HomeMy WebLinkAboutPLANNING MINUTES 1996-09-10 15154 MINUTES OF THE 376th SPECIAL MEETING HELD BY THE CITY PLANNING COMMISSION OF THE CITY OF LIVONIA '`ow On Tuesday, September 10, 1996, the City Planning Commission of the City of Livonia held its 376th Special Meeting in the Livonia City Hall, 33000 Civic Center Drive, Livonia, Michigan. Mr. James McCann, Chairman, called the meeting to order at 7:40 p.m. Members present: James C. McCann Jack Engebretson Robert Alanskas William LaPine R. Lee Morrow Daniel Piercecchi Patricia Blomberg Members absent: None Messrs. John J. Nagy, Planning Director; H. G. Shane, Assistant Planning Director; and Scott Miller, Planner II, were also present. Mr. McCann informed the audience that if a petition on tonight's agenda involves a rezoning request, this Commission only makes a recommendation to the City Council who, in turn, will hold its own public hearing and decide the question. If a petition involves a waiver of use request and the request is denied, the petitioner has ten days in which to appeal the decision to the City Council; otherwise the petition is terminated. The Planning Commission holds the only public hearing on a preliminary plat and/or a vacating ``► petition. Planning Commission resolutions become effective seven days after the resolutions are adopted. The Planning Commission has reviewed the petitions upon their filing and have been furnished by the staff with approving and denying resolutions. The Commission may use them or not use them depending upon the outcome of the hearing tonight. Mr. Alanskas, Secretary, announced the item on the agenda was 96-8-1-20 by First Industrial, L.P. requesting to rezone property located on the north side of Plymouth Road between Chase Boulevard and Eckles Road in the South 1/2 of Section 30 from M-2 to M-1. Mr. Shane presented a map showing the property under petition plus the existing zoning of the surrounding area. Mr. Nagy: We have received a letter from the Engineering Department stating they have no objections to this rezoning proposal. Mr. McCann: Is the petitioner present? David Draft, 24800 Denso Drive, Southfield: In total we are planning on developing three buildings. The medical warehouse distribution center, which is the first 15155 building to be constructed will be 140,000 sq. ft. and leased to General Medical. The second building will be 140,000 sq. ft., and the third building will be 160,000 sq. ft. First Industrial, which is our company, plans on owning and developing the site in total. The M-1 zoning district better accommodates our site plan proposal and is a better fit than M-2 zoning. Mr. LaPine: Can you explain for me the medical warehouse distribution center? Mr. Draft: General Medical is a national medical distribution company. They do not produce hazardous materials. They will be occupying the building for many years. Mr. LaPine: Since everything is trucked in, how will this affect the traffic in the area? Mr. Draft: The M-1 district will allow us to place the 17 loading docks on the west side of the building away from the residential subdivision. Seventeen loading docks are not a lot of docks for a 140,000 sq. ft. building. Jay Bermian: I am with First Industrial. As we see it the traffic likely to be generated by this development will not significantly increase over what was the case with the Hygrade development. Mr. LaPine: John, will they need site plan approval from the Planning Commission and City Council? Mr. Nagy: This property is zoned industrial and therefore a site plan will not need approval by the Planning Commission or City Council, only the Building Department, although it will be reviewed by the City Council in connection with their tax abatement request. (Mr. Draft handed out preliminary site plans and explained that the building would be constructed out of masonry and steel.) Mr. LaPine: Will there be any type of fencing? Mr. Draft: We will be putting up a wall along the east property line if it is required. Mr. Nagy: The Zoning Ordinance specifies that since this area was at one time master planned for industrial, protective walls are therefore not required for industrial development abutting these residential areas. 15156 Mr. Draft: It is our opinion that due to the topography of the property, a chain link fence would provide better protection. `ow Mr. Engebretson: A wall or fence is not required but I think it would be in your best interest to get together with the staff and come up with some kind of buffer between you and the residential subdivision. Mr. Morrow: Remember this is only a zoning matter. Mr. Engebretson: Why is an M-1 district better for your development than an M-2 district? Mr. Draft: Because of the setbacks of an M-2 district we would not be able to develop the site as we want to with due consideration being given to the adjoining residential area. Tammy Miller, 38025 Grantland: How much bigger than the Hygrade plant will the new buildings be? Also, what are the setbacks of the buildings and will they be in operation 24 hours a day? Mr. Draft: (He presented the preliminary plan to the audience) The medical warehouse would operate with two shifts and be placed 300 feet from the north property line. v.. There was no one else present wishing to be heard regarding this item and Mr. McCann, Chairman, declared the Public Hearing on Petition 96-8-1-20 closed. On a motion duly made by Mr. Engebretson, seconded by Mr. Morrow and unanimously approved, it was #9-161-96 RESOLVED that, pursuant to a Public Hearing having been held by the City Planning Commission on September 10, 1996 on Petition 96-8-1-20 by First Industrial, L.P. requesting to rezone property located on the north side of Plymouth Road between Chase Boulevard and Eckles Road in the South 1/2 of Section 30 from M-2 to M-1, the City Planning Commission does hereby recommend to the City Council that Petition 96-8-1-20 be approved for the following reasons: 1) That the proposed change of zoning is compatible to and in harmony with the surrounding zoning districts and uses in the area; 2) That the proposed change of zoning is consistent with the Future Land Use Plan designation for the property of"Industrial"; and 15157 3) That the proposed change of zoning is consistent with the intended use of the property. 'New FURTHER RESOLVED that, notice of the above hearing was given in accordance with the provisions of Section 23.05 of Zoning Ordinance#543, as amended. Mr. McCann, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mr. Engebretson, seconded by Mr. Morrow and unanimously approved, it was #9-162-96 RESOLVED that, the City Planning Commission does hereby determine to waive the provisions of Section 10 of Article VI of the Planning Commission Rules of Procedure regarding the seven day period concerning effectiveness of Planning Commission resolutions in connection with Petition 96-8-1-20 by First Industrial, L.P. requesting to rezone property located on the north side of Plymouth Road between Chase Boulevard and Eckles Road in the South 1/2 of Section 30 from M-2 to M-1. Mr. McCann, Chairman, declared the motion is carried and the foregoing resolution adopted.
