HomeMy WebLinkAboutPLANNING MINUTES 1962-06-26 3511 MINUTES OF THE 147TH SPECIAL MEETING OF THE CITY PLANNING COMMISSION 11[: OF THE CITY OF LIVONIA On Tuesday, June 26th, 1962 the City Planning Commission of the City of Livonia held the 147th Special Meeting at the Engineering Building, 13325 Farmington Road, Livonia, Michigan. Mr. Charles U. Walker, Chairman, called the Special Meeting to order at approximately 8:10 p.m. Members present: Dennis Anderson, Leonard K. Kane, Robert L. Greene, W. E. Okerstrom, Edward Milligan, James Cameron and Charles W. Walker Members absent : Robert L. Angevine and James Watson Mr. David R. McCullough, City Planner, was present. Mr. McCullough: The first item on the agenda is Petition Z-533 by the City Planning Commission on its own motion to determine whether or not to amend Article 14.00 and 15.00 by deleting certain sections. Public Hearing 11/21/61; Special Meeting 5/8/62; Regular Meeting, 5/15/62; Special Meeting 6/5/62, under advisement; Regular Meeting 6/19/62 under advisement until June 26th. This petition referred to the sections in the ordinance allowing drive-in theatres in the industrial zones. The petition was to delete said sections thus removing the use in the industrial zones. Upon a motion duly made by Mr. Greene, supported by Mr. Anderson, it was #6-141-62 RESOLVED that, pursuant to a public hearing having been held on Tuesday, November 21, 1962 on Petition Z-533 as submitted by the City Planning Commission to determine whether or not to amend Article 14.00 and 15.00 by deleting certain sections, the City Planning Commission does hereby recommend, after considering its previous policy of attempting to retain the relatively few large tracts in single ownerships for potential industrial users, denial of Petition Z-533 for the following reasons: (a) experience at nearby locations has demonstrated that even though drive-in theatres are already in existence, if the land is con- sidered more valuable for other commercial or industrial uses, the drive-ins become expendable; (b) our experience subsequent to the original drive-in theatre petition has indicated no particularly heavy demand for such large tracts by industrial users; (c) considering each of the factors mentioned below, the City Planning Commission concludes that the most satisfactory location of any drive-in theatre is generally within Sections 25-30, and this area is mostly zoned for manufacturing uses. Those factors supporting this position are: (1) Design - a tract of 30 acres having a width of at least 600 feet is necessary; 3 3512 . (2) Location - on a major road, preferably an improved one within 10 to 15 minutes driving time of approximately 1:: 65,000 people; (3) The Ordinance requirement that any drive-in theatre be 1,000 feet removed from the nearest residential district; (4) Effect on nearby land - when situated too close to existing or potential residential areas it tends to adversely affect them; (5) Legal - the Michigan Supreme Court indicated in the Schreiber Case that some area must be designated within the City for such uses. FURTHER RESOLVED, notice of the above hearing was published in the official newspaper, The Livonian-City Post under date of November 1, 1961 and notice of which hearing was sent to The Detroit Edison Co. , Chesapeake & Ohio Railway Co. , Michigan Bell Telephone Co. , The Consumers Power Co. , City Departments and petitioner as listed in the Proof of Service. A roll call vote on the foregoing resolution resulted in the following: AYES: Anderson, Kane, Greene, Okerstrom, Milligan, Cameron and Walker NAYS: None I: Mr. Walker declared the motion is carried and the foregoing resolution is adopted. Upon a motion duly made by Mr. Kane, supported by Mr. Okerstrom and unanimously adopted, the City Planning Commission does hereby adjourn the 147th Special Meeting held on Tuesday, June 26, 1962 at approximately 9:00 p.m. CITY PLANNING COMMISSION co( r 624i6a7Mplob W.
