The 1311" Regular Meeting of the Civil Service Commission was held on Wednesday, August
28, 2013. The meeting was called to order at 5:41 p.m.

Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was
13-98 RESOLVED, that the Minutes of the 1310th Regular Meeting held
Wednesday, July 17, 2013, be approved as submitted.
Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was
13-99 RESOLVED, That having reviewed the letter of July 31, 2013, from
Brenda Smyser, Legal Stenographer II, as approved for submission by Donald L.
Knapp, Jr., City Attorney, requesting additional Family Illness leave, the Civil
Service Commission does hereby affirm the administrative approval of
Ms. Smyser's request to use an additional six (6) eight (8) hour days for the
calendar year 2013 from her sick bank to be charged as family illness.
Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was
13-100 RESOLVED, That having reviewed the military orders dated June
26, 2013, and received in the Civil Service Department on July 19, 2013, from
Ruth Love, Clerk -Typist II, noted by Curtis Caid, Police Chief, requesting a
military leave of absence, the Civil Service Commission does hereby affirm the
administrative approval of Ms. Love's request for a military leave of absence for
the period of July 20, 2013 through August 4, 2013.
Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was
13-101 RESOLVED, That having reviewed the letter of August 8, 2013,
from Constance S. Kumpula, Accountant II, as approved by Michael T. Slater,
Director of Finance, requesting an unpaid medical leave of absence, the Civil
Service Commission does hereby affirm the administrative approval of an unpaid
medical leave of absence for Ms. Kumpula, not to exceed sixty (60) days from
the date Ms. Kumpula enters into an unpaid status, with the understanding that

Ms. Kumpula is responsible during her unpaid medical leave of absence to pay
the copayment for her medical insurance;
AND BE IT FURTHER RESOLVED, that should Ms. Kumpula wish to continue
her leave of absence to care for a family member, after she is no longer disabled
by her physician, Ms. Kumpula will be required to exhaust her vacation and
personal business banks prior to requesting additional unpaid time off;
AND BE IT FURTHER RESOLVED, that should Ms. Kumpula not return to work
for at least thirty (30) calendar days after the approved unpaid medical leave of
absence, she will be responsible to reimburse the City of Livonia for any cost for
benefits paid for Ms. Kumpula during her time off, in accordance with Section
25.6(c), Insurance Premium Payments, of the Civil Service Commission Rules
and Regulations and Final FMLA Regulations (29 C.F.R.), unless circumstances
for not returning to work are beyond Ms. Kumpula's control.
Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was
13-102 RESOLVED, That having reviewed the letter of August 13, 2013,
from Laura Sieracki, as approved for submission by Kevin Maillard, Director of
Public Works, requesting an unpaid medical leave of absence, the Civil Service
Commission does hereby affirm the administrative approval of an unpaid medical
leave of absence for Ms. Sieracki, not to exceed ninety (90) calendar days,
beginning on September 8, 2013 through December 8, 2013, with the
understanding that Ms. Sieracki is responsible during her unpaid medical leave
of absence to pay the copayment for her medical insurance;
AND BE IT FURTHER RESOLVED, that should Ms. Sieracki not return to work
for at least thirty (30) calendar days after the approved unpaid medical leave of
absence, she will be responsible to reimburse the City of Livonia for any cost for
benefits paid for Ms. Sieracki during her time off, in accordance with Section
25.6(c), Insurance Premium Payments, of the Civil Service Commission Rules
and Regulations and Final FMLA Regulations (29 C.F.R.), unless circumstances
for not returning to work are beyond Ms. Sieracki s control.
Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was
13-103 RESOLVED, That having reviewed the letter of August 7, 2013,
from Susan Hoff, Deputy City Clerk (RPT), requesting an extension of a leave of
absence from the classified service, the Civil Service Commission does hereby
affirm the administrative approval of an extension of a leave of absence from the
classified service for Ms. Hoff for one (1) year, commencing September 1, 2013,
pursuant to Civil Service Commission Rules and Regulations, RULE 16,
CERTIFICATION, APPOINTMENT AND REINSTATEMENT, Section 16.5,
Appointment of an Employee in the Classified Service to a Position in the
Unclassified Service.

Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was
13-104 RESOLVED, That having reviewed the memorandum of July 18,
2013, from Derrick L. Washington, Personnel Analyst 11, to Robert F. Biga,
Human Resources Director, regarding the passing point for the written test for
Water Meter Repairer 1 (1347 p.), the Civil Service Commission does hereby
affirm the administrative approval of the passing point in the written test, of a raw
score of 67 out of a maximum score of 100.
Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was
13-105 RESOLVED, That having reviewed the memorandum of July 18,

Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was
13-111 RESOLVED, That having reviewed the expiring eligible list for the
month of September 2013 - Clerk -Typist 1 (937 o.c.), the Civil Service
Commission does hereby affirm the administrative approval to extend the eligible
list for Clerk -Typist 1 (937 o.c.) for an additional six (6) months to March 28,
2014.
Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was
13-112 RESOLVED, That having reviewed the letter of July 31, 2013, from
Donald L. Knapp, Jr., City Attorney, as approved for submission by Mayor Jack
E. Kirksey, and the memorandum of August 5, 2013, from Jan Patterson,

and parts of examination and weights, the Civil Service Commission does hereby

The examination is open only to employees of the City of Livonia who, by the closing date of
the announcement, are:

Employed in the Department of Public Works; and

Be eligible for either a Temporary Instruction Permit (TIP) for, or a valid
Group "A" Industrial Truck Commercial Driver's License with Air Brake, and
must have or be eligible for, a valid Industrial Truck Driving Permit for
operation of a forklift. An employee in this classification is subject to all
requirements of the Federal Omnibus Transportation Employee Testing Act
of 1991, as amended; and

David Jacobsen -Harm, Assistant Driver, as approved for submission by Shadd
Whitehead, Fire Chief, requesting a waiver of the residency requirement, the Civil
Service Commission does hereby grant a request for a waiver of the residency
requirement for Mr. Jacobsen -Harm until further notice.
Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was
13-118 RESOLVED, That having reviewed the letter of July 11, 2013, from
Alex Bishop, Director of Inspection, requesting an open-competifive examination
for Code Enforcement Officer, and proposed qualifications and parts of
examination and weights, the Civil Service Commission does hereby approve the
following qualifications and parts of examination and weights:
QUALIFICATIONS
By the closing date of the announcement, an applicant must:
1. Be a citizen of the United States or an alien with the right to work in the
United States; and
2. Have a high school diploma or its equivalent; and
3. Possess and maintain a valid drivers license and have an acceptable driving
record; and
4. Have either:
a. One (1) year full-time, paid experience in inspection work, dealing with
codes and/or law enforcement, or

b. Completion of at least twenty (20) credit hours in law enforcement or
psychology at an accredited college or university; or
C. Four (4) years full-time paid experience in the construction field with the
ability to be registered as a Building Inspector and Plan Reviewer by the
State of Michigan ACT 54 requirements or already be registered; or
d. Combination of the above requirements acceptable to the department.
Applicants with State of Michigan PA 54 certification as a Building
Inspector, Electrical Inspector, HVAC Inspector or Plumbing Inspector
may be given preference.

be made of the applications and the fifteen (15) applicants with the most appropriate and
responsible combination of experience and training will be invited to the Interview. Candidates
must pass the Interview in order to be placed on the eligible list.
Mr. Biga, Human Resources Director, announced Brian Mills, Great Lakes Employee
Benefits, and Gary Molnar, AmWINS Group Benefits, were in attendance at the meeting to
present a proposal for prescription coverage for all City of Livonia retirees. Mr. Biga noted
that all Union presidents were contacted about this proposal. There was a presentation of the
program to the Board of Trustees of the Livonia Retirement System. One Union president
attended the meeting.
Mr. Biga explained that by City Charter, the Civil Service Commission and the City Council
approve contracts for health care. Any changes in health care contracts require approval by
both parties and that is why this proposal is in front of the Civil Service Commission. The
proposal is to modify the City of Livonia retiree past -65 medical programs to provide for a
separate group to handle the processing of prescriptions. The reason is primarily because of
the Affordable Health Care Act. Mr. Biga stated that is why Mr. Mills and Mr. Molnar were
present to review this proposal. Mr. Biga further stated he had hoped this meeting would
have been better attended. Mr. Mills and Mr. Molnar will provide the same presentation to the
Civil Service Commission that was provided to the City of Livonia Retirement Board. Mr. Biga
slated that the Retirement Board should understand what is happening because health care
costs are paid for out of the VEBA. The Retirement Board has no authority to approve health
care changes because by Charter, the health care program is set up by the Civil Service
Commission and the City Council. Mr. Biga explained that the VEBA is administered by the
Retirement Board and is the funding source for post -employment health care benefits.
Ms. Mahoney asked if City Council had already been presented with this information.
Mr. Biga stated they had not. Historically, changes have been approved by the Civil Service
Commission and then forwarded to City Council. Under the program, all of the City of Livonia
retirees will have a separate prescription drug card. Mr. Biga advised that retirees over the
age of 65 will actually have three (3) cards; their Medicare card, their Blue Cross card and
now this separate prescription card.

Ms. Mahoney asked if there was a down side to this prescription proposal. Mr. Mills staled
the down side is that it is a change. The transition to a new program may cause some
retirees to panic and they may believe the benefits won't be the same. Mr. Mills stated the
benefits will be the same. Ms. Mahoney asked if this was whether or not a person used a
generic or non -generic. Mr. Mills again stated the benefit would remain the same.
Mr. Molnar stated that AmWINS will match the benefit and the plan designs. There can be
several different plans for refirees over 65 years of age. Mr. Mills stated the reason they can
do this is the City of Livonia will still be self-funded. Mr. Mills indicated they will file for a
"rebate" and get a subsidy back for providing prescriptions to the City of Livonia retirees. That
subsidy is approximately 28%. The City will still be self-funded. We are using a Medicare
Part D contract and wrapping around it so all benefits will still be the same. Mr. Mills further
explained they will take advantage of some of the provisions of the Affordable Care Act and
some of the things that the pharmacy industry is doing, such as paying 50% of the cost if you
get into the doughnut hole for name brand drugs. For somebody who is really sick, the AHCA
provides catastrophic coverage, so the City is going to receive more rebates than it currently
receives. Mr. Mills made the analysis that if we have a 64 -year-old who is a retiree, the City is
paying 100% of that cost, because the City's insurance is primary. When someone turns 65
years old, Medicare will be primary on the medical. The prescription drugs are processed
through a Part D program for which the City pays. We will get the advantage of being a Part
D program. There is a financial incentive for the City to do this.
Ms. Mahoney asked if there was a guarantee on how long this program will last. Mr. Molnar
said no, there is no guarantee with how long any plan will last. Mr. Molnar said like Medicare
today, they are thinking about moving eligibility to 67-1/ years of age. He said imagine how
that would affect the City of Livonia having to carry the prescription coverage for retirees who
are pre -67-1/. But if the plan changes, the City can always purchase a better plan. Mr. Mills
stated if there is a major change to what is happening to Medicare Part D plan. There is
probably going to be a change to the RDS subsidy as well because they run hand in hand.
So if Medicare Part D changes, the subsidy would probably change as well. If it was more to
the City's economic advantage to move back, we could move back to Blue Cross. This does
make things easier, i.e., there would no longer be a need to have an attestation by an actuary
or any additional administrative expense insured by the Civil Service Department by filing the
RDS subsidy. Mr. Molnar explained that all the fling would now be their responsibility. Mr.
Molnar said it would be like the City renting their program. They are passing through all the
discounts. The most beneficial thing the City is getting immediately, is approximately $45 per
member, per month. So when the City signs up, the first month RDS will write a check to the
City for around $30,000 and do so each month. Today, the City has to wait for the subsidy on
an annual basis.
Ms. Mahoney stated she didn't see a down side to this change.
Mr. Biga explained that AmWINS will be paid by the City for their services. The contract for
the health care is between the City and Blue Cross right now. What this action does is carve
out the prescription coverage. The City of Livonia will still have a contract with Blue Cross for
the medical and surgical services. The only thing we are carving out is the prescription
coverage for past -65 year old retirees at the present. Mr. Molnar informed Mr. Biga that
AmWINS could manage the under -65 year old retirees as well, and to consider AmWINS
providing them with the same plan. Mr. Molnar said it would be the same program; it just

wouldn't be run through the Medicare Part D provision until the retiree reaches age 65. The
retirees would have the same 1-(800) number for call center assistance and the transition will
be very smooth when they turn 65 because it will be the same company they have already
been dealing with.
Ms. Mahoney clarified that AmWINS would become the administrator of the drug portion of
the City's health care package. Mr. Mills explained that they are a PBM, a Pharmacy Benefit
Manager. They have a contract that has 60,000 pharmacies in it. They pass along all the
rebates right back to the City, just like is done now with Blue Cross.
Ms. Mahoney asked why Blue Cross would want this to happen. Mr. Mills explained that Blue
Cross doesn't have a self-funded Employer Group Waiver Plan (EGWP). They do not want to
spend $2,000,000 to set up their own EGWP. They will write a fully insured Medical Part D
program and administer it as such. AmWINS projected that Blue Cross's cost is about $319
per member, per month for our current program. Mr. Mills asked Blue Cross what they could
do for a fully insured EGWP. Blue Cross quoted a fully -insured program at $310 per member,
per month. The estimated cost to rent this EGWP and run everything through is about $250
per member, per month. There is a substantial savings, and Blue Cross does not have the
vehicle to do it.
Mr. Molnar stated they provide a fully insured program as well, but Mr. Mills felt that the best
way to minimize the disruption was to have a self-funded program. Mr. Molnar cited an
example of when doctors prescribe 50,000 mg. of Vitamin D. He said the retirees are getting
Vitamin D at 20,000 mg. as a covered prescription drug benefit. So a lot of the retirees today
are getting Vitamin D because it is being covered. But under a fully -insured EGWP, they
couldn't add that 50,000 mg. dosage because it is not approved by Medicare. So under a
self-funded program, we could add that on and say that will be covered. The point is, on a
fully -insured plan, it is not easy to get that added, because it is registered with the State and
the Federal government. Under a self-funded plan, we could decide to add that, starting on
day one.
Mr. Mills explained that right now Blue Cross is paying all the claims whenever someone gets
a prescription. Under the EGWP, the plan will still pay for it, but there are more subsidies that
are available to us. Mr. Molnar slated that making a change is not easy and what they will do
is be a support unit for the retirees. Mr. Mills stated there will be a call center that is
specialized in talking with retirees. Mr. Molnar stated the 140 -seat call center is located in
North Kingston, Rhode Island. Ms. Mahoney recommended they could include the under -65
retirees in the AmWINS contract resolution and the City of Livonia will no longer provide any
pharmacy coverage with Blue Cross for retirees.
Mr. Molnar recommended this become effective January 1, 2014. He then suggested they
conduct educational meetings because the retirees are nervous when it comes to making any
kind of change.
Mr. Biga had one question. He asked when AmWINS gives the City of Livonia a bill, if the
administrative costs were incorporated in the bill. Mr. Molnar replied, yes, the fees are in the
bill. Mr. Biga stated there should be a decrease in the Blue Cross fees then because the
prescription management is a part of the claims and the City pays a percentage of the claims
as an administrative charge. Mr. Mills stated that was correct. Mr. Biga asked if the

administrative percentage rate was the same for Anti as it is for Blue Cross. Mr. Molnar
stated he was unaware of what Blue Cross was charging. He knew Anti fees are a flat
fee, not a percent of claims. Mr. Molnar further explained there was a small insurance
component because if the City didn't pay AmWINS, they could theoretically go after the
retirees, but the government says they can't. Once the retiree gets the prescription plan, they
are entitled to it. So AmWINS bought insurance if the City didn't pay, so AmWINS can't go
back after the retirees. This is one of the rules of a self-funded plan. Mr. Biga asked if an
individual has a prescription maintenance drug through Blue Cross, would that transfer over
to AmWINS. Mr. Molnar stated if people are doing mail order, they will need a new
prescription.
Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and adopted, it was
13-119 RESOLVED, That having heard a presentation from Brian Mills,
Great Lakes Employee Benefits, and Gary Molnar, AmWINS Group Benefits,
regarding proposed prescription coverage with AmWINS Group Benefits for all
City of Livonia retirees, including retirees under age 65 and over age 65, and
having discussion with Robert F. Biga, Human Resources Director, the Civil
Service Commission does hereby approve the City of Livonia Retiree
Prescription contract with AmWINS, and submits same to City Council for their
review and consideration.
Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian, and adopted, it was
RESOLVED, that the meeting be adjourned at 6:26 p.m.
