The meeting was called to order at 5:34 p.m. Members Present: Also Present: Brian Wilson, Superintendent of Public Service Harry C. Tatigian, Chairman Charlotte S. Mahoney Brian Meakin Robert F. Biga, Human Resources Director Gretchen Guisbert, Secretary III Upon a motion by Ms. Mahoney, seconded by Mr. Meakin and unanimously adopted, it was 1259 RESOLVED, that the minutes of the 1296'" Regular Meeting held Wednesday, May 9, 2012, be approved as submitted. Upon a motion by Ms. Mahoney, seconded by Mr. Meakin and unanimously adopted, it was 12-60 RESOLVED, that having reviewed the letter of May 11, 2012, from Jessica Modrzynski, Animal Control Officer, as approved by Brian Wilson, Superintendent of Public Service, requesting an unpaid medical leave of absence, the Civil Service Commission does hereby affirm the administrative approval of an unpaid medical leave of absence for medical necessity, not to exceed ninety (90) days beginning April 19, 2012, with the understanding that Ms. Modrzynski is responsible during her unpaid medical leave of absence to pay the copayment for her medical insurance; AND BE IT FURTHER RESOLVED, that should Ms. Modrzynski wish to continue her leave of absence to care for a family member, after she is no longer disabled by her physician, Ms. Modrzynski will be required to exhaust her vacation and personal business banks prior to requesting additional unpaid time off; AND BE IT FURTHER RESOLVED, that should Ms. Modrzynski not return to work for at least thirty (30) calendar days after the approved unpaid medical leave of absence, she will be responsible to reimburse the City of Livonia for any cost for benefits paid for Ms. Modrzynski during her time off, in accordance with Section 25.6(c), Insurance Premium Payments, of the Civil Service Commission Rules and Regulations and Final FMLA Regulations (29 C.F.R.), unless circumstances for not returning to work are beyond Ms. Modrzynski's control. Upon a motion by Ms. Mahoney, seconded by Mr. Meakin and unanimously adopted, it was 12-61 RESOLVED, That having reviewed the letter of May 31, 2012, from Alex Bishop, Director of Inspection, requesting an extension of his leave of absence from the classified service, the Civil Service Commission does hereby approve a leave of absence from the classified service for Mr. Bishop for one (1) Paget 1297" Regular Meeting June 13, 2012 year, commencing June 1, 2012, pursuant to Civil Service Commission Rules and Regulations, RULE 16, CERTIFICATION, APPOINTMENT AND REINSTATEMENT, Section 16.5, Appointment of an Employee in the Classified Service to a Position in the Unclassified Service. Upon a motion by Ms. Mahoney, seconded by Mr. Meakin and unanimously adopted, it was 12-62 RESOLVED, That having reviewed the Departmental Correspondence of May 14, 2012, from Francis Donnelly, Police Lieutenant, as approved for submission by Benjamin McDermott, Deputy Police Chief, for Curtis Caid, Police Chief, requesting to carry over vacation days in excess of the maximum allowed by Livonia Lieutenants and Sergeants Association (LLSA) contract, based on a projected retirement date of May 14, 2015, the Civil Service Commission does hereby affirm the administrative approval of this request; AND BE IT FURTHER RESOLVED, that the employee has been advised of the maximum number of days to be paid off at retirement as cited in the LLSA Contract, Article 16, VACATION, Paragraph E, and as set forth in Civil Service Commission Rule 25, LEAVES, Section 25.1 Annual Leave (Vacation), Paragraph (f); AND BE IT FURTHER RESOLVED, that the employee is advised that the maximum number of days will be increased by the number of bonus vacation days earned in the last three (3) years prior to retirement for not using more than five (5) sick leave days annually, up to a maximum of nine (9) days; AND BE IT FURTHER RESOLVED, that the employee is notified it is the employee's responsibility to manage his vacation time to avoid losing excess accrued time prior to retirement by scheduling sufficient time off prior to retirement, subject to the operating needs of the department. Upon a motion by Ms. Mahoney, seconded by Mr. Meakin and unanimously adopted, it was 12-63 RESOLVED, That the Civil Service Commission does hereby affirm the administrative approval of the additions to the eligible list for Police Officer (1332 p.), dated May 11, 2012. Upon a motion by Ms. Mahoney, seconded by Mr. Meakin and unanimously adopted, it was 12-64 RESOLVED, That the Civil Service Commission does hereby affirm the administrative approval of the additions to the eligible list for Police Officer (1332 p.), dated May 16, 2012. Upon a mofion by Ms. Mahoney, seconded by Mr. Meakin and unanimously adopted, it was 12-65 RESOLVED, That the Civil Service Commission does hereby affirm the administrative approval of the eligible list for Firefighter (940 o.c.). Page 3 1297u Regular Meeting June 13, 2012 Upon a motion by Ms. Mahoney, seconded by Mr. Meakin and unanimously adopted, it was 12-66 RESOLVED, That the Civil Service Commission does hereby affirm the administrative approval of the eligible list for Senior Clerk (1334 p.). Upon a motion by Ms. Mahoney, seconded by Mr. Meakin and unanimously adopted, it was 12-67 RESOLVED, That the Civil Service Commission does hereby affirm the administrative approval of the eligible list for Secretary II (1333 p.). The Commission received and filed the following: a. Status of Temporary Employees Report for May 2012. b. Non -Resident Report as of June 1, 2012. C. Current Open -Competitive and Promotional Eligible Lists as of June 1, 2012. d. Affirmative Action Report for May 2012. e. Removal of names from active eligible list report for the month of May 2012. f. Council Resolutions from the meeting of May 9, 2012 with minutes to be approved May 23, 2012: #192-12, approving the reappointment of Ashley Krueger, to the City Planning Commission for a term of three years, which will expire on June 9, 2015. #193-12, approving the reappointment of Carol Smiley, to the City Planning Commission for a tens of three years, which will expire on June 9, 2015. #194-12, approving the reappointment of Ian Wilshaw, to the City Planning Commission for a term of three years, which will expire on June 9, 2015. g. Council Resolutions from the meeting of June 6, 2012, with minutes to be approved June 18,2012: #238-12, approving the reappointment of Matthew Henzi, to the Zoning Board of Appeals, for a three-year tens, which will expire on July 12, 2015. It. Expiring eligible lists for the month of July 2012 - None. Robert F. Biga, Human Resources Director, recommended the Commission approve changes in the qualifications in the promotional examination for Service Representative (Water). These modifications came about as a result of contract negotiations with Local 192. Brian Wilson, Superintendent of Public Service, was present to answer any questions about the request for the Service Representative examination. He explained that the new contract requires a Group "A" Commercial Drivers License (CDL) for all the drivers. He also slated they have fewer employees than they used to and they have equipment that the State of Michigan requires drivers to have the Group "A" license. So in order to do leaf pickup and other programs, they need the employees to have Group "A" licenses. Page 4 1297" Regular Meeting June 13, 2012 Upon a motion by Mr. Meakin, seconded by Ms. Mahoney and unanimously adopted, it was 12-68 RESOLVED, That having reviewed the letter of May 8, 2012, from Brian Wilson, Superintendent of Public Service, and Kevin Maillard, Director of Public Works, requesting a promotional examination for Service Representative (Water) and a memorandum dated May 18, 2012, from Derrick L. Washington, Personnel Analyst II, to Robert F. Biga, Human Resources Director, discussing the proposed qualifications and parts of examination and weights, the Civil Service Commission does hereby approve the following qualifications and parts of examination and weights: QUALIFICATIONS This examination is open only to employees of the City of Livonia who, by the closing date of the announcement, are: Employed in the Public Service Division of the Department of Public Works; and Have regular status as a Water Meter Repairer; and Have a minimum of six (6) months experience as a Water Meter Repairer with the City of Livonia; and Are eligible for a Temporary Instruction Permit (TIP) for or have a Group "A" Commercial Drivers License with Air Brake. Must have or be eligible for an Industrial Truck Driving Permit for operation of a forklift. An employee in this classification is subject to all requirements of the Federal Omnibus Transportation Employee Testing Act of 1991, as amended. PARTS OF EXAMINATION AND WEIGHTS Written Test -40% Interview -30% Departmental Rating -30%' Candidates must pass the Written Test and the Interview in order to be placed on the eligible list. Pursuant to AFSCME Local 192, Promotions 20.13. in competitive examinations which include Departmental Ratings, the Departmental Rating from 0 to 100 will count as 30% of the examination, but a score under 70 will not disqualify the candidate from continuing in the process. 'In the event there is only one qualified applicant for the position, the Parts of Examination and Weights will be 100% Departmental Rating. Mr. Biga explained that the request for a promotional examination for Water Meter Repairer I had the same modifications as the request for a Service Representative examination, as a result of contract negotiations. Mr. Biga presented that the Civil Service Commission acted on a wage and pay step freeze for General unrepresented employees and for Parks and Recreation employees, but there was one group of employees that was left out of the August 18, 2011 resolution. The following resolution was proposed to expand the previous Civil Service Commission action. Upon a motion by Ms. Mahoney, seconded by Mr. Meakin and unanimously adopted, it was 12-70 RESOLVED, That having reviewed the memorandum of May 24, 2012, from Jan Patterson, Personnel Clerk, to Robert F.
