SYNOPSIS OF THE MINUTES OF THE 1,640REGULAR MEETING
LIVONIA CITY COUNCIL – SEPTEMBER 9, 2009
Meeting was called to order at 8:00 p.m. Present: John Pastor, Joe Laura, Brian
Meakin, Tom Robinson, James McCann, Terry Godfroid-Marecki and Laura Toy.
Absent: None.

#368-09 Resolution by Robinson and Godfroid-Marecki, unanimously adopted,

approving the minutes of the 1,639 Regular Meeting of the Council held August 26,
2009, as submitted.
Meakin requested a moment of silence for Leo Snage, former Director of Public Works
for Redford Twp, who passed away on September 3, 2009.
President Toy requested a moment of silence for Eugene R. Snycerski, former retired
Livonia Police Officer, who passed away on August 29, 2009.
President Toy announced new data on item #21.
AUDIENCE COMMUNICATION:
John Grzebik, 11301 Hubbell, was present on behalf of the Livonia PTSA Council. He
spoke briefly about what they do, the programs they run throughout the year and how to
join. He announced a 9/11 Remembrance Ceremony on Friday, September 11, 2009 at
the American Legion Post.
Paul Talbot, 14937 Santa Anita, offered new data on item #17.
The following items were received and filed:
A communication from the Department of Law dated August 17, 2009, re: a proposed
Ordinance for Vacant and Abandoned Structures. (CR 183-09)
A communication from the Inspection Department dated August 4, 2009, re:
Administrative Response to CR 344-05 – the subject of greater enforceability of the
noise ordinance.
A 2009 Assessment Data booklet from the City Assessor, dated April 30, 2009, re: the
subject of miscellaneous budget issues. (CR 171-05)
A Budget Presentation from the Office of the Mayor, dated August 24, 2009, re: the
subject of miscellaneous budget issues. (CR 171-05)
An email communication from Tahrik Alcodray, dated September 8, 2009, forwarding an
updated Landscaping Plan for property located at 34901 Ann Arbor Trail. (Petition 2005-
03-08-05)

The following resolutions were offered by Pastor and Laura:
#369-09 Approving the request of Thomas Hall, 16620 Country Club, to close
MAD
FAT
Country Club, between Wood and Grove on Saturday, September 12, 2009, from 4:00
Police
p.m. until 10:00 p.m., for the purpose of conducting a block party, with a rain date on
Saturday, September 19, 2009, subject to the approval of the Police Department.
#370-09 Approving the request of Leonard Schoenborn, 37644 Mallory, to close
MAD
Blue Skies between Mallory and Bloomfield on Saturday, September 12, 2009, from
FAT
Police
3:00 p.m. until 10:00 p.m., for the purpose of conducting a block party, with a rain date
on Saturday, September 19, 2009, subject to the approval of the Police Department.
#371-09 Approving the proposed bus maintenance agreement with the Livonia
MAD
Public School District and the City of Livonia for the period September 1, 2009 through
FAT
August 31, 2010 for the storage, maintenance and repair of up to seventeen (17) City of
Livonia transit buses.
#372-09 Approving the request to adopt a retirement health savings plan, in the
MAD
FAT
form of the ICMA (International City Management Association) Retirement Corporation’s
Civil Service
VantageCare Retirement Health Savings program, for non-represented employees
hired on or after December 1, 2009

#373-09 Approving the request to participate in and accept the 2009 Justice
FAT
Assistance Grant (JAG), in the amount of $66,274.00.
Police
#374-09 Approving the request to purchase electric targeting systems for the pistol
MAD
FAT
and rifle ranges, including needed repairs to the existing protective ballistic wall on the
Police
pistol range and installation of a protective wall and steel post covers on the rifle range
from Advanced Training Systems (ATS), 4524 Highway 61 North, Saint Paul, MN
55110, in the amount of $114,537.00 from budgeted funds; FURTHER, accepting the
USMS’ reimbursement consisting of Department of Justice Asset Forfeiture Funds in
the amount of $30,000.00 to be used on this range project; FURTHER, authorizing the
purchase without competitive bidding, in accordance with Section 3.04.140.D4 of the
Livonia Code of Ordinances, as amended.
#375-09 Accepting the quote submitted by Allie Brothers, 20295 Middlebelt, for
MAD
supplying the Fire Department with uniforms and related uniform items for the period

May 1, 2009 to May 1, 2011, at the same unit prices previously accepted in CR 174-03,
from budgeted funds.
#376-09 Approving the request to amend and revise CR 12-07 to amend the

disposal of the second line Reserve Fire Engine Pumper RE-2 (1988 Pierce) and to
Fire
donate it to Schoolcraft College’s Fire Training School.
#377-09 Accepting the lowest bid of the Summit Company, 13191 Wayne Road, for

completing all work required in connection with the construction of a new club house at
Parks & Rec

Whispering Willows Golf Course in an amount not to exceed $1,488,193.00; FURTHER,
authorizing an expenditure not to exceed $1,488,193.00 from budgeted funds.
#378-09 Approving the contract between the MI Department of Transportation and

the City of Livonia for the geometric improvements to the eastern quadrants of the
Engineering
interchange of highways I-96/I-275 and Six Mile Road; FURTHER, authorizing the
expenditure of a sum estimated at $9,600.00 for the City’s estimated share of this
project (2.5% of the total estimated cost for this project of $382,550.00).

#379-09 Resolution by McCann and Meakin, unanimously adopted, referring the

subject of the maintenance of bank-owned and abandoned properties to the

Department of Law for preparation of an appropriate amendment to Section 15.51

(vacant and abandoned structures) of the Livonia Code of Ordinances as amended.

Police
Meakin gave FIRST READING to the following Ordinance:
AN ORDINANCE ADDING SECTIONS 090, 100, 110, 120, 130, 140, AND
150 OF TITLE 13, CHAPTER 04 (GENERAL USE REGULATIONS) OF
THE LIVONIA CODE OF ORDINANCES, AS AMENDED.
Godfroid-Marecki gave SECOND READING to the following Ordinance:
AN ORDINANCE AMENDING SECTIONS 030, 050, 060, 070 AND 120
OF TITLE 13, CHAPTER 21 (WASTEWATER DISCHARGE CONTROL
ORDINANCE) OF THE LIVONIA CODE OF ORDINANCES, AS
AMENDED (Petition 2009-04-06-02)
A roll call vote was taken on the foregoing Ordinance:
AYES: Pastor, Laura, Meakin, Robinson, McCann, Godfroid-Marecki and
Toy.
NAYS: None.
Meakin gave SECOND READING to the following Ordinance:

ORDINANCE NO. 543, AS AMENDED, KNOWN AND CITED AS “THE
CITY OF LIVONIA ZONING ORDINANCE” (Petition 2009-04-06-02)
A roll call vote was taken on the foregoing Ordinance:
AYES: Pastor, Laura, Meakin, Robinson, McCann and Toy.
NAYS: Godfroid-Marecki
#381-09 Resolution by Robinson and Meakin, denying the request to waive the

sidewalk requirement in front of a newly-constructed home located at 14937 Santa Anita

Engineering inasmuch as there are sidewalks in the neighborhood and omitting the sidewalk on this
property would be detrimental to the best interest of the City and its residents.

#384-09 Resolution by Pastor and Godfroid-Marecki, accepting the proposal of

eTrak, Inc., Carl Kabbe, President, 810 Travelers Blvd., #E-2, Summerville, SC 29485,
Parks & Rec
to supply recreation software to the Department of Parks and Recreation for a period of
five (5) years, commencing October 1, 2009 and terminating on September 30, 2014, in
an amount not to exceed $104,000.00; FURTHER, authorizing an expenditure not to
exceed $104,000.00 from budgeted funds.

#385-09 Resolution by Godfroid-Marecki and Meakin, concurring in the

recommendation of the City Planning Commission to approve Petition 2005-03-08-05
Inspection
Planning submitted by EDCO Real Estate Ventures, L.L.C., requesting approval to construct an

addition and renovate the exterior of the service station on property located on the SW
corner of Wayne Road and Ann Arbor Trail (34901 Ann Arbor Trail), in the SW ¼ of
Section 33, subject to conditions.
A roll call vote was taken on the foregoing resolution:
AYES: Laura, Meakin, McCann, Godfroid-Marecki and Toy.
NAYS: Pastor and Robinson.
#386-09 Resolution by Godfroid-Marecki and Pastor, unanimously adopted,

determining to conduct a public hearing on Monday, October 5, 2009, at 7:00 p.m. at
the Livonia City Hall, 33000 Civic Center Drive, with respect to the annual budget for the
fiscal year ending on November 30, 2010.
#387-09 Resolution by Godfroid-Marecki and Pastor, unanimously adopted,

referring the subject of the annual budget for the fiscal year ending November 30, 2010,
to the Finance, Budget and Technology Committee for its report and recommendation.
AUDIENCE COMMUNICATION: None.
Pastor wanted to remind everyone to vote in the Tuesday, September 15, 2009 Primary
Election.
