HomeMy WebLinkAboutSYNOPSIS - 2014-07-07 th SYNOPSIS OF THE MINUTES OF THE 1,756 REGULAR MEETING LIVONIA CITY COUNCIL – JULY 7, 2014 Meeting was called to order at 7:00 p.m. by President Brosnan. Present: Lynda Scheel, Susan Nash, Brandon Kritzman, John Pastor, Brian Meakin, Laura Toy, and Maureen Miller Brosnan. Absent: None. #184-14 Resolution by Toy and Scheel, unanimously adopted, approving the MAD th FAT minutes of the 1,755 Regular Meeting of the Council held June 16, 2014. President Brosnan thanked Vice-President Meakin for Chairing the last Regular and Study meetings of the Council in her absence. President Brosnan announced there will be two (2) Public Hearings held in the Auditorium of City Hall, 33000 Civic Center Drive, Livonia, Michigan for the following items on the following dates and times: 1. Monday, July 14, 2014, at 7:00 p.m., re: Petition 2014-02-01-01 submitted by the City Planning Commission, requesting to rezone property located on the northeast corner of Farmington Road and Six Mile Road (17108 Farmington Road), in the Southwest ¼ of Section 10 from C-2 (General Business) to C-1 (Local Business). 2. Monday, July 28, 2014, at 7:00 p.m., re: Petition 2014-06-01-05 submitted by Trinity Continuing Care Services, Inc., on behalf of the Marycrest Manor, requesting to rezone property located on the west side of Middlebelt Road between Five Mile Road and Wentworth Avenue (15475 Middlebelt Road), in the Southeast ¼ of Section 14 from R-9-I (Housing for the Elderly) to OS (Office Services). President Brosnan announced there is new data on Items #10, #17, #19, #21 and #23. President Brosnan wished Councilmember Susan Nash a Happy Birthday, this coming Monday. Nash announced the passing of Patricia McCann and asked for a moment of silence. Pastor expressed his condolences to the family of Patricia McCann. Pastor also expressed condolences to the family of Jonathon Swanson who recently passed away. th Pastor wished a Happy Birthday to his daughter Rachel, July 16 and his son Ryan, th July 18. Kritzman wished a belated Happy Birthday to his daughter Isabella who turned 8 on June 27, 2014. th SYNOPSIS OF THE MINUTES OF THE 1,756 REGULAR MEETING 2 LIVONIA CITY COUNCIL – July 7, 2014 Toy announced the passing of retired Livonia Fire Chief Barney Knorp; she said he will be greatly missed and expressed her condolences to his family. Kritzman expressed his sympathy to the family of John Bieniewicz, the soccer referee that died from injuries he received when he was assaulted by a soccer player he was ejecting from a match last weekend at Mies Park. He said anyone wishing to make a donation to his family can drop off donations at the Livonia Police Department or any Huntington Bank branch in Michigan by mentioning his name. Toy said the Livonia Spree had another successful year; she commended all those involved in making it a success. President Brosnan congratulated Judy Priebe on officially becoming Director of Legislative Affairs, she has been acting in this role for a few years but now it has been made official. President Brosnan said that the position is well deserved. AUDIENCE COMMUNICATION: Timothy King, 1573 Mollie, Ypsilanti, spoke about the bi-partisan proclamation that was passed by the Willow Run Tea Party Caucus on March 18, 2014 that is being supported by mayors throughout Western Wayne and Washtenaw counties asking legislation to be passed providing funding for a memorial dedicated to the contributions of the Willow Run Bomber Plant in Ypsilanti, Michigan and its workers. John Grzebik, 11301 Hubbell, Vice-President, PTSA Council, encouraged voters to support the renewal of the millages for the Livonia Public Schools Operating Fund and the Building and Site Sinking Fund that will be on the ballot on the August 5, 2014 Primary Election. Mayor Kirksey commented on the liberalization of the sale of fireworks and how it is very troublesome. During the period July 3-5, 2014 there were over 100 calls received with many people complaining about fireworks going off after 11:00 p.m. and noise disturbances, especially by pet owners and the elderly. Mayor Kirksey said the City needs to ask State Legislators to revisit the Fireworks Law and see where it can be improved at the state and local levels. Captain Ron Taig, Livonia Police Department, confirmed that the fireworks that were being shot off in the vicinity of Eight Mile Road and Merriman Road rivaled the fireworks display at the Livonia Spree. He said it did take up a lot of time from the Livonia Police Department to respond to the many calls they received complaining about the fireworks. He said more needs to be done to empower the Police to keep peace in the community with regard to the Fireworks Law. th SYNOPSIS OF THE MINUTES OF THE 1,756 REGULAR MEETING 3 LIVONIA CITY COUNCIL – July 7, 2014 MAD #185-14 Resolution by Meakin and Kritzman, unanimously adopted, referring the FAT subject of what can be done to limit fireworks usage in the City, to the Legislative Affairs Police Committee for its report and recommendation. The following items were received and filed: Communication from the Department of Finance dated May 16, 2014, re: forwarding various financial statements of the City of Livonia for the month ending March 31, 2014. Correspondence from the Chief of Police, dated July 1, 2014, re: the total cost of the bid for the 9-1-1 System. Communication from the Livonia Traffic Commission, dated May 15, 2014, re: vehicle parking on both sides of the street limiting regular traffic and emergency response vehicles, in the neighborhood of Blue Skies, south of Seven Mile Road. Communication from the Livonia Traffic Commission, dated May 15, 2014, re: vehicles parking in the right-of-ways on Middlebelt Road between Six and Seven Mile Roads and Merriman Road between Plymouth and Joy Roads. Communication from the Livonia Traffic Commission, dated May 28, 2014, re: replacement Stop signs on Elmira Street between Merriman and Hubbard Roads. Communication from the Superintendent of Public Service-Environment & Utilities, dated June 30, 2014, re: additional information on request to purchase two (2) 2015 Ford F250 Super Cab 4X4 Pick-up Trucks with plows. Correspondence from the Livonia Hockey Association, dated June 17, 2014, re: the assignment of lease with consent of lessor agreement. (CRS 219-11, 221-10, 391-08, 144-06, and 145-06) Communication from the Superintendent of Public Service-Environment & Utilities, dated June 30, 2014, re: additional information on request to purchase one (1) 2015 Ford F250 Super Cab 4x4 Pick-up Truck with plow and lift gate. Correspondence from Primos Properties, LLC, dated July 2, 2014, re: their objection to the request to rezone the property at 27403 and 27451 Schoolcraft Road. (Pet. 2014- 02-01-02) Correspondence from Fadi Saad, Petitioner, dated July 6, 2014, re: several reasons why Council should approve their request to rezone the property at 27403 and 27451 Schoolcraft Road. (Pet. 2014-02-01-02) The following resolutions were offered by Meakin and Scheel: th SYNOPSIS OF THE MINUTES OF THE 1,756 REGULAR MEETING 4 LIVONIA CITY COUNCIL – July 7, 2014 #186-14 Approving the request of Denise Beers, 38778 Northfield Avenue, to close MAD FAT Marie Street at Knolson and Marie Street at Minton, on Saturday, August 2, 2014 from Police 4:00 p.m. to 10:00 p.m. for the purpose of conducting a block party, with a rain date of Saturday, August 16, 2014 requested, subject to the approval of the Police Department. MAD #187-14 Approving the request of Ron Bozzi, to close Curtis Street from Lathers FAT west to the nature trail, on Saturday, July 19, 2014 from 11:00 a.m. to 11:00 p.m. for the Police purpose of conducting a block party, subject to the approval of the Police Department. #188-14 Approving the request of Fred Florkowski, 15498 Meadowbrook, to close MAD FAT Grantland between Arcola and Cavell, on Saturday, July 26, 2014 from 10:00 a.m. to Police 9:00 p.m. for the purpose of conducting a block party, subject to the approval of the Police Department. #189-14 Approving the request of Patty A. Begley-Smith, waiving the sidewalk MAD FAT requirement for the single family home to be constructed at 20326 Purlingbrook Street; Eng FURTHER, reserving the right to require sidewalks at this location in the event that additional sidewalks are installed in this area at some future date. MAD #190-14 Determining to consider a revised proposal for a special assessment FAT Eng district to install a 10-inch sanitary public sewer main to service parcels located on the Assessr east side of Levan Road (15160, 15200, and 15230 Levan Road), subject to conditions. MAD #191-14 Approving the appointment of Robert S. Bowling to the Zoning Board of FAT Appeals for a three-year term expiring on July 12, 2017. CivSvc ZBA #192-14 Approving the reappointment of Vahan Nazarian to the Board of Review MAD for a three-year term expiring on February 16, 2017. FAT CivSvc #193-14 Authorizing the Mayor and City Clerk, for and on behalf of the City of MAD Livonia, to execute all contracts in connection with Phase Two of the Nehasil Park FAT P&R improvements, after review and approval of the Law Department; FURTHER, authorizing an appropriation and expenditure in an amount not to exceed $268,446.32 from the Unexpended Fund Balance of the Community Recreation Fund for this purpose, with the understanding that the fund will be reimbursed by private donations and the $140,000 grant from Wayne County. (CRS 137-14, 165-13, 293-13 and 298-13) MAD #194-14 Determining to conduct a Public Hearing on Wednesday, October 8, 2014 FAT at 7:00 p.m. at the Livonia City Hall, 33000 Civic Center Drive, Livonia, MI, regarding the Annual Budget for the fiscal year ending November 30, 2015. MAD #195-14 Referring the subject of the Annual Budget for the fiscal year ending FAT November 30, 2015, to the Finance, Budget and Technology Committee for its report and recommendation. th SYNOPSIS OF THE MINUTES OF THE 1,756 REGULAR MEETING 5 LIVONIA CITY COUNCIL – July 7, 2014 #196-14 Authorizing the purchase of a new Next Generation, Enhanced 9-1-1 MAD System (“NexGen E9-1-1) with additional options to improve the redundancy and FAT Police expandability of the system from Intrado Systems Corporation, 1601 Dry Creek Drive, Longmont, Colorado 80503, in an amount not to exceed $143,445.08; FURTHER, authorizing the Mayor and City Clerk, for and on behalf of the City of Livonia, to enter into a six-year maintenance agreement for the NEXGEN E9-1-1 System in an amount not to exceed $80,750.00; FURTHER, authorizing an expenditure in a total amount not to exceed $224,195.08 from funds budgeted for this purpose. #197-14 Accepting a risk avoidance program (RAP) grant from the Michigan MAD FAT Municipal Risk Management Authority in the total amount of $2,000.00 to reimburse the Police City for the purchase and training costs incurred for the newest K-9, Kuno. MAD #198-14 Directing the Administration to contact the Wayne County Road FAT Commission relative to placing signs which would restrict parking in the right-of-way on Police roads located in the City of Livonia which are under the jurisdiction of Wayne County. TrafCom #199-14 Designating the Director of Public Works and the City Engineer, positions MAD currently held by Kevin L. Maillard, P.E. and Todd J. Zilincik, P.E., respectively, as the FAT Eng authorized representatives for all activities associated with the DWRF Project No. 7355- 01, including the submittal of said Project Plan as the first step in applying to the State of Michigan for a Drinking Water Revolving Fund Loan to assist in the implementation of the selected alternative. #200-14 Authorizing the purchase of one (1) 2015 Ford F350 Dual Rear Wheel MAD FAT (DRW) - Stake Truck, for the Public Service Division to replace a current vehicle in the Roads Section, from Signature Ford, 1960 E. Main Street, Owosso, Michigan 48867, in the amount of $25,167.00, to be fitted with a snow plow and other items by Cannon Truck Equipment, 51761 Danview Technology Court, Shelby Township, Michigan 48315, in the amount of $17,810.00, and configured to run on either propane or unleaded gasoline by ICOM North America LLC, 54790 Grand River, New Hudson, Michigan 48165, in the amount of $6,325.00, for a total price for such truck as fitted and configured to not exceed $49,302.00 from funds budgeted. #201-14 Authorizing the purchase of two (2) 2015 Ford F250 Super Cab, 4x4 pick- MAD up trucks with plows, for the Public Service Division to replace current vehicles in the FAT Parks Maintenance and Road Section, from Signature Ford, 1960 E. Main Street, Owosso, Michigan 48867, in the total amount of $92,049.00 from funds budgeted. #202-14 Approving Petition 2014-05-02-08 submitted by EJB Enterprises, L.L.C., MAD FAT on behalf of Biggby Coffee #416, to operate a full service restaurant (Biggby Coffee), Insp located on the southwest corner of Ann Arbor Road and Newburgh Road (37405 Ann Plan Arbor Road), subject to conditions. Eng th SYNOPSIS OF THE MINUTES OF THE 1,756 REGULAR MEETING 6 LIVONIA CITY COUNCIL – July 7, 2014 MAD #203-14 Approving the assignment for Livonia Hockey Association of its rights and FAT responsibilities and transfer Livonia Hockey Association leases for use of the Devon- Insp Aire and Eddie Edgar Arenas to Livonia Civic Arenas, Inc. (LCA). (CRS 219-11, 221-10, Plan 391-08, 144-06 and 145-06) Eng A roll call vote was taken on the foregoing Resolutions: AYES: Scheel, Nash, Kritzman, Pastor, Meakin, Toy, and Brosnan. NAYS: None. Toy gave SECOND READING to the following Ordinance: AN ORDINANCE VACATING THE USE OF PORTIONS OF STREET, ALLEY AND PUBLIC GROUND. (Petition 2014-02-03-01) (CR 139-14 and CR 86-14) A roll call vote was taken on the foregoing Ordinance: AYES: Scheel, Nash, Kritzman, Pastor, Meakin, Toy, and Brosnan. NAYS: None. #204-14 Resolution by Kritzman and Toy, unanimously adopted, authorizing the MAD purchase of one (1) 2015 Ford F250 Super Cab, 4 x 4 pick-up truck with plow and lift FAT gate, for the Public Service Division, to replace a current vehicle in the Water Maintenance Section, from Signature Ford, 1960 E. Main Street, Owosso, Michigan 48867, in the total amount of $53,271.00, from funds budgeted. MAD #205-14 Resolution by Meakin and Toy, unanimously adopted, approving Petition FAT 2014-04-02-07 submitted by Panera Bread, L.L.C. to add a drive-up window facility to Insp an existing full service restaurant, located on the east side of Haggerty Road between Plan Seven Mile and Eight Mile Roads (20140 Haggerty Road), subject to conditions. Eng MAD #206-14 Resolution by Toy and Meakin, referring the matter of whether or not to FAT approve the rezoning of the property at 27403 and 27451 Schoolcraft Road from OS Plan (Office Services) and M-1 (Light Manufacturing) to C-2 (General Business) to the Committee of the Whole for its report and recommendation. (Pet. 2014-02-01-02) A roll call vote was taken on the foregoing Resolutions: AYES: Meakin, Toy, Scheel, Nash, Kritzman, and Brosnan. NAYS: Pastor. #207-14 Resolution by Pastor and Kritzman, unanimously adopted, approving the MAD request of Nicole Bush, 14641 Susanna, to close Susanna Street between Ross and FAT Police Donald, on Saturday, July 12, 2014 from 10:00 a.m. to 10:00 p.m. for the purpose of conducting a block party, with a rain date of Sunday, July 13, 2014 requested, subject to the approval of the Police Department. th SYNOPSIS OF THE MINUTES OF THE 1,756 REGULAR MEETING 7 LIVONIA CITY COUNCIL – July 7, 2014 #208-14 Resolution by Toy and Meakin, unanimously adopted, approving the MAD request of Kevin and Kristina Delisle, to waive the Noise Ordinance, in order to hold a FAT Police graduation party until 11:00 p.m. at their home located at 28290 Seven Mile Road, on Saturday, July 12, 2014, subject to the approval of the Police Department. MAD #209-14 Resolution by Toy and Kritzman, unanimously adopted, accepting the FAT cash donation of $1,000 from Allstate Insurance for the purposes designated by the Police donor.
