Absent: Joe Laura, and James McCann. MAD #289-10 Resolution by Meakin and Schwartz, unanimously adopted, approving the nd FAT minutes of the 1,662 Regular Meeting of the Council held August 9, 2010. th Meakin wished his daughter Kellie Anne a belated Happy 14 Birthday; her birthday was yesterday, August 24, 2010. Senior Councilmember Toy asked for a moment of silence for Pam Posthumus, wife of former Lieutenant Governor Dick Posthumus, who passed away August 18, 2010. Pastor wished City Clerk Terry Marecki a belated Happy Birthday, her birthday was August 24, 2010. Mayor Kirksey introduced his granddaughter, MacKenzie Kirksey; she will be visiting for the week. Senior Councilmember Toy announced there was new data for Items #11 and #12. At the direction of the Chair, Item #12 was removed from the Consent Agenda and moved to the Regular portion of the Agenda. At the direction of the Chair, Item #15, re: Petition 2010-06-02-12, submitted by Jeffery A. Scott Architects requesting waiver use approval, to add drive-thru facilities to an existing Dunkin’ Donuts Restaurant, was rescheduled to the next Regular Meeting to be held on Wednesday, September 8, 2010. AUDIENCE COMMUNICATION: None. The following items were received and filed: A communication from the Department of Finance, dated July 20, 2010, re: forwarding various financial statements of the City of Livonia for the month ending June 30, 2010. Letters of Understanding signed by the President and Vice President of Lone Pine Corral Inc. for the business located at 36480 Plymouth Road. rd SYNOPSIS OF THE MINUTES OF THE 1,663 REGULAR MEETING 2 LIVONIA CITY COUNCIL – August 25, 2010 A communication from the Department of Law, dated August 20, 2010, re: clarification on denial of drive-up window for Dairy Queen, located at 37405 Ann Arbor Road. (Petition 2010-06-02-13) The following resolutions were offered by Pastor and Schwartz: #290-10 Approving the request of Karen L. Werden, 19651 Flamingo, to hold a MAD FAT block party and close Flamingo Boulevard between St. Martins and Bretton on Police Saturday, September 11, 2010 from 2:00 p.m. to 10:00 p.m., with a rain date of September 12, 2010 requested, subject to the approval of the Police Department. #291-10 Approving the request of Julie Freda, 15643 Sussex, to hold a block party MAD and close Sussex between Sherwood and Fitzgerald on Saturday, September 11, 2010 FAT Police from 1:00 p.m. to 10:00 p.m., with a rain date of September 12, 2010 requested, subject to the approval of the Police Department. #292-10 Approving the request of Chris Conway, 14917 Fairway, to hold a block MAD party and close Fairway between Country Club and Jamison on Saturday, September FAT 18, 2010 from 4:00 p.m. to 10:00 p.m., with no rain date requested, subject to the Police approval of the Police Department. #293-10 Approving the request of Thomas Hall, 16620 Country Club, to hold a MAD block party and close Country Club between Wood and Grove on Saturday, September FAT 11, 2010 from 3:00 p.m. to 10:00 p.m., with a rain date of September 18, 2010 Police requested, subject to the approval of the Police Department. #294-10 Approving the request from BL Restaurant Operations, LLC (a Delaware MAD Limited Liability Company), to transfer ownership of a 2009 Class C licensed business FAT Planning with Sunday sales, Official Permit (Food), Outdoor Service (1 Area) and 2 bars from Bar Insp Louie Laurel Park, Inc. (an Illinois Corporation), for a business located at 37716 Six Police Mile Road, Suite A 100, Livonia, MI 48152, Wayne County. Fire MAD #295-10 Approving a Lease Agreement between the City of Livonia and the Livonia FAT City Soccer Club (LCSC), for the Greenmead Soccer Fields 1 & 2 and the Wilson Barn P & R Soccer Field for a period of five (5) years commencing September 1, 2010 and terminating on August 31, 2015, unless otherwise terminated, extended or renewed. #296-10 Approving a Sublease Agreement between the City of Livonia and Detroit MAD Medical Center (DMC) Rehab Institute Of Michigan, 261 Mack, Detroit, Michigan 48201 FAT to sublease a portion of the Community Recreation Center (Adult/Sr. Lounge) and to P & R provide health and wellness services to patrons for a period of five (5) years with the understanding that DMC will pay $24,000.00 per year for a total of $120,000.00. rd SYNOPSIS OF THE MINUTES OF THE 1,663 REGULAR MEETING 3 LIVONIA CITY COUNCIL – August 25, 2010 #297-10 Approving a contract between the City of Livonia and Orchard, Hiltz and MAD McCliment, 34000 Plymouth Road, Livonia, Michigan 48150, to provide Construction FAT Engineering (CE) services for the Newburgh Road improvements and Traffic Signal Eng Modernization Project, from Laurel Park Drive North to Seven Mile Road and to enter Planning into a third party agreement with MDOT in an amount not to exceed $127,916.44; FURTHER, authorizing an additional expenditure in the amount of $15,116.44 for Construction Engineering from budgeted funds. (CR 267-10) #298-10 Authorizing the expenditure of the additional sum of $87,891.30 from MAD budgeted funds, to be paid to Nagle Paving Company, 36788 Amrhein, Livonia, FAT Michigan 48150; FURTHER authorizing the City Engineer to approve minor adjustments Eng in the work, as needed. (CR 162-10) Planning #299-10 Approving and authorizing an agreement between the Michigan MAD Department of Transportation (MDOT) and the City of Livonia for traffic signal upgrades FAT along Middlebelt Road from Five Mile Road to Seven Mile Road; FURTHER authorizing Eng Planning the expenditure of the sum of $94,600.00 for the City’s estimated share of this project (20% of the total estimated cost for this project of $473,000.00). MAD #300-10 Approving the request from Lone Pine Corral, Inc. to transfer ownership of FAT a 2009 Class C licensed business, located in escrow at 6200-6208 N. Telegraph, Planning Dearborn Heights, Michigan 48127, Wayne County, from United Bank and Trust – Insp Washtenaw; for the business located at 36480 Plymouth Road, Livonia, Michigan Police 48150, Wayne County; and request for a new dance-entertainment permit. Fire #301-10 Amending and revising Council Resolution 188-10 to incorporate changes MAD requested by the Michigan Department of Treasury in connection with the application FAT submitted by Wahler Automotive Systems, Inc. for an exemption of New Personal Assessr Property at their facility located at 13753 Otterson Court. (Industrial Development Planning Overlay District No. 111) (CR 188-10) A roll call vote was taken on the foregoing resolutions with the following result: AYES: Brosnan, Schwartz, Pastor, Meakin, and Toy. NAYS: None. #302-10 Resolution by Pastor and Meakin, unanimously adopted, approving MAD Petition 2010-06-02-13 submitted by Dairy Queen requesting to operate a full service FAT restaurant on property located on the southwest corner of Ann Arbor Road and Eng Newburgh Road (37405 Ann Arbor Road), in the Northeast ¼ of Section 31, subject to Planning conditions. Insp #303-10 Resolution by Pastor and Brosnan, unanimously adopted, referring to the MAD Committee of the Whole for its report and recommendation the subject of drive-up FAT window facilities in connection with Petition 2010-06-02-13 submitted by Dairy Queen Planning on property located on the southwest corner of Ann Arbor Road and Newburgh Road (37405 Ann Arbor Road), in the Northeast ¼ of Section 31. rd SYNOPSIS OF THE MINUTES OF THE 1,663 REGULAR MEETING 4 LIVONIA CITY COUNCIL – August 25, 2010 UNFINISHED BUSINESS #304-10 Resolution by Schwartz and Pastor, unanimously adopted, approving the MAD request of Andy Magar and Carol White, 17515 Doris, to hold a block party and close FAT Sunset between Bobrich and Jeanine on Saturday, September 11, 2010 from 12:00 Police p.m. to 10:00 p.m., with a rain date of September 12, 2010 requested, subject to the approval of the Police Department.
