Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was 10-403 RESOLVED, That having reviewed the Departmental Correspondence of November 5, 2010 from Brian McLaren, Firefighter, as approved for submission by Shadd A. Biga, Human Resources Director, requesting a promotional examination for Police Lieutenant and proposed qualifications and parts of examination and weights, the Civil Service Commission does hereby approve the following qualifications and parts of examination and weights: QUALIFICATIONS This examination is open only to employees of the City of Livonia, who, at the closing date of this examination, are employed in the Police Division of the Department of Public Safety; as a Senior Sergeant or have regular status in the classification of Sergeant and, have had at least four (4) years of experience, immediately preceding the closing dale of the examination, as a Sergeant in the City of Livonia. Experience is counted through April B, 2011. Biga, Human Resources Director, requesting a promotional examination for Police Sergeant, and proposed qualifications and parts of examination and weights, the Civil Service Commission does hereby approve the following qualifications and parts of examination and weights: QUALIFICATIONS This examination is open only to employees of the City of Livonia, who, at the closing date of this examination, are employed in the Police Division of the Department of Public Safety; have regular status in the classification of Police Officer; and have had at least five (5) years of experience, immediately preceding the closing date of the examination, as a Police Officer with the City of Livonia. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was 10-414 RESOLVED, That having reviewed the letter of November 10, 2010, from Kathleen Monroe, City Librarian, requesting a promotional examination for Library Aide II, and proposed qualifications and parts of examination and weights, the Civil Service Commission does hereby approve the following qualifications and parts of examination and weights: QUALIFICATIONS Applications will be accepted only from employees of the City of Livonia who, by the closing date of this examination, are: Page 7 1278th Regular Meeting November 17, 2010 Currently employed in the Library Department; and Have regular status as a Library Aide I. Pursuant to AFSCME Local 192 contract, PROMOTIONS, 20.B., in competitive examinations which include departmental ratings, the departmental rating from 0 to 100 will count as 20% of the examination, but a score of under 70 will not disqualify the candidate from continuing the process. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was 10-417 RESOLVED, That the Civil Service Commission does hereby confirm the administrative approval of the eligible list for Program Supervisor (1316 p.). Charles Locke, President, AFSCME Union Local 192, presented AFSCME Union Local 192 Grievance #10-30, dated October 28, 2010, from DPW employees, regarding a change in shift starting time and explained that during the last negotiation meeting, Mr. Maillard, Director of Public Works, announced he was changing the shift time. The Union believes this decision was arbitrary and without research as to how it would affect DPW employees. The Union came up with a few statistics and stated a majority of accidents in Livonia on surface streets occur between 8:00 a.m. and 9:00 a.m. and between 5:00 p.m. and 6:00 p.m. He stated according to Sgt. Gibbs, from the Livonia Police Department, it is safer to be setting up on work sites on major roads before traffic is at its heaviest. Mr. Locke continued by stating the second highest traffic volume periods occur between 8:00 a.m. and 10:00 a.m. Seven (7) percent of the daily traffic or an average of 1,100 cars per hour travel on our surface roads during this time. The evening drive from 4:00 p.m. to 7:00 p.m. is slightly higher at eight (8) percent. If the new shift time were implemented, City crews would increase both of the traffic flows because they would be putting additional vehicles on the roads and work crews would be out there. Mr. Locke indicated there are more personal injury accidents after 8:00 a.m. than before 8:00 a.m. and there is no correlation between the time of year and the amount of daylight or darkness. Mr. Locke explained that there are a total of 36 working days in a 12 month period when there is not enough working daylight, dawn, before 7:30 a.m. He explained that daylight savings time helps correct this situation and that if there is not enough natural light to work by, there is more than an adequate amount of artificial lighting equipment for employees to Page 1278th Regular Meeting November 17, 2010 be productive. Also, according to Mr. Locke, contrary to the new shift time, there is a DPW policy in the month of April, wherein lawn repairs begin at 4:30 a.m. and this continues through October, so there are employees that are scheduled to work when it is pitch black. This is in contradiction to the argument that it is safer or somehow more productive for employees to be scheduled to work at 7:30 a.m. Mr. Locke added the employees have been starting their shift at 7:00 a.m. for at least 22 years that he knew of. Mr. Locke spoke with a 30 -year employee who also stated as long as he has been employed with the City of Livonia, other than when he was a part-time Custodian at night, they have started at 7:00 a.m. The article in the contract goes back before the time that Daylight Savings Time began. Mr. Locke stated that Mr. Maillard referenced Wayne County hours and Mr. Maillard thinks it is a good idea for the City of Livonia to follow these hours. Mr. Locke referenced the November 3, 2010 City Council meeting resolution by Mr. Schwartz and Mr. Meakin which indicated dissatisfaction with the slow progress and the disruption of affected businesses and residents by contractors working on the Wayne County Middlebelt Road construction project. Mr. Locke stated that Mr. Maillard proposed employees begin work at 7:30 a.m. but that would disrupt the lives of Livonia residents. Mr. Locke stated he repaired water main breaks and referenced three recent water main breaks and if he began work at 7:30 a.m. the second main break would have been attended to thirty (30) minutes later in the day and while that doesn't seem like a significant amount of time, a water break can do significant damage. By starting the shift at 7:00 a.m. they were able to get to the second water break in a timely fashion and both breaks were repaired by 3:30 p.m. If they had started work at 7:30 a.m. it would have been at the earliest 4:00 p.m. when they finished. Mr. Locke further explained that just last Monday he worked on another water break until 7:45 p.m. and it was pitch black during that time and they managed to complete the repair in a safe manner. The Union believes Mr. Maillard's intentions may be good, however, they don't think they are relative and they don't think they should change the working hours that have been in effect for the last 25 or 30 years. He added that employees know the shift and they schedule their lives around that. Mr. Maillard, Director of Public Works stated he did meet with the Union and he told them that the changes were being promulgated based on operational needs. The fact that employees are starting work in total darkness. There is no reason to have the normal working operations begin in the dark. The Department's research showed that they are the only agency that works from 7:00 a.m. to 3:30 p.m. for twelve (12) months a year. He differed from Mr. Locke stating that at one time there used to be a 7:30 a.m. starting time, but it was changed to a summer timeframe for the workers because they had a full eight (8) hours of sunlight between 7:00 a.m. and 3:30 p.m. Mr. Maillard reiterated his decision was based on operational needs and safety reasons. He agreed that employees do a lot of work on county primary roads. Mr. Maillard stated there are 195 days a year in which the sun comes up after 7:00 a.m. and he agreed that for water main breaks and for snow and ice operations, employees do have to work in the dark, but for the normal work that DPW employees perform, it made no sense to have people work an extra half-hour in the dark when they don't have to. He reiterated that other agencies have a shift time of 7:30 a.m. to 4:00 p.m. and in accordance with Management Rights, it made no sense for them to work 7:00 a.m. to 3:30 p.m, and that is why they told the Union their intention was to change the Page 10 1270th Regular Meeting November 17, 2010 starting time, but they held off until this Civil Service Commission meeting. He advised that this concept was also presented to 1917 but they opted not to file a grievance. Mr. Locke stated 1917 didn't file a grievance because 192 did and there would be no point in having the same grievance presented. Mr. Locke stated Mr. Maillard is looking at the issue differently and that there is a difference between sunrise and daylight. Mr. Tatigian stated the DPW employees have been working from 7:00 a.m. to 3:30 p.m. for a long time. Mr. Tatigian inquired if there had been any accidents to report that supports the contention that it is safer to begin work a half-hour later, to which Mr. Maillard replied no. Mr. Tatigian stated he couldn't remember a time when the shift for DPW employees was different and he began work for the City in 1963. Mr. Tatigian noted the number of DPW employees in attendance at the meeting because they are opposed to this change and asked Mr. Maillard if the City would be that much further ahead by changing the shift time. Mr. Maillard couldn't understand why the employees are so unhappy with a half-hour change in shift. Mr. Maillard believed for operational reasons it was better for the employees to start work when there is more daylight. Ms. Mahoney asked when employees show up at 7:00 a.m. do employees go immediately to the site or is there a half-hour or so preparation time before getting to the site? Mr. Maillard responded the preparation time is the same. Ms. Mahoney wanted to know if the issue was coming in at 7:30 a.m. or if the issue was having to slay a half-hour later in the afternoon. Mr. Locke staled his issue was working later in the afternoon. Ed Hoffman, Equipment Operator II, Roads Department, stated the employees of the City of Livonia don't need to compare themselves to other municipalities. He explained this would impact him because he has to pick up his son at 4:15 p.m. in Howell. He would have to use sick time or vacation time, and he can only take vacation in 4 hour increments, so there is a half a day when the City can't utilize him. If he used Personal Business leave, he would have to take that in 2 -hour increments. Audrey Young, Equipment Operator II, Roads Department, stated she picks up her granddaughter three (3) times a week. She gets out at 3:30. Audrey stated she gets there by 3:40 p.m. Last year they weren't called in a lot to salt the roads, so when they go in at 7:00 a.m., they go out right away to salt the secondary roads and it makes it safer for the school buses. If they come in at 7:30 a.m. it makes it even later and more dangerous. Mr. Locke slated the 7:00 a.m. to 3:30 p.m. shift works. He stated the DPW employees are already running short-staffed and they are being asked to take concessions. Ms. Mahoney asked Mr. Maillard what "operational needs" meant. Mr. Maillard explained it was productivity basically. Mr. Maillard agreed there is a good staff and they do a very good job. He stated when he comes into work he observes the staff leave at 7:15 a.m. or 7:30 a.m. He further explained that for a lot of the operations the crews go into residential areas and doing work very early in the morning. It is simply that there is more daylight and when they are on the street it is almost daylight at that point. He also explained they are only talking about a few months of the year, not the entire year. Mr. Maillard stated he heard the concerns about day care but these are the employees who work overtime during leaf pickup and who work snow and ice removal and all employees have to make accommodations. Page 11 1278th Regular Meeting November 17, 2010 Mr. Campau inquired if Mr. Maillard took into consideration all the workers who don't want to change the shift. Mr. Maillard stated he would be happy to work with them when they go into daylight savings time in April through Labor Day to switch it back when it makes more sense. Mr. Tatigian stated he thought Department Heads ought to be able to run their own departments and never questioned that, but on this one occasion where the contract provides that the Commission has influence on something that involves the employees he didn't think there was a strong enough case to justify making a change in the hours of these employees. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was 10-418 RESOLVED, That having reviewed AFSCME Union Local 192 Grievance #1030, dated October 28, 2010, from DPW employees, regarding a change of shift starting time, and having discussion with Charles Locke, President, AFSCME Union Local 192; Kevin Maillard, Director of Public Works; Ed Hoffman, Equipment Operator II; and Audrey Young, Equipment Operator II, the Civil Service Commission does hereby grant the grievance to continue the existing hours, because the employees are inconvenienced by this, not because the Department was acting arbitrarily or in a capricious manner.
