HomeMy WebLinkAboutMINUTES 2017-09-06 40297 MINUTES OF THE ONE THOUSAND EIGHT HUNDRED AND THIRTY-SECOND REGULAR MEETING OF SEPTEMBER 6, 2017 On September 6, 2017 the above meeting was held at the City Hall, 33000 Civic Center Drive, Livonia, Michigan, and was called to order by President Kathleen McIntyre at 7:00 p.m. Councilmember Jim Jolly led the meeting in the Pledge. Roll was called with the following result: Jim Jolly, Cathy White, Brian Meakin, Brandon Kritzman, Maureen Miller Brosnan and President Kathleen McIntyre. Absent: Scott Bahr. Elected and appointed officials present: Mark Taormina, Director of Planning and Economic Development; Todd Zilincik, City Engineer; Paul Bernier, Assistant City Attorney; Susan M. Nash, City Clerk; Judy Priebe, Director of Legislative Affairs; Shadd Whitehead, Fire Chief; Curtis Caid, Chief of Police; Ted Davis, Superintendent of Parks and Recreation; Lynda Scheel, Treasurer; and Mayor Dennis Wright. On a motion by Jolly, supported by Brosnan, and unanimously adopted, it was: #296-17 RESOLVED, that the minutes of the 1,831st Regular Meeting of Council held August 21, 2017 are approved as submitted. Councilmember Jolly presented Leo Neville with a certificate and thanked him for his service on the Zoning Board of Appeals. Councilmember Jolly then wished his wife Katie a Happy Birthday and Happy Anniversary as well. Chief Whitehead and Mayor Wright came to the podium to present a commendation to Firefighter Gregory Thomas for the heroic measures he took in assisting the Novi Police with an accident victim in June on Beck Road. 40298 Minutes of the September 6, 2017 Regular Meeting of Council President McIntyre announced there will be two (2) Public Hearings being held on Wednesday, September 20, 2017 in the Auditorium at City Hall, 33000 Civic Center Drive, Livonia, Michigan at 7:00 p.m. for the following: Proposed Special Assessment Street Lighting Project for the Mystic Creek Site Condominiums, located east of Wayne Road and south of Curtis Road, in the Southeast ¼ of Section 9. To Determine Necessity Proposed Special Assessment Street Lighting Project for the Washington Park Site Condominiums, located south of Ann Arbor Road and west of Hix Road, in the Southwest ¼ of Section 31. Establishment of the Assessment Roll President McIntyre stated that there is new data on Items 17, 18 and 19. During Audience Communication Fred and Marilyn Wheeler, 15643 Edgewood, th revisited the issue they brought before the Council at the July 10 meeting and asked what, if any, progress had been made on it. President McIntyre responded by saying that they could not comment on pending litigation but that she would research what avenues could be utilized in responding to their request. Treasurer Lynda Scheel came to the podium to remind citizens that the summer st tax bills that were issued July 1, 2017 are due by Thursday, September 14, 2017 and to feel free to visit the City’s website or call their office with any questions that may arise. On a motion by Brosnan, supported by Jolly, it was: #297-17 RESOLVED, that having considered an application from Rebecca Drzewicki, 18615 Parklane Street, Livonia, MI 48152, dated July 27, 2017, requesting permission to close Parklane Street between Clarita and Margareta, on Saturday, September 23, 2017, from 1:00 p.m. to 6:00 p.m., for the purpose of conducting a block party, the Council does hereby grant permission as requested, including therein permission to conduct the said affair on Sunday, September 24, 2017, in the event of inclement weather, the action taken herein being made subject to the approval of the Police Department. #298-17 RESOLVED, that having considered an application from Amanda Duke, 17200 Louise Street, Livonia, MI 48152, dated August 1, 2017, requesting permission to close 17200 to 17223 Louise Street, on Saturday, September 9, 2017, from 2:00 p.m. to 6:00 p.m., for the purpose of conducting a block party, the Council does hereby grant permission as 40299 Minutes of the September 6, 2017 Regular Meeting of Council requested, the action taken herein being made subject to the approval of the Police Department. #299-17 RESOLVED, that having considered a communication from the City Engineer, dated August 15, 2017, approved for submission by the Mayor, to which is attached a letter from Fabio Cervi, Cervi Construction, dated August 14, 2017, requesting a waiver of the sidewalk requirement in front of the newly constructed home located at 20290 Fremont, in the N.E. ¼ of Section 2, the Council does hereby approve this request inasmuch as omitting the sidewalk on the subject property would have no detrimental effect upon the neighboring properties at this time due to the very limited number of public sidewalks existing within the neighboring area; FURTHER, the Council does hereby reserve the right to require sidewalks at this location in the event that additional sidewalks are installed in this area at some future date. #300-17 RESOLVED, that having considered a communication from the City Engineer, dated August 15, 2017, approved for submission by the Mayor, to which is attached a letter from Fabio Cervi, Cervi Construction, dated August 14, 2017, requesting a waiver of the sidewalk requirement in front of the newly constructed home located at 20290 Hugh, in the N.E. ¼ of Section 2, the Council does hereby approve this request inasmuch as omitting the sidewalk on the subject property would have no detrimental effect upon the neighboring properties at this time due to lack of other public sidewalks existing within the neighboring area; FURTHER, the Council does hereby reserve the right to require sidewalks at this location in the event that additional sidewalks are installed in this area at some future date. #301-17 RESOLVED, that having considered a communication from the Human Resources Director, dated August 17, 2017, which bears the signature of the Director of Finance and is approved for submission by the Mayor, and which sets forth resolution no.17-113, adopted by the Civil Service Commission at its regular meeting of August 16, 2017, wherein it is recommended that the attached Tentative Agreement between the City of Livonia and the Livonia Lieutenants and Sergeants Association (LLSA), be approved for the period December 1, 2017 through November 30, 2020, and the necessary amendments to the Compensation Plan, the Insurance and Disability Plans and the Retirement Ordinance be adopted so as to effectuate the provisions set forth in the aforesaid agreement, the Council does hereby approve of and concur in the aforesaid action of the Civil Service Commission; and the Mayor and City Clerk are hereby requested to affix their signatures to the said contract, for and on behalf of the City of Livonia, and to do all other things necessary or incidental to the full performance of this resolution. #302-17 RESOLVED, that having considered the report and recommendation of the Director of Inspection, dated August 9, 2017, 40300 Minutes of the September 6, 2017 Regular Meeting of Council which bears the signature of the Director of Finance and is approved for submission by the Mayor, the Council does hereby authorize the purchase of one (1) 2018 Ford F150 4X4 Pick-up Truck, with spray in liner, tonneau cover, wig wag head and tail lights, grill mounted strobe lights and rear window LED amber/green strobe bar, at a cost of $32,176.00, from Signature Ford, 1960 E. Main Street, Owosso, Michigan 48867; and the outfitting of one (1) f150 4x4 pick-up truck by Cannon Truck Equipment, 51761 Danview Technology Ct., Shelby Township, Michigan 48315, at a cost of $3,069.00; for a total amount not to exceed $35,245.00, to be assigned to the Inspection Department, the same to be expended from funds already budgeted for this purpose in the Capital Outlay Budget, Account No: 101-371-985-000; and the Director of Inspection is hereby authorized to approve any minor adjustments as may be necessary; FURTHER, the Council does hereby determine to authorize the said purchase without competitive bidding inasmuch as the same is based upon the low State of Michigan bid price under Contract No. 071B1300009 and Macomb County Contract #71-15 for the new vehicle purchase; and the low State of Michigan MI-Deal bid price under Contract No. 071B7700166 for the outfitting of one (1) vehicle, and no advantage to the City would result from competitive bidding, and such action is taken in accordance with the provisions set forth in Section 3.04.140.D.4 of the Livonia Code of Ordinances, as amended. #303-17 RESOLVED, that having considered the report and recommendation of the Director of Public Works, dated July 31, 2017, which bears the signature of the Director of Finance and is approved for submission by the Mayor, the Council does hereby authorize the purchase of one (1) skid steer loader (246D) with auger bits, cold planer and maintenance agreement from Michigan Cat, 24800 Novi Road, Novi, Michigan 48375, in an amount not to exceed $69,103.00, to be assigned to the Roads Section of the Department of Public Works; FURTHER, the Council does hereby authorize an expenditure in an amount not to exceed $69,103.00 from funds already budgeted for this purpose in the Capital Outlay budget, Account No: 401-000-987-000; FURTHER, the Council does hereby determine to authorize the said purchase without competitive bidding inasmuch as the same is based upon the low State of Michigan bid price under Contract No. 071B7700084 for the new vehicle purchase; and no advantage to the City would result from competitive bidding, and such action is taken in accordance with the provisions set forth in Section 3.04.140.D.4 of the Livonia Code of Ordinances, as amended. #304-17 RESOLVED, that having considered the report and recommendation of the Director of Public Works, dated August 10, 2017, which bears the signature of the Director of Finance and is approved for submission by the Mayor, the Council does hereby authorize the purchase of one (1) Elgin Eagle Street Sweeper at a net cost (less trade-in) of $256,578.40, to replace Street Sweeper #102, and to be assigned to the Roads section of the department of public works, utilizing the national 40301 Minutes of the September 6, 2017 Regular Meeting of Council intergovernmental Purchasing Alliance (National IPA) Pricing, which was awarded to Bell Equipment Company, 78 Northpointe Drive, Lake Orion, MI 48359; FURTHER, the Council does hereby authorize an expenditure in an amount not to exceed $256,578.40 from funds already budgeted in Account No. 205-527-987-000 (Refuse Fund) for this purpose; FURTHER, the Council does hereby determine to authorize this purchase without competitive bidding inasmuch as the same is based upon the low National Intergovernmental Purchasing Alliance (National IPA) bid price (under Contract #RH-16-045), and no advantage to the City would result from competitive bidding, and such action is taken in accordance with the provisions set forth in Section 3.04.140.D.4 of the Livonia Code of Ordinances, as amended. #305-17 RESOLVED, that having considered the report and recommendation of the Director of Public Works, dated July 31, 2017, which bears the signature of the Director of Finance and is approved for submission by the Mayor, the Council does hereby authorize the purchase of one (1) 2017 Vorteq Trailer TMA Truck Mounted Attenuator (TL-3) from Carrier & Gable, Inc., 24110 Research Drive, Farmington Hills, MI 48335, in an amount not to exceed $19,292.35, to be assigned to the Roads Section of the Department of Public Works; FURTHER, the Council does hereby authorize an expenditure in an amount not to exceed $19,292.35 from funds already budgeted for this purpose in the Capital Outlay budget, Account No: 401-000-987-000; FURTHER, the Council does hereby determine to authorize the said purchase without competitive bidding inasmuch as the same is based upon the low State of Michigan bid price under MDOT Contract No. 591B7700077 for the new trailer purchase; and no advantage to the City would result from competitive bidding, and such action is taken in accordance with the provisions set forth in Section 3.04.140.D.4 of the Livonia Code of Ordinances, as amended. #306-17 RESOLVED, that having considered the report and recommendation of the Director of Public Works, dated August 10, 2017, which bears the signature of the Director of Finance and is approved for submission by the Mayor, the Council does hereby authorize the purchase of one Caterpillar Compactor (CB24B) with Towmaster T-12DT Trailer and Maintenance Agreement from Michigan Cat, 24800 Novi Road, Novi, MI 48375, in an amount not to exceed $52,702.50, to be assigned to the Roads Section of the Department of Public Works; FURTHER, the Council does hereby authorize an expenditure in an amount not to exceed $52,702.50 from funds already budgeted for this purpose in the Capital Outlay budget fund, Account No: 401-000-987-000; FURTHER, the Council does hereby determine to authorize the said purchase without competitive bidding inasmuch as the same is based upon the low State of Michigan MI-Deal bid price under Contract No. 071B7700084 for the new vehicle purchase; and no advantage to the City would result from competitive bidding, and such action is taken in accordance with the 40302 Minutes of the September 6, 2017 Regular Meeting of Council provisions set forth in Section 3.04.140.D.4 of the Livonia Code of Ordinances, as amended. #307-17 RESOLVED, that having considered the report and recommendation of the Director of Public Works, dated August 10, 2017, which bears the signature of the Director of Finance and is approved for submission by the Mayor, the Council does hereby authorize the purchase of one (1) 2017 Ford Transit 250 Cargo Van, at a cost of $29,941.00, from Signature Ford, 1960 E. Main Street, Owosso, Michigan 48867; and the outfitting of one (1) 2017 Ford Transit 250 Cargo Van by Truck and Trailer Specialties, 1200 Victory Drive, Howell, Michigan 48843, at a cost of $14,332.00; for a total amount not to exceed $44,273.00, to be assigned to the Water Maintenance Section of the Department of Public Works, the same to be expended from funds already budgeted for this purpose in the Capital Outlay Budget for Water and Sewer Account No: 592-142-000; and the Director of Public Works is hereby authorized to approve any minor adjustments as may be necessary; FURTHER, the Council does hereby determine to authorize the said purchase without competitive bidding inasmuch as the same is based upon the low State of Michigan bid price under MI-Deal Contract No. 071B1300009 and Macomb County Contract #71-15 for the new vehicle purchase; and through the Rochester Hills Co-Op Award Agreement (RFP-RH-13-030) for the outfitting of said vehicle; and no advantage to the City would result from competitive bidding, and such action is taken in accordance with the provisions set forth in Section 3.04.140.D.4 of the Livonia Code of Ordinances, as amended. #308-17 RESOLVED, that having considered a communication from the Director of Public Works, dated July 18, 2017, which bears the signature of the Director of Finance and is approved for submission by the Mayor, the Council does hereby approve a three (3) year extension of the existing contract with Brendel’s Septic Tank Service, LLC, 9481 Highland Road, White Lake, Michigan 48386, for providing portable toilet service for the City’s 2018 through 2020 season at the unit prices agreed upon in their proposal, dated June 10, 2017, and agreed upon in October, 2014, with a price freeze for the next three years, retaining the $5.00 per unit reduction in the prior contract for monthly handicap units, for the estimated total annual cost of $34,900.00; FURTHER, the Council does hereby authorize an expenditure in an amount not to exceed $34,900.00 from funds already budgeted for this purpose in the 2017-2018 fiscal year in Account No. 205-527-818-010 (Municipal Refuse Fund); FURTHER, the Council does hereby authorize the action herein without competitive bidding for the reason that the portable toilet business is not competitive by nature, such that said bid is lower than any the City is likely to receive through competitive bidding, and such action is taken in accordance with Section 3.04.140.D.3 of the Livonia Code of Ordinances, as amended. 40303 Minutes of the September 6, 2017 Regular Meeting of Council A roll call vote was taken on the foregoing resolutions with the following result: AYES: Jolly, White, Meakin, Kritzman, Brosnan and McIntyre NAYS: None The President declared the resolutions adopted. The above Ordinance was placed on the table for consideration at an upcoming Regular meeting. 40305 Minutes of the September 6, 2017 Regular Meeting of Council A communication from the Office of the Mayor, dated August 30, 2017, re: Additional Information for Item #18, Regular Meeting of September 6, 2017, was received and placed on file for the information of the Council. On a motion by White, supported by Brosnan, and unanimously adopted, it was: #309-17 RESOLVED, that having considered communications from the Human Resources Director, dated August 17, 2017, which bear the signature of the Director of Finance and is approved for submission by the Mayor, transmitting resolution no. 17-114, adopted by the Civil Service Commission at its regular meeting of August 16, 2017, recommending salary and fringe benefit adjustments for the classification of Police Command for the period December 1, 2017 through November 30, 2020, the Council does hereby concur with Civil Service Commission Resolution No. 17-114 and the salary and benefit adjustments for the classification of Police Command are hereby approved for the period December 1, 2017 through November 30, 2020. On a motion by White, supported by Brosnan, and unanimously adopted, it was: #310-17 RESOLVED, that having considered the correspondence from Livonia Police Chief Curtis Caid to Mayor Dennis Wright, dated August 10, 2017, and the Council having considered this request at its Study Meeting held on August 21, 2017, the Council does hereby approve the following: 1. Elimination of wage steps one (1) through four (4) for the position of police chief. 2. Legal representation. In the event that a member of the police command is under criminal investigation or a defendant in a criminal prosecution because of his or her involvement in a matter that is or was within the scope of his or her employment and the good faith performance his or her duties as a law enforcement officer and/or a command officer of the Livonia Police Department, subject to the approval of the Mayor and the City Attorney, he or she will have immediate access of an amount not to exceed $30,000.00 to retain an attorney(s) to represent him or her. Notwithstanding the foregoing, funds for legal representation may be denied at any time if evidence is provided to the Mayor and the City Attorney which convinces them that the member of the police command was not acting within the scope of his or her employment and the good faith performance of his or 40306 Minutes of the September 6, 2017 Regular Meeting of Council her duties as a law enforcement officer. On a motion by Meakin, supported by Brosnan, and unanimously adopted, it was: #311-17 RESOLVED, that having considered the report and recommendation of the Superintendent of Public Service and the Director of Public Works, dated August 10, 2017, which bears the signature of the Director of Finance, and is approved for submission by the Mayor, the Council does hereby accept the bid of Marc Dutton Irrigation, Inc., 4420 Hatchery Road, Waterford, MI 48239, for completing all work required in connection with the replacement and installation of a new irrigation system at Ford Field, for a total amount not to exceed $22,200.00, the same having been in fact the lowest bid received and meets all specifications; FURTHER, the Council does hereby authorize an expenditure in an amount not to exceed $22,200.00 from funds already budgeted in the Capital Outlay Fund - Account No. 401-000-987-000 for this purpose; FURTHER, in the event the low bidder is unable to complete the project, the Council does hereby accept the unit price bid of the second lowest bidder, D&B Landscaping, Inc., 13222 Merriman Road, Livonia, MI 48150 to complete the work for the estimated total cost not to exceed $44,994.00; and the Mayor and City Clerk are hereby authorized to execute a contract, approved as to form and substance by the Law Department, for and on 40307 Minutes of the September 6, 2017 Regular Meeting of Council behalf of the City of Livonia with the aforesaid bidder(s) and to do all other things necessary or incidental to the full performance of this resolution.
