HomeMy WebLinkAbout1280th CSC Meeting (January) Revised to reflect FY11 resolution numbers1280" REGULAR MEETING OF THE CIVIL SERVICE COMMISSION - REVISED The 1280" Regular Meeting of the Civil Service Commission was held on Wednesday, January 19, 2011. The meeting was called to order at 6:00 p.m. Members Present: Charlotte S. Mahoney, Chairperson Harry C. Tatigian Ronald E. Campau Also Present: Charles Locke, President, AFSCME Union Brian Wilson, Superintendent of Public Local 192 Service Kevin Maillard, Director of Public Works Robert F. Biga, Human Resources Director Steven Schoonover, Vice -President, Derrick L. Washington, Personnel Analyst II AFSCME Union Local 192 Gretchen Guisbert, Secretary III Chairperson Mahoney asked that before the meeting began, she would like to have a moment of silence in honor of our fallen Police Officer, Larry Nehasil. She stated it is a tragedy that this community would not like to have faced, but will live through. Ms. Mahoney thanked everyone. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was 11-01 RESOLVED, That the minutes of the 1279'" Regular Meeting held Wednesday, December 8, 2010, be approved as submitted. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was 11-02 RESOLVED, That having reviewed the Departmental Correspondence of December 6, 2010 from Dean Langley, Senior Police Officer, as approved for submission by Robert Stevenson, Police Chief, requesting to carry over vacation days in excess of the maximum allowed by contract, based on a projected retirement date of December 6, 2013, the Civil Service Commission does hereby affirm the administrative approval of this request; AND BE IT FURTHER RESOLVED, that the employee is advised of the maximum number of days to be paid off at retirement as cited in the Livonia Police Officers Association Contract, Article 22.7, Vacation Accrual, and as set forth in Civil Service Commission Rule 25, LEAVES, Section 25.1 Annual Leave (Vacation), Paragraph (f); AND BE IT FURTHER RESOLVED, that the employee is advised that the maximum number of days will be increased by the number of bonus vacation days earned in the last three (3) years prior to retirement for not using more than five (5) sick leave days annually, up to a maximum of nine (9) days; Paget 1288th Regular Meeting January 19,2811 AND BE IT FURTHER RESOLVED, that the employee is notified it is the employee's responsibility to manage his vacation time to avoid losing excess accrued time prior to retirement by scheduling sufficient time off prior to retirement, subject to the operating needs of the department. 11-03 RESOLVED, That having reviewed the Departmental Correspondence of December 6, 2010, from Timothy McGillivary, Senior Police Lieutenant, as approved for submission by Robert Stevenson, Police Chief, requesting to carry over vacation days in excess of the maximum allowed by contract, based on a projected retirement date of December 6, 2013, the Civil Service Commission does hereby affirm the administrative approval of this request; AND BE IT FURTHER RESOLVED, that the employee has been advised of the maximum number of days to be paid off at retirement as cited in the Livonia Lieutenants and Sergeants Association Contract, Article 16, VACATION, Paragraph E, and as set forth in Civil Service Commission Rule 25, LEAVES, Section 25.1 Annual Leave (Vacation), Paragraph (f); AND BE IT FURTHER RESOLVED, that the employee is advised that the maximum number of days will be increased by the number of bonus vacation days earned in the last three (3) years prior to retirement for not using more than five (5) sick leave days annually, up to a maximum of nine (9) days; AND BE IT FURTHER RESOLVED, that the employee is notified it is the employee's responsibility to manage his vacation time to avoid losing excess accrued time prior to retirement by scheduling sufficient time off prior to retirement, subject to the operating needs of the department. 11-04 RESOLVED, That having reviewed the letter of December 27, 2010, from Mary Via, Program Supervisor, as approved for submission by Donald Knapp, City Attorney, requesting to carry over vacation days in excess of the maximum allowed by contract, based on a projected retirement date of December 27, 2013, the Civil Service Commission does hereby affirm the administrative approval of this request; AND BE IT FURTHER RESOLVED, that the employee is advised that maximum number of days to be paid off at retirement is fifty-one (51), as set forth in Civil Service Commission Rule 25, LEAVES, Section 25.1 Annual Leave (Vacation), paragraph (f); AND BE IT FURTHER RESOLVED, that the maximum number of days will be increased by the number of bonus vacation days earned in the Iasi two (2) out of three (3) years prior to retirement for not using more than five (5) sick leave days annually, up to a maximum of six (6) days; AND BE IT FURTHER RESOLVED, that the employee is notified that it is the employee's responsibility to manage her vacation time to avoid losing excess Page 12B9th Regular Meeting January 19, 2011 accrued time prior to retirement by scheduling sufficient time off prior to retirement, subject to the operating needs of the department. The Commission received and filed the following: Status of Temporary Employees Report for December 2010. Non -Resident Report as of January 1, 2011. Current Open -Competitive and Promotional Eligible Lists as of January 1, 2011. Affirmative Action Report for December 2010. Removal of names from active eligible list report for the month of December2010. Nochanges. Council Resolutions from the meeting of November 3, 2010, with minutes to be approved November 17, 2010: #370-10, approving the reappointment of Jim Cambridge, to the Livonia Brownfield Redevelopment Authority for a term of three years, which will expire on November 24, 2013. #371-10, approving the reappointment of Michael Paul Condon, to the Livonia Brownfield Redevelopment Authority for a term of three years, which will expire on November 24, 2013. #372-10, approving the reappointment of Ashley Krueger, to the Livonia Brownfield Redevelopment Authority for a term of three years, which will expire on November 24, 2013. Expiring eligible lists for the month February 2011 — None. Charles Locke, President, AFSCME Union Local 192, discussed a request for an unpaid medical leave of absence from Dan West, Service Representative, and stated Mr. West was a long-term employee and he hoped the Civil Service Commission would make an exception and grant the extension. Robert Biga, Human Resources Director, stated the recommendation was to approve the leave of absence through March 1, 2011. Mr. Campau inquired if there was any possibility Mr. West might not be back by March 1, 2011 and Mr. Biga said there was a chance he might not be back by March 1, 2011, but at that time Mr. West could come back before the Commission and the Department would have to review the policy of how long a duration for which they would recommend approval. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was 11-05 RESOLVED, That having reviewed the letter of December 6, 2010, from Brian Wilson, Superintendent of Public Services, and Kevin Maillard, Director of Public Works, and letter of December 14, 2010, from Daniel West, Service Representative, requesting an extension of unpaid medical leave of absence, and having discussion with Charles Locke, President, AFSCME Union Local 192; and Robert F. Biga, Human Resources Director, the Civil Service Commission does hereby approve Mr. West's request for an extension of an unpaid medical leave of absence beginning December 30, 2010 through Page 12B0th Regular Meeting January 19, 2011 March 1, 2011; with the understanding that Mr. West is responsible during the unpaid leave to pay any copayment for his medical insurance; AND BE IT FURTHER RESOLVED, that should Mr. West not return to work for at least thirty (30) calendar days after the approved extension of the unpaid medical leave of absence, he will reimburse the City of Livonia for any costs for benefits paid for Mr. West during his time off, in accordance with Section 25.6(c), Insurance Premium Payments, of the Civil Service Commission Rules and Regulations. AND BE IT FURTHER RESOLVED, that this action constitutes the final extension of an unpaid medical leave of absence for Mr. West and this approval is not precedent setting. Kevin Maillard, Director of Public Works, stated in May 2010 he requested that the Civil Service Commission approve hiring Donald Rohraff at step 3 in the salary range for Superintendent of Public Service, due to his extensive employment background. At that time the Civil Service Commission determined to employ Mr. Rohraff at step 1 until he successfully completed his six (6) month probationary period. There was discussion regarding what his step progression would be. Mr. Maillard explained that Mr. Rohraff has been an exceptional employee and he has brought a lot of innovative ideas which have resulted in financial savings for the City of Livonia. He accepted the job offer as Superintendent which was at a lower pay level than his current pay rate. He replaced Jim Zoumbaris who was at step 5. Mr. Rohraff also gave up significant fringe benefits to accept the City position. Mr. Maillard stated they were back here today with a recommendation Mr. Rohraff be advanced to step 3 at his six (6) month step increase, December28, 2010, then to step 3-1/2 on his one-year anniversary, June 28, 2011; to step 4-1/2 on his two year anniversary, June 28, 2012; and to step 5 on his three-year anniversary on June 28, 2013. Mr. Tatigian inquired what the increase in pay would be from step 1 to step 3 and Mr. Biga responded it would be from $79,372.80 to $85,800.00. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was 11-06 RESOLVED, That having reviewed the letter of January 7, 2011, from Kevin Maillard, Director of Public Works, regarding the pay step for Donald Rohraff, Superintendent of Public Service, and memorandum of January18, 2011, from Robert F. Biga, and having discussion with Kevin Maillard, Director of Public Works; and Robert F. Biga, Human Resources Director, the Civil Service Commission does hereby approve a pay step progression for Donald Rohraff, Superintendent of Public Service, to step 3 after his six (6) month probation increase, December 28, 2010; step 3-1/2 on his one- year anniversary, June 28, 2011; step 4-1/2 on his two year anniversary, June 28, 2012; and step 5 on his three-year anniversary, June 28, 2013. Mr. Biga explained there was an x -item on tonight's agenda regarding a Police Officer working in the Detective Bureau and he didn't see the announcement or he wasn't given his Pages 1280th Regular Meeting January 19, 2D11 announcement setting forth the due date for applications for the promotional Police Sergeant examination. The officer does acknowledge that he was advised in November that the examination was forthcoming, but he said he didn't get the application materials until the 13" of January. The cutoff date for applications was January 4, 2011. Mr. Tatigian inquired if the officer applied on the 13" of January and Mr. Biga confirmed that he did. Mr. Biga stated he recommended against allowing the late application, but it was up to the Civil Service Commission. Mr. Campau stated that allowing the late application doesn't affect the process at all. Ms. Mahoney stated she thought they should be careful not to set a precedent. She added there are still rules and regulations and we could have other employees decide they don't have to be timely in their submission of applications. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and adopted, it was 11-07 RESOLVED, That having reviewed the memorandum of January 18, 2011, from Robert F. Biga, regarding the late submission of an application for the Police Sergeant (1318 p.) examination, the Civil Service Commission does hereby approve the submission of the late application for Police Sergeant (1318 p.) and allow the applicant to take the written examination, based on the unique circumstances and this action is not precedent setting. AYES: Tatigian and Campau NAYS: Mahoney Ms. Mahoney directed that the Human Resources Director find out how tests are being announced in each of our Departments because it is important that information is being communicated in a timely basis. The Civil Service Department should survey each Department to find out how information is posted and where, and who is the person responsible in each entity. Ms. Mahoney indicated she would like to see a report back on that. Mr. Campau reminded the attendees that next month there would only be two (2) Commissioners at the meeting, since he would be out of town. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was RESOLVED, That the meeting be adjourned at 6:15 p.m. Gretchen Guisbert, Secretary III Charlotte S.
