Tne 58th Special Meeting was called to order by Chairman Peter A. Ventura at approximately 8:05 p.m. Secretary Rufino Salinas called roll with the following result: Members present: William Robinson H. Paul Harsha Rufino Salinas Karle Steinhoff Robert L. Greene Peter A. Ventura Adelaide Nielsen Members absent: *Dallas F. Hay *Edwin Conway The following were present together with approximately 35 people attending the Public Hearing ana the Special Meeting: Mr. Eino Michaelson, Asst. Supt., Livonia School District Lieutenant Bob Perry - Fire Department Mr. Max Kohler, Building inspector The secretary announced that the first item on the agenda was the amended petition of J. J. Burman, Service Sign Company for permission to erect a ground sign similar to that constructed by Mohawk Lumber Company on Parcel F3b located 32222 Plymouth Roan and situated on the Northeast corner of Plymouth Road and Hubbara Road in the Southeast 1/4 of Section 27. The secretary read letter dated November 5, 1954 from Bill Brown, Bill Brown; inc. requesting the decision of the commission be withheld until after the opening of the new showroom. It was decided that the letter dated November 9, 1954 from Chief Calvin Roberts, Fire Department could be witnneld until the petition is resubmitted. *Mr. Dallas F. Hay arrived at approximately 8:Ub p.m. The petitioner or a representative was not present. Upon a motion duly made by Mr. Harsha, seconded by Mr. Steinhoff and unanimously carried, it was RESOLVED that, petition of J. J. Burman, Service Sign Company for permission to erect sign on Parcel F3b located 32222 Plymouth Road and situated on the Northeast corner of Plymouth and Hubbard Roads in the Southeast 1/4 of Section 27 be tabled until there is further communication from the petitioner. The Chairman declares the foregoing resolution adopted. The Chairman announces that that concluded the 58th Special Meeting and called the Public Hearing to order. The secretary read Petition No. Z-64 by Dr. Waldemar E. Gizynski, et al asking that the zoning classification of Lot No. 1, B. E. Taylor's ereenmoo• Sub— division located in the Northwest 1/4 of Section 24 and situated on the South- Page 110, Vol. 4 110 west corner of Five Mile Road and Harrison Avenue be cnanged from RUFB to C-1. ,(7) Tne secretary read letter dated November 3, 1954 from Dr. Waldemar E. Uizynski asking that consideration of this petition be postponed. The petitioner or a representative was not present. :]I Mr. Charles J. Bush, B. E. Taylor, Inc., 32788 Five Mile Roaq, Livonia stated that the property was bougnt from nis concern and that petitioner informed nim he was requesting petition be tabled as there was a matter of financing for the type of building required on lot. Upon a motion duly made by Mrs. Nielsen, seconded by Mr. Robinson and unanimously carried, it was RESOLVED that, Petition No. Z-b4 by Dr. Waldemar E. Gizynski, et al asking tnat the zoning classification of Lot No. 1, B. E. Taylor's Greenmoor Subdivision located in the Northwest°1/4 of Section 24 and situatea on the Southwest corner of Five Mile Road ana Harrison Avenue be changed from RUFB to C-1 be tabled until there is further communication from the petitioner. The Chairman declared the foregoing resolution adopted. The secretary read Petition No. Z-abs by V. R. Breiaenbach, Lytle Construction Company asking that the zoning classification of Parcel M located in the Northwest 1/4 of Section 31 and situated on the West side of Hix Roaa between Ann Arbor Road and Ann Arbor Trail be changed from RUFF to R-1-B. Mr. V. R. Breidenbach stated that they have worked out the school problem with Mr. Eino Michaelson, Asst. Supt., Livonia School District. Mr. Michaelson stated Mr. Breidenbacn came to him witn definite plans for four cottage type schools which they will build based on nouse plans at a price quoted and satisfactory to Board of Education. The Board of Education has not taken any official action except that they are satisfied and the four cottage type schools will take care of the school problem temporarily. **Mr. Edwin Conway arrived at approximately 8:10 p.m. Mr. Salinas asked if this could be applied to other subdivisions. Mr. Michael- son stated the buildings would be cheaper because subdivider builds them with other homes. State law requires School Board to let project out by bids. Have discussed situation with Lansing and they have approved plans. Mr. Breidenbach stated the buildings would be constructed along with other buildings, but they could be completed prior to the homes if the School Board so aesired. Mr. Michaelson stated the School Board goes have plans for a permanent school in Section 31 and that the cottage type schools would be a two or three year project. Stated it was their intent to back two lots up and use the center portion for play ground area in the cottage type scnool. Mr. Breidenbacn stated there will be approximately 234 lots in the two units. Mr. Michaelson stated they figure 1/2 child per home at kindergarten through sixth grade age. The cottage type school would be the size of a normal class room. iL ll Mr. Breidenbach stated the subdivision would be built in a period of two or three years aepending on the sale. Could insert two or three more cottage schools if there was need. Mr. Steinnoff asked what grades the Board of Education proposed to put in cottages. Mr. Michaelson statea they would no doubt be used for kindergarten first, second and third grades. Mr. Ventura asked where they intended to dispose of sewage. Mr. Breidenbach submitted revised plat. Stated the Wayne County Roaa Commission had no objection to their using Middle Rouge Interceptor. Did not Know who to con- tact regarding Newburg River. Mr. Ventura stated zoning change would be contingent on whether they will have facilities. The commission should know whether the particular area is adapted for the particular use to which it is to be zoned. Mr. Breidenbach stated they bought land for subdividing purposes. Percolation tests show that land is adapted for septic tanks. Mr. Robinson stated he did not think petition should be granted because of the Fire Department, Police Department and sanitary sewers inadequacy. Mr. Breidenbach stated they will run sewer 1/2 mile to proposed subdivision. As they now own land, they will have to build project. There is a water main on Hix Road and Ann Arbor Road and Ann Arbor Road and Ann Arbor Trail. Mr. Ventura stated Newburg Lake is a recreational lake, Before this zoning change is granted a letter from proper authorities should be in eviaence to commission that the sewer is aaequate and where the storm water is to be run. Mr. Robinson made the following motion. RESOLVED that, Petition No. Z-b5 by V. R. Breidenbach, Lytle Construction Company asking that the zoning classification of Parcel M located in the Northwest 1/4 of Section 31 and situatea on the West siae of Hix Road between Ann Arbor Road and Ann Arbor Trail be changed from RUFB to R-1-B be tabled until November 23, 1954 in order to give petitioner opportunity to present letter from proper authorities stating that the sanitary sewer is adequate and obtaining permission to discnarge storm water drains into proposed streams and lakes. Mr. Hay statea motion is out of order as there may be people present who have not been heara. Mr. Robinson withdrew his motion. No one was present opposed to petition. Upon a motion auly mace by 11r. Breiaenbach, Lytle Construction Company asking that the zoning classification of Parcels K and L located in the Northwest 1/4 of Section 31 and situatea approximately 1,925 feet West of Hix Roaa between Ann Arbor Trail and Ann Arbor Road be changed from RUFB to tz-1-B be tabled until November 23, 1954 in order to give petitioner opportunity to present letters from proper autnorities stating that the sanitary sewer is aaequate and obtaining permission to discharge storm water drains into proposed streams or lakes. A roll call vote on the foregoing resolution resultea in the following: AYES: Robinson, Hay, Steinhoff, Greene, Nielsen and Ventura NAYS: Conway, tiarsha and Salinas Tne secretary read Petition No. Z-b'( by Irving Levine, Burt Homes, inc. asking that the zoning classification of Parcel CC2, except the North 7.5 acres located in the Southeast 1/4 of Section 22 and situated approximately 1,325 feet West or Merriman Roaa between Schoolcraft ana Lyndon be changed from RuFB to R-1-B. Messrs. Irving Levine and Seymour Goldman, Attorney, 15034 Ford Bldg., Detroit were present. lir. Levine stated that the bids have been let for school in Section 22. Have not talkea to Board of Education but if neeaed is willing to establish cottage type schools similar to plans of Lytle Construction Company in Section 31. Stated the proposed sanitary sewer on Schoolcraft will include this property. There is a storm water sewer East over to Merriman Road. Propose 110 to 115 homes. Mr. Robinson statea the commission should not act on petition until the sanitary sewer is in. Mr. Levine stated they did not intend to start subdivision until the sewer is in. No one was present opposed to petition. Mr. Ventura stated Mr. Levine should furnish the same information as asked of Lytle Construction Company. interested in knowing where storm water will be run. Upon a motion duly made by Mr. Robinson and seconded by Mr. Steinhoff, it was RESOLVED that, pursuant to a Public Hearing having been held on Petition No. Z-b'( as submitted by Irving Levine, Burt Homes Inc. for a change of zoning in the Southeast 1/4 of Section 22 from RUt'B to R-1-B the City Planning Commission does hereby recommend 113 to the City Council that Petition No. Z-67 be denied as there are no sewer facilities, and PURI:HEIt RESOLVED, notice of the above nearing was published in the official newspaper, The Livonian, under date of October 21, 1954 and notice of which hearing was sent to The Detroit Edison Company, Chesapeake & Ohio Railway Company, Michigan Bell Telephone Company, The Consumers Power Company, City Departments and petitioner as listed in the Proof oz' Service. A roll call vote on the foregoing resolution resulted in the following: AXES: Robinson, Hay, Steinnoff, Greene, Ventura and Salinas NAYS: Conway, Nielsen and Harsha Mr. Conway asked if tnere was no solution to this. The secretary read Petition No. V—b by George W. Crane, et al asking that the first North and Soutn 20 foot alley East of Cavell situated between Lots 26 through 38 and Lots 90 through 102, B. E. Taylor's Como Lake Subdivision in the Northeast 1/4 of Section 24 be vacated. The secretary read the following letters: (a) letter dated March 8, 1954 with signatures of property owners approving of Petition No. V—b; (b) Letter dated October 21, 1954 from James A. Nicholas, Acting Supt. of Public Works and (c) Letter datea October 28, 1954 from Herald Hamill, Engineer. No one was present opposed to the petition. The petitioner or a representative was not present. Upon a motion duly made by Mr. Robinson, seconded by mr. Hay and unanimously carried, it was RESOLVED that, pursuant to a Public Hearing having been held on Petition No. V-6 as submitted by George W. Crane, et al for vacating of 20 foot alley in the Northeast 1/4 of Section 24 the City Plann— ing Commission does hereby recommend to the City Council that Petition No. V-6 be granted subject to the letter of recommendation from Herald Hamill dated October 28, 1954, and FURTHER RESOLVED, notice of the above hearing was published in the official newspaper, The Livonian under date of October 21, 1954 and notice of which hearing was sent to Tne Detroit Edison Company, Chesapeake & Ohio Railway Company, Michigan Bell Telephone Company, The Consumers Power Company, City Departments, petitioner and abutting property owners as listed in the Proof of Service. The Chairman declared the foregoing resolution adopted. The Chairman called a recess at approximately 9:00 pm. The Chairman called the Public Hearing to order at approximately 9:15 p.m. Upon a motion duly made by Mr. Hay seconded by Mr. Robinson and unanimously carried, it was 1 1 4 RESOLVED that, the next item appearing on the agenda be postponed ,01,61.10 temporarily in order to give petitioner's attorney an opportunity to be at meeting. The Chairman declared the foregoing resolution adopted. The secretary read Petition No. Z-69 by D. A. Laven asking that the zoning lassification of Parcels Vlala and Vlalb located in the Southeast 1/4 of Section 32 and situated on the Northeast corner of Levan Road and Ann Arbor Trail be changed from RUFB to R-l. Messrs. Burton Warner and Kenneth Fischer Attorney, 1663 Guardian Bldg., Detroit were present. Mr. Jiscner stated it was his understanding that the proposed subdivision plat was approved at the previous meeting. lir. Ventura stated that the subdivision plat was discussed but no action'was taken by commission. Mr. Warner stated tnat he was the engineer that prepared the proposed sub- division plat. Did not have letter from Wayne County Road Commission but did talk to Mr. A. T. Kunze, Sanitary Engineer as to the sanitary sewer being adequate and to the Board of Health. There is no question on either score. The sanitary sewage would be handled similar to that in Smokier Rousseau Sub- division -- through the Middle N.ouge interceptor. Mr. Kunze made no comment about it being overloaded. There will be 21 homes in the proposed subdivision. Mr. Fischer suggested the petition be approved subject to letters from proper authorities. Mr. Hay read portion of Page 660 (Member's copy) Page 79 (Official Minutes, Vol, 4) of the minutes of the meeting held by Planning Commission September 21, 1954. Mr. Warner stated that he understood the letter requested at this meeting was to be presented at the time of the subdivision plat. Mr. Conway stated that where the petitioner has been before the commission before the commission should grant petition subject to the letters being received. Mr. Ventura stated this would snow discrimination. No one was present opposed the petition. Upon a motion duly made by Mr. Steinhoff and seconded oy Mrs. Nielsen, it was RESOLVED that, Petition No. Z-69 by D. A. Laven asking that the zoning classification of Parcels Vlala and Vlalb located in the Southeast 1/4 of Section 32 and situated on the Northeast corner of Levan Road and Ann Arbor Trail be changed from RUFB to R-1 be tabled until November 23, 1954 in order to give petitioner opportunity to present letters from proper authorities stating tnat the sanitary sewer is adequate and obtaining permission to discharge storm water drains into proposed streams or lakes. The Chairman declared the foregoing resolution adopted. The secretary read the Petition No. Z-68 by Justus and Mildred Cunningham ask- ing that the zoning classification of Parcels A51a and A52a located in the Northeast 1/4 of Section 3 and situated on the Southeast corner of Fargo and Parker Avenues be changed from RuFB to R-1-B. Messrs. Justus Cunningham and Charles Robb, Attorney, 26825 Plymouth Rd., Det. 39 were present. Mr. Salinas stated the petition did not state the reason for re-zoning. Mr. Robb stated his client intended to split parcel into four 75' lots approxi- mately 170 feet deep. There is a County Ditch along South end of property. Presented percolation test taken by Carl L. Hammond, 18405 Garfield, Det. 19 The application did not mean that the Wayne County Board of Healtn approves test. At present there are Loo many homes in area. Mr. Ventura stated that tne Mayor and City Council have not been approving re- zoning where septic tanks will be used. Mr. harsha stated this would not be considered a subdivision as the parcel will be split into only rour lots. Mr. Cunningham stated this is considered the best part of Livonia for septic tanks. There is city water available. Mr. Bob Dickieson, 20111 Parker stated ne lives directly across the street from the property in question. Submitted a petition containing approximately 5U names of property owners in area opposed to cnange of zoning. The secretary read the petition submitted by Mr. Dickieson. Mr. Robb stated tnere would be four lots and that two acres are involved. Mr. Bob Melvin, 20301 Parker stated that tne neighborhood is uniform and that the smaller lots now established were there before the zoning ordinance and map were adopted. Opposed to re-zoning. Mr. Hay stated that Mr. Cunningham is qualified to build tour nomes on RUFB if it is changed to R-1 it is possible to build rive homes. Mr. Robb stated his client would not make lots smaller than 77 reet. Mr. Harsha read Section i3.04 oz the Zoning Ordinance, Ordinance No. bU. Mr. Robb stated the reason nis client petitioned for re-zoning is that even though the plat book shows parcel to be two acres the title to property is a little under two acres. Upon a motion duly made by lir. Hay and seconded by Mr. Steinhoff, it was RESOLVED that pursuant to a Public Hearing having been held on Petition No. Z-b8 as submitted by Justus and Mildred Cunningham for a change of zoning in the Northeast 1/4 of Section 3 from RUFB to R-1-B tne City Planning Commission goes hereby recommend to the City Council that Petition No. Z-b8 be denied because of the petition with approximately 5U signatures of property owners in area opposed to petition and according to the plat book and ordinance petitioner has sufficient area to build four nomes, and FURTHER RESOLVED, notice of tne above hearing was published in the official newspaper, 'Ine Livonian, under date of October 21, 1954 and notice of which hearing was sent to The Detroit Edison Company, Chesapeake & Onio Railway Company, Michigan Bell Telephone Oampany, The Consumers Power Company, City Departments and petitioner as listed in the Proc./ of Service. Z-'(U by Albert Simkins asking that tne zoning classification of Parcels Ula3a and &la3b located in the Southwest 1/4 of Section 32 and situated on tne South side of Ann Arbor Trail directly at the Southerly tip of Levan Road be changed from RUFB to R-1. Messrs. Burton Warner and Roscoe Gustafson, 22919 Michigan Avenue, Dearborn were present. Mr. Warner stated there would be approximately 110 homes. No one was present opposed to the petition. Upon a motion duly mace by Mr. Conway, seconded oy Mr. Salinas ana unanimously carried, it was RESOLVED that, pursuant to a Public Hearing having been held on Petition No. Z-70 as submitted by Albert Simkins for a change of zoning in the Southwest 1/4 of Section 32 from RUFB to R-1 the City Planning Commission hereby recommends to the City Council that Petition No. Z-7U be granted as Olde Indian Trail Subdivision has been tentatively approved and that zoning petition is to conform with new procedure, and FURTHER RESOLVED, notice of the above hearing was published in the official newspaper, The Livonian, under date of October 21, 1954 and notice of which hearing was sent to The Detroit Edison Company, The Consumers Power Company, Chesapeake & Ohio Railway company, Michigan Bell Telephone Company, City Departments and petitioner as listed in the Proof of Service. The Chairman declared the foregoing resolution aaoptea. The secretary read Petition No. Z-11 by Jesse M. Cook, Cook Development Company asking tnat the zoning classification of the following parcels of land be changed from RUFB to R-1: IAA Parcel CC located in the Southeast 1/4 of Section 33 and situated on the South side of Ann Arbor Trail directly at the Southerly tip of Stark Road, and Parcel W2a located in the Southwest 1/4 of Section 33 and situated on the Northeast corner of Ann Arbor Trail and Wayne Road, and Lots 747, '152, '153, 'b4 and 757, Supervisor's Livonia Plat, No. 12 located in the Soutnwest 1/4 of Section 32 and situated on the South side of Ann Arbor Trail East of Newburg Road. Messrs. Burton Warner and Roscoe Gustarson, 22919 Michigan Avenue, Dearborn were present. Mr. Warner stated that he did not prepare tne drawings on the proposed sub- divisions. These proposes subdivisions are in the same physical catagory as Olde Indian Trail Subdivision and Westrail Subdivision as they have access to the Middle Rouge Parkway sanitary sewer. Mr. Marsha presented the question whether the petition contained an accurate legal description of the property involved. No one was present opposed to the petition. Upon a motion duly made by Mr. Robinson, seconded by Mr. Hay and unanimously carried, it was RESOLVED that, Petition No. Z-71 by Jesse M. Cook, Cook Development Company requesting a change of zoning from RUFB to R-1 in the South- east 1/4 of Section 33, Southwest 1/4 of Section 33 and the Southwest 1/4 of Section 32 be tabled until November 23, 1954 in order to give petitioner opportunity to present letters from proper authorities stating that tne sanitary sewer is adequate and obtaining permission to discharge storm water drains into proposed streams and lakes. The Chairman declared the foregoing resolution adopted. The secretary read Petition No. Z-72 by Harold W. Schmidt, Hillside Custom Homes, Inc. asking that the zoning classification of the West 1/2 of Parcel 1'14 located in the Northwest 1/4 of Section 2 and situated on the Northeast corner of Sunset Blvd. and Pembroke Avenue be changed from RUFB to R-1-B. Mr. Schmidt was present and stated that ne is asking for Parcel "D" as indicated on plot plan attached to petition. Less than one acre is involved. use septic tanks in this area. There is a County Ditch running through this area. The commission found upon looking at the plat book that this entire area was split up into small pieces. No one was present opposed to the petition. Mr. Robinson reminded commission of Livonia Gardens Subdivision situation. Upon a motion duly made by Mr. Conway and seconded by Mr. Salinas, it was RESOLVED that, pursuant to a Public hearing having been held on Petition No. Z-/2 as submitted by Harold W. Schmidt, Hillside Custom homes, Inc. for a cnange of zoning in the Northwest 1/4 7. 18 of Section 2 from RUFB to R-1-13 the City Planning Commission does hereby recommend to the City Council thatPetition No. Z-72 be granted because of the nature of the surrounding area, and FURTHER RESOLVED, notice of the above hearing was published in the official newspaper, The Livonian under date of October 21, 1954 and notice of which hearing was sent to The Detroit Edison Company, The Consumers Power Company, Cnesapeake & Ohio Railway Company, Michigan Bell Telephone Company, City Departments and petitioner as listed in the Proof of Service. A roll call vote on the foregoing resolution resulted in the following: AYES: Conway, Greene, Harsha and Salinas NAYS: Robinson, Hay, Steinhoff, Nielsen and Ventura The Chairman declared the motion lost. The Cnairman called a recess at approximately 10:35 p.m. The Chairman called the meeting to order at approximately 10:45 p.m. 'Pne secretary read the letter dated October 5, 1954 from Russell C. Ashmore City Attorney regarding the procedure for tne recording of plats, furnishing of bonds and issuance of building permits. Mr. Ventura suggested that a photostat of this letter be given to each member of tne commission. Appointed the following committee to study letter and return to commission witn report stating whether the commission should adopt suggested procedure. Hay Upon a motion duly made by Mr. Conway, seconded by Mr. Robinson and unanimously carried, it was RESOLVED that, letter dated October 5, 1954 from Russell C. Ashmore City Attorney regarding procedure for the recording of plat, furnish, ing of bonds and issuance of building permits be placed on file. Tne Chairman declared the foregoing resolution adopted. There was a lengthy discussion regarding the purchase of camera for commission use as suggested by Jonn Daugherty at the last City Council meeting. Upon a motion duly made by Mr. Conway, seconded by Mr. Robinson and unanimously carried, it was RESOLVED that, a Land Polaroid Camera, Flash Attachment and necessary equipment be purchased for commission use. The Chairman declared the foregoing resolution adopted. Upon a motion duly made by Mr. Salinas and seconded by Mr. Robinson, it was 119 RESOLVED that, statement from The Livonian, Inc. in the amount of $87.50 be forwarded to the proper department for payment. IE: A roll call vote on the foregoing resolution resulted in the following: AYES: Robinson, Hay, Conway, Steinhoff, Greene, Nielsen, Harsha, Ventura and Salinas NAYS: None The following dates were set for commission meetings: November 23, 1954 Special Meeting November 30, 1954 Study Meeting December '( , 1954 Public Hearing December 14, 1954 Public Hearing December 21, 1954 Regular Meeting Mr. Ventura informed those members who are to attend City council meetings that all information pertaining to commission and on Countil agenda will be in a folder on top of secretary desk the night of said meeting. Suggested that member call secretary during day to check items on agenda. Mrs. Bachman, 18001 Lathers asked if the plat book belonging to the City of Livonia had been returned by Mr. Malcolm F. Waring, Waring and Johnson. Stated that this book may be used in the court case by Louis Garofalo against Hugn Wood, Jr., Friday, November 12, 1954. Mr. Salinas stated that the plat book had not been returned and that he had talked to Mr. Waring over the telephone. Mr. Hay suggested the City Attorney issue a replevy. Upon a motion auly mace by Mr. Steinhoff, seconded by L'ir. Robinson and unanimously carried, it was RESOLVED that, written and formal demands having been made to Mr. Mal- colm F. Waring, Waring and Johnson by the City Planning Commission and Rufino Salinas, Secretary and same having been refused, correspondence ignored be it RESOLVED that, the City Attorney be instructed to take tne necessary legal action to recover all property belonging to the City of Livonia and/or City Planning Commission at present in possession of Waring and Johnson. Tne Chairman declarea tne foregoing resolution adopted. Upon a motion duly made by Mr. Harsha, seconded by Mr. Steinhoff and unanimously carried, it was RESOLVED that, this meeting be adjourned.
