HomeMy WebLinkAboutPLANNING MINUTES 1957-12-17 3 Q3 19 MINUTES OF A PUBLIC HEARING AND THE 87TH REGULAR MEETING OF THE CITY PLANNING COMMISSION OF THE CITY OF LIVONIA On December 17, 1957 the above meeting was held by the City Planning Commission of the City of Livonia at the City Hall, 33001 Five Mile Road, Livonia, Michigan. Chairman William R. Robinson called the Public Hearing to order at approximately 8:07 p.m. Members present: Robert L. Greene Fred A. Lotz H. Paul Harsha Wilfred Okerstrom Leonard Kane Robert Angevine Dennis Anderson Charles Walker William Robinson Members absent: None Lieutenant Bob Perry, Livonia Fire Department and Albe Munson, Planning Consultant and Rodney Kropf, Asst. City Atto rney were present together with approximately twenty interested persons. The secretary announced that the first item onthe agenda was Petition M-94 by R. M. Dilworth, Gulf Oil Corporation requesting permission to erect service station with procelain enamel exterior on a portion of Parcel Jla,Kla, located on the Southeast corner of Five Mile Road and Farmington Road in the Northwest 1/4 of Section 22. The secretary read letter dated December 13, 1957 from J. D. Reeves, District Manager, Gulf Oil Corpaation. The petitioner nor a representative was present. No one was present wishing to be heard either in favor of or opposed to petition as presented. Upon a motion duly made by Mr. Kane, seconded by Mr. Okerstrom and unanimously carried, it was #12-374-57 RESOLVED that, City Planning Commission does hereby grant request dated December 13, 1957 from J. D. Reeves, District Manager, Bull' Oil Corporation requesting withdrawal of Petition M-94 as submitted by R. M. Dilworth, Gulf Oil Corporation requesting permission to erect a service station with porcelain enamel exterior on a portion of Parcel Jla,Kla located on the Southeast corner of Five Mile and Farmington Roads in the Northwest 1/4 of Section 22. The Chairman declared the foregoing resolution adopted. Upon a m otion duly made by Mr. Okerstrom, seconded by Mr. Greene and unanimously carried, it was #12-375-57 RESOLVED that, Public Hearing be adjourned. The Chairman declared the foregoing resolution adopted and called the 87th Regular Meeting to order. The secretary announced that the first item onthe agenda was Petition No. Z-241 by Weld S. Maybee, Jr. and Raymond F. Garrett asking for a change of zoning classification on Parcel 2928 located on the Southwest corner of Levan and Schoolcraft Roads in the Northwest 1/4 of Section 29 be changed from M-2 and RUF to C-2. The secretary read letter dated December 11, 1957 from William W. and Salena V. Crawford. Mr. Donald Deremo, Attorney, 33020 Five Mile Road was present. Plomok Those present objecting to petition as presented - eight. Mr. Walker informed Commission that he was asked by the Mother Superior to represent the Business and Industrial Committee at a meeting held at the Madonna Collage. There were also representatives of the City Council. Objected to request because: (1) A bowling alley might request license in the future for beer, liquor, etc. Explained that because college exists within 5001 that the State Law would protect them; (2) Would like to see this the cultural section of the City; and (3) Commercial property does not require set back that would be required if area was zoned industrial. Large plants as built today have a large spread which would be more in keeping with area. Mr. Deremo asked whether Madonna College objected to the commercial area at Levan and Schoolcraft Roads. Mr. William W. Crawford, 13451 Leval Road, stated he lives directly behind property in question. The drainage is very poor on corner andthat accord- ing to ordinance there must be adequate water supply, drainage, sewers, etc. The Water Department has not been able to read water meter for four years. Mr. Carl Marsh, 37025 Schoolcraft Road informed Commission that he was not notified of meeting. Mr. William Bassett, 36789 Schoolcraft questioned the fact that at the last meeting there was someone present who spoke as a representative of the people in the area. It was ascertained that Mr. Clarence Charest, Attorney was present representing a property owner and was not speaking for all residents in area. Mrs. William Bassett, 36789 Schoolcraft stated that she has been in contact with Madonna College and that they would prefer area not being commercial. Also got the impression that they do not want area industrial but that if it is to be industrial that it be a large area. Mr. Walker stated that how much commercial and where it should be along Schoolcraft Road is the question the Commission is to decide in acting on this petition. Commission has to visualize whole area and how request will fit into future plan of the City. Mr. Rodney Kropf temporarily left meeting at approximately 8:29 p.m. and returned at approximately 8:30 p.m. Mr. Angevine mentioned a resolution adopted at the last meeting of the Business and Industrial Committee at which time Mr. Walker was absent. The secretary read the second motion that was carried at the last meeting of the Business and Industrial Committee (Page 4, minutes of meeting 12/17/57). 365 1902 Upon a motion duly made by Mr. Angevine and seconded by Mr. Anderson, it VMS #12-376-57 RESOLVED that, Petition No. Z-241 by Weld S. Maybee, Jr. and Raymond F. Garrett asking for a change of zoning classification on Parcel 29I8 located on the Southwest corner of Levan and Schoolcraft Roads in the Northwest 1/4 of Section 29 from M-2 and RUFB to C-2 be taken under advisement for additional period of time. A roll call vote on the foregoing resolution resulted in the following: AYES: Greene, Okerstrom, Anderson, Walker, Angevine, and Robinson NAYS: Lotz, Kane and Harsha 7be secretary announced that the next item on the agenda was Petition No. X-240 by Daniel Bzovi, et al asking that the zoning classification of Parcel 26B and portion of Parcel 26Alb located on the South side of School- craft Road approximately 775 feet West of Middlebelt Road in the Northeast 1/4 of Section 26 be changed from RUFB to M-1. Mr. Irwin I. Cohn, Attorney, 1836 Guardian Building, Detroit was present. Mr. Cohn stated that the was to meet with Mr. Charles Pinto, Asst. City Attorney, tonight but because of his illness wasrpt able to. Presented two proposals (A and B) for Commission's consideration in order to resolve question and letter dated December 16, 1957 giving legal descriptions of proposal A. Proposal A - R-1 for North 192 feet. P-1 for 108 feet South of R-1 area. M-1 remainder of area. Stated that an R-1 classification is the only way they can see to put died classi- fication on parcel inasmuch as they would have to come before Commission in order to plat area. There is a 130' piece on the East which will remain C-2 to be used by The Detroit Edisc n Company for substation purposes and a 50' piece on the West that will be sold to Mrs. Shaw as was agreed by her and client when client purchased a portion of her property. Proposal B - is as proposed by the Business and Industrial Committee which shows North half R-i and South half M-1. Mr. Harsha asked whether area would be developed as one piece of property. Mr. Cohn stated that there are 34 acres involved. Mr. Harsha stated that on a main highway a ten acre parcel or more must have a set back of 2001 according to the ordinance. Mr. Cohn stated that that would depend on parcel being developed as a single parcel. Cannot say whether it will at this time. Mr. Cohn was of the opinion that Proposal A is a permanent thing and more desirable than Proposal B. 966 Mr. Walker asked whether Mr. Cohn had met with the property owner to the East to discuss dedication of road. Mr. Cohn stated that property owner lives in Florida and that he has not contacted her. Mr. Robinson stated that this is not pertinent. 3 The secretary read recommendation dated October 3, 1957 from Albe Munson, Planning Consultant. Mr. Robinson stated that there have been many objections to R-1 classifi- cation in area and suggested that area be rezoned RUF instead. Mr. Cohn stated he had no objection and amended letter dated December 16, 1957 accordingly. Upon a motion duly made by Mr. Lotz and seconded by Mr. Kane, it was RESOLVED that, pursuant to a Public Hearing having been held November 5, 1957 on Petition No. Z-240 as submitted by Daniel Bzovi, et al for a change of zoning in the Northeast 1/4 of Section 26 from RUFB to M-1, the City Planning Commission does hereby recommend to the City Council that Petition No. Z-240 be granted according to revised descriptions contained in letter dated December 16, 1957 from Irwin I. Cohn, Attorney and subject to approval of the Department of Law and the Engineering Depart- ment as to the descriptions contained in said letter, and FURTHER RESOLVED, notice of the above hearing was published in the official newspaper, The Livonian under date of October 10, 1957 and notice of which hearing was sent to The Detroit Edison Company, Chesapeake & Ohio Railway Company, Michigan Bell Telephone �'ompany, The Consumer Power Company, City Departments and petitioners as listed in the Proof of Service. Mr. Okerstrom stated that he had hoped Commission could go into question of road on the South end of parcel a little more. Mr. Robinson stated that he misunderstood previous remarks regarding road and apologized to Mr. Walker for having previously called him out of order. Mr. Cohn stated that he would dedicate the South 60' of parcel in question for road and that if he is unable to obtain dedication of 601 East of parcel suggested that the Commission recommend to the City Council that condemnation proceeding be instituted by the City to acquire 601. Mr. Robinson asked Mr. Kropf whether it is legally proper for Commission to require 601 dedication of easement as a condition of approval to petition. Mr. Kropf thought it not legally proper. Mr. Cohn suggested that with recommendation to approve petition that Commission recommend in addition that if he is not able to secure dedication within a reasonable time that the City institute proceedings to acquire 601. Mr. Kropf cited recent situation whereby two Outlots were deeded to the City of Livonia at the time the City Planning Commission took action on request. Mr. Harsha stated that recently Commission approved petition stating in resolution that Commission is cognizant of the fact that offer has been made which is a little more legal. K°9 ed) A904 Mr. Walker stated that his only point was that it be a matter of record. Upon a motion duly made by Mr. Lotz, seconded by Mr. Kane and unanimously carried, it was #12-377-57 RESOLVED that, City Planning Commission being cognizant of the fact that petitioner has offered to dedicate South 60' of parcel for road purposes and that every effort will be made by him to secure dedication east to Middlebelt Road and pursuant to a Public Hearing having been held November 5, 1957 on Petition No. Z-240 as submitted by Daniel Bzovi, et al for a change of zoning in the Northeast 1/4 of Section 26 from RUFB to M-1, the City Planning Commission does hereby recommend to the City Council that Petition No. Z-240 be granted according to revised descriptions and zoning classification requested as contained in letter dated December 16, 1957 from Irwin I. Cohn, Attorney and subject to approval of the Department of Law and Engineering Department as b the descriptions contained in said letter, and FURTHER RESOLVED, notice of the above hearing was published in the official newspaper, The Livonian under date of October 10, 1957 and notice ofwhich hearing was sent to The Detroit Edison Company, Ctesapeake & Ohio Railway Company, Michigan Bell Telephone ompany, The Consumer Power Company, City Departments and petitioners as listed in the Proof of Service. The Chairman declared the foregoing resolution adopted. Upon a motion duly made by Mr. Kane, seconded by Mr. Lotz, it was #12-378-57 RESOLVED that, statement from The Livonian for $5.00, $13.80 $75.90 and $7.75 (total $102.45) be approved and forwarded to the proper department for payment. A roll call vote on the foregoing resolution resulted in the following: AYES: Greene, Okerstrom, Anderson, Lotz, Kane, Walker, Harsha, Angevineand Robinson NAYS: None Mr. Okerstrom suggested that in the future Commission not use its valuable time to make resolutions, take roll call votes, etc., on matters that are of a routine nature. It was agreed by Commission that procedure would be followed. Mr. Robinson appointed the following committees: Civic Center Committee - Robert L. Greene Fred A.
