MINUTES OF STUDY MEETING HELD NOVEMBER 26, 2012
Meeting was called to order at 8:00 p.m. Present: James McCann, Joe Laura,
John Pastor, Maureen Miller Brosnan, and Laura Toy. Absent: Brandon Kritzman and
Thomas Robinson.
Elected and appointed officials present: Todd Zilincik, City Engineer; Mark
Taormina, Director of Planning and Economic Development; Don Knapp, City Attorney;
Terry Marecki, City Clerk; and Jack E. Kirksey, Mayor.
Brosnan congratulated Councilmember Kritzman and his wife on the birth of their 5th
daughter, Alexandra Cosette, born today at 2:56 p.m. weighing 7 lbs. and measuring 20
and '/4 inches long.
President Toy announced Item #9 is being removed from the Agenda.
Mayor Kirksey announced the Tree Lighting Ceremony is next Tuesday, December 4,
2012, at 7:00 p.m.

NEW BUSINESS
1. REQUEST TO APPROVE A SIDEWALK EXTENSION: submitted by Bryan
Garchar, re: for the south side of Ann Arbor Trail from Dowling Street to
Rosedale Elementary for safety reasons.
Bryan Garchar, 36549 Ann Arbor Trail, was present to answer any questions
council may have. He is requesting the sidewalk extension for the safety of the
students and parents who walk to and from school. He said it is a high traffic area
for students and parents.
McCann asked Taormina if he had an opportunity to review this before the
meeting tonight; Taormina replied no he had not.
McCann asked if it was known who owns the property where the proposed
sidewalks would be constructed. Garchar said yes, there are four (4) residences;
he had spoken to one (1) of the owners. McCann asked Garchar if he knew if any
of the owners are here tonight. Garchar replied one of them is present in the
audience. McCann noted he saw the petition signed by some residents but he is
not sure if any of them are one of the property owners, he was concerned if the
four (4) property owners had any issues with the request. Garchar said 2 of them

had concerns about the cost and financing of the sidewalks. He said 2 of them
had concerns about the location and whether it would interfere with their current
landscaping.
McCann offered the resolution referring the matter to the Administration for its
report and recommendation for the Consent Agenda.
Todd Zilincik, City Engineer, agreed with McCann, said they would need to go
out and take a look and get an estimate on the cost. He said the right of way is
also a concern of his. Zilincik said the area in question is about 1,000 lineal feet
which is about 500 square feet. He said they would do a thorough report and
recommendation for the Council with some diagrams.
Laura suggested referring the matter to the appropriate Committee and have
Zilincik go out and give his recommendation to the Committee.
McCann said his concern is for the residents. He said when the report comes
back with some estimates; it might be a 2 second discussion.
Brosnan thanked Mr. Garchar for bringing the matter to the attention of the
Council. She said he did exactly as he should have. She said Livonia is a City
with Special Assessments; she explained the process of having a first Public
Hearing to determine the necessity of the sidewalk and then a second Public
Hearing to determine the cost. The fact that there are neighbors that are
interested in having the sidewalk extended is also something for them to take into
consideration. She thinks it would be best if the City researched the matter and
kept him apprised of any meetings related to the matter. She said it is never just
a one stop deal for these types of requests.
President Toy did note there is a matter of safety for the children and asked
Zilincik how long before they would be able to get out there. Zilincik responded
by saying within ten (10) days they should be able to get out there, assess the
area of concern and report back with their recommendation.

2. APPLICATION FOR MASSAGE APPRENTICE PERMIT: Office of the City
Clerk, re: submitted by Charnika Holmes in accordance with Chapter 5.49 of the
Livonia Code of Ordinances, as amended.
Charnika Holmes, 1214 Stacey Drive, Canton, was present to answer any
questions Council may have.

3. APPLICATION FOR MASSAGE APPRENTICE PERMIT: Office of the City
Clerk, re: submitted by Jeffrey Ramseyer in accordance with Chapter 5.49 of the
Livonia Code of Ordinances, as amended.
Jeffrey Ramseyer, 33331 Oregon, Livonia, was present to answer any questions
Council may have. President Toy asked Ramseyer what got him into massage;
he said it has helped him personally; he is a painter by trade but eventually will
have to give that up and would like to help others discover the benefits of
massage therapy.
McCann offered the approving resolution for the Consent Agenda.

4. APPLICATION FOR MASSAGE APPRENTICE PERMIT: Office of the City
Clerk, re: submitted by Amy Jackey in accordance with Chapter 5.49 of the
Livonia Code of Ordinances, as amended.
Amy Jackey, 19936 Poinciana, Redford, was present to answer any questions
Council may have. She said her children are grown now and it is time for her to
begin a career of her own.

5. APPLICATION FOR MASSAGE THERAPIST PERMIT: Office of the City Clerk,
re: submitted by Barbara lovan in accordance with Chapter 5.49 of the Livonia
Code of Ordinances, as amended.
Barbara lovan, 14956 Auburndale, Livonia, was present to answer any questions
Council may have. She said it is something she has wanted to do for a number of
years. She said her practice is in the Livonia Yoga Center, she referenced the
location as her second home. She said it is a wonderful healing art and she is
very excited to start. Their website is www.caringtouch.massagetherapy.com.

6. APPLICATION FOR MASSAGE THERAPIST PERMIT: Office of the City Clerk,
re: submitted by Amy Des Jardins in accordance with Chapter 5.49 of the Livonia
Code of Ordinances, as amended.

Amy DesJardins, 624 Reed Court, Northville, was present to answer any
questions Council may have. She said her son was a premature baby and he
received massage therapy. She saw how beneficial massage therapy is and this
is her way of giving back.

7. REQUEST FROM THE MICHIGAN LIQUOR CONTROL COMMISSION TO
INVESTIGATE THE REQUEST FROM VIP LAZEEZ, LLC TO TRANSFER
OWNERSHIP OF A 2011 CLASS C LICENSED BUSINESS WITH DANCE
PERMIT AND OFFICIAL PERMIT (FOOD), FROM COMPTON VILLAGE
COCKTAIL LOUNGE INC.; AND A NEW OFFICIAL PERMIT (DANCE) FOR
WEEKDAYS 2:30 AM TO 7:00 AM AND SUNDAYS, 2:30 AM TO 12:00 PM
(STEP 2): Division of Police, re: for the business located at 28500 Schoolcraft,
Livonia, MI 48150.
At the Direction of the Chair, this item was removed from the Agenda, so that the
Petitioner can be present to answer any questions Council may have.
8. REQUEST TO APPROVE PURCHASE: Public Service Division, re: of one (1)
Combination Sewer Cleaning Truck (Vactor), Parts and Related Services through
the National Intergovernmental Purchasing Alliance (National IPA).
Donald Rohraff, Superintendent, Public Services, presented the request to
Council. The 2013 approved capital outlay budget includes the purchase of one
(1) Vactor for the Water and Sewer Department. Arrangements were made to
incorporate the new vehicle purchase through the National Intergovernmental
Purchasing Alliance (National IPA). The National IPA is a National Cooperative
purchasing contract which was originally a collaborative effort of purchasing
professionals from the Cities of Ann Arbor, Troy and Rochester Hills. This three
year contract was solicited and procured in March of 2011 through the Michigan
Intergovernmental Trade Network (MITN). The National contract runs from March
2011 through March of 2014 with an option to renew for two additional one-year
periods through March 2016. In addition to the National 5% across-the-board
truck pricing discount the contract also includes a 10% discount on all parts, 1
year extension of standard Vactor warranty (2 Years Total), no cost in-service
training, discounted training events (confined space, PACP/MACP etc.), leasing
options and an additional 3% discount on orders of three or more identical units.
One additional advantage of buying now through the National IPA is the more
stringent standards for exhaust systems being implemented in 2013. The same
truck would cost an additional $18,600.00 if they chose to wait until after January
2013. There have been a number of communities taking advantage of the
National IPA contract. The National IPA contract was awarded to Jack Doheny
Companies. Jack Doheny Companies has offered a trade-in on the City of

Livonia's old 2004 Vactor in the amount of $80,000. Doheny has also given the
City of Livonia the option of a 90 day window to sell the Vactor out right to
explore trying to recover additional funds. It is the recommendation of the Public
Service Division that Council authorize the purchase of one (1) 2013 Vactor
Model 2115 combination sewer vacuum & high pressure rodder with 15 cubic
yard debris collector from Jack Doheny Companies, 777 Doheny Court,
Northville, Michigan 48167, for a grand total of$398,512.00.
Brosnan asked Rohraff how many Vactors the City had in its fleet. Rohraff replied
two. Rohraff said they were also seeking Council's approval to put the old one on
MITN and try to sell it for more than $80,000.00; if it doesn't sell they will get at
least $80,000.00 for the trade-in.

9. PROPOSED AMENDMENT TO THE LIVONIA CODE OF ORDINANCES, AS
AMENDED: Law Department, re: to amend Section 2.08(14) (Massage
Establishment), to update the types of businesses that are allowed to have
massages performed.
At the direction of the Chair, this Item was removed from the Agenda.
10. ADMINISTRATIVE RESPONSE TO COUNCIL RESOLUTION 365-12-
Department of Law, re: prepared a resolution of intent to amend the Plymouth
Road Authority District by removing the purely residential parcels from the
district.
Don Knapp, City Attorney, presented the response to Council.

McCann wished his son Tyler a Happy 23rd Birthday on Monday and his grandson
Kaiden a Happy 5t" Birthday on December 4th.
As there were no further questions or comments, President Toy adjourned the Study
Session at 8:35 p.m. on Monday, November 26, 2012.
