The meeting was called to order at 5:30 p.m. Members Present: Charlotte S. Mahoney, Chairperson Harry C. Tatigian Ronald E. Washington, Personnel Analyst II Gretchen Guisbert, Secretary III Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was RESOLVED, That the minutes of the 1202nd Regular Meeting held Thursday, July 15, 2004, be approved as submitted. The Commission received and fled the Status of Temporary Employees Report for July 2004. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was RESOLVED, That having reviewed the Notice of the proposed Revisions to RULE 6, MEETINGS OF COMMISSION, Section 6.1 Regular Meetings, and RULE 16 — CERTIFICATION, APPOINTMENT AND REINSTATEMENT, Section 16.4 Character of Appointments, regarding casual appointment and "at will" related agreement, and having received no employee comments after pasting said proposed changes, and having had discussion with Mary E. Rutan, Human Resources Director, the Civil Service Commission does hereby approve adoption of the proposed revisions to RULE 6 — MEETINGS OF COMMISSION, Section 6.1 Regular Meetings and RULE 16, CERTIFICATION, APPOINTMENT AND REINSTATEMENT, Section 16.4 Character of Appointments, as stated and directs that the Civil Service Department to do all things necessary to publish the new language in the Civil Service Rules and Regulations. The Commission received and fled the Non -Resident Report as of August 1, 2004. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was RESOLVED, That having reviewed Livonia Fire Fighters Union (LFFU) Grievance # 240-01A, dated July 20, 2004, from Phillip D. Kamm, Firefighter, regarding denial of reimbursement for textbooks, and after reviewing a letter dated August 6, 2004, from Alan W. Brandemihl, Jr., Fire Chief, the Civil Service Commission does hereby refer this back, pursuant to the Agreement between the Paget 1203^ Regular Meeting August 1$2004 City of Livonia and the Livonia Firefighters Union, Article 7, Grievance Procedure, for Step 6 for the Labor Management Committee review which is required before submission to the Civil Service Commission. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was RESOLVED, That having reviewed the letter of July 28, 2004, from Linda Alverson, Sewer Maintenance Worker I, as approved for submission by Robert J. Beckley, Director of Public Works, requesting an unpaid medical leave of absence, the Civil Service Commission does hereby approve Ms. Alverson's unpaid medical leave of absence from July 9, 2004 through July 28, 2004. Upon a motion by Mr. Tatigian, it was RESOLVED, That having reviewed the letter of July 23, 2004, from John Orzech, Fire Engineer, as approved for submission by Alan W. Brandemihl, Jr., Fire Chief, requesting to convert vacation leave to personal illness leave, the Civil Service Commission does hereby approve Mr. Orzech's request to change his vacation time for the period of July 16, 2004 through August 5, 2004. The motion dies for lack of support. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was RESOLVED, That having reviewed the letter of July 23, 2004, from John Orzech, Fire Engineer, as approved for submission by Alan W. Brandemihl, Jr., Fire, requesting to convert vacation leave to personal illness leave, and having had discussion with Mary E. Rutan, Human Resources Director, and Derrick L. Washington, Personnel Analyst 11, the Civil Service Commission does hereby table this motion until clarification can be made of how many days off Mr. Orzech is requesting to be converted from vacation leave to personal illness leave. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was RESOLVED, That having reviewed the letter of July 30, 2004, from Brian Kahn, Senior Police Officer, as approved for submission by Robert Stevenson, Police Chief, requesting an extension of family illness leave, the Civil Service Commission does hereby approve Mr. Kahn's request for an additional six (6) family illness leave days, subject to his submission of appropriate medical documentation. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was RESOLVED, That having reviewed the letter of August 4, 2004, from Jack Engebretson, Mayor, requesting an open -competitive examination for Secretary I and proposed qualifications and parts of examination and weights, and having had discussion with Mary E. Rutan, Human Resources Director, the Civil Service Commission hereby approved the following qualifications and parts of examination and weights: Page 3 1203'° Regular Meeting August 12, 2084 QUALIFICATIONS By the closing date of the announcement, an applicant must: 1. Be a citizen of the United States or a resident alien with the right to work in the United States; and 2. Have a high school diploma or a valid equivalency certificate; and 3. Have had a minimum of two (2) years full-time paid secretarial work experience including shorthand dictation and/or dictaphone machine transcription. 4. Have had a minimum of two (2) years full-time paid work experience utilizing Microsoft Word. PARTS OF EXAMINATION AND WEIGHTS Performance Test -25% Written Test -25% Interview -50% A minimum of twenty (20) applicants who score highest on the Performance and Written Test will be invited to the Interview part of the examination. The required minimum typing speed is 50 words per minute without error and the minimum shorthand/dictaphone machine transcription speed is 80 words per minute without error. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was RESOLVED, That having reviewed the letter of July 14, 2004, from Robert Stevenson, Police Chief, requesting an open -competitive examination for Police Dispatcher and proposed qualifications and parts of examination and weights, the Civil Service Commission does hereby approve the following qualifications and parts of examination and weights: QUALIFICATIONS By the closing date of the announcement, applicants must: Be a citizen of the United States or resident alien with the right to work in the United States; and Have a high school diploma or a valid equivalency certificate; and Have either: A. At least one year full-time paid work experience as a Dispatcher for a law enforcement agency; or B. At least one year of full-time paid work experience as a Certified Police Officer; and Have an acceptable voice quality level as determined in the voice modulation test; and Not be an immediate family member of a swom officer employed by the Livonia Police Department (Immediate family member includes but is not limited to: Spouse, Child, Step -Child, Mother, Father, Sister, Step -Mother, Step -Father, Sister-in-law (married to Brother), Brother, Brother-in-law Page 1203'° Regular Meeting August 1$2004 (manned to Sister), Grandparents, Grandchild, or member of the Employee's household.); and Have keyboard skills that meet or exceed 25 wpm without error. PARTS OF EXAMINATION AND WEIGHTS Written Test — 40% Interview - 40% Performance - 20% Voice Modulation Test - Pass/Fail Background Investigation - Pass/Fail Psychological Evaluation Test - Pass/Fail A minimum of the top 15 applicants who score highest on the Written Test, and who pass the Performance keyboard test will be invited to the Interview part of examination. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was RESOLVED, That having reviewed the letter of August 2, 2004, from Alan W. Brandemihl, Jr., Fire Chief, requesting an open -competitive examination for Firefighter and proposed qualifications and parts of examination and weights, and having had discussion with Derrick L. Washington, Personnel Analyst II, the Civil Service Commission does hereby approve the following qualifications and parts of examination and weights: QUALIFICATIONS By the closing date of the announcement, applicants must: 1. Be a citizen of the United States or a resident alien with the right to work in the United States. 2. Be at least 18 years of age. 3. Have a high school diploma or valid equivalency certificate. Preference will be given applicants that have a Bachelors Degree or an Associates Degree in Fire Science or an EMS curriculum. 4. Hold a current State of Michigan Paramedic License or National Registry EMT - Paramedic and be ACLS (Advanced Cardiac Life Support) certified. 5. Possess the Conference of Western Wayne Firefighter Written and Physical Agility Test Certificates. THE AGILITY TEST CERTIFICATE MUST HAVE BEEN ISSUED IN THE TWELVE (12) MONTHS PRIOR TO THE CLOSING DATE OF THE ANNOUNCEMENT. 6. Possess normal visual functions and acuity in each eye of 20/100 or better, connectable to 20/20 with eyeglasses. NOTE: AT THE TIME OF APPLICATION, EACH APPLICANT MUST SUBMIT THE CITY OF LIVONIA VISUAL ACUITY FORM FROM A PHYSICIAN, OPTOMETRIST OR OPHTHALMOLOGIST GIVING THE APPLICANT'S VISUAL ACUITY IN EACH EYE CORRECTED AND UNCORRECTED. (Eye examination must be within six (6) months from the closing date of this announcement). 7. Be free from any physical defects, chronic diseases, organic diseases, organic or functional conditions or mental and emotional instabilities which Pages 1203^ Regular Meeting August 1$2004 may tend to impair the efficient performance of duties or which might endanger the lives of others or the individual employee. Possess and maintain a valid motor vehicle operators or a basic commercial driver's license and have an acceptable driving record. AT THE TIME OF CERTIFICATION TO THE DEPARTMENT FOR FINAL INTERVIEW AND HIRING CONSIDERATION, CANDIDATES MUST POSSESS: A. A current State of Michigan Paramedic License or National Registry EMT - Paramedic, and be currently ACLS certified. B. A State of Michigan Firefighter II Certificate or equivalent certification in a state that has reciprocity. PARTS OF EXAMINATION AND WEIGHTS Written Test -50%` Oral Interview -50% 'NOTE: A minimum of thirty (30) candidates with the highest passing scores on the Written Test will be invited to continue to the Interview portion of the examination process. Remaining candidates who pass the Written Test will have their names kept on file for future reference during the life of the eligible list. The results at each step in the application process will determine eligibility for continuation on to subsequent steps. The process will include application review, written examination, background investigation, oral board interview and a psychological evaluation. The psychological evaluation has a maximum possible score of 25 points. Possession of an Associates Degree in Fire Science or an EMS curriculum will result in one (1) additional point to overall composite score. Possession of a Bachelors Degree in Fire Science or an EMS curriculum will result in an additional two (2) points added to overall composite score. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was RESOLVED, That having reviewed the letter of August 4, 2004, from Kathleen Monroe, Acting City Librarian, requesting a promotional examination for Library Aide II and proposed qualifications and parts of examination and weights, the Civil Service Commission does hereby approve the following qualifications and parts of examination and weights: QUALIFICATIONS This examination is open only to employees of the City of Livonia, who, by the closing date of this announcement are: Currently employed in the Library Department; and Have regular status as a Library Aide I; and Have completed the equivalent of four (4) years full-time paid experience as a Library Aide I in the circulation area. Page 6 120V Regular Meeting August 12, 2004 PARTS OF EXAMINATION AND WEIGHTS Written Test -40% Interview -40% Departmental Rating -20%` `In the event there is only one qualified applicant for the position, the Parts of Examination and Weights will be 100% Departmental Rating. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was RESOLVED, That the Civil Service Commission does hereby approve the passing point of 70% or the actual score of 70 out of 100 in the written examination for Equipment Mechanic II (1189 p.). Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was RESOLVED, That the Civil Service Commission does hereby approve the eligible list for Equipment Mechanic II (1189 p.). Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was RESOLVED, That having reviewed the request to change the Parts of Examination and Weights for Senior Fire Equipment Mechanic (1190 p.) to 100% Departmental Rating, the Civil Service Commission does hereby approve the change in the Parts of Examination and Weights to 100% Departmental Rating, based upon the fact that there was only one (1) qualified applicant. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was RESOLVED, That the Civil Service Commission does hereby approve the eligible list for Senior Fire Equipment Mechanic (1190 p.). Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was RESOLVED, That having reviewed the expiring eligible lists for the month of August 2004 — Custodian (856 o.c.), Police Officer II (839 o.c.), Building Mechanic 1 (1167 p.) and Equipment Operator III (1153 p.), the Civil Service Commission does hereby approve to extend the eligible lists for Custodian (856 o.c.) and Building Mechanic 1 (1167 p.) for an additional six (6) months. The Commission received and filed the following items: Council Resolutions from the meeting of June 16, 2004, with minutes being approved July 7, 2004: CR# 306-04 Appointing Craig S. Pastor, 20072 Parker, Livonia, Michigan 48152, to the Zoning Board of Appeals for a three-year term expiring July 12, 2007, provided that Mr. Pastor takes the Oath of Office as required in Chapter X, Section 2 of the City Charter, to be administered by the City Clerk. Pagel 1203^ Regular Meeting August 12,2004 CR# 307-04 Appointing Sam Caramagno, 17441 Merman, Livonia, Michigan 48152, to the Zoning Board of Appeals for a three-year term expiring July 12, 2007, provided that Mr. Caramagno takes the Oath of Office as required in Chapter X, Section 2 of the City Charter, to be administered by the City Clerk. b. Council Resolutions from the meeting of July 21, 2004, with minutes being approved August 16, 2004: CR# 326-04 Approving the extension of the contract between the City of Livonia and MAT Court Recording & Court Services, 6225 Ardmore Park Circle, Dearborn Heights, Michigan 48127, to provide recording and transcription services for the City of Livonia Zoning Board of Appeals meetings for the period December 1, 2004, through November 30, 2007; and authorizing this action without the competitive bidding in accordance with Section 3.04.140D4 of the Livonia Code of Ordinances, as amended. CR# 343-04 Approving the three-year contract between the City of Livonia and the Livonia Police Lieutenants and Sergeants Association for the period December 1, 2003 through November 30, 2006; and approving the necessary amendments to the Compensation Plan and changes in certain benefits as required to effectuate this agreement. C. Letter of July 14, 2004, from Mary E. Rutan, Human Resources Director, as approved for submission by Jack Engebretson, Mayor, regarding the request of July 12, 2004, for the 16'^ District Court to consult with Sandra Rodwan, Actuary. J. Letter of July 23, 2004, from Mary E. Rutan, Human Resources Director, as approved for submission by Jack Engebretson, Mayor, regarding the correspondence of July 14, 2004 to Chief Judge Kathleen McCann and Court Administrator Joseph Mysliwiec. e. Affirmative Action Report for July 2004. Discussion commenced regarding the letter of August 6, 2004, from, Kevin Roney, Public Utilities Manager, and Robert J. Beckley, Director of Public Works, requesting an extension of original probation for Edward Gebnar, Custodian (PPT). Brian Wilson, Assistant Superintendent of Public Service, discussed Mr. Gebnar's work history and job performance and stated Mr. Gebnar had received a failing performance rating in March 2004. Mr. Wilson further stated that through an oversight, a request for extension of probation was not forwarded to the Civil Service Commission and he apologized on behalf of the Department. Mr. Wilson continued that Mr. Gebnar's anniversary step increase was an additional issue. As a result of Mr. Gebnar's temporary time, he has enough time for a one-year anniversary step increase as of May, but based on the assessment of his supervisors, the minimal satisfactory rating has not been achieved to be eligible for the step increase. Mr. Wilson reported that Mr. Gebnar's supervisors have worked with him though the rating process to improve his job performance. A follow-up meeting with Mr. Gebnar is scheduled following this request for extension of probation, to again go over the problem areas. The Department reviewed the matter with legal counsel and it is requested that the Civil Service Commission give consideration to this request for a six (6) month extension of probation. Steven Makie, Building Maintenance Supervisor Page 1203^ Regular Meeting August 12, 2004 and David Flahan, Custodial Foreman were also present at the meeting for any questioning. Mr. Wilson added that Mr. Gebnar received a copy of the letter and was notified by Mr. Washington of the time and place of this meeting. Mr. Campau inquired if Management was aware of Civil Service Commission RULE 17. Mr. Wilson responded he understood the maximum extension allowed was six (6) months. Mr. Campau referenced RULE 17, PROBATIONARY PERIOD, Section 17.2 Duration, stating, "Upon the request of an Appointing Authority, an extension of a probationary period shall only be granted by the Civil Service Commission prior to the completion of the prescribed probationary period and only in those instances where it is reasonable to conclude the individual with additional time and training can achieve satisfactory performance." Mr. Tatigian stated if the request is granted to extend the probationary period for six (6) months, that would expire next month. Mr. Wilson confirmed it would expire on September 17, 2004. He continued that unless his performance turns around rather dramatically, he would not pass his probation. Upon a motion by Mr. Tatigian, it was RESOLVED, That having reviewed the letter of August 6, 2004, from Kevin Roney, Public Utility Manager and Robert J. Beckley, Director of Public Works, requesting an extension of probation for Edward Gebnar, Custodian (PPT), and having had discussion with Brian Wilson, Assistant Superintendent of Public Service, the Civil Service Commission does hereby grant the request to extend Mr. Gebnars probationary period for six (6) months to expire September 17, 2004. The motion dies for lack of support. Ms. Mahoney inquired why the Department elected to keep him on after the March 17 date. Mr. Wilson replied that the supervisors were working with him and had they been timely, it would have been their hope that in an additional six months, they could have turned the situation around. Mr. Campau stated that approving the request to extend the original probation period was not fair to the City. Upon a motion by Mr. Tatigian, it was RESOLVED, That having reviewed the letter of August 6, 2004, from Kevin Roney, Public Utility Manager and Robert J. Beckley, Director of Public Works, requesting an extension of probation for Edward Gebnar, Custodian (PPT), and having had discussion with Brian Wilson, Assistant Superintendent of Public Service, and after severely reprimanding the Department for lack of timeliness, the Civil Service Commission does hereby grant the request to extend Mr. Gebnar's probationary period for six (6) months to expire September 17, 2004. The motion dies for lack of support. The Chairperson stepped down to support the following motion. Page 120V Regular Meeting August 1$2004 Upon a motion by Mr. Campau, seconded by Ms. Mahoney, and adopted, it was RESOLVED, That having reviewed the letter of August 6, 2004, from Kevin Roney, Public Utility Manager and Robert J. Beckley, Director of Public Works, requesting an extension of probation for Edward Gebnar, Custodian (PPT), and having had discussion with Brian Wilson, Assistant Superintendent of Public Service, the Civil Service Commission does hereby deny the request to grant an additional six (6) month probationary period for Mr. Gebnar, based on the untimeliness of the request on the part of Management. AYE: Campau and Mahoney NAY: Tatigian Mr. Wilson asked for clarification if Mr. Gebnar had to receive a satisfactory performance rating to be granted an anniversary step increase. Ms. Rutan, Human Resources Director and the Civil Service Commission confirmed that no rate increase would be granted if Mr. Gebnar's performance was rated less than satisfactory. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was RESOLVED, That having reviewed the memorandum of August 10, 2004, from Jeffrey Golm, Equipment Operator II, as approved for submission by Robert J. Beckley, Director of Public Works, requesting an unpaid medical leave of absence, the Civil Service Commission does hereby approve an unpaid medical leave of absence for four (4) weeks ending September 10, 2004, subject to submission of appropriate medical documentation. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was RESOLVED, That having reviewed the letter of August 9, 2004, from Vickie Wuerth, Personnel Clerk (TA), as approved for submission by Mary E. Rutan, Human Resources Director, requesting additional paid family illness days, the Civil Service Commission does hereby approve Ms. Wuerth's request for six (6) additional family illness leave days.
