PUBLIC HEARING
Minutes of Meeting Held on Monday, April 25, 2016

A Public Hearing of the Council of the City of Livonia was held at the City Hall
Auditorium on Monday, April 25, 2016.

The Public Hearing was called to order at 7:00 p.m. with President Kathleen McIntyre
presiding. She announced that Petition 2016-01-01-02 has been withdrawn by the
Petitioner and will not be heard tonight.
The first hearing is a hearing relative to the roll for a Proposed Special Assessment
District for the Street Lighting Project in the Richfield Park Estates Site Condominiums,
in the Southeast 1/4 of Section 31, located west of Newburgh Road, between Ann Arbor
Trail and Joy Road within the City of the Livonia, Wayne County, Michigan.
The City Clerk has mailed notices to those persons owning land on the Proposed
Special Assessment District and all of the requirements of Section 3.08.110 of the
Livonia Code of Ordinances, as amended, have been fulfilled. There were four people in
the audience. The Public Hearing is now open for comments. Please state your name
clearly and your address before making your comments.
McIntyre: Mr. Zilincik.
Zilincik: Madam President, just a quick brief summary from what had transpired.

As you know we did a letter dated March 17, 2016, it provides the
information on the two LED street lights at a cost of $1,364 which will be
split between several residents at a cost of $82.13. So I just want to make
sure that we’re all on the same page as far as two LED lights, 14 feet high

are being proposed and the developer will pay for those costs in the
amount of $1,364 and the cost that’s part of the certification roll was
$82.13. Thank you.
McIntyre: Thank you very much, Mr. Zilincik. Anyone else, Council? Is there
anyone here tonight in the audience who would like to speak on this Public
Hearing item?
Witby: My name is Charles Witby --
McIntyre: Can you come up to the podium, please, your first name and last name,
please.
Witby: Charles Witby, 37501 Quail Chase Drive, I just want to speak on behalf of
myself and my wife. We’re in support of the LED streetlights and just
wanted to mention, I think it was discussed at a previous meeting, that
whether there would be ten or eight lots sharing this, I guess whether the
other two residents decided to be on the other assessment roll for
Churchill Manor, I guess it’s indifferent as long as their costs are being
split somehow among the two. So I guess that’s my only comment.
Zilincik: Madam Chair.
McIntyre: Mr. Zilincik.
Zilincik: As we decided before this is only eight residents for two lights. There’s
another public hearing after this for Churchill Manor for the two outlots that
will be heard as far as next Special Assessment, however that transpired.
But this particular one has eight folks with two lights and that’s the cost.
White: Madam Chair.
McIntyre: Ms. White.
White: I’ll offer the approving resolution for approving the assessment roll. LED
lights are state of the art and I think we should move forward. Thank you.
Bahr: Madam Chair.
McIntyre: Mr. Bahr.
Bahr: Just a quick question to make sure I understand. The difference between
what we talked about two months ago, whenever it was, and tonight, on
this issue is purely the LEDs, it’s the same homes but it’s just LEDs now?

Zilincik: Yes, before it was a Public Hearing of necessity, there was talk of high
pressure sodium, LED lights, eight lots, ten lots, this is strictly LED lights,
two lights, eight lots at a cost of $82.13.
Bahr: For eight lots?
Zilincik: Correct.
Bahr: Thank you.
McIntyre: Thank you very much. Good evening.
Tominac: Good evening. Stephen Tominac at 37508 Quail Chase Drive. I also
agree with the comments by Charles that we do welcome LED streetlights
so thank you for going in that direction as opposed to the sodium. I have
a couple questions on just the roll that was mentioned was $82.13, I was
also wondering if that’s just for the first year and then for seceding years it
would be $77.13?
McIntyre: Can you clarify that, Mr. Zilincik?
Zilincik: The first year should be correct but the subsequent years depends on if
the electric rates fluctuate so I can’t say that it will be exactly the same but

based on the estimate we got from DTE, the letter dated September 30
and the cost which the developer paid for and put it in the roll that’s the
costs they’re estimating, so the cost of electric may go up or down
depending on the Public Service Commission but that would be the
approximate cost as we move forward.
Tominac: And I just want to clarify where those lights would be located on this
street? There was two maps that I was shown and they were a little bit
different. So I know that one looks like it will be right next to where an
existing tree was just planted, and I was just wondering in the interest of
the City I wouldn’t want to knock that tree down, it was just planted
recently.
Zilincik: As far as where it’s going to be, 9353 and 9335, and then just north of
37508 but again we’ll make sure we coordinate with DTE as far as the tree
and the right of way and hydrants and things of that nature, that that will
be looked upon as far as the placement but those are the approximate
locations of those two streetlights.
Tominac: Okay, thank you.

McIntyre: Thank you very much. All right. If no one else from Council or the
audience wants to comment, I’d like to inform you that this will be on our
agenda for the Regular meeting on Monday, May 16, 2016.
As there were no further questions or comments, the Public Hearing was declared
closed at 7:08 p.m.
