The meeting was called to order at 6:01 p.m. Members Present: Charlotte S. Mahoney, Chairperson Harry C. Tatigian Ronald E. Campau Also Present: Robert F. Biga, Human Resources Director Gretchen Guisbert, Secretary III Derrick L. Washington, Personnel Analyst II Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was 11-68 RESOLVED, That the minutes of the 1286th Regular Meeting held Wednesday, July 20, 2011, be approved as submitted. The Commission removed item 21 from the Confirming Agenda to permit discussion on that item. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was 11-69 RESOLVED, That having reviewed the letter of August 3, 2011, from Paulina Appel, Engineering Trainee, as approved for submission by Brian Wilson, Superintendent of Public Service, and Kevin Maillard, Director of Public Works, requesting an unpaid medical leave of absence, the Civil Service Commission does hereby affirm the administrative approval of an unpaid medical leave of absence, not to exceed ninety (90) days, with the understanding that Ms. Appel is responsible during her unpaid medical leave of absence to pay the copayment for her medical insurance; AND BE IT FURTHER RESOLVED, that should Ms. Appel not return to work for at least thirty (30) calendar days, after the approved ninety (90) day unpaid medical leave of absence, she will be responsible to reimburse the City of Livonia for any costs for benefits paid for Ms. Appel during her time off, in accordance with Section 25.6 (c) Insurance Premium Payments, of the Civil Service Commission Rules and Regulations and Final FMLA Regulations (29 C.F.R.), unless circumstances for not returning to work are beyond Ms. Appel's control. 11-70 RESOLVED, That having reviewed the memorandum of August 12, 2011, from Derrick L. Washington, Personnel Analyst II, to Robert F. Biga, Human Resources Director, regarding the passing point for the written examination for Custodian (934 o.c.), the Civil Service Commission does hereby affirm the administrative approval of the passing point of 70% or a score of 26 out of a maximum raw score of 38 for the written examination for Custodian (934 o.c.). Paget 1287" Regular Meeting August 18, 2011 11-71 RESOLVED, That having reviewed the memorandum of August 17, 2011, from Derrick L. Washington, Personnel Analyst II, to Robert F. Biga, Human Resources Director, regarding the passing point for the written examination for Police Service Aide (933 o.c.), the Civil Service Commission does hereby affirm the administrative approval of the passing point of 70 or 70 of the maximum raw scare of 100 for the written examination for Police Service Aide (933 o.c.). 11-72 RESOLVED, That the Civil Service Commission does hereby affirm the administrative approval of the eligible list for Tree Artisan (1322 p.). The Commission received and filed the following: Status of Temporary Employees Report for July 2011. Non -Resident Report as of August 1, 2011. Current Open -Competitive and Promotional Eligible Lists as of August 1, 2011. Affirmative Action Report for July 2011. Removal of names from active eligible list report for the month of July 2011. Expiring eligible lists for the month of September 2011 — Program Supervisor (930 o.c.), Account Clerk II (1308 p.), and Engineering Assistant 1 (1307 p.). Robert Biga, Human Resources Director, explained Confirming Agenda, item 21, a letter and attachment dated July 25, 2011, to City Council from Terry Marecki, City Clerk, requests to set the salary for the classification of Deputy Clerk equal to the salary of the Assistant City Clerk. The classification of Deputy Clerk is in the City Charter. However, the pay rate for Deputy Clerk has not been kept current. Several years ago a classification in the classified Civil Service called Assistant City Clerk, was created and that pay rate has been kept current. The current City Clerk would like to resurrect the Deputy City Clerk position and update the pay rate to the current level. He further slated the Civil Service has no jurisdiction because it is an appointed position. He explained that this was just a Receive and File item. At the last City Council study meeting, councilmember Brosnan inquired about the qualifications for the position. Appointed classifications do not have the same kind of qualifications as the Civil Service classifications. He indicated there are some appointed classifications that have specific requirements, for example, the Finance Director must be a CPA. However, other classifications do not have requirements, for example, the Director of Administrative Services; the Director of Legislative Affairs; the Director of Building Inspection; the Director of Community Resources; and the Deputy City Treasurer. Ms. Mahoney clarified that the Assistant City Clerk is a Civil Service Commission classification. Mr. Biga clarified the Deputy City Clerk is an unclassified appointed position. Page 3 1287u Regular Meeting August 18, 2811 Mr. Biga referenced a flow chart of the Civil Service of the City of Livonia. He stated the Civil Service of the City of Livonia includes classified and unclassified. The unclassified classifications are elected and appointed officials. The Civil Service Commission only has jurisdiction over the classified employees. Ms. Mahoney inquired if the City Clerk was going to do away with the Civil Service classification and use an appointed classification for that position. Mr. Biga responded that this action would give the City Clerk the option to use a classified position or an appointed classification with the Deputy City Clerk. Ms. Marecki has indicated she wanted to use the Deputy City Clerk classification and appoint someone. Mr. Biga informed the Commission that the City Council has this item on their regular agenda. Ms. Mahoney wanted the Minutes to reflect they requested discussion on this Receive and File item to better understand the role and responsibility of the Commission but it is the Council's prerogative to update the pay rate for Deputy City Clerk. Mr. Biga stated he would provide a copy of the flow chart to the Commissioners after the meeting. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was 11-73 RESOLVED, That having reviewed the letter of July 26, 2011, from Curtis Caid, Acting Police Chief, requesting an open -competitive examination for Police Dispatcher, and a memorandum from Derrick Washington, Personnel Analyst II, as approved by the Human Resources Director, proposing qualifications and parts of examination and weights, the Civil Service Commission does hereby approve the following qualifications and parts of examination and weights: QUALIFICATIONS By the closing date of the announcement, applicants must: Be a citizen of the United States or resident alien with the right to work in the United States; and Have a high school diploma or a valid equivalency certificate; and Be at least eighteen (18) years of age; and Have an acceptable voice quality level as detennined in the voice modulation test; and Have keyboard skills that meet or exceed 35 wpm without error; and Prior public safety dispatch experience is preferred, but not required. We seek candidates with excellent oral and written communication skills, the ability to make good decisions under pressure and during emergencies, and the ability to interact with a diverse public. Candidates must have a working knowledge of a computer and its various functions. PARTS OF EXAMINATION AND WEIGHTS Written Test -40% Interview -40% Performance Test -20% Page 1287" Regular Meeting August 1B, 2011 Voice Modulation Test— Pass/Fail Background Investigation — Pass/Fail Psychological Evaluation Test— Pass/Fail The fifteen (15) applicants who score highest on the Written Test, and who pass the Performance Test will be invited to the Interview part of examination. Candidates who possess an Associate's degree from an accredited college or university will have one (1) point added to their final examination score. Candidates who have one (1) or more years of full-time work experience as a public safety dispatcher will have two (2) points added to their final examination score. Applicants must pass the Written Test, the Performance Test, the Interview, a pass/fail Voice Modulation Test and a pass/fail Background Investigation in order to be placed on the eligible list. NOTE: APPLICANTS WILL ALSO BE REQUIRED TO SATISFACTORILY PASS A ONE (1) YEAR PROBATIONARY PERIOD BEFORE THE APPOINTMENT IS CONSIDERED REGULAR. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was 11-74 RESOLVED, That having reviewed the letter of August 1, 2011, from David Varga, Director of Administrative Services, requesting a promotional examination for Clerk Typist I, and a memorandum from Derrick Washington, Personnel Analyst II, as approved by Human Resources Director, proposing qualifications and parts of examination and weights, the Civil Service Commission does hereby approve the following qualifications and parts of examination and weights: QUALIFICATIONS This examination is open only to employees of the City of Livonia who, by the closing date of the announcement: 1. Are employed in the Department of Administrative Services; and 2. Have regular status in the classification of Clerk I; and 3. Have a minimum of one (1) year work experience with the City of Livonia. PARTS OF EXAMINATION AND WEIGHTS Written Test -30% Performance Test -30%` Departmental Rating —40%* 'In the event there is only one (1) candidate for the position, the Parts and Weights of examination will be 60% Performance Test and 40% Departmental Rating. Are employed in the classification of Police Service Aide; and 2. Are at least twenty-one (21) years of age; and 3. Have been awarded an Associate's Degree in Law Enforcement or Police Administration or a Bachelor's Degree in any non Criminal Justice discipline or upon graduation from an MCOLES approved training academy will be awarded an Associate's Degree in Law Enforcement; and Page 1287" Regular Meeting August 18, 2011 4. Possess and maintain a valid vehicle operator's license and have an acceptable driving record; and 5. Are one of the following: (a) A certified Michigan Police Officer or recertifiable at time of appointment; or (b) Certifiable as a Police Officer in the State of Michigan, subject to verification by the Michigan Commission On Law Enforcement Standards (MCOLES); or (c) Currently enrolled in an MCOLES approved training academy and certifiable by the promotion date; and 6. Able to pass a physical examination by the City Physician to determine that they are free from any physical defects, chronic diseases, organic diseases, organic or functional conditions, or mental and emotional instabilities which may tend to impair the efficient performance of duties or which might endanger the lives of others or the individual employee; and 7. Have passed an MCOLES physical fitness test within twelve (12) months of date of promotion; and 8. Have met all other standards as required by MCOLES RULES 28.14203 through 28.14207 of The Policies And Procedures Manual of the Michigan Commission On Law Enforcement Standards (Rev. 2009) for certification as a Police Officer. At the time of certification to department for hiring consideration, candidate must: 1. Have at least six (6) months service as a Police Service Aide with the City of Livonia; and 2. Have satisfactory performance reviews. PARTS OF EXAMINATION AND WEIGHTS Departmental Rating -60% Oral Interview -40%' 'In the event the number of qualified applicants is the same or less than the number of vacancies, the Parts of Examination and Weights will adjust to 100% Departmental Rating. Candidates must pass the Departmental Rating and Oral Interview' in order to be placed on the eligible list. Candidates on the eligible list must take and pass the Michigan Commission On Law Enforcement Standards (MCOLES) Physical Skills and the Physician's Medical examinations to qualify for the Police Academy, within 180 days prior to the start of the Academy and posses a valid reading/writing test. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was 11-77 RESOLVED, That having reviewed the Departmental Correspondence of August 1, 2011, from Ead Fesler, Fire Marshal, as approved for submission by Shadd A. Whitehead, Fire Chief, requesting an extension of the three-year retirement limit for excess vacation accrual in anticipation of retirement based on a revised retirement date of September 2, 2014, the Civil Service Commission does hereby approve this request; Page 7 1267u Regular Meeting August 18, 2011 AND BE IT FURTHER RESOLVED, that the employee must reduce his vacation balance to thirty-two (32) eight (8) hour duty days, effective December 31, 2013, since his basic vacation credit on January 1, 2014, is twenty-seven (27) eight (8) hour duty days; AND BE IT FURTHER RESOLVED, that the employee has been advised that the maximum number of days will be increased by the number of bonus vacation days earned in the Iasi three (3) years prior to retirement for not using more than forty (40) sick leave hours annually, up to a maximum of nine (9) days; AND BE IT FURTHER RESOLVED, that the employee has been notified it is the employee's responsibility to manage his/her vacation time to avoid losing excess accrued time prior to retirement by scheduling time off prior to retirement, subject to the operating needs of the department. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was 11-78 RESOLVED, That having reviewed the letter of August 12, 2011, from Terranda Jett, Clerk I (RPT), acknowledged for submission by Kathleen Monroe, City Librarian, requesting a second extension of an unpaid medical leave of absence, the Civil Service Commission does hereby approve an extension of Ms. Jett's unpaid medical leave of absence until August 22, 2011. Robert F. Biga, Human Resources Director, explained that he was proposing using the EMPCO testing procedure for vacancies for Police Officer that the Police Service Aides can't fill. The candidates can test through EMPCO and there will be a date set where individuals can apply. For any inquiries about Police Officer, potential candidates will be notified to go to Schoolcraft College or any other approved site and take the EMPCO examination and be put on the list. Ms. Mahoney inquired about possibility of having a trial period and Mr. Biga said this could be applicable for a one-year trial period on the EMPCO testing procedure. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was 11-79 RESOLVED, that having reviewed the letter of August 16, 2011, from Curtis Caid, Acting Police Chief, requesting an open -competitive examination for Police Officer, using the EMPCO written testing procedure, the Civil Service Commission does hereby approve using the EMPCO written test procedure in the open -competitive examination for Police Officer and this action would be effective for a one-year period, at which time it will be revisited by the Civil Service Commission. Upon a motion by Mr. Campau, seconded by Mr. Tatigian and unanimously adopted, it was 11-80 RESOLVED, That having reviewed the letter of August 16, 2011, from Lyle Tmdell, Interim Superintendent of Parks and Recreation, requesting Page 8 1287u Regular Meeting August 18, 2011 approval to freeze all Casual/At-Will Parks and Recreation staff pay levels at their current steps, effective December 1, 2011, the Civil Service Commission does hereby approve freezing the pay levels for all Casual/At-Will Parks and Recreation employees for the duration of the City's wage freeze for General employees.
