MINUTES OF THE 1,077T" PUBLIC HEARINGS AND REGULAR MEETING
HELD BY THE CITY PLANNING COMMISSION
OF THE CITY OF LIVONIA
On Tuesday, October 6, 2015, the City Planning Commission of the City of
Livonia held its 1,077th Public Hearings and Regular Meeting in the Livonia City
Hall, 33000 Civic Center Dnve, Livonia, Michigan
Mr Lee Morrow, Chairman, called the meeting to order at 7 00 p m
Members present Scott P Bahr Kathleen Mclntyre R Lee Morrow
Gerald Taylor
Members absent: Carol A. Smiley, lan Wilshaw
Mr Scott Miller, City Planner, and Ms Margie Watson, Program Supervisor, were
also present
Chairman Morrow informed the audience that if a petition on tonight's agenda
involves a rezoning request, this Commission makes a recommendation to the
City Council who, in turn, will hold its own public hearing and make the final
determination as to whether a petition is approved or denied The Planning
Commission holds the only public hearing on a request for preliminary plat and/or
vacating petition The Commission's recommendation is forwarded to the City
Council for the final determination as to whether a plat is accepted or re�ected if
a petition requesting a waiver of use or site plan approval is denied tonight, the
petitioner has ten days in which to appeal the decision, in writing, to the City
Council Resolutions adopted by the City Planning Commission become effective
seven (7) days after the date of adoption The Planning Commission and the
professional staff have reviewed each of these petitions upon their filing The
staff has furnished the Commission with both approving and denying resolutions,
which the Commission may, or may not, use depending on the outcome of the
proceedings tonight.

ITEM #1 PETITION 2015-09-02-15 VERIZON WIRELESS
(CELL TOWER)
Ms Mclntyre, Acting Secretary, announced the first item on the agenda, Petition
2015-09-02-15 submitted by TeleSite Wireless, on behalf of
Verizon Wireless, requesting waiver use approval pursuant to
Section 18 42A of the City of Livonia Zoning Ordinance #543, as
amended, to erect a wireless communication support structure
(130 foot high monopole) ad�acent to the Churchill High School
athletic field at 8900 Newburgh Road, located on the east side
of Newburgh Road between Joy Road and Ann Arbor Trail in
the Southwest 1/4 of Section 32
Mr Morrow� The petitioner is in the audience If you would come up to the
podium and give us your name and address for the record I
think you have something to share with the Commission

Mr Bell I'm the attorney representing Verizon Wireless We actually
previously requested that both of these items be tabled It was
our understanding actually that this was going to be a study
session because that's what it says in the ordinance, that the
first meeting will be a study session But apparently we didn't
get the notice in regard to the first meeting So as a result, we
haven't had that study session, and we do need that study
session to settle what we're going to do We talked about the
fact that there are several options with regard to what we're
going to be proposing So we're going to ask this to be tabled so
that we can, in fact, have a work session with the Planning
Department and get this a little more settled before we come
before you
Mr Morrow� I'll see if the Commission will offer a tabling resolution, but do
we have any type of a date certain or would this be determined
in the future?
Mr Bell It would have to be determined in the future because at this
point we got to talk to the Planning Department, go through that
work session that we were talking about, settling what we're
going to be doing and then we'll set a new date at that point.
We'll do that in conjunction with the Planning Department. At
that point, that date will be set.

On a motion by Taylor, seconded by Bahr, and unanimously adopted, it was
#10-67-2015 RESOLVED, that pursuant to a Public Hearing having been
held by the City Planning Commission on October 6, 2015, on

Ms Mclntyre, Acting Secretary, announced the next item on the agenda, Petition
2015-09-02-16 submitted by TeleSite Wireless, on behalf of
Verizon Wireless, requesting waiver use approval pursuant to
Section 18 42A of the City of Livonia Zoning Ordinance #543, as
amended, to construct a supporting cell tower equipment shelter
in the southeast corner of the American Legion property at 9222
Newburgh Road, located on the east side of Newburgh Road
between Joy Road and Ann Arbor Trail in the Southwest 1/4 of
Section 32
On a motion by Taylor, seconded by Bahr, and unanimously adopted, it was
#10-68-2015 RESOLVED, that pursuant to a Public Hearing having been
held by the City Planning Commission on October 6, 2015, on
Petition 2015-09-02-16 submitted by TeleSite Wireless, on

ITEM #3 PETITION 2015-09-02-14 POPEYES
Ms Mclntyre, Acting Secretary, announced the next item on the agenda, Petition
2015-09-02-17 submitted by Brodersen Management, on behalf
of Popeyes Louisiana Kitchen, Inc , requesting waiver use
approval pursuant to Section 11 03(c)(1) of the City of Livonia
Zoning Ordinance #543, as amended, to construct and operate
a freestanding full service restaurant with drive-up window
facilities at 13050 Middlebelt Road, located on the east side of
Middlebelt Road between the CSX Railroad right-of-way and
Schoolcraft Road in the Northwest 1/4 of Section 25
Mr Miller� This is a request to construct and operate a freestanding full
service restaurant with drive-up window facilities at 13050
Middlebelt Road The subject outlot, along with the Mei�er store,
is part of the Millennium Park retail complex, which is comprised
of a Home Depot and Costco, as well as several other shops
and restaurants The other two ad�acent outlots on the site of
the Mei�er store are occupied by a Culver's restaurant and an
Outback Steakhouse The sub�ect property is zoned C-2,
General Business, and is approximately 1 60 acres in total area
The proposed Popeyes restaurant would be classified as a full
service restaurant because it would have sixty interior seats
The plans do not indicate any type of outdoor patio seating The
site plan shows the Popeyes restaurant would be a one-story
building containing a gross floor area of 3,196 square feet The
restaurant would be positioned towards the middle of the
property with a ma�ority of its parking located on the west side of
the building The drive-up window service is planned along the
east side of the building Drive-up establishments are also
required to provide a by-pass lane or other suitable means of
access to a public street for vehicles that do not use the drive-
up window The plans do not show any by-pass lane and
therefore the proposed drive-thru for Popeyes would not comply
with this requirement The sub�ect outlot has no direct access to
Middlebelt Road Access to the proposed restaurant would be
from two new drive approaches one from the north off the
existing main driveway that extends from Middlebelt Road into
the Millennium Park development and the other from the

ad�acent Mei�er parking lot to the south Required parking for
restaurants with drive-thru facilities is based on the overall
number of customer seats and the number of employees In
addition, restaurants with drive-thru windows are required to
have two additional parking spaces beyond the drive-up window
for use of drive-up window patrons Popeyes would require a
total of 44 parking spaces The submitted plans show a total of
56 potential parking spaces, 42 of which would be built and 14
that would be landbanked Establishments are permitted to
landbank up to 25 percent of the total number of required
parking spaces The landscape plan submitted in connection
with this item provides for landscaping around the perimeter of
the site as well as within the parking lot islands and along the
foundation of the building The main building materials would
be cultured stone and E I F S Standing seam awnings would
be installed over the windows and doors To give the exterior of
the restaurant a Louisiana look, a fake balcony with metal
railings would be installed on the restaurant's upper east
elevation and shutters would cover some windows Goose neck
light fixtures would be positioned along the roofline of the
building The plans show a dumpster enclosure location at the
southeast corner of the proposed site A note on the plans
indicate that the parking lot lighting would have a maximum
height of twenty feet. The proposed wall signage as shown on
the building elevation plans would not be in conformance with
the sign regulations By Zoning Ordinance standards, the
proposed restaurant would be allowed one wall sign not to
exceed 60 square feet in area This site would also be allowed
one ground sign not to exceed 30 square feet in area or exceed
6 feet in height, 10 feet in length, and have a minimum setback
of 10 feet from any right-of-way line Any signage over what is
permitted by the ordinance would require a variance from the
Zoning Board of Appeals That is the extent of the proposal
Mr Morrow� Mr Miller, at the study session, we had seen one plan I
understand the petitioner has brought forth a new plan as far as
the architecture
Mr Miller� Yes, that is correct
Mr Morrow� I wonder if you could present the changes that were made since
the study session
Mr Miller� The original plan had a stone wainscot along the bottom portion
of the entire building The rest of the building was basically
dryvit, which is this yellow material shown on the color
rendering The petitioner has submitted revised elevation plans

that increase the amount of cultured stone on the exterior walls
of the building Basically, the building's bumps are now cultured
stone They have added probably about 50 percent more stone
on the building
Mr Morrow� Okay Would you please read out the correspondence and then
I'll see if the Commission has any more questions
Mr Miller� There are three items of correspondence The first item is from
the Engineering Division, dated September 28, 2015, which
reads as follows "In accordance w�th your request, the
Engineer�ng Div�s�on has rev�ewed the above referenced
plann�ng pet�t�on The legal descr�pt�on submitted w�th the
pet�t�on appears to be correct and should be used �n connect�on
w�th th�s pet�t�on The proposed outlot split from the parent
parcel has not been completed as of this time The spl�t is
expected to be completed pr�or to any permitting or
construction, but at th�s t�me the correct parcel address should
be #13000 M�ddlebelt Road wh�ch �s for the parent parcel Once
the split has been completed, the proposed restaurant will be
w�ll be located on the outlot w�th an address of #13050
M�ddlebelt Road The plans subm�tted with the pet�t�on do not
show s�zes or locat�ons of proposed utilit�es, so we cannot
comment on any impacts to the ex�st�ng systems at th�s t�me
Ut�l�ty and site development issues w�ll be addressed dur�ng the
s�te plan rev�ew process It should be noted that outparcel
currently has access to the pr�vate water main and storm sewer,
as well as the pr�vate roadway that runs through the Millenn�um
Park Development The owner of the parent parcel will need to
prov�de the outlot w�th an easement to be able to connect to the
ex�stmg publ�c san�tary sewer that runs to the west of the outlot
The owner w�ll a/so need to prov�de storm detent�on per the
Wayne County storm water ordinance " The letter is signed by
David W Lear, P E , Assistant City Engineer The second letter
is from the Livonia Fire & Rescue Division, dated September 21,
2015, which reads as follows "This office has rev�ewed the site
plan subm�tted m connect�on w�th a request to construct and
operate a freestand�ng full serv�ce restaurant with dr�ve-up
wmdow facil�ties on property located at the above referenced
address We have no ob�ect�ons to this proposal " The letter is
signed by Keith Bo, Senior Fire Inspector The third letter is
from the Division of Police, dated September 16, 2015, which
reads as follows "1 have rev�ewed the plans �n connect�on w�th
the petition I have no objections to the proposal " The letter is
signed by Joseph Boitos, Sergeant, Traffic Bureau That is the
extent of the correspondence

Mr Morrow� Are there any questions of Mr Miller?
Mr Taylor� Through the Chair to Mr Miller Scott, do you know
approximately what the percentage of brick is on this building?
Mr Miller� It is close to 50 percent of the building
Mr Taylor� I know they very much improved it on the bottom part, but the
Culver's building is almost all masonry as far as I can
remember I just want to make sure that we're putting in the
right type of building that Livonia is used to putting in with a
certain amount of brick Thank you
Mr Morrow� You had indicated that there is going to be cultured stone also?
Mr Miller� The building is cultured stone with dryvit.
Mr Morrow� Even along the base there is cultured stone?
Mr Miller� Yes
Mr Morrow� Okay Any other questions? We'll call the petitioner at this time

Jeremy Wilmot, 409 Church Court, Barlett, Illinois I represent John Brodersen
and DXU Architectural Solutions out of Chicago As Scott has
already stated, we have changed quite a bit of the exterior
material to the cultured stone, which I brought a sample here
with me It is �ust over 50 percent of the building, and the rest
would be dryvit, which I also have a sample of that too
Mr Morrow� Okay Let me �ust interrupt you there If you could �ust hold that
up at the podium so the people at home and in the audience
can see the material That's �ust the standard dryvit
Mr Wilmot. Correct.
Mr Morrow� Okay Thank you You can continue on, sir
Mr Wilmot. We received the comments that you would like to see it
resemble a little bit more like the Culver's directly to the west
Popeyes has a branded image that they try to maintain, so
we've tried to accommodate your request by raising the
parapets in certain spots and keeping them the same height in
others, but still maintaining the same color scheme of a
Popeyes restaurant and its branded image There is an awful lot
of dryvit. A lot of different cities also ask for masonry or brick.

It's hard to account for every variable in these designs, but this
is what we've come up with right now, which was approved by
Popeyes corporate as an alternate to their prototypical store
Mr Morrow� Are there any questions of the petitioner?
Ms Mclntyre I'm concerned about the fake balcony I understand that's a
branding element, but those are the things that on these kinds
of restaurants tend to be the first things that start not looking
good and the last things to be addressed because they're not a
structural part of the building I'm wondering if you have other
locations that perhaps do not include the faux balcony
Mr Wilmot: I understand your concern To be honest, no we don't have any
that exclude that balcony My client, Brodersen, is very hands-
on His stores are always very well maintained and kept up so
we haven't had any problems with the balcony in the past. I
could go back to Popeyes corporate and see if there's any other
alternatives that we could use in that area, but as far as I know,
no other store has been constructed without that.
Ms Mclntyre Okay Thank you
Mr Bahr� I have a couple questions Do you mind passing the dryvit piece
around? I'd just like to see it. Two questions Number one, it
was mentioned already about the requirement for a bypass lane
which isn't currently showing Is that something that you're able
to accommodate?
Mr Wilmot Actually, there is a bypass lane Scott, could you put the site
plan up please? As you can see in the drive-thru, if you come in
the south entrance and immediately take a right, that drive aisle
is 24 feet wide So the drive thru lane would be the northern
most portion and it would be striped and called out as a drive-
thru lane, and then the south 12 feet would be the bypass lane
that would go around the cars waiting for the drive-thru and be
able to park in those 45 degree angled stalls or continue and
circle around the building to park in any one of those 90 degree
stalls In my opinion, I feel that we've accommodated a bypass
lane
Mr Bahr� Through the Chair to Scott, does that meet our requirements? I
thought we needed a bypass lane all the way through the drive-
thru lane
Mr Miller� You usually need it after the menu board

Mr Wilmot That's correct. That's why I striped the pavement at the start of
the corner and then there's actually a curbed island between the
parking and the drive-thru
Mr Miller� So you're saying you could get out here if you didn't like
anything at the menu board You could go straight and then
around
Mr Wilmot. You could Yes
Mr Miller� That would be up to the Building Department if they would
accept that
Mr Wilmot. Again, if you're on the south portion of that drive aisle, you can
�ust go straight through
Mr Miller� Like I said, most of the bypass lanes are after the menu board
So if somebody goes to the menu board and changes their
mind, they would be able to get out.
Mr Wilmot So if I cut down the length of the curbed island, would that be
acceptable?
Mr Miller� Yes, I think you could cut this a little bit more
Mr Bahr� I assume that's grass on the island
Mr Wilmot. Yes
Mr Bahr� Which would look nice, but I think the purpose of the ordinance
is for people to be able to get out at any point, isn't it?
Mr Miller� We've seen it done different ways
Mr Bahr� So as far as you know, this would meet the ordinance? That's
�ust my main concern
Mr Miller� Yes If anything, we could tweak it a little bit more, but I guess
that would be acceptable
Mr Bahr� Overall, I think it's nice looking I don't have a problem with the
building and I think it's a fine looking plan My only remaining
concern is �ust with the landscaping I'm disappointed that
there's not more trees being added I see one on the outskirts
here and that's a big bare space right there Would you guys be
open to adding some more green, some more height?

Mr Wilmot. Absolutely I think the landscape plan submitted by Woolpert
Engineering shows a little bit more foliage and trees than I'm
showing here currently on this site plan, but absolutely We
would be happy to add more trees and shrubs, whatever is
requested
Mr Bahr� Yes, because I understand you want the restaurant to be visible
as well I'm thrilled this lot is being developed finally and it's �ust
a great opportunity to not just put a nice building there, but to
really spruce up the entire property Any approving resolution
from me - I would want a more detailed landscape plan to be
brought to the Planning Department.
Mr Wilmot Okay
Mr Morrow� Mr Miller, do we have an alternate plan in our packet?
Mr Miller� For the landscaping?
Mr Morrow� Yes
Mr Miller� I believe that's the only landscape plan we have
Mr Morrow� I think what I'm asking is, it sounds like there's another plan
somewhere around
Mr Wilmot: Yes I apologize I was told by my civil engineer that he had
submitted a landscape plan, and I �ust received it myself this
morning I have a small copy of it here if you would like to see it
I have a couple red marks on it, so please�ust excuse those
Mr Bahr� Does it show more trees?
Mr Morrow� While we're looking at this, I would �ust say, this will be
forwarded to the City Council We'd like to see the landscape
plan that the architects have drawn up so the Council will see
the actual plan
Mr Wilmot. Yes, absolutely
Mr Morrow� That way we can move it along We'll take a quick look at it
here, but the full blown plan will go to the Council
Mr Wilmot We will accommodate all of your requests here tonight for the
City Council

you've gone, and i appreciate it as one City Planning
Commissioner, that you've changed the look of the building and
yo�'Ve really updated it to what Livon�a likes ta see For the
scouts out fihere, I think you heard "landbank." Livonia has an
ordinance that mandates yau have #o have sa many parking
spaces for so many seats in a restaurant, or if the petitianer
doesn't feel that he needs that many, they can landbank tha#
property If the city decides afl of sudden that they're having a
parking problem, then they have to develop the parking So 1

how many cars are stacked up pnor to the menu board
Mr Wilmat: I believe I was showing 12 cars Two cars would be able ta pull
up past the window i# their order wasn't ready at the time they
arrived at the window Eleven cars from the drive-up windaw all
the way to the back near that southwestern most entrance
Mr Morraw� So it is a fairly large stacking area
Mr Wilmot. Yes, it is There are seven from fihe window back to the menu
board

Mr Morrow� So there's only four cars stacked up �n front of the menu board?

here at Five Miie and Middlebelt� ! think we have made some
exemptions to aiiow an exit once you're past the menu board
because it was a big backup tanight at the McDonald's and I
couldn't get out. Now 1 could have gotten aut before, sa I think
we have granted some waivers, if you will, on that requirement.
Mr Miller� The requirement for a bypass lane can be waived by City
Counc�l
Ms Mclntyre We absalutely have ta have them before the menu board, right,
sa you dan't get in a queue and then realize yau don't have
enough time But I �ust wan#ed to make that point because I was
paying attention ta it tanight.
Mr Morrow� Okay Thank yau
Mr Bahr I �ust noticed one more thing because I know it will come up at
the Council On your second landscape plan, which fooks much
better by the way, but l r�otice that there was less fol�age around
the dumpster area I'm fine with what you had on there, but I
know the question �s go�ng to come up at Council about the
material around the dumpster Is it the same ma#eria! that's an
the bu�lding? Is �t masonry, or what?
Mr Wilmot: No It would be a split faced concrete block araund the
dumpster enclosure itself and then it's manufactured woad
gates But yes, I would definitely add more trees and shrubs
around it to hide it.
Mr Bahr� Yes That's gair�g to be an issue at the Council You're go�ng to
want ta have that dumpster match�ng the materials on the
building
Mr Wilmot: Okay
Mr Bahr� I mean that's typically what they would have They can speak
for themselves, but it just creates a certain standard ofi
appearance that we've come ta expect in this community

On a motion by Bahr, seconded by Taylor, and unanimously adopted, it was
#10-69-2015 RESOLVED, that pursuant to a Public Hearing having been
held by the City Planning Commission on October 6, 2015, on
Petition 2015-09-02-17 submitted by Brodersen Management,
on behalf of Popeyes Louisiana Kitchen, Inc , requesting waiver
use approval pursuant to Section 11 03(c)(1) of the City of
Livonia Zoning Ordinance #543, as amended, to construct and
operate a freestanding full service restaurant with drive-up

side of Middlebelt Road between the CSX Railroad right-of-way

1 That the Site Plan prepared by DXU Studio, dated
September 28, 2015, is hereby approved and shall be
adhered to,
2 That in accordance with Section 18 37�) of the Zoning
Ordinance, the petitioner shall be allowed to bank up to
twenty five percent (25%) of the total number of required
parking spaces,
3 Unless waived by City Council, a by-pass lane along the
outer edge of the drive-up lane shall be provided,
4 That the Landscape Plan marked Sheet C600 prepared by
Woolpert, dated August 20, 2015, is hereby approved and
shall be adhered to,
5 That all disturbed lawn areas shall be sodded in lieu of
hydro-seeding,
6 That underground sprinklers are to be provided for all
landscaped and sodded areas and all planted materials
shall be installed to the satisfaction of the Inspection

Department and thereafter permanently maintained in a
healthy condition,
7 That the maximum customer seating count shall not
exceed a total of si�y (60) seats,
8 That the two Building Elevation Plans prepared by DXU

of the context of this site The site itself is an 11 acre property
that's be�ng redeveloped A ma�or�ty af it �s a charter school The
four acres that's left on the west side includes the storage site,
which is the south part�on of the site 1t has no frantage at a11 on
Eight Mile Road, it's a good 200 feet from Eight Mile We
eonsider it backyard retail 1t's k�nd of a redevelopment in that
con#e�. The school building itself consists of a redeveloped
shopping center building that's gat some pamted masonry and
steel siding Our closest other commerctal ne�ghbor is O'Reilly
Auto Parts right at the carner of Anglmg and Eight Mile They've
got a peanut masonry as the�r material I know the Plar�ning
Commission is familiar with this petition because we are also
I, going for a cor�d�t�onal rezoning Along with that rezon�ng is a
; concept plan that we submitted in early summer During thafi
� #ime, we've had a lot af input from a nt�mber af avenues, one af

address that. Secondly, our engineer, as he became more
familiar with this site, changed the orientation of the buildings

the utility access particularly That's one of the recent changes
Ubvious{y, we've had a working sessian recently with the
Planr�ing Gomm�ssion and the th�ngs that were asked for at that
time were some architectural improvements, part�cularly that the
carners on the northwest create some more detail and
coordinate with the affice bu�lding itseif So that was
accomplished Secondly, that the height of the masanry wa11s be
made a little higher so that there was same difference �n the
variation between the long elevations so we d�dn't have one
honzontal line at the top So we added a little bit more variation
there I believe we added two courses to the masonry walls
there to get that feature Thirdly, that we add more definition to
the wainscoting that's on the Eight Mile side and the Angling
Road side for the meta( siding itself Then there were additional
comments about the s�te plan ltself and questions Qne was if
we caufd include the landscapmg that's on Ar�gling Road So we
added that ta thjs drawmg In fact, there are a good #en trees or
so that are already existing, and they vary between 15 and 20
feet in height. So they provide a fairly effective sereen between
the residential and the site itself if we were to propose new
trees, they'd be smaller, a three inch caliper tree, and they'd be
maybe 8 to 10 feet tall So it may be a less effect�ve screen So
for the time, we're proposing that we leave the existing trees
and then that focuses our landscape efforts an �ust the trees
� tha# krnd of enhance #he building �tself We are proposing metal
� s�d�ng an portions of the bu�lding but that's beca�se �t's very
� consistent with that type of bu�idmg and use, the storage use
; But the trees are placed so that they ktind of conceal that siding
' and break it up even further Unfortunately, on an elevatian
; view, we're not allowed to add landscapmg necessarily sa it
doesn't show it, but I'm sure you can see from the site plan that
that's the intention Another question came up about the bio
, swales So we were able to, in redesigning the site plan, push
the bui{dings to the norkh a bit and create a 50 foot setback
� between the resident�al to the south and the first building Of
that 5C? feet, 24 feet of it Es able to be greenspace The engineer
was able ta figure out a way to do a bio swale with that space so
that it functians as part of the storm water system as well The
way that's detailed is that �t's intended to be mowed and it w�ll
planted wfth a grass species that's hardy and doesn't require
irrigation I know that question came up at our meetEng, sa the

engineer's reply is tha# exactly There is alsa another swale on
the west side between the building and the landscaping on the
build�ng and #he sEdewalk and that's the same condition there
They are not recommending planting trees or shrubs in that
area because it's part af the starm water system, and it wiii be
mowed and maintained in a neat manner The other question
was to update the photometric plan, which we d�d 1t shows zero
light bleeding over onto the residential properties to the south
and to the west as well So that's been updated Finally, we
added some landscapmg to the southwest corner of the buildmg
of the site plan right near the fire access on Angling Road We
added a couple trees there to help conceal that area and further
buffer the residential from the use itself I understand one of the
comments from Engineering was about the trash receptacfes
Sa the plan there is that each of the tenants has a lease, and
the access ar�d cond�tians are cot�tralled exactly by the lease
So in our existing facility in other operations, peaple aren't
allowed to leave belongings when they move aut. They have ta
take everything with them That's actually regulated by the
managers on site, and they canfirm that people have remaved
their belong�ngs from the unit before they close the account. For
that reason, we don't provide a dumpster on site because we
feel that would create mare of a nuisance than if we didn't have
one So for the refuse of the office itself and the company, we
use curb carts and there's a provision for those behind a wall
near the office building itself
Mr Morrow� So this is a system that you have at your ather locations and it
works well?
Mr Davis It is, right And as I understand, facilfties #hat do have dumps#ers
often times they do get inundated with trash over the weekend
and thmgs and it creates more problems than �ts worth it's
eas�er to manage people's access rather than firy and leave it
open

On a motion by Mclntyre, seconded by Taylor, and unanimously adopted, it was
#1Q-72-2015 RESOLVED, that the Planning Cammission does hereby
recommend to the C�ty Cauncil that Petition 2015-09-08-15
submitted by Charter Real Estate, on behalf of Livon�a 5torage
Un�ts, requesting approva! of all plans required by Section 18 58
of the City of Livar�ia Zoning C}rdinance #543, as amended, in
connection with a proposai to develop a self-storage facility at
28�53 E�ght M�le Road, located on the south side af E�ght Mile
Road between Grand River Avenue and Angling Road m the
Nartheast 114 of Section 1, be approved subject to the following
conditions
1 That the Site Plan marked Sheet C-4 0, prepared by Wade
Trim, dated Octaber 5, 2015, is hereby approved and shall
be adhered to,
2 That appropriate recordable legal instrumentation, such as
a crass access agreemer�t, that gives nat�ce and outlines
the terms af haw the subject property would share parking

the appearance of the main entry tower an the cl�mate
controlled buiiding, and some form of masonry shall be
incorparated along the base a# the same building where �t
faces the street;
8 That ail rooftop mechanicai equipment shall be concealed
from public view on ali sides by screening that shall be of a
compatible character, material and color to other exterior
materials on the building,
9 That thss site shall meet either the City of Livonia or the
Wayne Gour�ty 5torm Water Management 4rdinance,
wh�chever applies, and shall secure any required permits,
including soil erosion and sed�mentation contral perm�ts,

10 That the photometric plan be modified so as to reduce the
' mtensity of the e�erior lighting, and that all light fixtures not
exceed twenty feet (20') in height and sha11 be aimed and
shielded so as to minimize stray light trespassing acrass
property lines and glaring into adjacent roadways,
11 That the �ssues as outlined in the correspandence dated
September 3Q, 2015, from the Senior F�re Inspector shall
be resolved to the sat�sfaction of the Fire Department
and/or Inspect�on Depar#ment,
12 That only canforming signage is approved with this pet�t�on,
and any additional signage sha11 be separately submitted
far review and approval by the Zoning Board of Appeals,

on this site including, but nat limited to, the building or

14 That the spec�fic plans referenced in this approving
resolut�on shall be submitted to the Inspection Department

we'll just not put them there I think the language is okay
