or place in private ownership and used for vehicular travel by the owner and those having express or implied per- mission from the owner, but not by other persons "RAILROAD" A carrier of persons or property upon cars other than street cars, operated upon stationary rails "RAILROAD TRAIN" A steam engine, electric or other motor, with or with- out cars coupled thereto, operated upon rails, but does not include street cars "RESIDENCE DISTRICT" The territory contiguous to and including a high- way not comprising a business district when the property on such highway for a distance of three hundred (300) feet or more is in the main improved with dwellings or dwellings and buildings in use for business "RIGHT-OF-WAY" The privilege of the immediate use of the roadway. "ROADWAY" That portion of a street or highway improved, designed, or ordinarily used for vehicular travel In the event a highway includes two or more separate roadways the term "roadway" as used herein shall refer to any such roadway separately but not to both or all such roadways collectively "SAFETY ZONE" The area or space officially set apart within a roadway for the exclusive use of pedestrians and which is protected or is so marked or in- dicated by adequate signs as to be plainly visible at all times while set apart as a safety zone "SIDEWALK" That portion of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines intended for the use of pedestrians "STANDING" The stopping of a passenger vehicle upon a street, for more than three (3) minutes with an operator in the driver's seat, and the stopping of a commercial vehicle for the purpose of loading or unloading of merchandise or materials and then only for a reasonable length of time actually required to effect such loading or unloading, and the operator is not required to remain in the driver's seat "STOP" When required means complete cessation of movement "STOPPING" The stopping of a vehicle to load or unload passengers for a period not to exceed three (3) minutes and the operator remaining in the driver's seat Where prohibited, no vehicle shall stop except to obey traffic control devices or a police officer's directions "STREET OR HIGHTAY" The entire width between the boundary lines of every way publicly maintained when any cart thereof is open to the use of the public for purposes of vehiculor travel Page 208 "THROUGH HIGHAY" Every street or highway or portion thereof at the entrances to which vehicular traffic from intersecting streets or highways is re— quired by law to stop before entering or crossing the same and when stop signs are a Iii erected as provided in this ordinance. "TRAFFIC" Pedestrians, ridden or herded animals, vehicles, and other conveyances either singly or together while using any street for purposes of travel "TRAFFIC—CONTROL SIGNAL" Any device, whether manually, electrically, or mechanically operated, by which traffic is alternately directed to stop and to pro— ceed "VELICLE" Every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power or used exclusively upon stationary rails and every vehicle which is propelled by electric power obtained from overhead trolley wires SECTION 1 3 ADDITIONAL DEFINITIONS Whenever any words and phrases used herein are not defined herein but are defined in the State laws regulating the operations of vehicles, any such definition therein shall be deemed to apply to such words and phrases used herein CHAPTER 2 0 TRAFFIC ADiINISTRATION SECTION 2 1 CREATION There may be established, with the consent and approval of the city council and traffic commission, in the police department of the city, a traffic division to be under the control of a police officer appointed by and directly responsible to the chief of the police department Until such traffic division is established, the chief of police shall be in direct charge of all traffic matters under the direction of the traffic commission Until such time that a traffic division is created, the police department and the members thereof shall have all of the powers, authority, du+ies and responsibilities given to the traffic division by the provisions of this ordinance SECTION 2 2 DUTIES OF TRAFFIC DIVISION It shall be the duty of the traffic division, with such aid as may be rendered by other members of the police department, to enforce the street traffic regulations of the city and all of the state vehicle laws applicable to street traffic in the city, to make arrests for traffic violations, to investigate accidents and to cooperate with other officers of the city in the administration of the tra'fic laws and in developing ways and means to improve traffic conditions, and to carry out those duties specially imposed upon said division by this ordinance, and the traffic ordinances of this city SECTION 2 3 RECORDS OF TRAFFIC JIuLATIONS (a) The police department or the traffic division thereof shall keep a record of all violations of the traffic regulations of the city or of the State vehicle laws of which any person has been charged, together with a record of the final disposition of all such alleged offenses Such record shall be so maintained as to show all types of violations and the total of each Said record shall accumulate during Pt least a five (5) year period, and from that time on the record shall be maintained complete for at least the most recent five (5) year period IL (b) All forms for records of violations end notices of violations shall be serially numbered For each month and year a written record shall be kept available to the public showing the disposal of all such forms Page 209 (c) All such records and reports shall be public records SECTION 2 4 TRAFFIC DIVISION TO INVESTIGATE ACCIDENTS It shall be the duty of the traffic division, assisted by other police officers of the department, to investigate traffic accidents, to arrest and to assist in the prosecution of those persons charged with violations of law causing or contributing to such accidents. SECTION 2 5 TRAFFIC ACCIDENT STUDIES Whenever the accidents at any particular location become numerous the traffic division shall cooperate with the traffic commission in conducting studies of such accidents and determining remedial measures SECTION 2 6 TRAFFIC ACCIDENT REPORTS (e) The traffic division shall maintain a suitable system of filing traffic accidents reports Accident reports shall be cross—indexed alphabetically by location (b) The traffic division shall receive and properly file all accident reports made to it under State law or under any traffic regulation of the city, but all such accident reports made by drivers shall be for the confidential use of the police department end the traffic commission, and no such report shall be admissible in any civil or criminal proceeding other then upon request of any person making such report or upon request of the court having jurisdiction to prove a compliance with the law requiring the making of any such report. SECTION 2 7 DRIVEiS' FILES TO BE IdaINTAINED (a) The police department or the traffic division thereof shall maintain a suitable record of all traffic accidents, warnings, arrests, convictions, and complaints reported for each driver, which shall be filed alphabetically under the name of the driver concerned. (b) Said division shall study the cases of all the drivers charged with frequent or serious violations of the traffic laws or involved in frequent traffic accidents or any serious accident, and shall attempt to discover the reasons therefor, and shell take whatever steps are lawful and reasonable to prevent the same or to have the licenses of such persons suspended or revoked (c) Such records shall accumulate during at least a five (5) year period and from that time on such records shall be maintained complete for at least the most recent five (5) year period. SECTION 2 8 TRAFFIC DIVISION TO SUBMIT TRAFFIC—SAFETY REPORT The traffic division shell annually prepare a traffic report which shall be filed with the council Such report shall contain information on traffic matters in the city as follows• 1 The number of traffic accidents, the number of persons killed, the number of persons injured, end other pertinent traffic accident data; 2 The number of traffic accidents investigated and other pertinent data on the safety activities of the police, 3 The plans and recommendations of the division for future traffic safety activities Page 210 SECTION 2 9 TRAFFIC DIVISION TO DESIGNATE METHOD OF IDENTIFYING FUNERAL PROCESSIONS The traffic division shall designate a type of pennant or other identifying insignia to be displayed upon, or other method to be employed to identify, the vehicles in funeral processions SECTION 2 10 CITY TRAFFIC ENGINEER (a) The office of city traffic engineer is hereby established The city engineer shall serve as city tra"fic engineer in addition to his other functiLns, and shell exercise the powers and luties with respect to traffic as provided in this ordinance. (b) It shall be the general duty of the city engineer to determine the installation and proper timing and maintenance of traffic-control devices, to conduct engineering analyses of traffic accidents and to devise remedial measures, to conduct engineering investigation of traffic conditions and to cooperate with other city officials in the development of ways and means to improve traffic conditions, and to carry out the additional powers and duties imposed by ordinances of this city. SECTION 2 11 EMERGENCY AND EX,'ERIMENTAL REGULATIONS (a) The chief of police by and with the approval of the traffic commission is hereby empowered to make regulations necessary to make effective the provisions of the traffic ordinances of this city and to make and enforce temporary or experimental regu-ations to cover emergencies or special conditions No such temporary or experimental regulation shall remain in effect for more than 90 days 111 (b) The city traffic engineer may test traffic-control devices under actual conditions of traffic SECTICN 2 12 TRAFFIC COMMISSION, ITS POWERS AND DUTIES (a) There is hereby established a traffic commission to serve without compensation, consisting of the city traffic engineer, the chief of police or in his discretion as his representative the chief of the traffic division, the chairman o' the city council traffic committee, the city attorney and such number of other city officers end representatives of unofficial bodies as may be deter- mined and appointed by the mayor The chairman of the commission shall be appointed by the mayor and may be removed by him. (b) It shall be the duty of the traffic commission, and to this end it shall have the authority within the limits of the funds at its disposal, to coordinate traffic activities, to carry on educational activities in traffic matters, to supervise the preparation and publication of traffic reports, to receive complaints having to do with traffic matters, and to recommend to the legislative body of this city and to the city traffic engineer, the chief of the traffic division, and other city officials ways and means for improving traffic conditions and the administration and enforcement of traffic regulations (c) The traffic commission shall have all of the powers and duties conferred upon it by this ordinance or any ordinance of the City of Livonia CHAPTER 3 0 ENFORCEMENT AND OBEDIENCE TO TRAFFIC REGULATIONS SECTION 3 1 AUTHORITY OF POLICE AND FIRE DEPARTMENT OFFICIALS (a) It shall be the duty of the officers of the police department or such officers as are assigned by the chief of police +o enforce all street traffic laws of this city and all of the State vehicle laws applicable to street traffic in this city Page 211 (b) Officers of the police department or such officers as Pre assigned by the chief of police re hereby authorized to direct All traffic by voice, hand, or signal in conformance with traffic laws, provided that, in the event of a fire or other emergency or to expedite traffic or to safeguard pedestrians, officers of the police department may direct traffic es conditions may require notwithstanding the provisions of the traffic laws (c) Officers of the fire department, when at the scene of a fire, may direct or assist the oolice in directing traffic thereat or in the immediate vicinity SECTIC:N 3 2 OBEDIENCE TO POLICE AND FIRE DEPARTMENT OFFICIALS No person shall fail or refuse to comply with any lawful order or direction of a. police or fire department official or any member of such department SECTION 3.3 PERSONS PROPELLING PUSH CARTS OR RIDING ANIMALS TO OBEY TRAFFIC REGULATIONS Every person propelling any push cart or riding an animal upon a roadway, and every person driving any animal—drawn vehicle, shall be subject to the provisions of this ordinance applicable to the driver of any vehicle, except those provisions of this ordinance which by their very nature can have no application Every animal when carrying a rider or riders shall be equipped with the same lights or reflectors as is required for bicycles in subdivision (a) of section 7 21 of this ordinance SECTION 3 4 USE OF COASTERS, ROLLER SKATES, AND SIMILAR DEVICES RESTRICTED No person upon roller skates, or riding in or by means of any coaster, toy vehicle, or similar device shall go upon any roadway except while crossing a street on a cross walk and when so crossing such person shall be granted all the rights and shall be subject to all the duties applicable to pedestrians This section shall not apply upon any street while set aside as a play street as authorized by resolution of the council SECTION 3 5 PUBLIC EMPLOYEES TO OBEY TRAFFIC REGULATIONS The provisions of this ordinance shall apply to the driver of any vehicle owned by or used in the service of the United States Government, this State, county or city, and it shall be unlawful for any said driver to violate any of the provisions of this ordinance except as otherwise permitted in this ordinance or by State statute SECTION 3 6 EXEMPTIONS TO AUTHORIZED EMERGENCY VEHICLES (a) The provisions of this ordinance regulating the oper?tion, parking, and standing of vehicles shall apply to authorized emergency vehicles as defined in this ordinance except as follows. A driver when operating any such vehicle in an emergency, except when otherwise directed by a police officer, may 1 Pork or stand notwithstanding the provisions of this ordinance 2 The driver of any authorized emergency vehicle when responding to an emergency call upon approaching a red or stop signal or any stop signs shall give an audible signal by bell, siren or exhaust whistle and shall slow down as necessary for safety but may proceed cautiously past such red or stop sign or signal At other times drivers of authorized emergency vehicles shall stop in obedience to a stop sign or signal. This provision shall not operate to relieve the driver of en emergency vehicle from the duty to drive with due regard for the safety of all persons using the highway Page 2.12 3 Operate his vehicle at a speed consistent with all conditions specified by state la , as constituting prudent speed plus the audible signal given to warn of the nature of his vehicle 4 Disregard regulations governing direction of movement or turning in specified directions so long as he gives audible signal customarily used on emergency vehicles and does not endanger life or property (b) Those exemptions hereinbefore granted in reference to the movement of an authorized emergency vehicle shall a'nly only when the driver of said vehicle sounds such audible signal customarily used on emergency vehicles as may be reasonably necessary, and the vehicle displays a lighted red lamp visible from the front as a warning to others (c) The foregoing exemptions shallnot, however protect the driver of any such vehicle from the consequences of his reckless disregard of the safety of others, nor shall the driver of any authorized emergency vehicle assume any special privileges under this section except when such vehicle is operated in response to an emergency call or in the immediate pursuit of an actual or suspected violator of the law SECTION 3 7 OPERATIONS OF VEHICLES ON APPROACH OF AUTHORIZED EWERGENCY VEHICLES Upon the immediate approach of an authorized emergency vehicle equipped with at least one (1) lighted lamp exhibiting red light visible under normal atmospheric conditions from a distance of five hundred (500) feet to the front of such vehicle and when the driver is giving audible signals customarily used on emergency vehicles, the driver of every other vehicle shall yield the right-of-way and shall immediately drive to a position parallel to, and as close as possible to the right-hand edge or curb of the roadway, clear of any intersection, and shall stop and remain in such position until the authorized emergency vehicle has passed, except when otherwise directed by a police officer This section shall not operate to relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons using the highway SECTION 3 8 DRIVERS TO REPORT ACCIDENTS AND RENDER ASSISTANCE TO INJURED (a) The driver of any vehicle involved in any accident resulting in injury or death to any person or damage to property shall stop such vehicle at the scene of such accident and shall give his name and address and the registration number of his vehicle, also the name and address of the owner and exhibit his operator's or chauffeur's license to the person struck and the driver or occupant of any vehicle or vehicles involved, and shall render to any person injured in such accident reasonable assistance, including the carrying or the making of arrangements for the carrying of such person to a physician, surgeon or hospital for medical or surgical treatment, if it is apparent that such treatment is necessary or if such carrying is requested by the injured person (b) The driver of any vehicle which collides with any vehicle which is unattended shall immediately stop and shall then and there either locate and notify the operator or owner of such vehicle of the name and address of the driver and owner of the vehicle striking the unattended vehicle or shall leave in a conspicuous place in the vehicle struck a written notice giving name and address of the driver and of the owner of the vehicle doing the striking (c) The driver of any vehicle involved in an accident resulting only in damage of fixtures legally on or adjacent to a highway shall take reasonable steps to notify the owner of such property of such fact, and of his name and address and Page 213 of the registration number of the vehicle he is driving and shall upon request exhibit his operator's or chauffeur's license, and shall make a report of such accident when and as recuired in sub-section (d) hereof. (d) The driver of a vehicle involved in an accident resulting in injury to or death to any person or in any property damage whatsoever shall forthwith report such accident to a police officer or to the police department Such reports shall not be available for use in any court action but shall be for the purpose of furnishing statistical information as to the number and causes of accidents CHAPTER 4 0 TRAFFIC-CONTROL DEVICES SECTION 4 1 AUTHORITY TO IN 'TALL TRAFFIC-CONTROL DEVICES The traffic commission shall, of its own order or by direction of the city council, place and maintain traffic-control signs, signals, and devices when and as authorized by the council SECTION 4 2 MANUAL AND SPECIF'ICA?'IONS FOR TRAFFIC-CONTROL DEVICES All traffic-control signs, signals, and devices shall conform to the manual and specifications approved by the council All signs and signals required hereunder for a particular purpose shell so far as practicable be uniform as to type and location throughout the city SECTION 4 3 OBEDIENCE TO OFFICIAL TRAFFIC-CONTROL DEVICES Except as otherwise provided in this ordinance, the driver of any vehicle shall obey the instructions of any official traf"ic-cortrol device applicable thereto which is placed in accordance with the traffic regulations of the city, unless otherwise directed by a police of'icer SECTION 4 4 WHEN TRAFFIC DEVICES REQUIRED FOR ENFORCEMENT PURPOSES No provision of this ordinance for which signs are required shall be enforced against an alleged violator if, at the time and place of the alleged violation, an official sign is not in proper position and sufficiently legible to be seen by an ordinarily observant person Whenever a particular section does not state that signs are required, such section shall be efaective even though no signs are erected or in place SECTION 4 5 TRAFFIC-CONTROL SIGNAL LEGEND 'Whenever traffic is con- trolled by traffic-control signals exhibiting the words "Go", "Caution" or "Stop", or exhibiting difference colored lights successively one at a time, or with arrows, the following colors only shall be used and said terms and lights shall indicate and apply to drivers of vehicles and pedestrians as follows. (a) "Green" alone or "Go": 1 Vehicular traffic facing the signal, may proceed straight through or turn right or left unless a sign at such place prohibits either such turn; Provided, that vehicular traffic including vehicles turning right or left, shall yield the right-of-way to other vehicles and to pedestrians lawfully within the intersection or an adjacent crosswalk at the time such signal is exhibited; 2 Pedestrians facing the signal may proceed across the roadway within any marked or unmarked crosswalk, 3 "Yellow" or "Caution" when shown together with or alone following the "green" or "go" signal. 1 Page 214 (1) Vehicular traffic f. cing the signal is thereby, warned that the red or "Stop" signal will be exhibited immediately thereafter and vehicular traffic shall not enter the intersection when the red or "Stop" signal is exhibited and vehicular traffic facing the yellow signal shall stop until the green signal again shows before entering the nearest crosswalk et the intersection; Provided, however, that if such stop cannot be made in safety, a vehicle may be driven cautiously through the intersection, (2) Pedestrians facing such signal are thereby advised that there is insufficient time to cross the roadway, and any pedestrian then starting to cross shall yield the right-of-way to all vehicles, (c) "Red" alone or "Stop"- (1) Vehicular traffic facing the signal shall stop before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection and shall remain standing until green or "Go" is shown alone. (2) No pedestrian facing such signal shall enter the roadway unless he can do so safely and without interfering with any vehicular traffic. (d) "Red" with green arrow: (a.) Vehicular traffic facing sucr signal may cautiously enter the inter- section only to make the movement indicted b- such arrow but shall yield the right- of-way to pedestrians lawfully within a crosswalk and to other traffic lawfully using the intersection, (2) No pedestrian facing such signal shall enter the roadway unless he can do so safely end without interfering with any vehicular traffic, (e) "Red" with red arrow. (1) Vehicular traffic facing such signal may cautiously enter the inter- section only to make the movement indicated by such arrow, after coming to a com- plete stop, but shall yield the right-of-way to pedestrians lawfully within a. crosswalk and to other traffic lawfully using the intersection (2) No pedestrian facing such signal shall enter the roadway unless he can do so safely and without interfering with any vehicular traffic; (f) In the event an official traffic-control signal is erected and main- tained at a place, other than an intersection, the provisions of this section shall be applicable, except as to those provisions which, b:, their nature, can have no application Any stop required shall be made at a sign or marking on the pavement indicating where the stop shall be made, but, in the absence of any such sign or marking, the stop shall be made at the signal SECTION 4 6 PEDESTRIAN WPLK-AND-WAIm SIGN"LS Whenever special pedestrian-control signals exhibiting the words "Walk" or "Wait" are in place such signals shall indicate as follows: WALK Pedestrians facing such signal may proceed across the roadway in the direction of the signal end shall be given the right-of-way by the drivers of all vehicles; Page 215 WAIT No pedestrians shall start to corss the roadway in the direction of such signal, but any pedestrian who has partially completed his crossing on the lij walk signal shall proceed to P sidewalk or safety zone while the "wait" signal is showing SECTION 4 7 FLASHING SIGNALS Whenever flashing red or yellow signals are used they shall require obedience by vehicular traffic as follows. 1 FLASHING RED (ST0° SIGNALS) When a red lens is elluminated with intermittent flashes, drivers of vehicles shall stop before entering the nearest crosswalk at an intersection or at a limit line when marked, or, if there be no crosswalk or marking, then before entering the intersection, and the right to proceed shall be subject to the rules applicable after making a stop at a stop sign; a FLASHING YELLOW( CAUTION SIGNAL) When a yellow lens is illuminated with intermittent flashes, drivers of vehicles may proceed through the intersection or past such signal, without stooping, only with caution SECTION 4 8 DISPLAY OF UNAUTHORIZED SIGNS, SIGNALS, OR MARKINGS (a) No person shall place, maintain, or display upon or in view of any street or highway any unauthorized sign, signal, marking, or device which purports to be or is en imitation of or resembles an official traffic-control device or railroad sign or signal, or which attempts to direct the movement of traffic, or which hides from view or interferes with the effectiveness of any official traffic-control device or any rrilroad sign or signal, and no person shall place or maintain nor shall any public authority permit upon any street or highway any traffic sign or signal bearing thereon any commercial advertising This shall not be deemed to prohibit the erection uoon private property adjacent to highways of signs, giving useful directional information, of a type that cannot be mistaken for official signs (b) Every such prohibited sign, signal, or marking is hereby declared to be a public nuisance and the authority having jurisdiction over the highway is here- by empowered to remove the same or cause it to be removed without notice SECTION 4 9 INTERFERENCE WITH OFFICIAL TRAFFIC-CONTROL DEVICES OR RAILROAD SIGNS CR SIGNALS. No person shall without lawful authority attempt to or in fact alter, deface, injure, knock down, or remove any official traffic-ccntrol sign or device, or any railroad sign or signal, or any inscriotion, shield, or insignia thereon, or any other part thereof SECTION 4 10 PLAY STREETS The council may declare any street or part thereof a play street and order appropriate signs or devices placed in the roadway to indicate the same Whenever authorized signs are erected indicating any street or part thereof as a play street, no person shall drive a vehicle upon any such street or portion thereof except drivers of vehicles having business or whose residences are within such closed area, and each driver shall exercise the greatest care in driving upon any such street or portion thereof SECTION 4 11 '"RAFFIC COIv11►,ISSION TO DESIGNATE CROSSWALKS, ESTABLISH SAFETY ZONES, MARK TRAFFIC LANES AND PARKING LIIviITS The traffic commission is hereby authorized: Page 216 1. To designate and maintain, by appropriate devices, marks or lines upon the surface of the roadway, crosswalks at intersections where, in its opinion, there is particular danger to pedestrians crossing the roadway, and et such other places as it may deem necessary or shall be directed so to do by the city council 2 To establish safety zones of such kind and character and at such places as it may deem necessary for the protection of pedestrians or shall be directed so to do by the city council 3 Designate the streets or parts of streets upon which there shall be no parking of vehicles or upon which there shall be parking for a limited time 4 To mark lanes for traffic on street pavements at such places as it may deem advisable, consistent with the traffic regulations of the city 5 To erert signs and designate stop streets as the city council may ordain. CHAPTER 5.0 DRIVING RULES AND REGULATIONS SECTION 5 1 SPEED REGUTATIONS (a) Each person driving a vehicle on a highway shall drive the same at a careful: and prudent speed not greater nor less than is reasonable and proper, having due regard to the traffic, surface, and width of the highway and any other conditions then existing and no person shall drive any vehicle on any highway at a speed greeter than will permit him to bring it to a stop within the assured clear 111 distance ahead (b) Subject to the provisions of subdivision (a) of this section, and excepting in those instances where a lower speed is specified in this ordinance, it shall be prima facie lawful for a driver to drive at a speed not exceeding the following, but in any case when such speed would be unsafe it shall not be lawful. Twenty-five (25) miles per hour on all streets in a business district as defined herein, Twenty-five (25) miles per hour in a residence district as defined herein and in public parks, unless such parks are posted for a lower speed by order of the traffic commission with the approval of the council. Forty (40) miles per hour The West one-half (-k-) of Inkster Road from Joy Road to :'ive I_le Road Forty (40) miles per hour Middlebelt Road from Joy Road to Eight Mile Rd Forty (40) miles per hour Farmington Road from Joy Road to Eight Mile Rd Forty (40) miles per hour Wayne Road from Joy Road to Plymouth Road Forth (40) miles per hour Merriman Road from Seven Mile Road to Joy Road Forty (40) miles per hour (d) On all State and Feder 1 trunk line highways within the city it shall be prima facie lawful for a driver of a vehicle to drive at a speed not exceeding that which may be determined from time to time by the Michigan State Highway Commissioner under provisions of Act 119 of the P A 1933, or any amend- ment thereof, Provided, however, that on any and all State and Federal trunk line highways or parts thereof within the city on which no speed limitations have been determined by said State Highway Commissioner or on which said Commissioner's determinations may have been revoked or suspended, the ordinary speed limits as set forth in the foregoing subdivisions o`' this section shall apply (e) It shall be prima facie unlawful for any person to exceed any of the foregoing speed limitations SECTION 5 2 ONE-WAY STREETS AND ALLEYS• THROUGH TRAFFIC STREE'T'S, STOP STREETS AND STOP CORNERS (a) All streets, when so designated by the traffic commission, of its own order or by 31.rection of the city council, and when marked by appropriate signs or markings, shall constitute one-way streets and one-way alleys Page 21$ (b) Upon those streets or parts of streets and in those alleys, desig- nated as one-way streets or alleys, vehicular traffic shall move only in the indi- cated direction when signs indicating the direction of traffic are erected and maintained at every intersecticn where movement in the opposite direction is • • prohibited (c) All vehicles approaching streets designated as through traffic streets from any intersection street, alley, driveway or other approach shall be stopped before entering upon or crossing any such through traffic street, same to be stopped before reaching the nearest crosswalk or pedestrian right-of-way except when otherwise directed by an officer of the police department or traffic signal • (d) At all designated stop corners and stop streets, when stop signs are erected, every driver of a vehicle shall stop such vehicle before entering the intersection except when directed to proceed by a police officer or traffic control signal (e) The driver of a vehicle entering through streets, as designated in accordance with this section, shall yield the right-of-way to all vehicles ap- proaching on such highways or streets • SECTION 5 3 EMERGING FROM ALLEY OR PRIVATE DRIVEWAY The driver of a vehicle emerging from an alley, driveway, or building shall sound his horn and stop such vehicle immediately prior to driving onto a sidewalk, or onto the side- walk area extended across any highway, yielding the right-of-way to any pedestrian es may be necessary to avoid collision, and upon entering the roadway shall yield the right-of-way to ell vehicles approaching on said roadway SECTION 5 4 STOP WHEN TRAFFIC OBSTRUCTED No driver shall enter an intersection or marked crosswalk unless there is sufficient space on the other side of the intersection or crosswalk to accommodate the vehicle he is operating without obstructing the passage of other vehicles or pedestrians, notwithstanding any traffic control signal indication to proceed SECTION 5 5 OBEDIENCE TO SIGNAL INDICATING APPROACH OF RAILROAD TRAIN (a) Whenever any person driving a vehicle approaches a railroad grade crossing under any of the circumstances stated in this section, the driver of such vehicle shall stop within fifty (50) feet but not less than fifteen (15) feet from the nearest rail of such railroad, and shall not proceed until he can do so safely The foregoing requirements shall apply when. 1. n clearly visible electric or mechanical signal device gives warning of the immediate approach of a railroad train, 2 A crossing gate is lowered or when a human flagman gives or con- tinues to give a signal of the approach or passage of a railroad train; 3 A railroad train approaching within fifteen hundred (1500) feet i of the highway crossing emits a signal audible from such distance and such railroad train, by reason of its speed or nearness to such crossing, is an immediate hazard, 4 approaching railroad train is plainly visible and is in hazardous proximity to such crossing (b) No such person shall drive any vehicle through, around, or under any crossing gate or barrier at a railroad grade crossing while such gate or barrier is closed or is being opened or closed Page 219 SECTION 5 6 REQUIRED POSITION AND LIETHOD OF TURNING AT INTERSECTIONS The driver of a vehicle intending to turn at an intersection shall do so as follows. (a) Both the approach for a right turn and a right turn shall be made as close as practical to the right-hand curb or edge of the roadway, (b) approach for a left turn shall be made in that portion of the right half of the roadway nearest the center line thereof and, after entering the inter- section, the left turn shall be made so as to leave the intersection to the right of the center line of the roadway being entered. (c) Approach for a left turn from a two-way street into a one-way street shall be made in that portion of the right half of the roadway nearest the center line thereof and by passing to the right of such center line where it enters the intersection, (d) A left turn from a one-way street into a two-way street shall be made by passing to the right of the center line of the street being entered upon leaving the intersection, (e) Where both streets or roadways are one way, both the approach for a left turn end a left turn shall be made as close as practicable to the left-hand curb or edge of the roadway SECTION 5 7 AUTHORITY TO PLACE AND OBEDIENCE TO TURNING MARKERS (a) The traffic commission is authorized to place painted strips, markers, buttons, or signs within or adjacent to intersections indicating the course to be traveled by vehicles turning at such intersections, and such course to be traveled as so indicated may conform to or be other than es prescribed by law or this ordinance (b) When authorized painted strips, markers, buttons, or other indicators are placed within an intersection indicating the course to be traveled by vehicles turning thereat, no driver of a vehicle shall disobey the directions of such indicators SECTION 5 8 RESTRICTED TURN SIGNS AND OBEDIENCE THERETO The traffic commission, of its own order or by direction of the city council, is hereby authorized to determine those streets, parts of streets and intersections in which drivers of vehicles shall not make a right, left, or "U" turn, and shall cause proper signs to be erected or placed giving notice of such turning restrictions, The making of such turns may be prohibited between certain hours of any day and permitted at other hours, in which event the same shall be plainly indicated on the signs which are posted or placed setting forth for public notice the type of turn prohibited Whenever authorized signs are erected indicating that no right or left or "Ti" turn is permitted, no driver of a vehicle shall disobey the direction of any such sign SECTION 5 9 LIMITATIONS ON TURNING AROUND The driver of any vehicle shell not turn such vehicle so as to proceed in the opposite direction upon any street where a "U" turn is prohibited• nor upon any other street, unless such movement can be made in safety end without interfering with other traffic. ILISECTION 5.10 DRIVING ON RIGHT SIDE OF ROADWAY Upon all roadways of sufficient width, except upon one-way streets, the driver of a vehicle shall drive the same es closely as possible to the right hand edge or curb of such roadway unless it is impracticable to travel on such side overtaking and passing another vehicle pt Page 220 SECTION 5 11 FOLLOWING AND OVERTAKING A VEHICLE (a) The driver of any vehicle overtaking another vehicle proceeding lit in the same direction shall pass at a safe distance to the left thereof and shall not again travel to the right side of the roadway until safely clear of overtaken vehicle (b) The driver of a vehicle shall not drive to the left side of center line of a street in overtaking and passing another vehicle proceeding in the same direction, unless such left side is clearly visible and is free of oncoming traffic for a sufficient distance ahead to permit such overtaking and passing to be made in safety (c) The driver of a vehicle shall not overtake and pass another vehicle proceeding _n the same direction upon a grade or upon a curve on a. street unless the driving view along the highway is sufficient to insure safety (d) The driver of a vehicle upon a street about to be overtaken and passed by another vehicle approaching from the rear shall give way to the right in favor of the overtaking vehicle on a suitable and audible signal by the driver of the overtaking vehicle and shall not increase the speed of his vehicle until completely passed by the overtaking vehicle (e) The driver of e motor vehicle shall not follow another vehicle more closely than is reasonable and prudent having due regard for the speed of such vehicle and the traffic upon and condition of the street (f) Slowly moving or heavily laden vehicles shall not be driven abreast on any highway, but one must follow behind the other and keep es near to the right hand curb as practicable . SECTION 5 12 ?MEETING OF VEHICLES Drivers of vehicles proceeding in opposite directions shall pass each other to the right, each giving to the other at least one-half portion of the main traveled portion of the roadway as possible SECTION 5.13 DRIVING THROUGH OCCUPIED SAFETY ZONES UNLr ?FUL No person shall drive a vehicle upon or through a safety zone when said zone is occupied or about to be occupied by any person SECTION 5 14 RIGHT-CF-:"AY AT INTERSECTIONS (a) When vehicles approaching at approximately the same time at an intersection o' a. street which marked as an extension of a Federal or State trunk-line highway and any other which is not e State or Federal trunk-line highway, the vehicle proceeding on the State of Federal trunk-line highway shall have the right-of-way. (b) When vehicles approach at approximately the same time at an inter- section of two (2) streets, neither of which are or both of which are State or Federal trunk-line highways, the vehicle approaching the driver's right shall have the right-of-way (c) Through traffic streets which are not State or Federal trunk-lines shall have the right-of-way over all other streets, alleys, and driveways, other than State or Federal trunk-line highways Page 221 (d) When vehicles approach at the same time at an intersection of two or more streets other than State or Federal trunk-lines which are through traffic streets, the vehicle approaching on the driver's right shall have the right-of-way (e) When the driver of a vehicle within an intersection intends to turn to the left, he shall yield the right-of-way to any vehicle approaching from the opposite direction which is within the intersection or so close thereto as to constitute an immediate hazard, but said driver, having so yielded and having given a signal when and as required by Section 5 29, may make such left turn and the drivers of all other vehicles approaching the intersection from said opposite direction shall yield the right-of-way to the vehicle making the left turn; Pro- vided, that at an intersection which a traffic signal is located, a driver intending to make a left turn shall permit vehicles bound straight through in the opposite direction which are awaiting a "go" signal to pass through the intersection before making the turn SECTION 5 15 RECKLESS DRIVING No person shall drive any vehicle or drive or ride any animal upon the street carelessly or heedlessly in wilful or wanton disregard of the rights or safety of others or without due caution and at a speed or in a manner so as to endanger or be liKely to endanger any person or property SECTIOd 5 16 DRIVING UNDER THE INFLUENCE OF LIQUOR OR NARCOTICS No person, who is an habitual user of narcotic drugs, barbitol, or any derivative of barbitol, and no person who is drunk or under the influence of intoxicating liquor or narcotic drugs, barbitol, or any derivative of barbitol, shall drive or be in actual physical control of any vehicle upon any street in the City of Livonia No person, being the owner of any vehicle or having such in charge or under his control, shell authorize or knowingly permit the same of be driven or operated upon any street within this city by any person who is an habitual user of narcotic drugs, barbitol, or any derivative of barbitol, or by any person who is drunk or under the influence of intoxicating liquor, barbitol, or a derivative of barbitol. SECTION 5 17 FOLLOWING FIRE APPARATUS PROHIBITED No person, other than one on official business in connection therewith, shall follow any fire apparatus traveling in response to a fire alarm, closer than five hundred (5C0) feet or drive into or park any vehicle within the block where fire apparatus has stopped in answer to a fire alarm SECTION 5 18 CROSSING FIRE HOSE No person shall drive any vehicle over any unprotected hose of a fire department when laid down on any street or private driveway, to be used et any fire or alarm of fire, without the consent of the fire department official in commend SECTION 5 19 FUNERAL OR OTHER PROCESSION No person shall drive any vehicle between the vehicles comprising a funeral or other authorized procession while they are in motion and when such vehicles are conspicuously designated as required in this section This provision shall not apply at intersections where traffic is controlled by traffic-control signals or police officers Each driver in a funeral or other procession shall drive as near to the right-hand edge of the roadway as practical, and shall follow the vehicle ahead as close as is practical 114 and safe A funeral composed of a procession of vehicles shall be identified as such by the display upon the outside of each vehicle of a pennant or other identifying insignia or by such other method as may be determined and designated by the traffic commission Page 222 SECTION 5 20 PERMITS FOR PARADES AND ?'ROCESSIONS No procession or parade containing two hundred (200) or more persons or fifty (50) or more vehicles, excepting the forces of the United States Army or Navy, the military forces of this State, and the forces of the police and fire departments, shall occupy, march, or proceed along any street except in accordance with a. permit issued by the city council and such other regulations as are set forth herein which may apply SECTION 5 21 VEHICLES SHALL NOT BE DRIVEN ON A SIDEWALK No person shall drive a vehicle within any sidewalk area except at a permanent or temporary driveway SECTION 5 22 LIMITATIONS ON BACKING No driver of a vehicle shall back the same, unless such movement can be made with reasonable safety and without inter- fering with other traffic SECTION 5 23 RIDING ON ZTORCYCLES No person, operating a motorcycle, shall ride other than upon the permanent and regular seat attached thereto or carry any other person, nor shall any other person ride upon such motorcycle, other than upon a firmly attached seat to the rear or side of the operator SECTION 5 24 CLINGING TO MOVING VEHICLES No person, riding upon any bicycle, motorcycle, coaster, sled, roller skates, or any toy vehicles shall attach the same, or himself, to any moving vehicle upon any roadway SECTION 5 25 OBSTRUCTION TO DRIVER'S VIEW OR DRIVING MEChANISM (a) No person shall drive any vehicle when such vehicle is so loaded or where there are in the front seat of such vehicle such number of persons as to obstruct the view of the driver to the front, or sides or interfere with the driver's control of the driving mechanism of the vehicle (b) No more than three (3) persons shall occupy the front or driver's seat of a motor vehicle and no person, adult or minor, nor any animal, shall be seated or carried in the lap of the driver, nor shall the driver be seated in the lap of a person occupying the front seat when the motor vehicle is in motion (c) No person in a vehicle shall ride in such n position as to interfere with the driver's view ahead or to the sides, or to interfere with the driver's control of the driving mechanism of the vehicle (d) Drivers shall have an unobstructed view to the rear of the vehicle by direct view or by mirror The windshield at all times, in front of the driver shall be kept clear of dirt, snow, and ice, or open, so that the driver's view is unobstructed No person shall drive any vehicle upon any roadway with any sign, poster, or other nontransparent material upon the front windshield, side-wings or the side or rear windows of such motor vehicle other than any certificate or other paper required or permitted to be displayed by law SECTION 5 26 GETTING OUT OF T'ARKED VEHICLES When a vehicle parks or comes to a stop parallel with the curb, so far as practicable, the driver or any other occupant thereof getting out of the vehicle shell do so through the door or doors on the right hand or curb side of the vehicle SECTION 5 27 NOISE AND SMOKE li (a) No person, in charge or control of any vehicle, shall make with such vehicle, or any device connected therewith, any noise so excessive as to annoy the public, or unnecessarily race his motor while running idle, or open the muffler on any vehicle, or permit such vehicle or any device thereon to emit any unnecessary quantity of smoke, obnoxious gases, or vapor Page 223 (b) No person shall use any sound amplifying device, recorded music, or radio in or from any vehicle on any street for the purpose of attracting the attention of persons to the sounds issuing therefrom, excepting in vehicles and by devices 111 officially used by governmental units in the exercise of the functions of such units; provided, however, that on written application the police chief may issue in writing permission to use amplifying devices, recorded music or radios in or from any vehicle, the discretion and determination of the police chief in each instance being hereby made subject to review by the council (c) No exhaust whistle, siren, or other warning device similar to those used by fire and police vehicles, and no cutouts, shall be used by any person on any vehicle on the public highway SECTION 5 28 PROJECTING ARTICLLS Vehicles of all kinds carrying any article which projects or extends beyond such vehicle for a distance of over two (2) feet from the body thereof shall, while on public streets or alleys, have a red cloth or some other red signaling device displayed or attached at or near the end of such article so projecting or extending, so as to give warning to others, and during the period of one (1) hour after sunset to one (1) hour before sunrise, a lighted lamp shall be displayed at or near the end thereof. SECTION 5 29 SIGNALS ON STARTING, STOPPING, OR TURNING (a) Before turning to the right or left to leave a street and before turning around or stopping thereon, or before mAterially varying the course in which the vehicle is proceeding, the driver of a vehicle shall give a timely warning signal to other drivers by extending the arm beyond and outside of the vehicle holding the arm in a horizontal position for sufficient time to advise approaching drivers of vehicles of his intention to change his course or stop, as the case may be, provided, however, that in lieu of such signal, signals may be given by any mechanical or electrical device which conveys an intelligible warning to another driver approaching from the rear In all cases, the driver of a vehicle to whom such signal has been given, as required in this section, shall bring and keep his vehicle under such control as to be able to avoid an accident resulting from any misunderstanding of such signals, and shall, in all cases, heed any such warning as shall have been given him (b) A standing vehicle, about to start, shall give moving vehicles the right-of-way and the operator thereof shall give a timely and visible warning signal by extending the arm as provided in the proceeding subsection before so starting SECTION 5 30 TOWING (n) No vehicle shall tow more than one (1) other vehicle nor more than two (2) trailers and the connection shall not be over sixteen (16) feet long and a red flag or other signal or cloth, not less than twelve (12) inches both in length and width, shall be fastened to the tow line so as to make it plainly discernible. Each vehicle shell separately display thereon the license required on the vehicle of the class to which it belongs (b) No vehicle, including a trailer or trailers attached, shall exceed 60 feet in :length; provided however, that a greater length may be permitted when the load consists of poles, structural iron, scenery, or other articles which, from their nature, cannot be shortened IL (e) All trailers shall track within six (6) inches of the preceding vehicle (d) Trailers shall be attached to the preceding vehicle by means of a suitable coupling Two safety chains, one on each side of the coupling, must also be used Both chains shall be attacned to the same part of the chassis as is the coupling Each chain shall be of sufficient strength to pull the trailer, or trailers, attached to it, when loaded to maximum capacity Page 224 SECTION 5 31 SCHOOL BUS, OVER'^AKING aND PASSING Notwithstanding the preceding provisions of this ordinance, it shell be anlawful for the driver of a vehicle to overtake end pass any school bus proceeding in the sane direction, which Ill bus has stopped for the purpose of receiving or discharging passengers The driver of a vehicle overtaking any school bus which has stopped for the purpose of receiving or discharging any passenger shall bring such vehicle to a full stop at least ten (10) feet in the rear of such school bus and then, after such receiving or discharging of passengers hos been completed and such bus is in motion, proceed with caution, provided, however, that at en intersection where traffic is controlled by en officer or a traffic stop-and-go signal, a vehicle need not be brought to a full stop before passing any such school bus, but may proceed post such school bus at a speed not greeter than ten (10) miles an hour end with due caution for the safety of passengers being received or discharged from such school bus It shall be unlawful for the driver of a vehicle to pass any school bus proceeding in a direction opposite to that of such vehicle, which bus has stopped for the purpose of receiving or discharging passengers, unless the speed of such vehicle et the time of such passing is reduced to not more than ten (10) miles per hour All school buses shall contain such signs on the back and front thereof as shall be approved by the chief of police SECTION 5 32 R! ILROAD GRADE CROSSING No person, owning or operating any train or cars shall cause or permit any train or cars to obstruct any street for more than five (5) minutes at any one (1) time After obstructing any crossing sufficient time shell be given for all waiting vehicular traffic to clear the crossing before the crossing is again obstructed SECTION 5 33 SIZE, ;YEIGHT AND LOAD RESTRICTIONS (a) It shall be unlawful for any person to drive or move or for the owner 111 to cause or knowingly permit to be driven or moved on any highway, street, or alley in the City of Livonia any vehicle or vehicles of a size, weight or load exceeding the limitations stated in the Statutes of the State of Liichigan, pertaining to such size, weight, or load (b) The chief of police, with respect to highways and streets under the jurisdiction of the City of Livonia, may in his discretion, upon application in writing and good cause being shown therefor, issue a special permit in writing authorizing the applicant to operate or remove a vehicle or combination of vehicles of a size or weight of vehicle or load exceeding the maximum specified in such Statutes of the State of Michigan or otherwise not in conformity with the provisions of such statutes, provided, however, that such permit shall be issued subject to the provisions of such statutes and in the manner provided therein (c) If the load carried by any truck or motor vehicle over the public streets of the city is of such nature that it is likely to fall from said truck during its operations over the streets in the city, then in that event all trucks end motor vehicles carrying said loads shall be covered with a substantial canvass or other suitable covering securely fastened over said load so as to prevent its falling from the vehicle (d) The tires of all motor trucks, tractors, trailers, or semi-trailers shall be considered defective, and the use thereof shall not be permitted, if the rubber or other material has been reduced by wear, to a thickness of less than one (1) inch, or if such tires have been so worn or otherwise damaged as to cause metal contact or pounding upon the pavement Page 225 (e) No person shall operate or drive any motor truck, tractor, trailer, or semi-trailer on the streets of the City of Livonia, the tires of which are equipped with metal that comes in contact or partial contact with the pavement, except where chains or other proper non-skidding devices are used (f) Any member of the police department of the City of Livonia is hereby authorized to stop any vehicle on the streets or alleys of the City of Livonia for the purpose of determining whether such vehicle is loaded in excess of the schedule And provisions contained in this section, and, if it shall be found that such vehicle is loaded in violation of the schedule and regulations herein provided for, the person stopping such vehicle shall have the right and duty, at that time and place, to order the excess load to be removed from such vehicle, provided, however, that nothing herein contained shall be construed to bar a complaint for any violation of this section (g) No person shall leave any machinery or other heavy load on the street at night except in the case of an emergency, in which case there shall be a sufficient number of colored lights or flares thereon during the period from one- half hour after sunset and until one-half hour before sunrise and visible for a distance of 200 feet along the street (h) No person shall move any machinery or other heavy or bulky load into, along or across any street or alley, unless the wheels under such load are so equipped es to prevent such wheels from cutting, breaking, or injuring the road surface SECTION 5 34 COIF:°LIANCE WITH STATE LAW RELATIVE TO EQUIPMENT AND LICENSE (a) No person shall operate any vehicle or permit the same to be operated on any highway, street or alley in the City of Livonia unless the same complies with the laws of the State of Michigan in reference to construction, parts, accessories and equipment and the use, condition and operation of such parts, accessories and equipment (b) No person shall operate any vehicle, unless he is licensed as an operator or chauffeur as required by the State of Michigan, and, unless he has a license os granted in his possession at all times while operating a vehicle. No person shall violate any condition of such license No person shall permit an unlicensed driver to operate any vehicle owned by him (c) Each licensed driver who has changed his residence shall immediately return his operator's or chauffeur's license to the police department where such change of residence ,:ill be properly recorded thereon as required by law (d) No person, whose operator's or chauffeur's license has been sus- pended, revoked, or refused, shall drive any vehicle while such license is sus- pended, revoked, or refused CHAPTER 6 0 PEDESTRIANS' RIGHTS AND DUTIES SECTION 6.1 PEDESTRIANS' RIGHT-OF-WAY IN CROSSWALK (a) When traffic-control signals are not in place or not in operation, the driver of a vehicle shall yield the right-of-way by slowing down or stopping, if need be, to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon the hal' of the roadway upon which the vehicle is traveling No pedestrian shall abruptly or suddenly leave a curb or other place of safety and walk or run into the path of a vehicle, which is so close that it is impossible for the driver to yield { Page 226 (b) Whenever any vehicle is stopped at a marked crosswalk, or at any unmarked crosswalk, in compliance with any signal requiring him so to do, at an intersection, no driver of any other vehicle approaching from the rear shall over- take and pass such stopped vehicle. SECTION 6 2 PEDESTRIANS TO USE RIGHT HALF OF CROSSWALK Pedestrians shall move, whenever practicable, upon the right half of all crosswalks SECTION 6 3 CROSSING AT RIGHT ANGLES No pedestrian shall cross a street at any place other then by a route at right angles to the curb or by the shortest route to the opposite curb except where crossing lanes are marked or indicated upon a street or highway, in which case, pedestrians shall cross within such lanes SECTION 6 4 WHEN PEDESTRIANS SHALL YIELD. (a) Each pedestrian, crossing a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at en intersection, shall yield the right-of-way to all vehicles upon the roadway (b) Each pedestrian, crossing a roadway on the surface thereof, at a point where a pedestrian tunnel or overhead pedestrian crossing has been provided, shall yield the right-of-way to all vehicles upon the roadway SECTION 6 5 PROHIBITED CROSSING No pedestrian shall cross a roadway, other than in a crosswalk in any business district. SECTION 6 6 PEDESTRIANS WALKING ALONG ROADWAYS (a) No pedestrian shell walk along and upon an adjacent roadway where sidewalks are provided (b) Where sidewalks are not provided, each pedestrian walking along and upon a highway shell, when practicable, walk only on the left side of the roadway or its shoulder, facing traffic which may approach from the opposite direction (c') No person shall stand within the curb lines of a street or highway for the purpose of soliciting a ride from the driver of any vehicle SECTION 6 7 DRIVERS TO EXERCISE DUE CARE Each driver of a vehicle shall exercise due care to avoid colliding with any pedestrian upon any street or highway and shall give warning by sounding the horn when necessary and shall exercise proper precaution upon observing any child or any confused or incapacitated person upon a roadway SECTION 6 8 BLIND PERSONS AND PERSONS .;'ITH AFFLICTIONS Blind persons, or persons incapacitated by lack of vision to the extent that their movement on foot is retarded, when carrying a white or illuminated cane in such a manner as to indicate the direction they desire to travel over crosswalks or on a street, shall be given the right-of-way over all vehicles, except emergency vehicles which are sounding the audible signals customary to such vehicles CHAPTER 7 0 REGULATIONS FOR BICYCLES SECTION 7 1 RESPONSIBILITY OF PARENTS AND GUARDIANS No parent of any child, nor guardian of any ward, shall authorize or knowingly permit any such child or ward to violate any of the provisions of this chapter. Page 227 SECTION 7 2 LICENSE REQUIRED No person, who resides within this city, shall ride or propel a bicycle on any street or upon any public path set aside for 111 the exclusive use of bicycles, unless such bicycle has been licensed and a license plate is attached thereto as provided herein SECTION 7 3 LICENSE APPLICATION Application for a bicycle license and license plate shall be made upon a form provided by the city and shall be made to the chief of the police department An annual license fee of fifty (50) cents shall be paid to the city before each license or renewal thereof shall be granted SECTION 7 4 ISSUANCE OF LICENSE (a) The chief of the police department, upon receiving proper application therefor, is authorized to issue a bicycle license which shall be effective until the next succeeding first day of December (b) The chief of the police department shall not issue a license for any bicycle when he knows or has reasonable ground to believe that the applicant is not the owner of, or entitled to the possession of, such bicycle (c) The chief of the police department shall keep a record of the number of each license, the date issued, the name and address of the person to whom issued, and the number on the frame of the bicycle for which issued, and a record of all bicycle license fees collected by him The police department may place numbers on the frames of bicycles which shall be peculiar to the City o' Livonia SECTION 7 5 ATTACHMENT OF LICENSE PLATE (a) The chief of the police department, upon issuing a bicycle license shall also issue a license plate bearing the license number assigned to the bicycle, the name of the city, and the calendar year for which issued (b) The chief of the police department shall cause such license plate to be firmly attached to the rear mudguard or frame of the bicycle for which issued in such position as to be plainly visible from the rear (a) No person shall remove a license plate from a bicycle during the period for which issued, except upon a transfer of ownership or in the event the bicycle is dismantled and no longer operated upon any street in the city SECTION 7 6 INSPECTION OF BICYCLES The chief of the police department, or an officer assigned such responsibility, shall inspect each bicycle before licensing the same and shall refuse a license for any bicycle which he determines is in unsafe mechanical condition SECTION 7 7 RENEWAL OF LICENSE Upon the expiration of any bicycle license the same may be renewed upon application and payment of the same fee as upon an original application SECTION 7.8 TRANSFER OF OWNERSHIP Upon the sale or other transfer of ownership of licensed bicycle, the licensee shall remove the license plate and shall either surrender the same to the chief of the police department or may, upon proper application but without payment of additional fee, have said plate assigned to another bicycle owned by the applicant SECTION 7 9 RENTAL AGENCIES d rental agency shall not rent or offer any bicycle for rent, unless the bicycle is licensed and a license plate is attached thereto as provided herein and such bicycle is equipped with the lamps and other equipment required in this ordinance Page 228 SECTION 7 10 BICYCLE DEALERS Each person engaged in the business of buying or selling new or second-hand bicycles shall make a report to the chief of the police department of every bicycle purchased or sold by such dealer, giving the name and address of the person from whom purchased or to whom sold, a description of such bicycle by name or make, the frame number thereof, and the number of license plate, if any, found thereon SECTION 7 11 TRAFFIC LAWS APPLY TO PERSONS RIDING BICYCLES Each person, riding a bicycle upon a roadway, shall be granted all the rights and shall be subject to all of the duties applicable to the driver of a vehicle by the laws of this State declaring rules of the road applicable to vehicles or by the traffic regulations of the city applicable to the driver of a vehicle, except as to special regulations in this ordinance pertaining to bicycles and except as to those provisions of laws and regulations which, by their netu"e, can have no application SECTION 7 12 OBEDIENCE TO TRAFFIC-CONTROL DEVICES (a) Each person, operating a bicycle, shall obey the instructions of official traffic-control signals, signs, and other control devices applicable to vehicles, unless otherwise directed by a police officer (b) Whenever authorized signs are erected indicating that no right or left or "U" turn is permitted, no person operating a bicycle, shall disobey the direction of any such sign, except where such person dismounts from the bicycle to make any such turn, in which event such person shall then obey the regulations applicable to pedestrians SECTION 7 13 RIDING ON BICYCLES (a) No person, propelling a bicycle, shall ride other than astride a permanent And regular seat attached thereto (b) No bicycle shall be used to carry rr.ore persons at one time than the number for which it is designed and equipped SECTION 7 14 RIDING ON ROADWAYS AND BICYCLE PATHS (a) Each person operating a bicycle upon a roadway shall ride as near to the right-hand side of the roadway as practicable, exercising due care when passing a standing vehicle or one proceeding in the same direction (b) No person, riding a bicycle upon a street or highwsy shall ride more than two abreast, except on paths or parts of roadways set aside for the exclusive use of bicycles (c) Whenever a useable path for bicycles has been provided adjacent to a street or highway, bicycle riders shall use such path and shall not use the street or highway SECTION 7 15 SPEED No person shall operate a bicycle et a speed greater than is reasonable and prudent under the conditions then existing SECTION 7.16 EiCERGING FROPti. ALLEY OR DRIVEWAY The operator of a bicycle, emerging from en alley, driveway, or building, shall, upon approaching a sidewalk or the sidewalk area extending across any alley-way, yield the right-of-way to all pedestrians approaching on said sidewalk or sidewalk area, and upon entering the roadway, shall yield the right-of-way to all vehicles approaching on said roadway Page 229 SECTION 7.17 CLINGING TO VEFICLLS No person, operating a bicycle, shall attach the same or himself to any vehicle upon a roadway SECTION 7 18 CARRYING ARTICLES No person, operating a bicycle, shall carry any package, bundle, or article which prevents the rider from keeping at least one hand upon the handle bars SECTION 7 19 PARKING No person shall park a bicycle upon a street other than upon the roadway against the curb or upon the sidewalk in a rack to support the bicycle or against a building or pt the curb, in such manner as to afford the least obstruction to pedestrian traffic SECTION 7 20 RIDING ON SIDE.JA.LKS (a) The chief of the police department is authorized to erect signs on any sidewalk, street, or roadway, prohibiting the riding of bicycles thereon by any person, and, when such signs are in place, no person shall disobey the same (b) Whenever any person is riding a bicycle upon a sidewnik such person shall yield the right-of-way to any pedestrian and shall give audible signal before overtaking and passing such pedestrian SECTION 7.21 LAMPS AND OTHER EQUI?JENT ON BICYCLES (a) Each bicycle when in use at night-time shall be equipped with a lamp on the front which shall emit a white light visible from a distance of at least 50C feet to the front and with a red reflector on the rear of a type which will be visible from all distances from 50 feet to 300 feet to the rear when directly in front of lawful upper beams of headlamps on a motor vehicle A lamp emitting a red light visible from a distance of 500 feet to the rear may be used in addition to the red reflector (h) No person shall operate a bicycle unless it is equipped with e bell or other device capable of giving a signal audible for a distance of at least 100 feet except that a bicycle shall not be equipped with nor shall any person use upon a bicycle any siren or whistle (c) Every bicycle shall be equipped with a brake which will enable the operator to make the wheel skid on dry level, clean pavement CHAPTER 8 0 STOPPING, STANDING AND PARKING SECTION 8 1 OBEDIENCE TO PARKING SIGNS OR MARKINGS (a) The chief of the police dep rtment shall cause appropriate signs and markings to be erected upon all streets or parts of streets upon which the traffic commission shall designate es no parking or as restricted parking or angle parking, or as reserved 4.or public carriers, busses, and taxicabs (b) No person shall nark or stand a vehicle upon the portion of any street which hos been signed or marked by the traffic commission as authorized or approved by the traffic commission, in a manner or for a length of time contrary to such posted signs or markings SECTION 8 2 STANDING OR PARKING CLOSE TO CURB No person shall stand or park a vehicle in a roadway, other than parallel with the edge of a street or road- way, heading in the direction of lawful traffic movement, and with the right hand wheels of the vehicle within twelve (12) inches of the curb or edge of the roadway or except as otherwise provided in this ordinance Page 230 SECTICh 8 3 OBEDIENCE TO ANGLE PARKING SIGNS OR I.:AR,KS On those streets which have been signed or marked by the +raffic commission f'or angle parking, no 111 person shall park or stand a vehicle, other than at the angle at the curb or edge of the roadway indicated by such signs or markings. SECTION 8 4 LIGHTS ON PARKED VEHICLES (a) Whenever a vehicle is lawfully parked at night-time upon any street within a business or residence district no lights need be displayed upon such parked vehicle if the street lighting is such as to render such vehicle visible for a distance of not less than one hundred (1C0) feet (b) Whenever a vehicle is parked upon a street or highway outside of a business or residence district, during the hours between one-half hour after sunset and one-held hour before sunrise, such vehicle shall be equipped with one or more lamps which shall exhibit a white light on the roadway side visible prom a distance of five hundred (500) feet to the front of the vehicle and a red light visible from the distance of five hundred (500) feet to the rear (c) Lighted headlamps upon a parked vehicle shall be depressed or dimmed SECTION 8 5 orOPPING, STANDING OR PARKING, PROHIBITED - NO SIGNS REQUIRED (a) No person shall stop, stand, or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with law or the directions of police officer or traffic-control device in any of the following places. 1 On a sidewalk; 2 In front o{' a public or private driveway, 3 Within an intersection; 4 Within fifteen (15) feet of a fire hydrant; 5 On a crosswalk, 6 Within twenty (20) feet of a crosswalk at an intersection• 7 Within thirty (3C) feet upon the approach to any flashing beacon, stop sign, or traffic-control signal located at the side of a roadway; 8 Between a safety zone and the adjacent curb or within thirty (30) feet of points on the curb immedi_tely opposite the ends of a. safety zone, unless the traffic commission has indicated a different length by signs or markings• 9 Within fifty (50) feet of the nearest rail of a railroad crossing, 10 Within twenty (20) feet of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within seventy- five (75) feet of said entrance when properly signposted, 11. Alongside or opposite any street excavation or obstruction when stopping, standing, or parking would obstruct traffic• 12 On the roadway side of any vehicle stopped or parked at the edge or curb of a street; Page 231 13 Upon any bridge or other elevated structure upon a highway or within III a highway tunnel; 14 At any place where official signs prohibit stopping. (b) No person shall move a vehicle, not lawfully under his control, into any such prohibited area or away from a curb such a distance as is unlawful (c) No person shall park any truck weighing more than four thousand (4,000) pounds or measuring more than thirty (3C) feet in length, or any truck having a trailer or semi-trailer attached, nor permit any such truck or any trailer or semi-trailer, whether coupled or not, to stand upon any residential street or near any church or school or alley of the city for a period exceeding one (1) hour, except for the purpose of loading or unloading, the making of emergency repairs, or at the direction of a police officer SECTION 8 6 PARKING NOT TC OBSTRUCT TRAFFIC No person shall park a vehicle in a public alley nor shall he stop or stand a vehicle in a public alley if such stopping or standing shall obstruct passing by other vehicle; provided, that a commercial vehicle may load or unload in a public alley, but shall not obstruct other vehicles from passing No person shall stop, stand or park a vehicle on that portion of this highway located between the property lot lines and the curb, unless permitted by Action of the traffic commission and appropriate signs erected SECTION 8 7 PARKING FOR CERTAIN PURPOSES PROHIBITED No person shall park a vehicle upon any roadway for the principal purpose of: III1 Displaying such vehicle for sale 2. Washing, greasing, or repairing such vehicle except repairs necessitated b.- an emergency SECTION 8 8 STANDING IN BUS PASSENGER LOADING ZONE No person shall stop, stand, or park a vehicle for any purpose in any place marked as a bus or taxicab loading zone, during hours when the regulations applicable to such loading zone are effective SECTION 8 9 PARKING OF BUSSES AND TAXICABS REGULATED The driver of a bus or taxicab shall not park u?on any street, in any business district, at any place other than at a bus stop, or taxicab stand, as the case may be, except that this provision shall not prevent the driver o° any such vehicle from temporarily stopping in accordance with other stopping or parking regulations at any place for the purpose of and while actually engaged in loading or unloading passengers. SECTION 8 10 RESTRICTED UsE OF BUS AND TAXICAB STANDS No person shall stop, stand, or park a vehicle, other than a bus, in a bus stop, or, other than a taxicab, in a taxicab stand when any such stop or stand has been officially designated and appropriately signed, except that the driver of a passenger vehicle may temporarily stop therein for the purpose of and while actually engaged in loading or unloading passengers when such stopping does not interfere with any bus, or taxicab waiting to enter or about to enter such zone 114 SECTION 8 11 PARKING PROHIBITED AT ALL TIMES ON CERTAIN STREETS When signs are erected giving notice that parking at all times is prohibited, no person shall park a vehicle at any time upon any of the streets designated by the traffic commission Page 232 SECTION 8.12 PARKING PROHIBITED DURING CERTAIN HOURS ON CERTAIN STREETS When signs are erected in each block giving notice thereof, no person shall park a vehicle between the hours specified thereon any day except Sundays and public ' Illholidays within the district or upon any of the streets or parts of streets designated by the traffic commission SECTION 8 13 STOPPING, STANDING OR PARKING PROHIBITED DURING CERTAIN HOURS ON CERTAIN STREETS When signs are erected in each block giving notice thereof, no person shall stop, stand, or park a vehicle between the hours specified thereon any day except Sundays and public holidays, within the district or upon any of the streets or parts of streets designated by the traffic commission SECTION 8 14 PARKING TIME LIMITED ON CERTAIN STREETS When signs are erected in each block giving noti^e thereof, no person shall park a vehicle at any time between the hours designated thereon, except Sundays and public holidays, within the district or upon any of the streets or parts of streets therein, for a longer period than is specified and indicated on the said signs SECTION 8 15 SHIPPING ENTRANCES - NOW PROVIDED Special "no-parking" spaces may be provided and established by compliance with the following conditions• Any owner or occupant of a building adjacent to a street or alleL , desiring "no- parking" space imm..edintely in front of a shipping entrance to such building, shall make application to the traffic comrission, setting forth all relevant information and stating the number of feet desired for such purposes The traffic commission shall have authority to grant or refuse such application at its discretion, or to grant the same with such restrictions or limitations as it may fix In case such application is granted, the traffic commission shall issue to the applicant a permit or certificate setting forth the location of such "no-parking" space, the number of feet frontage fixed and such other limitations as may be pertinent Such permit may, at any time, be withdrawn, or further limited by the traffic commission To enforce the provisions of such permit, the holder of same shall have the right to place "no-parking" signs on the sidewalk, marking the limits of such "no-parking" space Such signs shall be of the exact size, character and description required by the traffic commission, but shall be provided at the expense of the permit holder, and shall bear the number of the permit issued by the traffic commission No person shall park or allow any vehicle to stop or remain standing in any such special "no-parking" space, except for the purpose of taking on or discharging merchandise or passengers SECTION 8 16 UNATTENDED VEHICLES No person, having charge or control of a motor vehicle, shall leeve the same standing unattended in any public roadway, without first shutting off the motor, locking the same, and removing the keys therefrom so as to prevent the starting end operation of the vehicle by an unauthorized person SECTION 8 17 UNAUTHORIZED PERSON NOT TO MOVE VEHICLES No person, except a member of the police or fire departments, while in the performance of his duties, shall move any vehicle not owned by such person or lawfully in his possession, except to clear the roadway. SECTION 8 18 REMOVING PARKED VEHICLES FROM STREETS (a) When any vehicle shall be parked or left standing on any public 111 street or highway of the City of Livonia, contrary to the provisions of this section, such vehicle may be removed, by and under the direction of A member of the police department, to a place or places in the City of Livonia, to be designated by the chief of the police department and it shall be the duty of any officer so removing or causing to be removed any such vehicle, to make a written note of the manufacturer's number of the motor and body, if obtainable, and its State and license s 1 Page 233 plate number, and to file the same with the chief of the police department end the traffic violations bureau of the city III (b) Any person owning or entitled to the possession of such vehicle so removed may thereafter obtain possession thereof by paying to the traffic violations bureau the sum of three dollars ($3 00) es a removal fee, plus the sum of one dollar ($1 00) per day or any pert thereof during which the vehicle is held It shall then be the duty of such traffic violations bureau collecting any such fee to issue receipt therefor The traffic violations bureau shall pay to the city treasurer the amount collected from the impounding fees (c) Within ten (10) days after the impounding of a vehicle under the pro- visions of this section, the police department or officer impounding such vehicle shall cause a notice of such impounding, setting forth in such notice that, if such vehicle is not repossessed within forty-five (45) days from the date of such notice, the vehicle will be sold at public auction, fully describing the vehicle, its license number, and the place and date of impounding, to be mailed to the registered owners thereof by registered mail (d) Such charges and fees as are herein provided and the cost of mailing of notice shall be a first lien on the impounded vehicle Should the owner or operator of the impounded vehicle fail to repossess same in the manner herein pro- vided within forty-five (45) days after the giving of notice of impounding, as herein required, the City of Livonia shall have the right and privilege of selling same at public sale in the same manner and a"ter the same notice required by State law in sales of property seized on chattel mortgage The proceeds of sale shall be applied first to the fees and charges for impounding, storage and sale, together with all expenses incident to the publication of such notice and the sale of the vehicle and L the balance shall be deposited with the treasurer of the City of Livonia, to Le paid upon demand to the owner of the vehicle or other persons properly shown to be entitled thereto The chief of the police department shall report all abandoned cars to the Secretary of State immediately upon receiving a report that such car has been abandoned in the same manner as is required of sheriffs by State laws SECTION 8 19 REMOVAL CF DISABLED OR STALLED VEFICLES Whenever a vehicle becomes stalled upon a street or when because of damage or other reason it cannot be moved by its own power and consequently, blockades the street or interferes with use of the same by other vehicles, it shall be the duty of its owner and its operator to remove it by towing or otherwise within a reasonable time SECTION 8 20 ILLEGAL STANDING AND PARKING PROHIBITED - PROCEDURE No oerson shall allow, permit, or suffer any vehicle registered in his name to stand or park in any street in this city in violation of any of the regulations of the city regulating the standing or parking of vehicles In any proceeding for the violations of any provision contained in this ordinance relative to the stopping, standing or parking of motor vehicles, or any rule or regulation adopted pursuant thereto, it shall be presumed prima facie, in the absence of exidence as to the identity of the driver of the vehicle in question, that the owner of such veh.Lcle stopped or parked or placed such motor vehicle at the point and upon the occasion when and where such violation occurred In the absence of evidence as to the identity of the owner of such motor vehicle, it shall be presumed, prima facie, that the person in whose name such motor vehicle is registered in the office of the Secretary of State of the State of Michigan, or in case of vehicles registered in lb another state, then in the office in which the same is registered as required by the laws of such state, as shown by the license place displayed upon such motor vehicle at the time of such violation, together with the records of the office of the Secretary of State, or other office registration, with respect to the registration of Page 234 such motor vehicle, or any properly certified copy of such records, was at the time of such violation the owner of such motor vehicle CHAPTER 9 0 TRAFFIC VIOLATIONS BUREAU SECTION 9 1 TRAFFIC VIOLATIONS BUREAU CREATED (a) The justice of the peace, of the City of Livonia, shall establish a traffic violations bureau to assist the court with clerical work of traffic cases The justice of the peace shall, also, designate the person or persons, and the com— pensation of such person or persons, to be in charge of the traffic violations bureau, subject to the formal approval of the council The person designated to be in charge of the traffic violations bureau may, with the approval of the council, be deputized by the city treasurer as a deputy treasurer (b) The justice of the peace shall designate the specified offenses under the provisions of this ordinance in respect to which payments of fines may be accepted by the traffic violations bureau in satisfaction thereof, and shall specify by suitable schedules the amount of such fines for first, second and subsequent offenses, provided such fines are within the limits declared by law or this ordinance, and shall further specify what number of violations of such designated offenses may be permitted to be settled in the traffic violations bureau SECTION 9 2 WHEN PERSON CHARGED kAY ELECT TO APPEAR BEFORE A BUREAU OR BEFORE JUSTICE OF THE PEACE (a) Any person charged with an offense for which payment of a fine may be made to the traffic violotions bureau shall have the option of paying such fine at the traffic violations bureau within the time specified in the notice of arrest, upon entering a plea of guilty and waiving appearance in court• or may have the option of depositing required lawful bail and shall be then entitled to a trial as authorized by law (b) The payment of a fine to the bureau shall be deemed a plea of guilty of the alleged offense, and the bureau, upon accepting payment of the prescribed fine, shall issue a receipt to the violator acknowledging such payment and the full sat— isfaction of the offense committed SECTION 9 3 DUTIES OF TRAFFIC VIOLATIONS BUREAU The following duties are hereby imposed upon the traffic violations bureau in reference to traffic offenses. 1 It shall accept designated fines, issue receipts, and represent in court such violators as are permitted and desire to plead guilty, waive court appearance, and give power of attorney. 2 It shall receive and issue receipts for cash bail from the persons who must or wish to be heard in court, enter the time of their appearance on the court docket and notify the arresting officer and witnesses, if any, to be present. 3 It shall keep an easily accessible record of all violations of which such person has beer guilty during the preceding 12 months, whether such guilt was established in court or in the traffic violations bureau SECTION 9 4 TRAFFIC VIOLATIONS BUREAU TO KEEP RECORDS The traffic violations bureau shall keep records and submit summarized monthly reports to the justice of the peace of all notices issued and arrests made for violations of the traffic laws and this ordinance, and of all the fines collected by the traffic violations bureau or the court, and of the final disposition or present status of every case of violation of the provisions of said laws and of this ordinance Such Page 235 records shell be so maintained as to show all types of violations and the totals of each Said records shall be public records ILSECTION 9.5 ADDITIONAL DUTI2S OF mRAFFIC VIOLATIONS BUREAU The traffic violations bureau shall Follow such procedure as may be prescribed by this ordinance or as may be required by the council and by any laws of the State. CHAPTER 10 0 PROCEDURE ON ARREST OR VIOLA'ICN SECTION 10 1 FOR11S AND NOTICES OF ARREST OR APPEARANCE The treasurer shall provide in triplicate suitable serially numbered forms for notifying violators to appear and answer to charges of violating traffic laws and the pro- visions of this ordinance Such forms shall be issued to the chief of the police department, or other person acting for him, who shall give his receipt therefor The treasurer shall, in each month, report to the council and justice of the peace of the city court the disposal made by the police cf all triplicate forms issued to them For this purpose the treasurer or his representati•res shall have access to the necessary records of the police department, the justice court of the city, and the traffic violations bureau These reports shall be public records SECTION 10 2 PROCEDURE UPON ARREST Except when authorized or directed under State law immediately to take a person arrested for a violation of any of the traffic laws before a justice of the peace, any police officer, upon making an arrest for violation of the State traffic laws or the provisions of this ordinance, shall take the name, address, and operator's license number of the alleged violator and the registered number of the motor vehicle involved and shall issue to him, in writing on a form provided by the city treasurer a notice to answer to the IL charge against him at a place and at a time at least three (3) days after such arrest to be specified in the notice SECTION 10.3 FAILURE TO CBEY NGTICE OR SUMi,!ONS No person shal) fail to appear at the traffic violations bureau or before the justice of the peace of the city, as the case may be, in response to any traffic violation ticket issued to him by a member of the police department or placed upon a vehicle owned by him or registered in his name in the office of the Secretary of State SECTION 10 4 NOTICE ON ILLEGALLY PARKED VEHICLE Whenever any motor vehicle without driver is found parked or stopped in violation of any of the restrictions imposed by this ordinance or by State law, the officer finding such vehicle shall take its registration number and may take any other information displayed on the vehicle which may identify its use, and shall conspicuously affix to such vehicle a notice in writing, on a form provided by the treasurer, for the driver to answer to the charge against him within five (5) days during the hours and at a place specified in the notice The officer shall send one (1) copy of such notice to the chief of the police department and one (1) copy to the justice court of the city or to the traffic violations bureau as the case may be, according to the nature of the violation alleged and the rules of the traffic violations bureau SECTION 10 5 FAILURE TO COMPLY ;JITH NOTICE ATTACHED TO PARKED VEHICLE If a violator of the restrictions on stopping, standing, or parking under the traffic laws or this ordinance, does not appear in response to a notice affixed to such lb motor vehicle within a period of five (5) days, the clerk of the justice court of the city, or the traffic violations bureau, as the case may be, shall send to the owner of the motor vehicle to which the notice was affixed a letter informing him of the violation and wamazg him that in the event such letter is disregarded Page 236 for a period of five (5) days a complaint will be filed and warrant of arrest issued for the violations indicated upon the notice affixed to his vehicle SECTION 10.6 WHEN COMPLAINT "0 BE ISSUED In the event any person fails to comply with a notice given to such person or attached to a vehicle or fails to make appearance pursuant to a summons directing an appearance in the traffic violations bureau, or if any person fails or refuses to deposit bail as required end within the time permitted by this ordinance, the clerk of the justice court of the city or the traffic violations bureau shall forthwith have a complaint entered against such person and secure and issue a warrant for his arrest for the violation indicated on the notice attached to his vehicle SECTION 1C 7 AUTHORITY TO I:,POUND VEHICLE (a) The traffic division is hereby authorized to create a vehicle pound, or pounds, to which automobiles and other vehicles may be removed by members of the police department, in the manner hereinafter provided Such pound or pounds shall be located and operated upon land owned or leased by the City of Livonia. (b) The parking of vehicles in places where parking is prohibited, or the parking of vehicles in violation of the terms and provisions of this ordinance, is hereby declared to be a nuisance (c) Whenever any vehicle shell be found parked in a place where parking is not permitted, or whenever, any vehicle shall be found parked in violation of the terms of this ordinance, such vehicle may be removed and conveyed by or under the direction of a member of the police dep rtment by means of towing the same or otherwise, to a vehicle pound Before the owner, or persons in charge of such vehicle shall be permitted to remove the same from the custody of the police department, he shall furnish evidence of his identity and ownership, he shall sign a receipt and he shall pay a fee of three dollars ($3 00) to cover the cost of removal plus the cost of storage for not exceeding twenty-four (24) hours and he shall pay an additional storage fee of one dollar ($1 00) for each day, or fraction of a day, said vehicle is stored in +he vehicle pound in excess of the first twenty-four hours said vehicle is impounded (d) Whenever any vehicle shall be stored in a vehicle pound for any reason whatsoever, a charge of 1 00 for each day or fraction of a day, in excess of twenty-four (24) hours, shall be charged for the storage of such vehicle (e) It shall be the duty of the officer or person in charge of any impounded vehicle to inform the owner, or person claiming an impounded vehicle of the nature and circumstances of the violation on account of which such vehicle has been impounded In case protest is made against the payment of any impounding or storage fee, the officer or person in charge of said pound shall mark upon the receipt evidencing payment of the impounding and storage fees, the words "paid under protest " In such case it shall thereupon be the duty of the police officer having knowledge o" the facts to forthwith institute proceedings in the justice court of the City of Livonia, by charging the owner or driver of such vehicle with that violation of this ordinance or provisions of State law on account of which the vehicle was impounded On the final disposition of the cause in the justice court for the City of Livonia, it shall be the duty of the chief of the police department to refund to such person the fees paid under protest (f) It shall be the duty of the chief of the police department to account for all fees collected under this section and to pay the same to the treasurer He shall also keep a record of the names of all owners of vehicles impounded, the numbers of their State license tags, and the nature and circumstances of each vio- lation and the disposition of each case Page 237 CHAPTER 11 0 MISCELLANEOUS PROVISIONS SECTION 11 1 SCHEDULES The schedules hereto appended relative to through traffic streets, one-way streets stop streets and limitations on parking, are a part of this ordinance and may be revised only on action by the council SECTIC•N 11 2 DESIGNATION OF THROUGH TRAFFIC STREETS The following streets, within the City o{' Livonia, are hereby designated as through traffic streets 1. It shall be unlawful and constitute a misdemeanor for any person to viol to or fail to comply with any of the provisions of this ordinance or any regulations or order of the traffic commission 111 or the chief of police, adopted or issued in pursuance hereof, unless such violation person convicted of a misdemeanor for a viol?tion of, or failure to comply with any provision of this ordinance or any regulation or order adopted or issued in pursuance thereof, shall be punished by a fine of not more than five hundred ($500 00) dollars, or by imprisonment for a period of time not to exceed ninety (90) days, or Page 238 to both such fine and imprisonment in the discretion of the court, unless otherwise IL provided in this ordinance Each Act of violation and every day upon which such violation shall occur shall constitute a separrte offense SECTION 11 4 REPEAL All ordinances or parts of ordinances in conflict or inconsistent with the provisions of this ordinance are hereby repealed SECTION 11 5 SEVRA.BILITY If any part or parts of this ordinance are for any reason held to be invalid, such decision shall not effect the validity of the remaining portions of this ordinance SECTICN 11 6 EFFECTIVE DATE This entire ordinance shall be construed as an exercise of the police power of the City of Livonia This ordinance is hereby declared to be immediately necessary for the preservation of the public peace, health end safety, and shall become effective immediately on publication The foregoing ordinance was placed on the table for further study On motion of Councilmen Raymond E Grimm, seconded by Councilman "William Taylor and unanimously carried, the meeting was adjourned Time of adjournment being 12:45 A M November 28 1950 III VAl&f....- %=-3//,C--/-eVf-A Mai 71 Clark, City Clerk Attested: add* J A6I11( Harry S .tlfe, President /
