A Public Hearing of the Council of the City of Livonia was held at the City Hall
Auditorium on Monday, February 22, 2016.

This is a Public Hearing relative to a request for a change of zoning within the City of
Livonia on the following matter: Petition 2016-01-01-01 submitted by the City Planning
Commission, to rezone the west 100 feet of property located on the west side of
Newburgh Road, between Joy Road and Ann Arbor Trail, 9309 Newburgh Road, in the
southeast square of Section 31 from PL (Public Land) to R-1 (One Family Residential
60 x 120 lots). The City Clerk has mailed notices to all persons in this area effected by
the proposed changes and all the other requirements of Ordinance No. 543 of the
Zoning Ordinance have been fulfilled. The Public Hearing was called to order at 7:50
p.m. with President Kathleen McIntyre presiding. There were four people in the
audience. The Public Hearing is now open for comments. Please state your name and
address before making your comments.
McIntyre: We’ll begin with Mr. Taormina.
Taormina: Thank you. This is a request to rezone the westerly portion of a parcel of
land from its current classification of PL (Public Lands) to R-1 (One Family
Residential), and really what this is, it’s a petition that’s intended to fix the
boundaries of the zoning map on what appears to have been an error that
was discovered during a recent request by the owner of this property to
split the subject site.

If I go through a little bit of history, it’s a bit convoluted but hopefully it will
make sense. In or around 1988 the previous owner of this property, 9309
Newburgh Road, purchased one acre of property from the City and in fact
it’s the area highlighted in red here. And at the time the property in
question was zoned RUF and was part of a larger parcel which actually
has an address of 9400 Stonehouse that was previously designated on
the Future Land Use Plan as a proposed park. Unfortunately after the
sale of the property, the new parcel boundaries and the descriptions were
never properly recorded on the City’s records and subsequently the Future
Land Use Plan was amended to show the land as a future park site and
then in 2006 the City actually rezoned the property on Stonehouse to PL
and that included the 134 feet. So we relied on the old legal descriptions
prior to when the land was sold to the owners at 9309 to complete the
rezoning and as a result the portion of this private property is zoned PL.
And we discovered it again at the time a split was proposed. This
particular owner wants to split the property in half from east to west, it
wants to create a new building site on the south side of the property,
there’s ample room on the property to create a new home site but it was
through this rezoning process that we realized the mistake that goes back
a couple decades now so the intention here is to fix that error. Thank you.

Taormina: That’s correct.
Meakin: Madam President.
McIntyre: Councilmember Meakin.
Meakin: This is just correcting a longstanding problem so I’ll offer an approving
resolution.
McIntyre: Okay. Does anybody else have any other comments or would like to offer
any other resolutions? Would anyone from the audience like to speak on
this public hearing item? Seeing none, we have an approving resolution
from Mr. Meakin and we will adjourn this at 7:54 p.m.
