HomeMy WebLinkAboutPLANNING MINUTES 1965-02-04 4401 MINUTES OF A PUBLIC HEARING OF THE CITY PLANNING COMMISSION OF THE CITY OF LIVONIA . On Thursday, February 4, 1965, the City Planning Commission of the City of Livonia held the Public Hearing at the Livonia City Hall, 33001 Five Mile Road, Livonia, Michigan. Mr. Donald Heusted, Vice-Chairman, called the public hearing to order at approximately 8:10 p.m, with approximately airty--five interested persons present. Members present: James Cameron John J. Ward Donald C. Pollock Harry Henry Wrightman Donald Heusted Members absent: aob R. Whitehead Charles W. Walker Raymond W. Tent Mr. Don Hull, Planning Director, was present. Mr. John J. Ward presided as Secretary pro tern in the absence of Bob R. Whitehead. Mr. Heusted announced the only item on the agenda is the zoning in Sections 13-24 as shown on the new comprehensive zoning map of bind for the City of Livonia. First the present zoning will be shown and then an over-lay will be placed on the section showing the proposed zoning classifications. Section 13 Mr. Wrightman questioned the C-1 area along Five Mile Road and the broken piece to the west that is RUE. Mr. Hull stated he would assume there will be changes requested in the future. Mr. Wrightman stated commission was talking about P in . Mrs. Frances Moore, 15192 Paderewski, stated the reason this is RUF is that there are four homes from Paderewski east fronting on Five Mile Road. Section 14 Mr. Wrightman questioned the C-2 being changed to Rl (north side of Five Mile Road west of Merriman). Asked if this is because of what is there. Mr. Hull stated he ould assume so but did not know for sure. Section 15 - no comment Section 16 - no comment Section 17 - no comment Section 18 Mr. Robert Fisken, 15441 Fitzgerald, stated zoning as shown does not affect land that has already been platted. Mr. Hull stated it does to some extent. Intent is to tailor category to existing use. Mr. Fisken questioned whether land being changed to 801 lots but being platted to 60+ lots could city prevent developer from building on 60' lots. Mr. Hull stated city could with one exception - if plat is recorded and developer is building in the field. The developer will IL develop on the basis of zoning and not according to plat in the hopper. 440: Section 19 Mr. Fisken stated that heavy trucks are passing through residential area and asked whether this is allowed. Referred to Newburg Road and stated this is getting to be a problem in Livonia. Asked if there is anything that can be done about this. Mr. Pollock stated that the road is built and maintained by the County and it is their say what travels on it. Mr. Wrightman stated that if the freeway goes through, it will alleviate a lot of the heavy traffic. Mr. Hull stated that the City Planning Commission could re-evaluate the Master Thoroughfare'P.Xan along these lines. Section 20 Mr. Walter Juras, 36039 Scone, referred to Levan Road and the fact that for three miles it has two traffic lights and a flasher. This is an 86' road (five lanes) and is heavily travelled. According to the state, it will be the last exist onto freeway. Suggested a ;.ocmplete study is needed in this area because of the truck traffic etc. Should make an effort for a good Thoroughfare Plan for City of Livonia. Mr. Heusted, Vice-Chairman, declared a recess at approximately 9:35 p.m. Mr. Heusted, Vice-Chairman, called the Public Hearing to order again at 9:50 p.m. Section 20 Mr. Juras, represe-iting Madonna Estates Civic Assocation and the adjacent property owners, stated he would like to have a classification of B at least on parcels K2, K1J2, Jl, Il, I2, H, and Mlbl. Also would like R-3 parcel to B. Section 21 Mr. Henry Koloff, 25408 Henley, Huntington Woods, referred to small section of R-3 (Lots 31 and 32) . Stated when R-3 was originally approved, it was a cs:npromise as a buffer zone on Five Mile Road. This was zoned R-3 when homes were built. A classification of R-2 will not work because of the size of the parcel. Suggested 60' x 120' lots going into the subdivision and the two small areas left on the back would be for P building and parking. Mr. Harry C. Tatigian, First Assistant City Attorney, arrived at meeting at approximately 10:15 p.m. Mr. Pollock asked what direction P building would face. Mr. Koloff stated Five Mile Road. Mr. Pollock suggested two lots be zoned P with greenbelt separating subdivision. Mr. Koloff stated that in either case (his suggestion or Mr. Pollook's suggestion) the two lots should not remain zoned R-2 as shown. 4403 Section 22 - no comment Section 23 Mr. Robert Bertoli, 14112 Henry Ruff Road, questioned how snail lots were developed when area is zoned RUF. Mr. Hull stated at one time lots smaller than 1/2 acre were permitted but the standards have changed. Mr. Walter Abraham, 29127 Five Mile Road, stated he owned a vacant 36' corner lot. Next door is also a 36' vacant lot. Both located on the Northwest corner of Cavour and Jamison. He would gladly sell his lot for $500 which is what it's worth; however, the owner next door wants $2,000. He (Mr. Abraham) is unable to secure a building permit and yet he is also unable to get additional property at a fair price. The owner lives in Brooklyn, New York. Stated somewhere in the ordinance it should state that lots platted prior to ordinance, do not have to apply. Mr. Pollock stated he is against this. Mr. Abraham stated this would give people a chance to use their property that was platted a long time ago. Mr. Donald Barton, 30280 Oakview, referred to undeveloped parcel along Lyndon (the proposed Lu Har Subdivision by Gordon-Begin) . Stated developer has submitted plat showing 60' lots. Requested R-3 at least for area along Henry Ruff Roadextended to Oakview (Parcels Mla and others). This classification would more closely reflect the use of the land. Mr. Pollock suggested commission look at M-1 area. Mr. Hull stated commission might want to rezone the whole thing to residential category.which is what adjacent area is zoned. Mr. Abraham stated this is the Spanich property and that there is industrial building being constructed there now. If this is a non-conforming use there could be no building or enlargement in area. Section 24 Mr. Abraham requested the C-2 on Five Mile Road (northeast corner) be extended to Garden. Mrs. Frances Moore stated she would like area to remain as is. To the north, east and south it is residential. Paderewski east has always been residential and across Five Mile Road is RUF. Stated she represents Mrs. Frieda Harder, 15192 Paderewski and Mrs. Clark Richa rdseit, 29105 Five Mile Road. Stated she recently secured 120 signatures wanting area to remain as is. Mr. Abraham stated across the street is not all residential as Mrs. Moore says. There are only two homes in there and Mr. Novak is in favor of commercial. The one home they want to sell for funeral_home and on the North side there is existing R-3. In these two blocks it was commercial at the time of the township zoning and before 1952. The lots are 20' wide and 100' deep. Listed what was e-; sing in commercial area now - rent-it shop, cleaners, electric shop, Ab-Ro Realty, gas company pressure station, doctor office, heating company, barber shop, grocery, B & Td Meats and a gas station. Across the street at Middlebelt Road is a gas station, feed store, vet., bar, and hardware. The house is the only parcel zoned residential. This will be commercial because the whole back area is R-3. Area is not residential. 4404 Mr. Heusted questioned whether objection is to use or zoning. Mr. Abraham stated they would like area commercial so that property can be used. Stated he represents Floyd Hopkins and all the people in business in area. No one objects to it except the Richardson's and Mrs. Moore. Mrs. Moore stated residents do not want it changed Will compromise to a buffer area of P zoning. Mr. William Titus, 29103 Five Mile Road, stated there could not be two blocks of P zoning in area. Mr. Abrahar,stated there is a PS area at Northeast corner of Deering and Five Mile Road and no one wants it. There is also area at Southeast corner of Jamison and Middlebelt Roads and owner cannot get rid of it either. There is too much PS zoning in area and there is a biapr demand for commercial. Mrs. Richardson's house is up for sale now. Mrs. Moore stated Mrs. Richardson's husband recently died and it was he who put sign up just to see what he could get for land. Mrs. Richardson has been unable to take sign down since husband's death. Has no intention of selling house now Mr. Hull stated that it is the intention to reflect present zoning and use of area and not to correct ills. Not trying to make whole-sale changes at this time. The important thing now is the text. Upon a motion duly made by Mr. Wrightman, seconded by Mr. Pollock and unanimously adopted, it was #2-26-65 RESOLVED that, the City Planning Commission does hereby adjourn the Public Hearing held on Thursite, , February 4, 1965 at approximately 11:20 p.m. CITY PLANNING COMMISSION Jo J.
