HomeMy WebLinkAboutPLANNING MINUTES 1973-10-16 5431 • fd, MINUTES OF THE 292nd SPECIAL MEETING HELD BY THE CITY PLANNING COMMISSION OF THE CITY OF LIVONIA On Tuesday, October 16, 1973 the City Planning Commission of the City of Livonia held its 292nd Special Meeting in the Engineering Building, 13325 Farmington Road, Livonia, Michigan. Mr. Daniel R. Andrew, Chairman, called the meeting to order at 10:25 p.m. Members present: Daniel R. Andrew Joseph J. Falk Francis M. Hand David Merrion Suzanne Taylor Joseph R. Talbot Esther Friedrichs Members absent: Charles Pinto (personal business) Herman H. Kluver Messrs. John J. Nagy, Planning Director; Ralph H. Bakewell, Planner IV; and H. G. Shane, Planner IV, were also present. On a motion duly made by Mr. Hand, seconded by Mr. Falk and unanimously adopted, it was #10-259-73 RESOLVED that, pursuant to Council Resolution #636-73 which refers to the Planning Commission for report and recommendation all matters concerning amendments to the Zoning Ordinance with respect to recrea- ,• tional vehicles, the Planning Commission, having reviewed this matter with the Building Department wherein the Building Department indicated that the present Ordinances are adequate for purposes of properly regulating recreational vehicles, does hereby deem that no further action by the City is necessary with respect to this matter. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mr. Hand, seconded by Mr. Talbot and unanimously adopted, it was #10-260-73 RESOLVED that, the Planning Commission concurs with the principle that possible additional controls are needed to regulate the location ,_. of adult book stores, massage parlors, etc., within the City and does hereby request that the Department of Law prepare appropriate language for public hearing- purposes so as to establish that henceforth adult book stores, massage parlors, etc., shall be permitted only as waiver uses within the C-2 District regulations. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mr. Hand, seconded by Mrs. Friedrichs and unanimously adopted, it was #10-261-73 RESOLVED that, pursuant to Section 23.01 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended, the City Planning Commission does hereby establish and order that a public hearing be held in the Livonia City Hall to determine whether or nor to amend Section 3.01, Zoning Districts, of Ordinance #543, the Zoning Ordinance of the City of Livonia, by adding thereto the R-8, R-9, C-3, C-4 and P.O. Districts. • Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. 5432toOn a motion duly made by Mr. Talbot, seconded by Mr. Hand and unanimously adopted, it was #10-262-73 RESOLVED that, Petition 73-10-8-37P by Dr. Roger Ajluni requesting approval of all plans required by Section 18.58 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended by Ordinance #988, submitted in connection with a proposal to construct a 5,000 square foot building on property located on the east side of Farming- ton Road between Curtis and Six Mile Road in Section 10, is hereby removed from the table. Discussion with the petitioner on a revised site plan disclosed that there continued to be a deficiency of twenty-five parking spaces. The petitioner was advised by the Chair that two courses of action were available, i. e., petition the Zoning Board of Appeals for relief from the requirements of the Ordinance or to submit a site plan which conforms to the Ordinance of the City of Livonia. On a motion duly made by Mr. Hand, seconded by Mr. Merrion and unanimously adopted, it was _ #10-263-73 RESOLVED that, the City Planning Commission does hereby determine to table Petition 73-10-8-37P by Dr. Roger Ajluni requesting approval of all plans required by Section 18.58 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended by Ordinance IL #988, submitted in connection with a proposal to construct a 5,000 square foot building on property located on the east side of Farm- ington Road between Curtis and Six Mile Road in Section l0.until such a time as a site plan meeting the requirements of the Zoning Ordinance is submitted for consideration. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mr. Talbot, seconded by Mr. Friedrichs and unanimously adopted, it was #10-264-73 RESOLVED that, pursuant to Section 18.58 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended by Ordinance #988, the City Planning Commission does hereby approve Petition 73-10-8-39P by David H. Josephson and L. Jack Akey requesting approval of all plans required by Section 18.58 submitted in ' connection with a proposal to build a health studio on property located on the east side of Middlebelt Road between Terrence and Sunnydale in Section 13, subject to the following conditions: (1) That Site Plan #756-73, Sheet 1 of 2, prepared by Wah Yee Associates, Inc., revised 10/15/73, which is hereby . approved, shall be adhered to. (2) That Building Elevation Plan #756, Sheet 2 of 2, revised 10/15/73, prepared by Wah Yee Associates, Inc., -which is t: hereby approved, shall be adhered to with the exception that the north building elevation shall be full brick to match that of the brick used on the west building elevation. 5433 ° (3) That Landscape Plan prepared by Wah Yee Associates, Inc. revised by the City Planning Department 10/30/73, -which is hereby approved, shall be adhered to. (4) That all landscaping shall be installed on the site before issuance of a Certificate of Occupancy. (5) That all landscaping installed shall be permanently main- tained in a healthy condition. (6) That the sign treatment shall conform to that shown on the approved Building Elevation Plan wherein there is one build- ing identification sign proposed and that if any additional signs are proposed, they shall be subject to approval of the Planning Commission. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mrs. Friedrichs, seconded by Mr. Hand and unanimously adopted, it was #10-265-73 RESOLVED that, pursuant to Section 18.58 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended by Ordinance #988, the City Planning Commission does hereby approve Petition 4 73-10-8-40P by Maguran & Ritivol requesting approval of all plans submitted in connection with a proposal to alter and expand the existing Miller Equipment Company building located on the north side of Plymouth Road between Farmington Road and Mayfield in Section 27, subject to the following conditions: (1) That Site Plan I57312, Sheet 1, dated 9-14-73, prepared by Clark W. Corey, Architect, which is hereby approved, shall be adhered to. (2) That the building elevations as shown on Site Plan I57312, Sheet 1, dated 9-14-73, prepared by Clark W. Corey, Architect, which are hereby approved, shall be adhered to. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mrs. Taylor, seconded by Mr. Talbot and unanimously adopted, it was #10-266-73 RESOLVED that, pursuant to Section 18.58 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended by Ordinance #988, the City Planning Commission does hereby approve Petition 73-5-8-19P by A. R. Kramer Company requesting approval of all plans required by Section 18.58 submitted in connection with a proposal to expand the existing A. R. Kramer Company building located on the east side of Middlebelt Road between Terrence and Sunnydale in Section 13, subject to the following conditions: (1) That Site Plan #7305, Sheet A-1, dated 10/18/73, prepared by Kamp-DiComo Associates, Architects, which is hereby approved, shall be adhered to. (2) That building elevation as shown on Site Plan #73-05, Sheet • 5434 IL, A-4, dated 7/25/73, prepared by Kamp-DiComo Associates, ° Architects, which are hereby approved, shall be adhered to. (3) That all landscaping as shown on the approved Site Plan #73-05, Sheet A-1, dated 10/18/73, shall be installed before issuance of a Certificate of Occupancy. (4) That any additional sign area shall conform to existing requirements as stipulated in Section 18.50E, Zoning Ordinance No. 543. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made, seconded and unanimously adopted, the City Planning Commission of the City of Livonia adjourned its 292nd Special Meeting held on Tuesday, October 16, 1973, at approximately 12:40 a.m. CITY PLANNING COMMISSION David F.
