Absent: None. th MAD #263-13 Resolution by Pastor and Robinson, approving the minutes of the 1,734 FAT Regular Meeting of the Council held August 12, 2013. A roll call vote was taken on the foregoing resolution: AYES: Robinson, Brosnan, McCann, Laura, Pastor, and Toy. NAYS: None. PRESENT: Kritzman. President Toy announced there is new data on Item #24. President Toy wished a Happy Birthday to Councilmember Joe Laura and City Clerk Terry Marecki. Vice-President Pastor wished a Happy Birthday to Heather Lombardini, John Walsh, and his daughter-in-law Ashley. Kritzman wished a Happy Birthday to his wife Rebecca and his daughters Anna and Jackie. Brosnan wished a Happy Birthday to her son Rory. AUDIENCE COMMUNICATION: Suzanne Yarbrough, 33428 Richland, expressed her concerns regarding Smart Meters. Ron Yarbrough, 33428 Richland, expressed his concerns regarding Smart Meters. Dianne Webb, Wayne County Commissioner, said she was glad that Lyle Trudell, Parks and Recreation Superintendent, was going to be investing the grant dollars allocated to the City by Wayne County for the pool liner and said she happy to work with him on this project. Christopher Martin, 12275 Inkster, expressed his concerns regarding Council procedures. Communication from the Office of the City Clerk, dated July 17, 2013, re: tax rate for the Clarenceville School District for the 2013-2014 school year, as approved by the Board of Education on June 27, 2013. Communication from the Office of the City Clerk, dated July 17, 2013, re: tax rate for the Wayne County Regional Educational Service Agency (RESA) for the 2013-2014 school year, as approved by the Board of Education of the Wayne County Regional Educational Service Agency on June 12, 2013, and requesting that it be collected as a summer tax. Communication from the Office of the City Clerk, dated July 17, 2013, re: tax rate for Schoolcraft College for the 2013-2014 school year, as approved by the Board of Trustees of the Schoolcraft Community College District on May 22, 2013, and requesting that it be collected as a summer tax. Communication from the Office of the City Clerk, dated July 17, 2013, re: tax rate for Oakland Schools Intermediate School District, for the 2013-2014 school year, as approved by the Oakland County Board of Commissioners on June 10, 2013, and requesting that it be collected as a summer tax. Communication from the Office of the City Clerk, dated July 17, 2013, re: tax rate for the State Education Tax, as submitted by the State Treasurer on April 23, 2013, and requesting that it be collected as a summer tax. Communication from the Office of the City Clerk, dated July 17, 2013, re: tax rate for the Wayne County and requesting that 5.6483 Charter authorized mills be collected by the City of Livonia as part of the summer tax and the remainder be collected as part of the winter tax collection. Communication from the Office of the City Clerk, dated July 17, 2013, re: tax rate for the Plymouth Road Development Authority as approved on May 13, 2013, and requesting that it be collected as a summer tax. Communication from Jill Johnson, 11724 Cardwell Avenue, received in the Office of the City Clerk on August 23, 2013, re: providing signatures of neighboring residents on Cardwell Avenue who oppose the proposed lot split submitted by Marco Cervi for property at 11683 Cardwell Avenue. MAD #267-13 Approving a request by Paul Manoian, Blue Cross Blue Shield of FAT Michigan, for an annual meeting on September 13, 2013, waiving the Noise Control Police Ordinance, to allow the use of a low volume sound system at Rotary Park, from 8:00 OrdEnf a.m. to 2:00 p.m. P&R #268-13 Approving the request of Tina Schiller, Valassis, to conduct a 5K MAD Fun/Run/Walk Wellness Challenge and barricade Victor Parkway between Seven and FAT Police Eight Mile and Pembroke off of Newburgh, on Saturday, October 5, 2013, between 7:30 a.m. and 10:30 a.m., with a rain date scheduled for Sunday, October 6, 2013, subject to the approval of the Police Department. MAD #269-13 Referring the matter of the request of Ali Albo, to purchase the City- FAT owned lot located at 27560 Joy Road, in order to establish a driveway and allow for a Insp Planning garage to be built to the Planning Commission for its report and recommendation. (Tax Eng Parcel No. 46-144-99-0161-000) MAD #270-13 Approving a request submitted by Kimberly Griffin, 14364 Bentler Street, FAT Ord Enf Detroit, Michigan 48223, for a massage apprentice permit. Police #271-13 Approving a request submitted by Beverly Osentoski, 15097 Inkster, MAD FAT Livonia, Michigan 48154, for a massage apprentice permit. Ord Enf Police #272-13 Accepting the proposal of Plante & Moran, LLP, 27400 Northwestern MAD Highway, P.O. Box 307, Southfield, Michigan 48037-0307, to perform the City's FAT annual audits for the fiscal years ending November 30, 2013 through November 30, 2017. #273-13 Accepting a grant in the amount of $238,594.00 from the Federal MAD FAT Transit Administration for Livonia Community Transit to update and build out ComRes the City's Call Center; FURTHER, the Council does hereby appropriate and credit the amount of $238,594.00 to the Capital Outlay Account for the purposes as designated by the grantor. th SYNOPSIS OF THE MINUTES OF THE 1,735 REGULAR MEETING 4 LIVONIA CITY COUNCIL – August 26, 2013 #274-13 Authorizing another contract between the City of Livonia and Livonia MAD FAT Towing, Inc., 12955 Levan, Livonia, Michigan 48150, for police towing and storage Police services for a period of two (2) years, with the contract fees to remain the same as the existing agreement; with a clause to extend the contract for an additional year subject to a satisfactory performance. (CR 106-09 and CR 116-11) MAD #275-13 Approving and updating the Nationwide Retirement Solutions Plan to FAT permit participant loans in accordance with applicable IRS regulations. Fire MAD #276-13 Authorizing the Mayor and City Clerk, for and on behalf of the City of FAT Livonia, to execute an agreement between the Michigan Department of Eng Transportation (MDOT) and the City of Livonia for the temporary widening work on the left-turn lane of the ramp connecting Southbound Highway I-275/I-96 to 6 Mile Road; FURTHER, the Council does hereby appropriate and authorize the expenditure of a sum not to exceed $2,600.00 for this project from the Unexpended Fund Balance of the Major Road Fund in the amount of $2,600.00 for this project be approved. #277-13 Approving Petition 2013-05-03-01 submitted by Farmington Property MAD FAT L.L.C., to vacate part of an existing utility easement located on the west side of Eng Levan Road between Amrhein Road and Commerce Street (12445 and 12319 Levan Insp Road) subject to conditions. Brosnan gave SECOND READING to the following Ordinance: AN ORDINANCE AMENDING SECTION 13 OF THE ZONING MAP OF THE CITY OF LIVONIA AND AMENDING ARTICLE III OF ORDINANCE NO. 543, AS AMENDED, KNOWN AND CITED AS “THE CITY OF LIVONIA ZONING ORDINANCE” BY ADDING SECTION 3._____ THERETO. (PETITION 2013-04-01-02) A roll call vote was taken on the foregoing Ordinance: AYES: Robinson, Brosnan, Kritzman, McCann, Laura, Pastor, and Toy. NAYS: None. MAD #278-13 Resolution by Robinson and Brosnan, unanimously adopted, denying the FAT request for a lot split of Tax Item No. 46-100-01-0384-001, located at 11683 Cardwell Eng Avenue, submitted by Marco Servi, 12419 Stark Road, Livonia, Michigan 48150, Assessr because the request, if granted, would create two lots that do not meet the minimum lot Planning size dimensions of 60 feet in lot width by 120 feet in lot depth set forth in Section 4.04 of Zoning Ordinance No. 543, as amended. th SYNOPSIS OF THE MINUTES OF THE 1,735 REGULAR MEETING 5 LIVONIA CITY COUNCIL – August 26, 2013 MAD #279-13 Resolution by Brosnan and Kritzman, unanimously adopted, approving FAT the proposed Intergovernmental Agreement between the County of Wayne and the City P&R of Livonia for the purchase of a heavy duty vinyl liner for Clement Circle Pool utilizing grant funds of $33,000.00. MAD #280-13 Resolution by Pastor and Kritzman, unanimously adopted, approving the FAT request of Elena Herrera, 29840 Mason Street, to waive the Noise Ordinance in Police connection with an outdoor family reunion to be held at 29840 Mason on Saturday, August 31, 2013, from 1:00 p.m. to 10:30 p.m., subject to the approval of the Police Department.
