The Commission received and fled the Temporary Report for February 2007. The Commission received and filed the Non -Resident Report as of March 1, 2007. Upon a motion by Mr. Campau, seconded by Ms. Mahoney and unanimously adopted, it was 07-56 RESOLVED, That having reviewed the letter of February 5, 2007, from Patricia A. Seleski, Director of Administrative Services, requesting a leave of absence from the classified service, the Civil Service Commission does hereby approve a leave of absence from the classified service for Ms. Seleski for one (1) year, commencing March 1, 2007, pursuant to Civil Service Commission Rules and Regulations, RULE 16, CERTIFICATION, APPOINTMENT AND REINSTATEMENT, Section 16.5, Appointment of an Employee in the Classified Service to a Position in the Unclassified Service. Paget 1234' Regular Meeting March 21,2007 Upon a motion by Mr. Campau, seconded by Ms. Mahoney and unanimously adopted, it was 0757 RESOLVED, That having reviewed the Departmental Correspondence of February 5, 2007, from Tim Eskin, Firefighter, as approved for submission by Shadd A. Whitehead, Fire Chief, requesting permission to use three (3) additional sick leave days for Family Illness above the four (4) twenty- four (24) hours permitted in Civil Service Rules for 2007, the Civil Service Commission does hereby approve the use of three (3) additional twenty-four (24) hour paid sick leave days, beyond the maximum four (4) twenty-four (24) hour days allowed per calendar year in Civil Service Rules 25.2 (e). Upon a motion by Ms. Mahoney, seconded by Mr. Campau and unanimously adopted, it was 0758 RESOLVED, That having reviewed the correspondence of January 22, 2007, from Felicia Cross, Program Supervisor, as approved for submission by Linda McCann, Director of Community Resources, requesting permission to use six (6) additional sick leave days for Family Illness beyond the eight (8) days allowed for such use in 2007, the Commission approves this request. Upon a motion by Ms. Mahoney, seconded by Mr. Campau and unanimously adopted, it was 0759 RESOLVED, That having reviewed the memorandum of March 8, 2007, from Derrick L. Washington, Personnel Analyst II to Robert F. Biga, Human Resources Director, requesting an extension of a military leave of absence for Thomas Clark, Firefighter/Assistant Driver, the Civil Service Commission does hereby grant a leave of absence for Mr. Clark from February 27, 2007 for one (1) year until February 27, 2008. Jeffrey Wallick stated he had sent a letter dated November 14, 2006, to the Civil Service Department requesting to carry over excess vacation hours into 2007. The response came back in January denying his request. He alleged that if he had known earlier he could have taken the vacation days but since he wasn't informed until January, he couldn't do anything about it. He stated the letter that Mr. Washington sent him explained he was denied because he had not met the len (10) year service requirement to be eligible to carry over vacation time in excess of the maximum for purposes of retirement and to please refer to AFSCME Union Local 192 Contract, Article 35, VACATIONS, (F.), and Civil Service Commission RULE 25 — LEAVES, Section 25.1 (f). Mr. Wallick stated the language is almost identical and he read the AFSCME Union Local 192 contract language. He asked Mr. Washington what the ten year rule was for and Mr. Washington replied that was in the Defined Benefits section of the ordinance. Mr. Wallick further stated he was in the Defined Contribution plan and he didn't think the ten year rule had any relevance to a person in the Defined Contribution plan. Derrick Washington, Personnel Analyst II, stated that it was true that when Mr. Wallick came to his office, he informed him the Commission meeting would be a good venue to air his grievance. Upon further review of the retirement ordinance, which is available to the public online, the ordinance does state in Article 2.97.130 — Voluntary retirement — Age and service requirements, that "When the general employee/member attains thirty (30) years of service or Page 3 1234'^ Regular Meeting March 21, 2007 the age of 55 years with ten (10) years of service, or satisfies the requirements of the rule of 85," and this is the provision that Mr. Wallick falls within. Robert Biga, Human Resources Director, added that the reference to Article 2.96 is the Defined Benefit plan. The Defined Contribution plan has the same provision which states when you are eligible for retirement. He agreed that Mr. Wallick was correct that after four (4) years, he is vested in the Defined Contribution plan, which means if he leaves, he can take the City's contribution with him, but as far as eligibility for pension, the pension ordinance is very specific about voluntary retirement age and as Mr. Washington has read from 2.97.130, that still has the ten (10) year requirement. Mr. Wallick stated he still would not be eligible for any pension. Mr. Tatigian stated there seemed to be some misunderstanding. Ms. Mahoney referred to the Civil Service Commission resolution made at the March 15, 2006 meeting which stales, "that no request will be considered for carry over of excess vacation hours into 2007;" therefore, Mr. Wallick was notified that he couldn't ask for excess vacation carry over. Mr. Wallick countered that he asked for vacation carry over for purposes of retirement. Yvonne Lillibridge, President, AFSCME Union Local 192, agreed that while everyone receives a letter stating that no further request will be considered, there have been instances when the Commission has approved excess vacation carry over for two years in a row, due to special circumstances occurring in the Fire Department and more recently Police Officers on patrol have been allowed carry over excess vacation time. She added that if Mr. Wallick had known about it before January he could have taken most if not all of that vacation time. Mr. Washington clarified that he explained to Mr. Wallick, the ten (10) years has significance for vesting with retirement benefits, such as hospitalization, sick leave payout, and things that would be available to a person who terminates their employment after ten (10) years with the age requirement. He added that the Civil Service Commission has granted requests for consecutive year vacation carry over in special circumstances. He further added that if a person applies within three (3) years of retirement, s/he can accumulate up to the maximum for purposes of payout. When Mr. Wallick's letter was received by the Civil Service Department, Mr. Wallick had nine (9) years and eight (8) months of service. Mr. Tatigian inquired what would happen if someone was allowed to accumulate for the three (3) year period and then decided they would not be able to retire. Mr. Biga stated there have been people who have lost their time and have not come to the Civil Service Commission. The Civil Service Commission Rule is very explicit. It says if you don't use the excess vacation time, you lose it. If a person doesn't retire they need to bring the number of hours down by the end of the year or they will lose it. With this case there are two issues, one was he was notified in April of 2006 to gel his vacation bank down and the second issue is whether or not he is within three (3) years of retirement. According to the Defined Contribution retirement ordinance, an employee must have ten (10) years. Based on Mr. Wallick's stated retirement date, he will only have nine (9) years, eight (8) months of service so he is not eligible for the three (3) year carry over. Mr. Washington added that if they had discussed this issue in April they could have tried to clear up the issue, but the Civil Service Department rarely gets requests that have to be denied. Page 1234'^ Regular Meeting March 21, 2007 Ms. Lillibridge stated she wasn't sure if there were any extenuating circumstances in the Department of Public Works. Ms. Mahoney commented that since Mr. Wallick submitted his letter advising his retirement date would be November of 2009, he might want to consider changing his retirement date. Mr. Wallick stated he believed the ten year rule was tied to the Defined Benefit plan because they weren't vested until 10 years. Mr. Wallick asked if he didn't want the hospitalization at 50% or the other retirement benefits if he could retire after four (4) years for his retirement funds. He understood he wouldn't get the health insurance and that was a benefit that was a function of credited service time. Mr. Tatigian stated that was Mr. Wallick's prerogative. Ms. Mahoney clarified that what Mr. Wallick was requesting was to be removed from the ten year requirement because he didn't think it applied to him, but the fact of the matter is that it applies to everybody, no matter which benefit plan they are in. Mr. Biga further explained that once you have four (4) years, you are entitled to the City's contribution. If you leave with less than ten (10) years of service, it is not a retirement; you are entitled to the money in the plan, but you are not a retiree. In order to be retired, you have to meet the requirements of the ordinance; the Defined Benefit or the Defined Contribution retirement plans have the same requirement to be eligible as a retiree, that is you have to have 10 years of service. Ken Grzembski, Vice -President, AFSCME Union Local 192, explained that the main issue was that the letter was given to Mr. Washington on November 14, 2006 and had it been responded to within a couple of weeks, he could have used his time. Mr. Biga asked Mr. Wallick if there was any reason he wouldn't change his retirement date until sometime four months later. Mr. Wallick replied he could do that. Ms. Mahoney reiterated that Mr. Wallick was notified in April of 2006 that he had to use excess vacation time. He didn't use his vacation time because he thought he could accrue it and when he submitted the request, he waited until November with only one month left in the year. Mr. Wallick stated he was unaware of the ten-year rule and others he spoke to were not aware of it either. Mr. Tatigian asked Mr. Wallick if he would be willing to work the additional four months to meet the ten year requirement and he replied he would. Mr. Tatigian clarified that he thought Mr. Wallick was intending to submit a letter for purposes of accruing vacation for retirement, but because Mr. Wallick was under the Defined Contribution plan, he didn't understand that the ten year rule applied to him. The Chairperson stepped down to second the following motion: Upon a motion by Mr. Campau, seconded by Mr. Tatigian and adopted, it was 07-60 RESOLVED, That having reviewed the letter of February 25, 2007, from Jeffrey Wallick, Water Meter Repairer II, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting to carry over vacation days two years in a row, the Civil Service Commission does hereby approve allowing Mr. Wallick to rescind his original letter of intent to retire in the year 2009, to submit a new letter with the additional four (4) months of service and reflecting a revised retirement date of March 20, 2010, with the understanding that this is non -precedent setting due to the special circumstances involved. Pages 1234'^ Regular Meeting March 21, 2007 AYES: Campau and Tatigian NAY: Mahoney Brian Wilson, Assistant Superintendent of Public Service, presented new information regarding the letter of February 27, 2007, from Brian Beerbower, Custodian, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting an extension of an unpaid medical leave of absence. Mr. Wilson stated Mr. Beerbower was in the Department that afternoon, submitting another disability certification for an additional two (2) months. He added Mr. Beerbower was at the point where, as of March 11, 2007, he exhausted his 90 day unpaid leave of absence. The letter to the Commission indicated the medical certification disabled Mr. Beerbower through May 14, 2007. Mr. Wilson informed the Commission that Mr. Beerbower was no longer covered under the Family Medical Leave Act (FMLA). Also, the Department is not endorsing an extension of an unpaid leave of absence beyond the ninety (90) days. Mr. Tatigian clarified that Mr. Beerbower exhausted his ninety (90) days as of March 12, 2007. Mr. Wilson explained that he had not spoken to Mr. Beerbower but he found the new information in his inbox that afternoon. Mr. Campau inquired if the Union was aware of this. Ken Grzembski, Vice -President, AFSCME Union Local 192, responded the Union was not aware of this. Mr. Tatigian stated that if Mr. Beerbower wasn't going to be back at work on May 14, this was really an act of futility. Mr. Wilson explained the new certification incapacitated Mr. Beerbower from March 21, 2007 through May 21, 2007. Prior to this meeting Mr. Beerbower indicated he had a doctor appointment today and Mr. Wilson advised if there was new information to bring it forward, with the hope that he was going to be returned to work. Ms. Mahoney stated she was a little confused and asked when Mr. Beerbower's Family Medical Leave ended. Mr. Wilson replied Mr. Beerbower's paid leave time was used up on December 11, 2006. Mr. Biga added that Mr. Beerbower was on an unpaid medical leave of absence, which is permitted under the Civil Service Commission Rules for ninety (90) days. The Commission has extended leaves of absence in the past and they have also not extended them, depending on the Department's recommendation. Ms. Mahoney recalled the Commission action granting Mr. Beerbower an extension of his unpaid leave of absence through March 12, 2007, based upon Mr. Beerbower submitting another letter and with the knowledge that he would have a medical appointment today. The Department hoped that this would return Mr. Beerbower to work. Consistent with the Department's recommendation and other similar instances, they have not been going beyond the ninety (90) days. Mr. Washington suggested the Commission put Mr. Beerbower on notice that he should return to work at the end of this extension and no further request for an extension would be granted. Ms. Mahoney inquired what benefits Mr. Beerbower received while on an unpaid leave of absence. Mr. Biga advised the benefits were continued seniority so there is no break in service and the City does not terminate medical benefits or any other benefits. Mr. Campau made the following motion, and it was supported by Ms. Mahoney for purposes of discussion only: RESOLVED, That having reviewed the letter of February 27, 2007, from Brian Beerbower, Custodian, as approved for submission by Patrick A. Biga, Human Resources Director and Derrick L. Washington, Personnel Analyst II, the Civil Service Commission does hereby approve an unpaid medical leave of absence through May 14, 2007, with the proviso that there will be no further extension granted. Ms. Mahoney noted that Mr. Beerbower's doctors certificate disabled him for one week more than the requested extension, or through May 21, 2007. Mr. Beerbower is not approved to return to work on May 14, 2007. Ms. Mahoney suggested the resolution be amended to allow the extension for one additional week, or through May 21, 2007, but with the caveat of no further request for extension being allowed. The original motion was withdrawn. Upon a motion by Mr. Campau, seconded by Ms. Mahoney and unanimously adopted, it was 07-61 RESOLVED, That having reviewed the letter of February 27, 2007, from Brian Beerbower, Custodian, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting an extension of an unpaid medical leave of absence, and having discussion with Brian Wilson, Assistant Superintendent of Public Service; Ken Grzembski, Vice -President, AFSCME Union Local 192; Robert F. Washington, Personnel Analyst II, the Civil Service Commission does hereby approve an unpaid medical leave of absence through May 21, 2007, with the proviso that there will be no further extension granted. Upon a motion by Ms. Mahoney, seconded by Mr. Campau and unanimously adopted, it was 07-62 RESOLVED, That having reviewed the letter of March 5, 2007, from Dennis Opsommer, Custodian, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting an unpaid medical leave of absence, the Civil Service Commission does hereby approve an unpaid medical leave of absence for the period of March 15, 2007 through April 20, 2007. 07-63 RESOLVED, That having reviewed the letter of March 8, 2007, from Enomwoyi Franklin, Clerk I, as approved for submission by Kathleen Monroe, City Librarian, requesting an unpaid medical leave of absence, the Civil Service Commission does hereby approve an unpaid medical leave of absence, beginning April 21, 2007 for approximately six (6) to eight (8) weeks. 07-64 RESOLVED, That having reviewed the letter of March 12, 2007, from Vickie L. Wuerth, Personnel Clerk, as approved for submission by Robert F. Biga, Human Resources Director, requesting an unpaid medical leave of absence, the Civil Service Commission does hereby approve an unpaid medical leave of absence for the period February 28, 2007 through March 12, 2007. Upon a motion by Ms. Mahoney, seconded by Mr. Campau and unanimously adopted, it was Pagel 1234'^ Regular Meeting March 21,2007 07-65 RESOLVED, That having reviewed the letter of March 1, 2007, from Shadd A. Whitehead, Fire Chief, requesting a step increase for Brian McLaren, Firefighter, and having discussion with Shadd A. Whitehead, Fire Chief and Robert Biga, Human Resources Director, the Civil Service Commission does hereby grant a one-step pay increase effective January 17, 2007 from step 4 to step 5. Upon a motion by Mr. Campau, seconded by Ms. Mahoney and unanimously adopted, it was 07-66 RESOLVED, That having reviewed the letter of March 6, 2007, from David Woodcox, Director of Inspection, requesting to extend the employment of a temporary Clerk -Typist, and having discussion with Alex Bishop, Assistant Director of Inspection, the Civil Service Commission does hereby extend the employment of the temporary Clerk -Typist until the establishment of the Clerk -Typist 1 (889 o.c.) eligible list. Upon a motion by Mr. Campau, seconded by Ms. Mahoney and unanimously adopted, it was 07-67 RESOLVED, That having reviewed the letter of February 5, 2007, from Gretchen Guisbert, Secretary III, as approved for submission by Robert F. Biga, Human Resources Director, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Ms. Guisbert's request to carry over 24 excess vacation hours into 2007 with the understanding that these hours will be used in 2007; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation hours into 2008. 07-68 RESOLVED, That having reviewed the letter of March 7, 2007, from Felicia Cross, Program Supervisor, as approved for submission by Linda McCann, Director of Community Resources, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Ms. Cross' request to carry over 5.25 excess vacation hours into 2007 with the understanding that these hours will be used in 2007; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation hours into 2008. 07-69 RESOLVED, That having reviewed the letter of March 8, 2007, from Sharon Sabat, Recreation Supervisor, as approved for submission by Linda McCann, Director of Community Resources, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Ms. Sabal's request to carry over 48.75 excess vacation hours into 2007 with the understanding that these hours will be used in 2007; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation hours into 2008. Page 1234' Regular Meeting March 21,2007 07-70 RESOLVED, That having reviewed the letter of January 12, 2007, from David Flahan, Building Maintenance Foreman, as approved for submission by James Zoumbaris, Superintendent of Public Service, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Flahan's request to carry over 32 excess vacation hours into 2007 with the understanding that these hours will be used in 2007; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation hours into 2008. 07-71 RESOLVED, That having reviewed the letter of January 12, 2007, from Gregory Pirtle, Equipment Maintenance Supervisor, as approved for submission by James Zoumbaris, Superintendent of Public Service, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Pirtle's request to carry over 38 excess vacation hours into 2007 with the understanding that these hours will be used in 2007; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation hours into 2008. 07-72 RESOLVED, That having reviewed the letter of January 1, 2007, from Mark Raitanen, Sign Maintenance Worker I, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Raitanen's request to carry over 95 excess vacation hours into 2007 with the understanding that these hours will be used in 2007; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation hours into 2008. 07-73 RESOLVED, That having reviewed the letter of January 12, 2007, from Kevin Roney, Public Utility Manager, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Roney's request to carry over 32 excess vacation hours into 2007 with the understanding that these hours will be used in 2007; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation hours into 2008. 07-74 RESOLVED, That having reviewed the letter of February 9, 2007, from Thomas Stadler, Custodian, as approved for submission by Patrick A. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Stadler's request to carry over 13.25 excess vacation hours into 2007 with the understanding that these hours will be used in 2007; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation hours into 2008. Hogan, Director of Public Works, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Woehrle's request to carry over 15.75 excess vacation hours into 2007 with the understanding that these hours will be used in 2007; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation hours into 2008. 07-76 RESOLVED, That having reviewed the letter of February 9, 2007, from Alexander Kwasniuk, Engineering Assistant I, as approved for submission by Robert Schron, City Engineer, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Kwasniuk's request to carry over 80 excess vacation hours into 2007 with the understanding that these hours will be used in 2007; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation hours into 2008. 07-77 RESOLVED, That having reviewed the letter of February 23, 2007, from Denise Marvel, Account Clerk II, as approved for submission by Michael T. Slater, Director of Finance, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Ms. Marvel's request to carry over 27.25 excess vacation hours into 2007 with the understanding that these hours will be used in 2007; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation hours into 2008. 07-78 RESOLVED, That having reviewed the letter of February 8, 2007, from James Brophy, Fire Lieutenant, as approved for submission by Shadd A. Whitehead, Fire Chief, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Brophy's request to carry over 7 excess vacation hours into 2007 with the understanding that these hours will be used in 2007; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation hours into 2008. 07-79 RESOLVED, That having reviewed the letter of February 9, 2007, from David Dobiesz, Senior Fire Equipment Mechanic, as approved for submission by Shadd A. Whitehead, Fire Chief, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Dobiesz's request to carry over 84 excess vacation hours into 2007 with the understanding that these hours will be used in 2007; Page 10 1234' Regular Meeting March 21,2007 AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation hours into 2008. 07-80 RESOLVED, That having reviewed the letter of February 9, 2007, from Scott Graham, Fire Lieutenant, as approved for submission by Shadd A. Whitehead, Fire Chief, requesting to carry over excess vacation hours, the Civil Service Commission does hereby approve Mr. Graham's request to carry over 72 excess vacation hours into 2007 with the understanding that these hours will be used in 2007; AND BE IT FURTHER RESOLVED, That no request will be considered to carry over excess vacation hours into 2008. 07-81 RESOLVED, That having reviewed the letter of February 12, 2007, from Brian Kukla, Firefighter, as approved for submission by Shadd A. PARTS OF EXAMINATION AND WEIGHTS Written — 50% Interview — 50% Background Investigation — Pass/Fail Yvonne Lillibridge, President, AFSCME Union Local 192, questioned the new qualification #4 on the request for promotional examination for Equipment Operator III, which required lifting in excess of 75 pounds. Ms. Lillibridge didn't think this was ever a requirement of the classification before. Mr. Campau inquired why it was a requirement now. Mr. Wilson responded that recently the Commission approved the Water Operations Mechanic II and in order to make sure that Group "A" and Group "B" Commercial Driver's License language is correct, he looked at the previous posting and noted the 75 pound lifting requirement was listed on the previous Water Operations Mechanic announcement. Mr. Wilson also noted that the Department had been inconsistent in putting that lifting requirement. Page 17 1234'^ Regular Meeting March 21, 200] Ken Grzembski, Vice -President, AFSCME Union Local 192, responded that this was not a Water Operations Mechanic job and it wasn't listed on the previous Equipment Operator III and the Union wanted that lifting requirement to be excluded from the announcement because it could discriminate against some of their members. Mr. Wilson said there was no intent to discriminate. Debra Jamieson, Equipment Operator II, questioned why the Water Operations Mechanic position was included in this because it is a separate series and a separate Department. Mr. Campau did not read anything in the Description of Work that said lifting was required. Mr. Wilson advised it was routinely done in that work. Mr. Campau made a motion to approve the request with qualification #4 deleted. The motion died for lack of support. Ms. Mahoney inquired if the objection from the Union was the requirement to lift anything or was the objection the amount of weight being required. Mr. Wilson replied there was no objection to making the requirement to lift 50 pounds. Ms. Jamieson stated she personally had no issue with lifting at all. Her issue was with why the Water Operations Mechanic qualifications are included in this examination. Mr. Wilson recalled a few months ago the Department requested an Equipment Mechanic III and how there was a lot of discussion about the eligibility to take the test even though some of the employees had not been in that series or done that work for ten years. The Water Operations Mechanic II's routinely operate the same equipment daily so why not just let the employees take the test. Ms. Jamieson commented that the Construction Worker II series are routinely required to have a CDL in case they need to drive dump trucks, which is the Equipment Operator II series. Routinely, the Construction Worker II's and the Park Maintenance Worker III's are requested to drive a dump truck on straight time and some drive on overtime. Mr. Wilson added he had no objection to adding the Construction Worker II's to this. No" Siira, Equipment Operator III, said there shouldn't be a problem with the 50 pound lifting requirement. He added that as far as opening this up to anybody other than the Equipment Operator II's, he stated Mr. Wilson was incorrect, because he was a Water Operations Mechanic II as well as a Water Operations Mechanic I and they specifically operate tractors. They do not have experience operating gradealls, end loaders, sweepers, so it is a separate series. Mr. Wilson asked Mr. Siira to understand that the Equipment Operator II's eligible for taking the test, may have never operated any of those pieces of equipment. Mr. Siira added that in the situation of the lest, because of the testing requirement, the City will probably use a backhoe for the equipment operating part of the test, which would give those employees who are currently in the Water Operations Mechanics position who operate the tractor every day, an unfair advantage over people in the Equipment Operator II series looking for promotional opportunity. Jim Sturgill stated what he found amusing is that the Equipment Operator III now has a weight requirement and there was a push for the Equipment Operator I, which is a glorified laborer, and an Equipment Operator I is more prone to be lifting something that there should be a Page 18 1234'^ Regular Meeting March 21, 2007 weight restriction on, than an Equipment Operator III. Mr. Wilson confirmed the Department was going to be consistent with that with future examinations. The Commission recessed at 6:37 p.m. The Commission reconvened at 6:42 p.m. Roger Ponder, Custodian, was present to discuss AFSCME Union Local 192 Grievance #06- 14, dated July 19, 2006, regarding a letter placed in his file. Eric Frankie, Attorney, introduced himself to the Commission. Mr. Wilson slated they were not notified that legal counsel would be present at tonight's meeting and the City didn't have their legal counsel present. Mr. Wilson preferred to have labor counsel present if legal counsel was present for Mr. Ponder. Mr. Tatigian asked Mr. Frankie if they objected to putting this item over to the April 18, 2007 Civil Service Commission meeting. Mr. Frankie replied he would like to consult with his client. Mr. Frankie then stated their concern was probably more practical than anything and this has been hanging over Mr. Ponder's head for nine months. The incident that gave rise to the discipline occurred on or about June 19, 2006 and he thought that just for Mr. Ponder's sake this should be resolved as quickly as possible. Mr. Tatigian responded that he was not above letting Mr. Frankie make his presentation but if the City wanted to have a lawyer, Mr. Frankie should understand being a lawyer that the Commission wants to give due process to both parties. Mr. Frankie stated they would like to move forward; if the Commission sees Page 21 1234'^ Regular Meeting March 21, 2007 differently they wouldn't want it bifurcated. Mr. Tatigian advised they would have to come back anyhow, because if the City wants a lawyer, they are entitled to legal representation. Mr. Frankie responded that he understood that. The direction of the Civil Service Commission is that notification be given if someone is bringing legal counsel to the meeting. Mr. Campau commented that Mr. Frankie kept referring to the letter as disciplinary. Mr. Frankie confirmed they viewed this as a disciplinary letter. Mr. Wilson disagreed, stating it was not disciplinary in any form; it was an AVO, which they tried to explain through a labor- management meeting and by re -writing the letter. Mr. Campau inquired if Mr. Frankie understood that Management's position was this is an AVO. Mr. Frankie disputed that this was an AVO. Mr. Tatigian again stated this issue would be put over to the next meeting. Mr. Tatigian inquired if Mr. Frankie was also present for AFSCME Union Local 192 Grievance 07-01 regarding being paid time for being present at the MERC hearing. Mr. Frankie responded he was not present for the other item. Mr. Ponder added he was not sure why this item was on the Agenda, unless someone brought it forward that he wasn't aware of. Mr. Ponder stated the matter was resolved by the Civil Service Commission at its meeting of December 6, 2006. Mr. Biga clarified this was brought forward by William Ivanac on February 12, 2007. The Commission reiterated that it had acted on Mr. Ponders request to be paid for time he was in attendance at a MERC hearing. Gretchen Guisbert, Secretary III, read resolution 06-206 from the December 6, 2006 Civil Service Commission meeting which states in part, "the Civil Service Commission does hereby grant the remedy requested in the grievance and grants the paid time off for Mr. Ponder, and advises that in the future, there would not be paid time off for attending hearings that are not court ordered" Mr. Tatigian directed that New Business item 3 be removed from the Agenda and the Commission returned to their review of Old Business 1. Upon a motion by Ms. Mahoney, seconded by Mr. Campau and unanimously adopted, it was 07-113 RESOLVED, That having discussion with Brian Wilson, Assistant Superintendent of Public Service; Roger Ponder, Custodian; Eric Frankie, Attorney and Robert F. Biga, Human Resources Director regarding AFSCME Union Local 192 Grievance 06-14, concerning a letter placed in Mr. Ponders file, the Civil Service Commission does hereby refer this to the next regular Civil Service Commission meeting of April 18, 2007 so that Management may have legal counsel present. Upon a motion by Mr. Campau, seconded by Ms. Mahoney and unanimously adopted, it was RESOLVED, That the meeting be adjourned at 6:52 p.m. Gretchen Guisbert, Secretary III Harry C.
