MINUTES OF THE 409th REGULAR MEETING
, HELD BY THE CITY PLANNING COMMISSION

On Tuesday, March 24, 1981 the City Planning Commission of the City of Livonia held
flits 409th Regular Meeting in the Livonia City Hall , 33000 Civic Center Drive, Livonia,
Michigan.

Mr. Daniel R. Andrew, Chairman, called the meeting to order at 9:40 p.m.
Members present: Daniel R. Andrew C. Russell Smith Carol Sue Sobolewski
Donald Vyhnalek Judith Scurto Jerome Zimmer
R. Lee Morrow
Members absent : Joseph J . Falk Herman Kluver
Messrs John J . Nagy, Planning Director; H. G. Shane, Assistant Planning Director; and
Ralph H. Bakewell , Planner IV, were also present.
On a motion duly made by Mr. Vyhnalek, seconded by Mr. Morrow and unanimously adopted,
it was
#3-46-81 RESOLVED that, pursuant to Section 18.58 of Zoning Ordinance #543,
as amended by Ordinance #1468, the City Planning Commission does
hereby approve Petition 81-1-8-4P by Rolland D. Schlosser requesting
approval of all plans required by Section 18.58 submitted in connec-
tion with a proposal to construct a commercial building on the south-
li; west corner of Five Mile Road and Santa Anita in Section 24, subject
to the following conditions:
(1 ) that the revised Site Plan #80199, Sheet P-1 , dated 2/2/4/81 ,
prepared by R. A. DeMattia Company, which is hereby approved
shall be adhered to;
(2) that Building Elevations as shown on Plan #80199, Sheet P-2,
dated 2/24/81 , prepared by R. A. DeMattia Company, which are
hereby approved shall be adhered to;
(3) that the landscaping as shown on Plan #80199, Sheet P-1 , dated
2/24/81 , which is hereby approved shall be adhered to;
(4) that the approved landscaping shall be installed on the site
prior to building occupancy and thereafter permanently main-
tained in a healthy condition;
(5) that all signage proposed for this site shall be reviewed and
approved by the Planning Commission;
(6) that a "no right turn" sign shall be installed adjoining the
proposed driveway leading from the site to Santa Anita so as
to prevent right hand turns;
(7) that the metal facia proposed for the building shall be of an
earth-tone color; and

(8) that two outdoor lights shall be provided on the east building
wall so ,as to light the driveway for improved pedestrian access
and that the outdoor lights to the south shall be so shielded
to prevent light from spilling over onto the adjacent residential
property located to the south.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution
adopted.
On a motion duly made by Mr. Smith and seconded by Mr. Morrow, it was
#3-47-81 RESOLVED that, pursuant to Section 18.58 of Zoning Ordinance #543,
as amended by Ordinance #1468, the City Planning Commission does
hereby determine to table Petition 81-2-8-8P by Giuseppi Alongi
requesting approval of all plans required by Section 18.58 sub-
mitted in connection with a proposal to construct a commercial
building on the south side of Seven Mile Road between Floral
and Deering in Section 12, until the Planning Commission Study
Meeting to be conducted on March 31 , 1981 .
A roll call vote on the foregoing resolution resulted in the following:
AYES: Morrow, Scurto, Smith, Sobolewski
NAYS: Vyhnalek, Zimmer, Andrew
ABSENT: Falk, Kluver
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution
adopted.
On a motion duly made by Mr. Zimmer and seconded by Mr. Smith, it was
4 #3-48-81 RESOLVED that, pursuant to Section 18.47 of Zoning Ordinance #543,

as amended by Ordinance #990, the City Planning Commission does
hereby recommend to the City Council that Petition 81-3-8-12 by
James Hoseini requesting approval of all plans required by Section .
18.47 submitted in connection with a proposal to construct an addi-
tion to a fruit market located on the southeast corner of Plymouth
Road and Garden in the Northwest 1/4 of SEction 36, be denied for
the following reasons:
(1) The proposed development is in conflict with Section 18.22,
Nonconforming Use; Elimination, of Zoning Ordinance #543,
in that it is the expressed policy of the City as set forth
in the above referenced section to eliminate or discontinue
nonconforming structures.
(2) The proposed site development overdevelops the property and
as such the site lacks capacity to support both the expansion
in use and all of the required offstreet parking.
(3) Because of the overdevelopment of the site, it will cause
undue hardship on the surrounding and established uses of
the area.

(4) The petitioner has failed to show that the proposed use complies
10 with the requirements of Section 19.06, the general standards of

Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution
adopted.
On a motion duly made by Mr. Zimmer and seconded by Mr. Vyhnalek, it was
#3-49-81 RESOLVED that , pursuant to Section 18.58 of Zoning Ordinance #543,
as amended by Ordinance #1468, the City Planning Commission does
hereby approve the Revised Building Elevation submitted in connec-
tion with a condition of approval of Petition 81 -1-8-1P by John E.
Roth & Sons, Inc. , requesting approval of all plans required by
Section 18.58 in connection with a proposal to construct a com-
mercial building on the north side of Schoolcraft between Inkster
and Middlebelt Roads in Section 24, subject to the following con-
ditions:
(1 ) that Revised Building Elevation Plan #8036, Sheet 3, dated
3/20/81 , which is hereby approved shall be adhered to;
1[10 FURTHER RESOLVED that, the City Planning Commission does hereby
approve the Landscape Plan submitted in connection with a con-
dition of approval of Petition 81-1-8-1P subject to the follow-
conditions :
(1 ) that Landscape Plan #8036, Sheet LP-1 , dated 3/20/81 , pre-
pared by Roth Engineers, which is hereby approved shall be -
adhered to; and
(2) that all landscape materials as shown on the approved Landscape
Plan shall be installed on the site before building occupancy
and thereafter maintained in a healthy condition; and
FURTHER that, all other conditions attached to the original approval
of Petition 81-1-8-1P are in full force and effect and shall be
adhered to.
A roll call vote on the foregoing resolution resulted in the following:
AYES: Morrow, Sobolewski , Vyhnalek, Zimmer, Andrew
NAYS: Scurto, Smith
ABSENT: Falk, Kluver
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution
adopted.

On a motion duly made by Mrs. Scurto, seconded by Mr. Zimmer and unanimously adopted,
10 it was
#3-50-81 RESOLVED that, pursuant to Section 23.01 (b) of Zoning Ordinance #543,
the City Planning Commission does hereby establish and order that
a public hearing be held to determine whether or not to amend Section
30.03, Permitted Uses, of Zoning Ordinance #543, to incorporated sub-
section (e) , Theaters, in the C-3 Zoning District regulations.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution
adopted.
On a motion duly made by Mrs. Scurto and seconded by Mr. Vyhnalek, it was
#3-51-81 RESOLVED that, the minutes of the 408th Regular Meeting and Public
Hearings held by the City Planning Commission on March 10, 1981
are approved.
A roll call vote on the foregoing resolution resulted in the following:
AYES: Morrow, Scurto, Smith, Sobolewski , Vyhnalek, Andrew
NAYS: None
ABSTAIN: Zimmer
ABSENT: Falk, Kluver
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution
adopted.
IL On a motion duly made by Mr. Morrow, seconded by Mrs. Scurto and unanimously adopted,
it was
#3-52-81 RESOLVED that, pursuant to a request from Cummings, McClorey, Davis
& Acho, Attorneys and Counsellors at Law, the City Planning Commis-
sion does hereby determine to grant an extension of approval to
Petition 80-12-8-36P requesting approval of all plans required by
Section 18.58 of Zoning Ordinance #543, as amended by Ordinance
#988, submitted in connection with a proposal to use an existing
residence located on the north side of Schoolcraft Road between
Farmington and Stamford in Section 21 for office purposes includ-
ing a possible addition, for a period of one year from the date of
this resolution.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution
adopted.
On a motion duly made by Mrs. Scurto, seconded by Mr. Vyhnalek and unanimously adopted,
it was
#3-53-81 RESOLVED that, pursuant to Section 23.01 (b) of Zoning Ordinance #543,
the City Planning Commission does hereby establish and order that
a public hearing be held to determine whether or not a public alley
located west of Deering, immediately south of Seven Mile Road in
Section 12, should be vacated .

Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution
adopted.

On a motion duly made, seconded and unanimously adopted, the 409th Regular Meeting
held by the City Planning Commission on March 24, 1981 was adjourned
at 10:25 p.m.
