MINUTES OF THE 419th REGULAR MEETING
IIHELD BY THE CITY PLANNING COMMISSION
OF THE CITY OF LIVONIA
On Tuesday, September 22, 1981 the City Planning Commission of the City of Livonia
held its 419th Regular Meeting in the Livonia City Hall , 33000 Civic Center Drive,
Livonia, Michigan.
Mr. Daniel R. Andrew, Chairman, called the meeting to order at 8 :00 p.m.
Members present: Daniel R. Andrew Donna Naidow Sue Sobolewski
Jerome Zimmer Donald Vyhnalek Herman Kluver
Judith Scurto Joseph Falk R. Lee Morrow
Members absent : None
Messrs. John J. Nagy, Planning Director; H. G. Shane, Assistant Planning Director;
and Ralph—H. Bakewell , Planner IV, were also present.
On a motion duly made by Mr. Falk, seconded by Mr. Morrow and unanimously adopted ,
it was
#9-169-81 RESOLVED that, the City Planning Commission does hereby determine
to remove Petition 81-7-2-16 by Michael Neubauer requesting
waiver use approval to construct an auto wash on the east side
of Farmington Road, south of Eight Mile Road in the Northwest
1/4 of Section 3 from the table.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.

On a motion duly made by Mr. Falk and seconded by Mr. Morrow, it was
#9-170-81 RESOLVED that, pursuant to a Public Hearing having been held on
September 1 , 1981 on Petition 81-7-2-16 as submitted by Michael
Neubauer requesting waiver use approval to construct an auto wash
on the east side of Farmington Road, south of Eight Mile Road in .
the Northwest 1/4 of Section 3, the City Planning Commission does
hereby recommend to the City Council that Petition 81 -7-2-16 be
denied for the following reasons:
(1 ) The petitioner has failed to affirmatively show that this
proposed use is in compliance with all of the special and
general waiver use requirements contained in Section 11 .03
and 19.06 of Zoning Ordinance #543, as amended .
(2) The proposed use would be detrimental to and incompatible
with the adjoining uses of the area.
(3) The location and size of the proposed use, its nature and
intensity, the site layout and its relation to the thorough-
fare giving access to and from the site will be hazardous to
the neighborhood since it will unduly conflict with the free
1[4:: flow of traffic along the abutting thoroughfare.

(4) The subject site has limited capacity for positive storm
drainage thereby requiring temporary ponding of storm
water on site, a condition which is not recommended by
the City of Livonia Division of Engineering.
4 FURTHER RESOLVED that, notice of the above public hearing was sent
to property owners within 500 feet, petitioner and City departments
as listed in the Proof of Service.
A roll call vote on the foregoing resolution resulted in the following:
AYES: Kluver, Morrow, Vyhnalek, Falk, Zimmer, Andrew
NAYS: Scurto, Naidow, Sobolewski
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mr. Vyhnalek and seconded by Mrs. Naidow, it was
RESOLVED that, pursuant to a Public Hearing having been held on
September 1 , 1981 on Petition 81-8-2-18 as submitted by Stephen A.
Warehime for Bob Evans Farms, Inc. , requesting waiver use approval
to construct a restaurant on the northwest corner of Middlebelt
and Schoolcraft in the Southeast 1/4 of Section 23, the City Plan-
ning Commission does hereby recommend to the City Council that
Petition 81-8-2-18 be approved subject to the following conditions :
(1 ) that the Site Plan, Sheet 1 , dated 8/31/81 , as revised, prepared
by Wolfgang Doerschlag, Architect, which is hereby approved
shall be adhered to;
(2) that the Building Elevations, Sheets 4 and 5, dated 8/10/81
and 12/29/80, respectively, prepared by Wolfgang Doerschlag,
Architect, which are hereby approved shall be adhered to;
(3) that the Floor Plan, Sheet EQ3, dated 6/26/81 , prepared by
Wolfgang Doerschlag, Architect, which is hereby approved
shall be adhered to;
(4) that the Landscape Plan, Sheet 1B, dated 8/31/81 , as revised ,
prepared by Wolfgang Doerschlag, Architect, which is hereby
approved shall be adhered to; and
(5) that the sign treatment for the site shall be limited to one
free-standing sign (as may be modified by the Zoning Board of
Appeals) and one wall sign only is approved for the front or
east elevation as shown on the approved Building Elevation
Plans;
A roll call vote on the foregoing resolution resulted in the following:
AYES: Kluver, Naidow, Vyhnalek, Andrew
NAYS: Morrow, Scurto, Sobolewski , Falk, Zimmer
Mr. Andrew, Chairman, declared the resolution fails.

On a motion duly made by Mr. Zimmer and seconded by Mrs . Scurto, it was
[9-171-81 RESOLVED that, pursuant to a Public Hearing having been held on
September 1 , 1981 on Petition 81 -8-2-18 as submitted by Stephen A.

with the residential uses in the area.

Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
It was ruled by Mr. Andrew, Chairman, that Petition 81-2-6-3 by the City Planning
Commission pursuant to Section 23.01 (b) of Zoning Ordinance #543
to amend Article XII of Ordinance #543 by adding Section 12.03,
Waiver Uses, to the P.L. District regulations is referred to the
Planning Commission study meeting to be conducted on October 13,
1981 .
On a motion duly made by Mrs. Scurto, seconded by Mr. Vyhnalek and unanimoustly adopted,
it was
#9-172-81 RESOLVED that pursuant to Section 23.01 (b) of Zoning Ordinance #543,
the City Planning Commission does hereby establish and order that a
public hearing be held to determine whether or not to amend Section
18.58 of Ordinance #543 to incorporate regulations requiring site
plan approval in connection with office buildings located in industrial
districts.
FURTHER RESOLVED that, notice of such hearing be given as provided in
Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of
[40 Livonia, as amended.

Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted .
On a motion duly made by Mrs. Sobolewski , seconded by Mrs. Scurto and unanimously adopted,
it was

#9-173-81 RESOLVED that, pursuant to Section 23.01 (b) of Zoning Ordinance #543,
the City Planning Commission does hereby establish and order that a
public hearing be held to determine whether or not to rezone property
located on the southwest corner of Seven Mile Road and Shadyside in
the Northwest 1/4 of Section 10, from P.L. to P.S.
FURTHER RESOLVED that, notice of such hearing be given as provided in
Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of
Livonia, as amended.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mr. Morrow, seconded by Mrs. Naidow and unanimously adopted,
it was
#9-174-81 RESOLVED that, pursuant to Section 23.01 (b) of Zoning Ordinance #543,
the City Planning Commission does hereby establish and order that a
public hearing be held to determine whether or not to amend Article II ,
Definitions, by adding Section 2. 11 , Flood Plain Terms, and Article
XXVIII , Flood Plain District Regulations, by incorporating language
pertaining to flood hazard district regulations.
FURTHER RESOLVED that, notice of such hearing be given as provided in
Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of
Livonia, as amended.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mr. Vyhnalek and seconded by Mr. Zimmer, it was
#9-175-81 RESOLVED that , the minutes of the 418th Regular Meeting and Public Hearings
held by the City Planning Commission on September 1 , 1981 are approved.
A roll call vote on the foregoing resolution resulted in the following :
AYES: Kluver, Morrow, Scurto, Naidow, Sobolewski , Vyhnalek, Zimmer, Andrew
NAYS: None
ABSTAIN: Falk
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mr. Morrow, seconded by Mrs. Scurto and unanimously adopted,
it was
#9-176-81 RESOLVED that, the City Planning Commission does hereby approve the
Sign Plan submitted in connection with Petition 79-12-2-28 by Robert
German requesting waiver use approval to redevelop an office building
on the north side of Five Mile Road between Woodring and Loveland in
the Southwest 1/4 of Section 15, subject to the following conditions :

(1) that the Sign Plan submitted by Robert German showing a
1[400 2 '6" x 4' wooden frame with aluminum facing, which is hereby
approved shall be adhered to; and
(2) that the approved sign shall have a maximum height of 6'
above ground at a 15' setback.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mrs. Scurto, seconded by Mrs. Naidow and unanimously adopted,
it was
#9-177-81 RESOLVED that, pursuant to Section 18.47 of Zoning Ordinance #543,
as amended by Ordinance #990, the City Planning Commission does
hereby recommend to the City Council that the Sign Plan submitted
in connection with Petition 79-8-8-29 by A. J. Foland requesting
- approval of all plans required by Section 18.47 submitted in con-
nection with a proposal to remodel an existing building located
within the Wonderland Shopping Center at the southwest corner of
Middlebelt and Plymouth Roads in Section 35 be approved subject to
the following conditions:
(1) that the Sign Plan prepared by A. J. Foland Company which is
hereby approved shall be adhered to; and
(2) that all conditions set forth in Appeal Case No. 8109-115 by
the Zoning Board of Appeals shall be adhered to.

On a motion duly made, seconded and unanimously adopted, the 419th Regular Meeting
held by the City Planning Commission on September 22, 1981 was adjourned
at 9:05 p.m.
