HomeMy WebLinkAboutPLANNING MINUTES 1964-09-01 4271 IL: MINUTES OF THE 189TH SPECIAL MEETING AND A PUBLIC HEARING OF THE CITY PLANNING COMMISSION OF THE CITY OF LIVONIA On Tuesday, September 1, 1964, the City Planning Commission of the City of Livonia held the 189th Special Meeting and a Public Hearing at the Livonia Civil Defense Office, located in the Police Building, 15050 Farmington Road, Livonia, Michigan. Mr. Charles W. Walker, Chairman, called the 189th Special Meeting to order at approximately 8:10 p.m. with approximately four interested persons in the audience. Members present: Raymond W. Tent Bob R. Whitehead Peggy Anne Miquelon James Cameron Donald Heusted Charles W. Walker Members absent: Robert L. Angevine Mr. Don Hull, Planning Director, and Mrs. Doris Bachman, Traffic Commission, were present. Mrs. Peggy Anne Miquelon acted as Secretary pro tem in the absence of Mr. Robert L. Angevine. Mrs. Miquelon announced the first item on the agenda is Petition V-80 by Gordon and Florence Belt, requesting the vacation of two feet of a twelve foot wide easement of Lot 19 of O'Connor & Porter Subdivision, located on the west side of Doris Avenue between Curtis Avenue and Seven Mile Road in the Northeast 1/4 of Section 11. I: Upon a motion duly made by Mr. Whitehead, seconded by Mrs. Miquelon and unanimously adopted, it was #9-165-64 RESOLVED that, pursuant to a Public Hearing having been held on August 25, 1964, on Petition No. V-80 as submitted by Gordon and Florence Belt for the vacation of two feet of a twelve foot wide easement in the Northeast 1/4 of Section 11, the City Planning Commission does hereby recommend to the City Council that Petition No. V-80 be granted subject to vacating two feet of the existing twelve foot wide easement only within the limits of the house encroachmeht and not for the full length of Lot 19, O'Connor. & Porter's Subdivision according to the following amended description: The South 2 feet of the West 27 feet of the East 90 feet of a 12 foot wide easement, said easement being more particularly described as the North 12 feet of Lot 19, O'Connor & Porter's Subdivision, as recorded in Liber 66, Page 79, Wayne County Records, said subdivision being a part of the West 1/2 of the N.E. 1/4 of Section 11, T. 1 S., R. 9 E., Livonia Township (now City of Livonia), Wayne County, Michigan. for the following reasons: I[: (1 ) It is quite apparent that there is no conflict with the existing utilities within the easement. Since there is an existing 12" sanitary sewer within this 12 foot easement, vacating the two feet of the existing 12 foot wide easement only within the limits of the house encroachment and not for the full length of the lot will 4272 allow the City to retain rights to a maximum amount of easement area for future maintenance, and (2) The Engineering Department through. Mr. William J. Strasser, Chief City Engineer, is in agreement with granting this approval, and (3) It is apparent that encroachment on the easement was an honest mistake and was not an attempt to make use of additional land, and FURTHER RESOLVED, .notice of the above hearing was published in the official newspaper, The Livonian-City Post under date of July 29, 1964 and notice of which hearing was sent to the Detroit Edison Company, Chesapeake & Ohio Railway Company, Michigan Bell Telephone Company, The Consumer Power Company, City Departments, petitions rs, and abutting property owners as listed in the Proof of Service. The Chairman declared the motion is carried and the foregoing resolution is adopted. Mrs. Miquelon announced the next item on the agenda is Petition Z- 652 by the City Planning Commission on its own motion on the question whether or not to amend and change Resolution #5-80-64 adopted by the City Planning Commission amending Settion 4.46 of Article IV, where ail future construction shall back onto Eckles Road, and the depth of lots platted be at least 130 feet with no construction being allowed on the 10 feet of the property immediately adjacent to the right-of-way IL: Upon a motion duly made by Mrs. Miquelon, seconded by Mr. He.usted, and unanimously adopted, it was #9-L66--64 RESOLVED that, Eursualft. to a Public Hearing having been Held on August 25, 1964, on Petition Z-652 as submitted by the City Planning Commission on its own motion to amend the Zoning Ordinance No. 60, as amended, to add Section 4.46, Lots Along Section Line, to Article IV, the City Planning Commission does hereby recommend to the City Council that Petition Z-652 be granted becfuse it seems reasonable to back up lots to traffic streets if no homes on the opposite side are facing the street, and FURTHER RESOLVED, notice of the above hearing was published in the official newspaper, The Livonian-City Post under date of July 29, 1964, and notice of which hearing was sent to the Detroit Edison Company, The Chesapeake & Ohio Railway Company, Michigan Bell Tele- phone Company, The Consumers Power Company, City Departments as listed in the Proof of Service. The Chairman declared the motion is carried and the foregoing resolution is adopted. Mrs. Miquelon announced the next item on the agenda is Petition by the City Planning Commission on its own motion on the question whether or not to amend the Master Thoroughfare Plan to include the location of the I[: Industrial Road in the North half of Section 26. The Industrial Road traverses in an irregular path across the north half of Section 26 going westerly from Middlebelt Road to Merriman Road. I[: 4273 Upon a motion duly made by Mr. Cameron, seconded by Mr. Tent and unanimously adopted, it was #9-167-64 RESOLVED that, pursuant to the provisions of Act 285 of the Public Acts of Michigan, 1931, as amended, the City Planning Commission of the City of Livonia having duly held a public hearing on Tuesday, August 25, 1964 for the purpose of ametding Part I of the Master Plan of the City of Livonia, entitled, "Master Thoroughfare Plan", the same is hereby amended so as to include the location of the Industrial Road which said Industrial Road traverses in an irregular path across the north half of Section 26 going westerly from Middle- belt Road to Merriman Road for the reason that the City Planning Commission's previous action has indicated affirmative concurrance on this item, and having given proper notice of such hearing as required by Act 285 of the Public Acts of Michigan, 1931, as amended, the City Planning Commission does hereby adopt said amendment as part of the Master Thoroughfare Plan of the City of Livonia, which is incorporated herein by reference, the same having been adopted by resolution of the City Planning Commission under date of April, 1951, with all amendments thereto, and further that this amendment shall be filed with the City Council, City Clerk, and the City Planning Commission; and a copy shall also be forwarded to the Register of Deeds for the County of Wayne with the following certification contained thereon: "We certify that the foregoing resolution was duly adopted at a meeting of the City Planning Commission held on Tuesday, September 1, 1964 by the following vote: AYES: Tent, Cameron, Miquelon, Whitehead, Heusted, and Walker NAYS: None The Chairman declared the motion is carried and the foregoing resolution is adopted. Mrs. Miquelon announced the next item on the agenda is petition by the City Planning Commission on its own motion on the question whether or not to amend the Master Thoroughfare Plan to include the location of a proposed expressway with a right-of-way of approximaely 350 feet in width. The proposed expressway is located coincidental with the west boundary line of the City of Livonia (Haggerty Road) between the centerline of Five Mile Road and Eight Mile Road. The Chairman declared the motion is carried and the foregoing resolution is adopted. Upon a motion duly made by Mr. Whitehead, supported by Mr. Heusted and unanimously adopted the City Planning Commission does hereby adjourn the 189th Special Meeting held on Tlesday, September 1, 1964 at approximately 8:20 p.m. Mr. Charles W. Walker, Chairman, called the Public Hearing to order at approximately 9:30 p.m. with approximately 60 interested persons in the audience in addition to Mr. Daniel R. Andrew, Coordinator, Industrial Development Commission. Mrs. Miquelon announced the first item on the agenda is Petition Z-650 by Mr. Jacob Menuck, President, Curtis Building Company, requesting the rezoning of property located on the Southeast corner of Hubbard Road and Six Mile Road in the Northeast 1/4 of Section 15, from RUFB to RLA. Messrs. Jacob Menuck and David A. Goldman, Attorney, were present. IL: Mr. Walker read from Zoning Ordinance No. 60 for the benefit of those present what RUF and RLA meant insofar as lot size in concerned. Mr. Goldman stated the Curtis Building Company has built over 300 homes within the City of Livonia thus far in the Lyndon Meadows Subdivision and the Newburgh 4275 Heights Subdivision. The proposed subdivision plat, if the zoning classification is changed as requested, shows 176 lots on 60 acres with an average of 10,000 square feet even though Zoning Ordinance No. 60 would allow 9,600 square feet (2.9 lots per acre). His client proposes to retain as many trees as possible and all utilities will be placed underground. There will be a service drive on Six Mile Road. Minimum cost per home will be $25,000. Referred to Burton Hollow Subdivision located on the Northeast corner of Six Mile Road and Farmington Road as having been rezoned from RUFB in February, 1963. There are 110 lots in this subdivision with 1/3 being 80' x 120'. Also referred to the Wood Creek Farms Subdivision which has 96 lots and was rezoned from RUFB in October, 1962. One third of these 96 lots are 80' x 1204. Client has what he believes to be a development of the highest type. The success of the two aforementioned subdivisions indicates a need and a demand for the proposed subdivision. Felt client would have a quality development. There will be an exit on Grove; however, client is prepared to redesign subdivision to exclude this exit and have a cul-de-sac instead if the commission wishes. This exit was suggested to the developer by someone within the City Government. Mr. W. W. Edgar, 31515 Grove, spoke for the residents of Grove Drive. Stated they are pleased with development except for two exceptions. Referred to ten lots shown on the cul-de-sacs in the proposed subdivision having front lot lines of less than 604 (two 47' and three 524). The building line is the required width; however the front lot lire should also be the required width. The residents are more concerned with the exit onto Grove Drive. This road is 99.304 for approximately IL: 2004 then it is reduced to 60' . Would rather see a cul-de-sac than exit as shown. Mr. Paul H. Rieker, 31545 Grove, questioned why developer couldn't build on 1/2 acre lots instead of requesting zoning classification change. Mr. Goldman stated that with the area costing $6,000 per acre, his client could not build subdivision with 1/2 acre lots. Mr. Miles MacShara, 17969 Mayfield, representing Green Brier Association, stated he is happy the way the area is now. How do the residents gain by additional 176 lots as pr .osed. With 176 lots there is not much left for trees. In the two cited subdivisions, there are only seven trees per lot on the average. Mrs. Donna Smith; 32599 Greenland Court, objected to proposed change of zoning. Mr. R. G. Siffermann, 31694 Curtis, representing Merriman-Six Oivic Association, submitted petition of residents in area objecting to change of zoning. Thought it about time petitioner stopped referring to smaller size lots in area and referred to what is in area in larger lot size. Mr. Ed Smitn, 1)2599 Greenland Court, stated he purchased his home in area just because area is zoned RUFB. Had he known this development would be proposed .would have ' '-:-chased elsewhere. Thought commission should hold to 1/2 acre lots. Mr. Ted Teslik, 16333 Hubbard Road, asked what mayor had to say regarding proposed change of zoning. Mrs. James Burkett, 31643 Six Mile Road, objected to change of zoning. Mrs. Barbara Teslik, 16333 Hubbard Road, also objected to change of zoning. 4276 Mr. MacShara stated he is back to back with one of the cited subdivisions ($urton I[: Hollow Subdivision) and that now to has three back neighbors A show of hands of those present objecting to change of zoning resulted in a count of 50-60 people. Mr. Goldman referred to recent court case in the City of Troy and as he under- stands the decision a city has no right to use zoning to control population. Client has prepared a quality development. Mayor Harvey W. Moelke, as a resident only and not as mayor of the City of Livonia, stated this is the third time this parcel has appeared before the City Planning Commission for smaller size lots. Petitioner is well aware of the fact that others have tried to have zoning classification changed. The Burton Hollow Subdivision referred to by Mr. Goldman is located 1/4 mile West and not directly north of area in question. Also between the Burton Hollow Subdit sion and area directly North of Parcel in question, area is developed with lots in excess of 1/2 acre. The Wood Creek Farms Subdivision is also 1/2 mile West of subject property. It was in fact at one time zoned R1 but developer platted 80' lots. The larger lots that the developer put in, after protest of the residents, are now selling up to $12,500 each. Referred to improvements on an 80' lot vs. improvements on 1/2 acre lot costing $1,200 more per lot on a 1/2 acre lot than an 804 lot. The pattern of this area has already been established and this requested change of zoning is spot zoning. Unless the petitioner can say that this request is of benefit to the community, this change of zoning would be illegal. Wished petitioner would look at over-all economic market and provide the people who want IL: to live on large lots in this community with that product. The market for 804 lots is in over-supply. Urged commission to reject request for zoning classification change. Mr. Goldman questioned whether; when the prior petitions for change of zoning were submitted to commission, they were requesting 604 lots rather than 80' lots. Mr. Walker stated he was not certain and that commission would check into this item Mrs. Roy Puckett, 31642 Grove Drive, asked whether there wasn't a place within the City of Livonia where petitioner could build without having to request change of zoning. Mrs. William Simon, 17300 Merriman, referred to homes on small lots she knew of that in her opinion would look much better if located on a large lot. Mr. Roland Kenny, 16425 Hubbard Road, asked whether residents would be notified when item would again be presented to commission. Mr. Walker stated that residents who are represented by a group representative would be notified by mail date of meeting when Commission will make its decision. Mayor Moelke stated that he spoke to Judge Otis Smith (re. Troy Case) and that Judge Smith informed him that the decision in this case was not to be considered a precedent and that each zoning case would be decided on its own merits. The City of Troy does not provide for smaller lots in their community whereas the City of Livonia does provide for small as well as large lot areas. Referred to a I[: Connecticut Case wherein decision stated that zoning is not for the purpose to enrich the subdivider. Mr. Walker declared Petition Z-650 would be taken under advisement. 4277 I[: Mrs. Miquelon announced the next item on the agenda is Petition V-79a by Stanley H. Kline and Ruby Kline, requesting the vacating of the west 4 feet of a 20 foot wide easement of Lot 70, Livrance Estates Subdivision located north of Greenland Avenue approximately 1270 feet west of Middlebelt Road and approximately 1100 feet east of Henry Ruff Road in the Northeast 1/4 of Section 14. Mr. Kline was present. Mr. Kline stated that when he planned his home he thought side yard requirement was 54. Planned home and then found out later thab the side yard requirement is 101. He obtained in writing William J. Strasser, Chief City Engineer's permission to build garage over 34 of easement; however, when he applied for the mortgage it was found garage is over 41 of easement. Mr. Cameron asked for letter written by Mr. Strasser giving petitioner permission to build garage over 3' easement. Mr. Kline stated he would submit a copy to commission. Mr. Walker read letter dated August 24, 1964 from William J. Strasser, Chief City Engineer. This letter is not the one referred to by Mr. Kline. Mr. Milton Firestone, Assistant City Attorney arrived at meeting at approximately 10:50 p.m. Mr. Walker declared Petition V-79a would be taken under advisement. Mrs. Miquelon announced the next item on the agenda is Petition V--81 by Stephan F. Slavik, President of Rouge Building Company, requesting the vacating of a portion of Wood Drive, west of Riverside Drive in the Burton Hollow Estates Subdilasion #3. This portion of Wood Drive is located just west of Riverside Drive, approximately 330 feet South of Six Mile Road, in the Burton Hollow Subdivision No. 3 in the Northwest 1/4 of Section 16. Mr. David Meinzinger was present representing the petitioner. Mr. Walker read letters dated August 10, 1964 from William Strasser, Chief City Engineer; dated August 24, 1964 from Cecil H. Alford, Assistant Superintendent, Livonia Public Schools, and dated June 30, 1964 from Stephan F. Slavik, Rouge Building Company. Mr. Meinzinger stated the reason for request and timing of request is that in the foreseeable future Rouge Building Company does not see that Wood Drive will be continued west because of the presence of a large size natural open water course located along the west perimeter of the Golfview Estates Subdivision. The extension of Wood Drive would require the construction of an expensive bridge across this natural water course. To take care of the school situation, willing to dedicate a 10' easement for foot crossing for children which will be only a temporary thing. The reason for requesting this at this time is that Rouge Build- ing Company want to have Wood Drive vacated now before homes on either side of proposed road (lots497 and 498)are constructed and sold. Once the homes are constructed and sold, the vacated road would be divided between the two lots. Mr. Cecil H. Alford, Assistant Superintendent of Livonia Public Schools, stated this problem of access to school sites in the N rthwest 1/4 of Section 16 and in Section 17 started back in 1956 and 1957 and 1938. Referred to letter dated April 16, 1959 fro-. William J. Strasser, Chief City Engineer. Mr. Slavik has said he would be willing to talk and discuss subject of foot bridges across revine from his subdivision. Livonia Public Schools rad 63 busses on the road last year and • 4278 IE will have 73 busses this year. Interested in some sort of way to get to the schools in area. Having an easement would not solve the whole problem uhless there is also an agreement regarding the bridge to get across the revine. Mr. Wal ker questioned Mr. Meinzinger regarding the bridge across the revine. Mr. Meinzinger stated that if Rouge Building Company provided the land for the easement he thought the user should provide the bridge. Rouge Building Company is willing to provide the 104 easement but Frank J. Volk and Adolph Rovsek (Parcel El - Golfview Meadows Subdivision) is providing the population and should provide the bridge. Mr. Walker asked Mr. Meinzinger about contam Messrs. Volk and Rovsek and negotiating with them for bridge. Mr. Meinzinger stated that that would be impossible as it is difficult to negotiate one developer with another developer. Stated they are willing to cooperate in any way but to leave spur does not solve problem. Mr. Walker stated that commission would check with the Engineering Department to determine just what this would cost and then come back to Rouge Building Company and Mr. Volk and School District and see what can be worked out. Would suppose that Rouge Building Company would assume part of the burden. Mr. Walker announced that PetitionV-81 would be taken under advisement. Mrs. Miquelon announced that the next item on the agenda is Petition Z-649 by Seymour Weissman, President of Dale Investment Company, Inc. request- IL ing the rezoning of property located on the East side of Farmington Road between Plymouth Road and the Chesapeake & Ohio Railway, approximately 780 feet South of the railroad, in the Southwest 1/4 of Section 27, from RUFB to M-1. Mr. Weissman was present. Mr. Weissman stated this is all within the industrial park area. Propose to build an office building. Own 13 acres. There is a shop on the back portion of property but the front is zoned RUFB. Mr. Daniel Andrew stated he thought area should be rezoned to conform with rest of area.. Kr. Walker announced that Petition Z-649 would be taken under' advisement. Mrs.. Miquelon announced the next item on the agenda is Application TA-106 by Angelo DiPonio, requesting permission to remove eight inches of topsoil from TAX Parcel 7I2 (approximately 62.77 acres) located on the Northwest corner of Six Mile Road and Newburgh Road in the Southeast 1/4 of Section 7. Mr. Stuart W. Grant, 17242 Westmoreland Detroit, was present representing the petitioner. Mr. Grant stated they wish to level area and stock pile topsoil on Newburgh Road. Mr. Ralph Schweikhart, 17800 Newburgh, stated 25-30 acres of this land is all under water when it rains. Asked that area be seeded. In his opinion there isn't IL: 8'r of topsoil on this land because grass etc. has been removed in the past. Looks below grade right now. 4279 I() Mr. Walker asked whether Mr. DiPonio intended to backfill during operation. Mr. Grant stated he did not. Stated they felt it would be at grade level; however some back fill will be needed eventually. Proposed to do the same as was done on Merriman Road whereby Mr. DiPonio will seed with wheat and oats. Mr. Tent questioned length of operation. Mr. Grant stated it will take one year. The land has not been sold to developer but Mr. DiPonio plans to put in sewers, roads, etc. before offering land to developer. Improvements will be put in when water is available. Mr. Walker asked whether ingress and egress would be on Newburgh Road. Asked that this be shown on plans. Mr. Walker announced that Application TA-106 would be taken under advisement. Mrs. Miquelon announced that the next item on the agenda is Petition Z-653 by Harvey Deilfield, Harben Realty Company, requesting the rezoning of property on the Southeast corner of Vassar and Middlebelt Road in the Southwest 1/4 of Section 1, from RUFB to C-2. The petitioner was present. . Beilfield stated they intend to develop area in accordance with C-2 zoning. The exact type of business has not been determined- have several things in mind. Mr. Hull questioned feeling of Mr. Beilfield regarding vacating of Vassar. Mr. Beilfield stated he would be interested in this. The ingress and egress is IL: planned for Middlebelt and not Vassar. Mr. Walker announced that Petition Z-653 would be taken under advisement. Mrs. Miquelon announced that the next item on the agenda is Petition Z-654 by Wesley and Onahlee Goff, requesting the rezoning of property located on the South side of Fargo Between Merriman Road and Sunset in the Northwest 1/4 of Settion 2 from RUFB to RLA. The petitioners were present. At First Mr.Goff stated he proposed to develop area into three lots (110,113 and 113 x 135) but when further questioned the dimensions were slightly altered from plan filed with petition. It was not established whether pbtitioners would have to submit subdivision plat later or would be able to file just for lot split. Mr. Walker announced that Petition Z-654 would be taken under advisement. Mrs. Miquelon announced the next item on the agenda is Petition Z-655 by Sidney C. Morgan, et al, requesting the rezoning of Lots 1 through 7, Storm and Fowler's Country Crest Subdivision, located on the west side of Mid''lebelt Road, between Morlock and Norfolk in the Northeast 1/4 of Section 2, from RUFB to C-1. Mr. Morgan was present. 1'!r. Morgan stated he owned Lot 5 and that with the widening of Middlebelt Road, the homes are too close to road for residential use. IL: Mr. Percy Wainer, 20373 Middlebelt Road, stated 234 was dedicated for widening of Middlebelt Road. With the noise and traffic, property is no longer desirable for residential use. 4280 Mr. David Parshall, 20330 Freemont, stated he would rather see area rezoned to PS than C-1. Miss Lillian Welsh, 20335 Middlebelt Road, was preselt in favor of request. Mrs. Eugene Harris, 20365 Middlebelt Road, stated they have three small children and area is not desirable for residential use. Lots are now 1554 deep. Mr. Walker announced that Petition Z-655 would be taken uhder advisement Mrs. Miquelon announced the next item on the agenda is Petition M-329 by Sheldon Rose, Bishop Construction Company, requesting approval of site plan for multiple dwelling units on property located on the east side of Farming- ton Road, approximately 900 feet south of Sheldon Shopping Center, in the Northwest 1/4 of Section 34. The petitioner was present. Mr. Rose stated that the streets are already in and paved and that this determined the layout of the development. The development will contain both one story and two story buildings. Each unit is just like a home. There will be a total of 116 units all located West of Woodring Avenue. There will be two parking spaces provided for each unit. Mrs. Carl Hoheisel, 9910 Woodring, stated they do not need any more traffic either coming in or going out of Woodring. There is already an excess of traffic coming from and going to Sheldon Center. IL: Mr. Warren Sheldon stated that at the time of development it was thought this area would be commercial but this is impossible now. Mr. Joseph Cyr, 10811 Farmington Road, referred to units along Farmington Road and their being so close to road. Questioned saturation of land in terms of sewers. Mr. Rose informed Mr. Cyr he was informed this (sewers) was not a problem. Mr. Cyr referred to recreation areas provided for in terms of number of units in development. M . Rose stated the rent for units would be approximately: $130 for 1 bedroom unit 160 for 2 bedroom unit 180 for 3 bedroom unit Mr. Walker referred to three bedroom units in that they will create too much density in one area. Commission will want to discuss this further at Study Meeting. Mrs. Doris Bachman, Traffic Commission, stated there should be an area drawing for the Traffic Commission's study. There is nothing showing what is in surrounding area. Mr. Rose submitted area drawing for Mrs. Bachman's use. Mrs. Bachman asked for sketch showing traffic flow in and out of driveways as shown.
