HomeMy WebLinkAboutPLANNING MINUTES 1950-08-02 27 MINUTES OF THE PUBLIC HEARING OF THE PLANNING COMMISSION OF THE CITY OF LIVONIA must 2, 1950 Petition No. 1 Petition of V,alter V6ilson and Lucy ilson, his wife, to change zoning classification from C-1 to M-1. Walter Wilson, 9613 Blackburn, Plymouth, Mich. (for change) : "I have M-1 across the road from me. I have a chance to sell the farm if it is zoned 1:1-1; that is only reason. The man who wanted to buy the land from me told me it was none of my busi- ness what he wanted to use it for. " Mrs. Hensley, 11531 Gavel (against change) : New subdivision is going in near this property and there are no other factories around there at all; nice locality. Mr. M. H. Tinkham, Tinkham and Snyder, Attorneys, Vv�ayne, Michigan: "I represent the Equitable Land Company which owns the property mentioned by Mrs. Hensley, 120 acres to the east and south of this particular piece of property. I desire to present to members of the board the position that the Equitable Land Company is about to find itself in if the proposed change of the ordinance takes place here. Some time ago this 120 acres was purchased by the Equitable Land Company for only one purpose and that was to plat the land into a plat with such provisions with reference to the plat as would be agreeable to the Township of Livonia, then the City, and undoubtedly the members of the board know as much about the history of this as I do. The Equitable Land Company paid v120,000. 0O for this property and have had it surveyed, platted, all lot markers put in, they have committed themselves to put in. the streets as the County of litayne and the City of Livonia desire to the extent of putting up ;;50,000. 00 in cash with the City. They have made all their applications to the F. H.A. ; paid all fees necessary for those approvals. They have tentative approval. They are already to go. They have been delayed because of things that are no fault of theirs; they were caught in the middle. Not until day before yesterday was the plat approved out here; but it was approved and submitted prematurely to the County so that it will be apyroved there for certain. New subdivision is made up of 457 nice, beautiful lots. It is going to be a beautiful job. They are going to build 457 houses. Some time ago the Township had a sewer revenue bond issue here. I have been in the municipal law business for 36 years, for 2e years attorney for a_yne, where I live. A sewer revenue bond issue cannot be sold unless there 29 are sufficient house connections to make enough revenue to pay the shot. The Equitable Land Company committed themselves to do what they are doing now; committed themselves on school bond issue; have played ball with the Township of Livonia and City 100;'.. They are figuring on constructing houses that cost 10, 12 and 14 thousand dollars. If, however, the property mentioned (farm) is zoned for light manufacturing and it can be used for such purposes as read out of the book, houses would not sell there. People don't want that sort of thing next to their homes. I appreciate Mr. u:ilson 's position, but my opinion is that he does not have to worry too much about that farm if farms go as they are--120 acres at .120,000.00. I do think that the Equitable Land Company has to worry. If they were the only ones hurt and no one else, I wouldn 't speak here to you. I feel that the Equitable Land Company had a reasonable, equit- able, fair objection to this. It isn't that they want to stop the betterment of the City of Livonia. They have indicated in every way up until now that it has been the opposite. They fear, and I am sure myself, that this is going to hurt them. Under the circumstances, they should not be hurt inasmuch as what they are doing is good for the City of Livonia, and if they are hurt to the point where they cannot carry out their plans, everybody is Laing to be hurt. You need houses like that--beautiful places. Zoning should not be changed in fairness to my client 's position. They have done everything up to now they have been asked to do; put up cash of bond for .;50,000.00; they mean business; play I square; they did not expect a change. Is it reasonable now, if a person does all those thinks if in keeping with the law as it was, with the special and the legal assurance , that they can 't count on the zone that they were in being the same. Isn 't it unreasonable and unfair to change that now when they have their feet on the ground; all this money expended; to stop them from completing something that will not only help them but also the City of Livonia. I would like to make my objections and I want to direct it to the sense of fairness of this board as the situation is now presented. That is my position at the present time. 'uouldn 't be here if it wasn 't good; just the fairness of the deal i want to present. Mrs. Hensley: People feel that they were going to live in a nice locality and would not like to live in factory district. Mrs. Gains : Ve should grow as a city--need people--should develop. Mrs. Stephens : The understanding was that we would keep industry near the railroad track. I say let 's keep the industry near the railroad track and keep off south side of Plymouth ;toad. Yr. Carson Johnston: Plan was approved recently. Tentatively approved back in Larch. City now has <; 50,000.00. 1 -31 Mr. Tinkham: During this change the signing of the plats was held up until day before yesterday. A half of this year 's construction weather shot. That is the reason that there are no houses there now. Petition N o. 2 Petition of Newman to cnange zoning classification from R-1 to C-1. Mr. Newman, 1515 Monroe Blvd. , Dearborn, Michigan: Mr. Newman was asked by Mr. MacIntyre what type of business the property would be used for and Mr. Newman answered: "Business would be fair to the City and public; fair all around. " Letter was read from Boardof County Road Commissioners. A. A. Campbell, Attorney for Road Commission (opposed to change) : "The Board feels that the change in zoning, if it allows the existence of a retail business at that point, will be a very serious hazard to the park development and will create traffic hazard in the way of parking, being entrance to parkway in the City of Livonia; public would be served by keeping the zoning at that point as presently exists. " Wm. H. Schnell, 37470 Plymouth Road: "I have a petition signed by 32 taxpayers in the surrounding; territory opposing change. " (turned petition over to Board) . :rs. Kennedy, 37825 Plymouth Road: Vrhen applying for building permit was told then this locality was definitely residential. Change will endanger children waiting for bus. Mrs. Schnell, 37470 Plymouth Road: There are 19 of us who can speak if required to. G.e are all opposed to it, plus extras. Attorney A. A. Campbell: Newburg Road is uniform width. There is additional 75 feet that belongs to the public, which is included in the park lands. 1:e do not desire any chance in the zoning of the 75 feet. Mrs. Hoffert, 37560 Plymouth Road: "I am across from the property in question. I would like to state at this time I don 't see where any type of business that could be gut in velich would be profitable to the person wouldn 't be detrimental to the rest of us. Anything that would pay would be out of place there. " Blorence Crawford: 1,e do already have a bad traffic condition there, cars passing and turning around; especially on Sundays; except during of hours, do not allow children out on Sunday. 1 Business there would make it worse. 111/ Petition No. 3 Asa '<<fi lson, et al - not represented. Petition No. 4 Hartmann: '!Change for business frontage; not suited for any- thing else because of the race track. " Petition No. 5 Rutenbar: (same as Hartmann) Petition No. 6 Bernice Lehn: (same as Hartmann) Petition No. 7 Letter in favor of change of zoning written by Slopinkas ' attorney was read. Carl Rumon, 16854 R.ouceway Drive. "Have been here four times on that same issue; live directly in back of this lot which used to be R-B-l. For almost ten years we have had trouble; supposed to be residential, invested money, nice homes, and would not like to have any business on that lot. Three lots being asked to change to business frontage wouldn't help them and only spoil our property as a residential section. All single homes. ;:rs. Eynatt : also protested. B. A. Letter was read from Beamer. Petition denied. Recess : The chairman, Mr. George Bentley, called the meeting to order for the purpose of making final recommendations to the City Council on all Petitions that came before the Public Hearing tonight. All members of the Planning Commission were present. 35 Upon a motion duly made by 'Jr. Walter Russell, seconded by Lr. Harold Bower, and unanimously carried, it was RESOLVED, to deny the petition of falter and Lucy L. Wilson (r/1) . Upon a motion duly made by Br. Robert P.'aclntyre, seconded by Mr. Clarence Jahn, and unanimously carried, it was RESOLVE, to deny the petition of David and Sarah l ewi_ian, petition #2. Upon a motion duly made by 1.r. Harold fower, seconded by T,`Br. Clarence Jahn, and unanimously carried, it was RESOLVED, to grant requests in the following petitions : Petition #3 - Asa Wilson r4 - Hans Hartmann #5 - Win. Rutenbar 16 - Bernice Lehn Upon a motion duly made by Er. Clarence Jahn, seconded by Br. Robert Bac intyre, and unanimously carried, it was RCCSOLV'LD, to deny the petition of Anna Slap- inskas, petition f7. The Chairman instructed the Secretary to write a letter to the City Council informing them of the above disposition of petitions that came up for Public rearing tonight.
