HomeMy WebLinkAbout1281st CSC Meeting (February) Revised to reflect FY11 resolution numbers1281' REGULAR MEETING OF THE CIVIL SERVICE COMMISSION - REVISED The 1281" Regular Meeting of the Civil Service Commission was held on Wednesday, February 16, 2011. The meeting was called to order at 5:31 p.m. Members Present: Charlotte S. Mahoney, Chairperson Harry C. Tatigian Members Absent: Ronald E. Campau Also Present: Robert F. Biga, Human Resources Director Derrick L. Washington, Personnel Analyst II Gretchen Guisbert, Secretary III In the absence of Commissioner Campau, Chairperson Mahoney stepped down to second all the motions for the meeting. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and adopted, it was 11-08 RESOLVED, That the minutes of the 1280th Regular Meeting held Wednesday, January 19, 2011, be approved as submitted. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and adopted, it was 11-09 RESOLVED, That having reviewed the letter of February 11, 2011, from James McCracken, Custodian, approved for submission by Kevin Maillard, Director of Public Works, requesting additional family illness leave, the Civil Service Commission does hereby confine the administrative approval of Mr. McCracken's request to charge six (6) additional days as family illness to sick leave, however, Mr. McCracken does not have sufficient accrued sick time in his bank to cover the time requested and will be permitted to use time as he accrues it. The Commission staff reviewed Mr. McCracken's sick leave usage. Mr. McCracken charged thirteen (13) days of family illness time off in calendar year 2010. In addition, Mr. McCracken used 142.25 hours of personal illness time in 2010. Mr. McCracken is advised to review his sick leave usage in the future to assure that he has sufficient time in his bank to provide income when he must be off work due to personal or family illness. 11-10 RESOLVED, That having reviewed the Departmental Correspondence of January 22, 2011, from Harold Higgins, Senior Police Officer, as approved for submission by Robert Stevenson, Police Chief, requesting to carry over vacation days in excess of the maximum allowed by contract, based on a projected retirement date of January 22, 2014, the Civil Service Commission does hereby affirm the administrative approval of this request; AND BE IT FURTHER RESOLVED, that the employee has been advised of the maximum number of days to be paid off at retirement is fifty-nine (59), as cited in the Livonia Police Officers Association Contract, Article 22.7, Vacation Accrual, Paget 1281°regular Meeting February 16, 2011 as set forth in Civil Service Commission Rule 25, LEAVES, Section 25.1 Annual Leave (Vacation), Paragraph (f); AND BE IT FURTHER RESOLVED, that the employee is advised that the maximum number of days will be increased by the number of bonus vacation days earned in the last three (3) years prior to retirement for not using more than five (5) sick leave days annually, up to a maximum of nine (9) days; AND BE IT FURTHER RESOLVED, that the employee is notified it is the employee's responsibility to manage his vacation time to avoid losing excess accrued time prior to retirement by scheduling sufficient time off prior to retirement, subject to the operating needs of the department. 11-11 RESOLVED, That having reviewed the Departmental Correspondence of January 3, 2011, from Karen Wyman, Clerk -Typist II, as approved for submission by Robert Stevenson, Police Chief, requesting to carry over vacation days in excess of the maximum allowed by contract, based on a projected retirement date of January 3, 2014, the Civil Service Commission does hereby affirm the administrative approval of this request; AND BE IT FURTHER RESOLVED, that the employee is advised that the maximum number of days to be paid off at retirement is fifty-one (51), as set forth in Civil Service Commission Rule 25, LEAVES, Section 25.1 Annual Leave (Vacation), paragraph (f); AND BE IT FURTHER RESOLVED, that the maximum number of days will be increased by the number of bonus vacation days earned in the last two (2) out of three (3) years prior to retirement for not using more than five (5) sick leave days annually, up to a maximum of six (6) days; AND BE IT FURTHER RESOLVED, that the employee is notified that it is the employee's responsibility to manage her vacation time to avoid losing excess accrued time prior to retirement by scheduling sufficient time off prior to retirement, subject to the operating needs of the department. 11-12 RESOLVED, That having reviewed the letter of February 11, 2011, from Felicia Cross, Program Supervisor, as approved for submission by Linda McCann, Director of Community Resources, requesting to carry over vacation days in excess of the maximum allowed by contract, based on a projected retirement date of February 11, 2014, the Civil Service Commission does hereby affirm the administrative approval of this request; AND BE IT FURTHER RESOLVED, that the employee is advised that the maximum number of days to be paid off at retirement is fifty-one (51), as set forth in Civil Service Commission Rule 25, LEAVES, Section 25.1 Annual Leave (Vacation), paragraph (f); AND BE IT FURTHER RESOLVED, that the maximum number of days will be increased by the number of bonus vacation days earned in the last two (2) out of Page 1281` Regular Meeting Febmary 16, 2011 three (3) years prior to retirement for not using more than five (5) sick leave days annually, up to a maximum of six (6) days; AND BE IT FURTHER RESOLVED, that the employee is notified that it is the employee's responsibility to manage her vacation time to avoid losing excess accrued time prior to retirement by scheduling sufficient time off prior to retirement, subject to the operating needs of the department. 11-13 RESOLVED, That having reviewed the memorandum of January27, 2011, from Derrick L. Washington, Personnel Analyst 11, to Robert F. Biga, Human Resources Director, regarding the passing point for the written examination for Library Aide II (1319 p.), the Civil Service Commission does hereby affirm the administrative approval of the passing point of 70% or a score of 70 out of a maximum raw score of 100 for the written examination for LibraryAide II (1319 p.). 11-14 RESOLVED, That the Civil Service Commission does hereby confirm the administrative approval of the eligible list for LibraryAide II (1319 p.). The Commission received and filed the following: Status of Temporary Employees Report for January 2011. Non -Resident Report as of February 1, 2011. Current Open -Competitive and Promotional Eligible Lists as of February 1, 2011. Affirmative Action Report for January 2011. Removal of names from active eligible list report for the month of January 2011. Letter of January 28, 2011, from Robert F. Biga, Human Resources Director, to Charles Locke, President, AFSCME Union Local 192, regarding a work stoppage by DPW employees. Robert Biga, Human Resources Director, gave the Commissioners a full report of the events leading up to the necessity of this letter. 11-15 RESOLVED, That having reviewed the expiring eligible lists for the month of March 2011 — Account Clerk III (921 o.c.), Firefighter (915 o.c.), Account Clerk II (1308 p.), Engineering Assistant 1 (1307 p.), Police Lieutenant (1300 p.) and Police Sergeant (1299 p.), the Civil Service Commission does hereby confirm the administrative approval of the extension of the eligible list for Account Clerk 11 (1308 p.) for six (6) months to September 16, 2011 and the extension of the eligible list for Engineering Assistant 1 (1307 p.) for six (6) months to September 29, 2011. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and adopted, it was 11-16 RESOLVED, That having reviewed the Departmental Correspondence of January 27, 2011, from Brian Miencier, Fire Captain, as approved for submission by Shadd A. Whitehead, Fire Chief, requesting an Page 1281' Regular Meeting February 16, 2011 extension of the three-year vacation day carry over limit in anticipation of retirement based on a revised retirement date of January 27, 2014, the Civil Service Commission does hereby approve this request; AND BE IT FURTHER RESOLVED, that the employee must reduce his vacation balance to fifteen (15) twenty-four (24) hour duty days, effective December 31, 2013, since his basic vacation credit on January 1, 2014, is thirteen (13) twenty-four (24) hour duty days, and the maximum number of days the employee can have in the vacation bank is twenty-eight (28) twenty-four (24) hour duty days; AND BE IT FURTHER RESOLVED, that the employee has been advised that the maximum number of days will be increased by the number of bonus vacation days earned in the last three (3) years prior to retirement for not using more than fifty-six (56) sick leave hours annually, up to a maximum of three (3) days; AND BE IT FURTHER RESOLVED, that the employee has been notified it is the employee's responsibility to manage his/her vacation time to avoid losing excess accrued time prior to retirement by scheduling sufficient time off prior to retirement, subject to the operating needs of the department. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and adopted, it was: 11-17 RESOLVED, That having reviewed the Departmental Correspondence of January 27, 2011, from Ronald Selleck, Senior Police Officer, as approved for submission by Robert Stevenson, Police Chief, requesting an extension of the three-year vacation day carry over limit in anticipation of retirement based on a revised retirement date of January 27, 2014, the Civil Service Commission does hereby approve this request; AND BE IT FURTHER RESOLVED, that the employee must reduce his vacation balance to thirty-two (32) eight (8) hour duty days, effective December 31, 2013, since his basic vacation credit on January 1, 2014, is twenty-seven (27) eight (8) hour duty days, and the maximum number of days the employee can have in the vacation bank is fifty-nine (59) eight (8) hour duty days; AND BE IT FURTHER RESOLVED, that the employee has been advised that the maximum number of days will be increased by the number of bonus vacation days earned in the last three (3) years prior to retirement for not using more than forty (40) sick leave hours annually, up to a maximum of nine (9) days; AND BE IT FURTHER RESOLVED, that the employee has been notified it is the employee's responsibility to manage his vacation time to avoid losing excess accrued time prior to retirement by scheduling sufficient time off prior to retirement, subject to the operating needs of the department. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and adopted, it was Page 5 1281' Regular Meeting February 16, 2011 11-18 RESOLVED, That having reviewed the Departmental Correspondence of February 3, 2011, from Doris Malik, Clerk -Typist II, as approved for submission by Robert Stevenson, Police Chief, requesting an extension of the three-year vacation day carry over limit in anticipation of retirement based on a revised retirement date of February 3, 2014, the Civil Service Commission does hereby approve this request; AND BE IT FURTHER RESOLVED, that the employee must reduce her vacation balance to thirty-one (31) days, effective December 31, 2013, since her basic vacation credit on January 1, 2014, is twenty (20) days, and the maximum number of days the employee can have in the vacation bank is fifty-one (51); AND BE IT FURTHER RESOLVED, that the maximum number of days payable at retirement will be increased by any bonus vacation days earned for not using more than five (5) sick leave days in the last two (2) out of three (3) years of employment, up to a maximum of six (6) days; AND BE IT FURTHER RESOLVED, that it is the employee's responsibility to manage her vacation time to avoid losing excess accrued time prior to retirement by scheduling sufficient time off prior to retirement, subject to the operating needs of the department. Ms. Mahoney inquired about a request for an extension of an unpaid medical leave of absence from Louis Rivas and asked what happens if he doesn't return to work by March 7, 2011. Robert Biga, Human Resources Director, advised he could be subject to termination and he would be subject to pay back the City of Livonia for medical insurance provided to him while on an unpaid medical leave of absence. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and adopted, it was 11-19 RESOLVED, That having reviewed the letter of February 8, 2011, from Brian Wilson, Superintendent of Public Service, and Kevin Maillard, Director of Public Works, requesting an extension of an unpaid medical leave of absence for Louis Rivas, Water Meter Repairer II, and having discussion with Robert F. Biga, Human Resources Director, the Civil Service Commission does hereby approve Mr. Rivas' request for an extension of an unpaid medical leave of absence beginning February 1, 2011 through March 6, 2011; with the understanding that Mr. Rivas is responsible during the unpaid leave to pay any copayment for his medical insurance; AND BE IT FURTHER RESOLVED, that should Mr. Rivas not return to work for at least thirty (30) calendar days after the approved extension of the unpaid medical leave of absence, he will reimburse the City of Livonia for any costs for benefits paid for Mr. Rivas during his time off, in accordance with Section 25.6(c), Insurance Premium Payments, of the Civil Service Commission Rules and Regulations. Page 1281' Regular Meeting February 16, 2011 AND BE IT FURTHER RESOLVED, that this action constitutes the final extension of an unpaid medical leave of absence for Mr. Rivas and this approval is not precedent setting. The Commission received and fled the Blue Cross Blue Shield monthly Health Insurance Rates for March 1, 2011 through February 28, 2012.
