HomeMy WebLinkAboutSYNOPSIS - 2011-12-14 th SYNOPSIS OF THE MINUTES OF THE 1,695 REGULAR MEETING LIVONIA CITY COUNCIL – DECEMBER 14, 2011 Meeting was called to order at 8:00 p.m. Present: Brian Meakin, Joe Laura, Laura Toy, Maureen Miller Brosnan, Conrad Schwartz, John Pastor and James McCann. Absent: None. #402-11 Resolution by Schwartz and Pastor, unanimously adopted, approving the MAD th minutes of the 1,694 Regular Meeting of the Council held November 30, 2011. FAT On behalf of Council, President McCann presented a plaque to Councilman Schwartz and a plaque to Councilman Meakin and thanked both of them for their years of service. Councilman Meakin said he was grateful for his friends and family and all their support. He said Mayor Kirksey has been a great mentor and is a great leader. He also gave a special thank you to his wife, Colleen, for all her support. He said it has been his honor to serve the people of Livonia and he plans to continue to be involved with public service. th John Pastor wished his nephew Adam, Happy 13 Birthday on December 23, 2011 and th his niece Taylor, Happy 18 Birthday on December 15, 2011. He reminded the public about the Coat, Hat, Glove and Can Drive at the Knights of Columbus on December 19, 2011 from 5:30 p.m. to 7:30 p.m., sponsored by Brian Meakin, Representative John Walsh, and John Pastor. He also reminded everyone about the Toys for Tots program. Pastor said his office at 34018 Beacon is the host for Toys for Tots for the Livonia area; their office telephone number is (734) 522-3800. Families in need can apply at his office. Pastor commended Councilmember Brian Meakin for his service to the City of Livonia and he looks forward to great things from Brian in the future. Pastor also commended Councilmember Conrad Schwartz for his service to the City of Livonia and hopes Conrad stays involved with the community. th Maureen Brosnan wished her daughter, Marie, a Happy 17 Birthday, her birthday is December 22, 2011. Brosnan commended Councilmembers Meakin and Schwartz for their service to the City of Livonia. She said it has been a pleasure serving on Council with both of them. Laura Toy thanked Councilmembers Meakin and Schwartz for their service to the City of Livonia and asked that God bless both of them. Vice-President Joe Laura said he also extends his congratulations to Councilmembers Brian Meakin and Conrad Schwartz. Vice-President Laura, on behalf of the Council, presented President McCann with a gavel and thanked him for serving as President of the Council for the past two (2) years and thanked him for his leadership and work. President James McCann said it is a privilege to serve on Council and he is honored to have served as the Council President. He thanked Mayor Kirksey for all his support. Mayor Kirksey said Council did an excellent job outlining the hard work and dedication of Councilmembers Brian Meakin and Conrad Schwartz. He expressed his appreciation to both of them for their service to the community and says he knows they will both continue to serve the community well in other capacities. Mayor Kirksey commended Council President James McCann for all his hard work and dedication serving as Council President. He thanked Council collectively for all their hard work this year. Mayor Kirksey said at the last Council meeting he failed to mention the Annual Friends of Greenmead Christmas Walk, which was held on Saturday, December 3, 2011, all the proceeds from the event benefit the Greenmead Historical Park. Mayor Kirksey said he welcomes home the 50,000 veterans returning home to the United States, some returning home to Michigan. He said in January some type of structure will be set up to aid them with employment opportunities in the community as they return home. AUDIENCE COMMUNICATION: Marguerite Gwizdala, 9870 Seltzer, distributed a handout because Clara Zerbo Adams could not make it to the meeting herself to distribute the material. The handout contained information on Smart Meters as well as a letter from a customer of Clara’s describing her belief that two Smart Meters on her home are causing her to have headaches and other ill symptoms. She also noted Rochester, Rochester Hills and Brighton have recently adopted a moratorium on Smart Meters in their communities until more information is available. The following items were received and filed: Communication from the Department of Finance, dated November 21, 2011, re: forwarding various financial statements of the City of Livonia for the month ending October 31, 2011. Letter from the City Clerk, dated November 23, 2011, re: tax rate for the Schoolcraft Community College District for the year 2011. Letter from the City Clerk, dated November 23, 2011, re: tax rate for the Oakland Schools District for the year 2011. th SYNOPSIS OF THE MINUTES OF THE 1,695 REGULAR MEETING 3 LIVONIA CITY COUNCIL – December 14, 2011 Letter from the City Clerk, dated November 23, 2011, re: tax rate for the State of Michigan, State Education Tax for the year 2011. Letter from the City Clerk, dated November 23, 2011, re: notification to include Wayne County Zoological Authority Millage in 2011 Winter Tax Levy. Letter from the City Clerk, dated November 23, 2011, re: Breakdown of Wayne County Summer Tax Rates for 2011. Letter from the City Clerk, dated November 23, 2011, re: notification to include Huron- Clinton Metropolitan Authority Millage in 2011 Winter Tax Levy. Communication from the Department of Law, dated October 31, 2011, re: proposed Ordinance Amendment to waive the minimum three story building height requirement in PO, High Rise Professional Office Districts. (Petition 2011-10-06-01) The following resolutions were offered by Schwartz and Meakin: MAD FAT #403-11 Reappointing Margaret Gray as a Republican member of the Board of CivServ Canvassers of the City of Livonia for another four-year term, expiring December 31, ElecClrk 2015. MAD #404-11 Reappointing David Sudek as a Democratic member of the Board of FAT Canvassers of the City of Livonia for another four-year term, expiring December 31, CivServ 2015. ElecClrk MAD #405-11 Approving the agreement between the City of Livonia and the AFSCME FAT Union Local 1917 for the period December 1, 2010, through November 30, 2013. CivServ MAD #406-11 Authorizing participation in the Justice Assistance Grant (JAG) Program FAT and accepting the 2011 Justice Assistance Grant in the amount of $12,228.00, to be Police used to purchase law enforcement equipment. #407-11 Accepting the unit price bid, meeting all specifications, of Dukes Root MAD Control, Inc., 1021 Hiawatha Blvd. West, Syracuse, New York 13204, for completing all FAT work required in connection with the City’s Sewer Line Chemical Root Control Services Eng in an amount not to exceed $30,000.00 from budgeted funds. MAD #408-11 Directing and authorizing the Director of Public Works together with the FAT Finance Director to do all things necessary to prepare specifications and obtain bids for Eng the maintenance and repairs of the City’s sanitary sewer system. #409-11 Authorizing an amendment to the Engineering contract with Orchard, Hiltz, MAD and McCliment, Inc., 34000 Plymouth Road, Livonia, Michigan 48150, in an amount not FAT to exceed $8,000.00 for Design Engineering services for the Pedestrian Signals and Eng ADA Ramp Upgrade Project for Newburgh Road at Churchill High School; FURTHER, th SYNOPSIS OF THE MINUTES OF THE 1,695 REGULAR MEETING 4 LIVONIA CITY COUNCIL – December 14, 2011 authorizing an additional expenditure in the amount of $8,000.00 from funds budgeted; FURTHER, authorizing the City Engineer to approve minor adjustments in the work as required. #410-11 Authorizing an amendment to the Engineering contract with Orchard, Hiltz, MAD and McCliment, Inc., 34000 Plymouth Road, Livonia, Michigan 48150, in an amount not FAT to exceed $7,602.86 for Construction Engineering services for the Churchill High School Eng Pedestrian Traffic Signal Replacement Project in an amount not to exceed $7,602.86 from budgeted funds; FURTHER, authorizing the City Engineer to approve minor adjustments in the work as required. #411-11 Authorizing a third party agreement between the City of Livonia and MAD Orchard, Hiltz, & McCliment, Inc., 34000 Plymouth Road, Livonia, MI, 48150, to provide FAT Construction Engineering Services for the Newburgh Road Improvement Project from Eng Five Mile Road to Laurel Park Drive North, in an amount not to exceed $531,876.88; FURTHER, the Council does hereby authorize an expenditure in an amount not to exceed $531,876.88 from funds budgeted for this purpose; and the City Engineer is hereby authorized to approve minor adjustments in the work, as it becomes necessary; FURTHER, authorizing the Mayor and City Clerk, for and on behalf of the City of Livonia, to execute a contract amendment with Orchard, Hiltz & McCliment, Inc., 34000 Plymouth Road, Livonia, MI 48150, pertaining to materials testing. MAD #412-11 Approving Petition 2011-10-08-12, submitted by Masri Orthodontics, in FAT connection with a proposal to demolish an existing building and construct a new medical Eng office building, located at 15230 Levan Road subject to conditions. Insp Planning A roll call vote was taken on the foregoing resolutions: AYES: Meakin, Laura, Toy, Brosnan, Schwartz, Pastor and McCann. NAYS: None. Brosnan gave FIRST READING to the following Ordinance: AN ORDINANCE AMENDING SECTION 23 OF THE ZONING MAP OF THE CITY OF LIVONIA AND AMENDING ARTICLE III OF ORDINANCE NO. 543, AS AMENDED, KNOWN AND CITED AS "THE CITY OF LIVONIA ZONING ORDINANCE" BY ADDING SECTION 3.____ THERETO. (Petition 2011-07-01-03) Pastor gave FIRST READING to the following Ordinance: AN ORDINANCE AMENDING CHAPTER 32 (PROPERTY MAINTENANCE CODE) OF TITLE 15 OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. Pastor gave FIRST READING to the following Ordinance: th SYNOPSIS OF THE MINUTES OF THE 1,695 REGULAR MEETING 5 LIVONIA CITY COUNCIL – December 14, 2011 AN ORDINANCE AMENDING SUBSECTION (a) OF SECTION 26.04 OF ARTICLE XXVI (PERMITTED USES) OF ORDINANCE NO. 543, AS AMENDED, KNOWN AND CITED AS "THE CITY OF LIVONIA ZONING ORDINANCE." (Petition 2011-10-06-01) Toy gave SECOND READING to the following Ordinance: AN ORDINANCE AMENDING SECTIONS 020 AND 030 OF TITLE 15, CHAPTER 16 (FIRE PREVENTION CODE) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. A roll call vote was taken on the foregoing Ordinance: AYES: Meakin, Laura, Toy, Brosnan, Schwartz, Pastor and McCann. NAYS: None. AUDIENCE COMMUNICATION: None. Toy announced Tail Waggers will be hosting a Pet Food Drive this weekend at Five Mile and Harrison from 9:30 a.m. to 5:00 p.m., Saturday, December 17, 2011 and Sunday, December 18, 2011. The public is encouraged to participate. Pastor wished everyone a Merry Christmas and Happy New Year. Councilmember Conrad Schwartz said it has been a privilege to serve the residents of Livonia as Councilmember. He thanked Council for the opportunity to serve with them on Council. He said the Council serves the City of Livonia very well and works very hard and take their jobs very seriously. He thanked Mayor Kirksey for his respect and leadership and the men and women he has chosen to assist him. He also thanked Dennis Wright, Terry Marecki and Don Knapp for their friendship. He also expressed his appreciation to Judy Priebe, Jackie Higham and the recently retired Karen Tesner. He said he is very grateful to all those who serve and protect the citizens of Livonia. He welcomed Brandon Kritzman and Tom Robinson as the newly elected Councilmembers. President McCann thanked Councilmembers Schwartz and Meakin for their kind words.
