HomeMy WebLinkAboutPUBLIC HEARING - 2017-07-19 - REZONING FARMINGTON RD CITY OF LIVONIA PUBLIC HEARING Minutes of Meeting Held on Wednesday, July 19, 2017 ______________________________________________________________________ A Public Hearing of the Council of the City of Livonia was held at the City Hall Auditorium on Wednesday, July 19, 2017. MEMBERS PRESENT: Kathleen E. McIntyre, President Scott Bahr Maureen Miller Brosnan Jim Jolly Brian Meakin Cathy K. White MEMBERS ABSENT: Brandon M. Kritzman, Vice President OTHERS PRESENT: Mark Taormina, Director of Planning Todd Zilincik, City Engineer Paul Bernier, Assistant City Attorney Bonnie J. Murphy, CER-2300, Certified Electronic Recorder The Public Hearing was called to order at 7:08 p.m. with President Kathleen McIntyre presiding. This is a Public Hearing relative to Petition 2017-05-01-03 submitted by Brian Duggan, on behalf of Soave/Oro Construction, L.L.C., to rezone the properties located on the west side of Farmington Road Between Pickford and Curtis Roads (18491, 18489, 18481, 18477, 18451, 18431, 18421, and 18363 Farmington Road), in the Northeast ¼ of Section 9, from OS (Office Services) to R-1 (One Family Residential – 60’ x 120’ Lot). within the City of Livonia, Wayne County, Michigan. The City Clerk has mailed notices those persons owning land in the proposed Special Assessment District and all other requirements of Section 3.08.110 of the Livonia Code of Ordinances, as amended, have been fulfilled. There in the area affected by the proposed changes, and all other requirements of Ordinance No. 543, the Zoning Ordinance, have been fulfilled. The public hearing is now open for comments. There were eight people in the audience. Please state clearly your name and address before making your comments. McIntyre: Mr. Taormina. Taormina: Thank you. This petition is very similar to the petition that was just considered, it’s located on the west side of Farmington Road. This particular group of properties is further to the south, it’s south of Pickford 2 Avenue. The lots are currently zoned OS(Office Services), the request is to rezone them to R-1 (One Family Residential). There are eight contiguous lots that make up this petition, if rezoned they would subdivided into three building sites, each of which would measure roughly 60’ x 110’ or 6600 square feet, so same size as the previous lots, so the Zoning Board of Appeals would be required for the slight lot deficiency. Again, plot plans have developed showing how homes can be built on these parcels and meet all of the setback. The lot coverage requirements, you have residential zoning to the west, there’s an office immediately to the north which is located right at the southwest corner of Farmington and Pickford Road and then lying to the south is the site of the Curtis Creek Apartments zoned R-7 (Multiple Family Residential). This property was previously approved, or a site plan approved for an office building back in 2007. At that time the site was rezoned actually from R-3 to OS (Office Services). A site plan was then subsequently approved for a 4,000 square foot one story general office building, however no improvements were ever made to the property and the property has remained vacant since that time. The Planning Commission again is recommending approval of this rezoning petition. Thank you. McIntyre: Thank you. Council? Bahr: Madam President. McIntyre: Yes. Bahr: Through the Chair to Mr. Taormina, has this property ever been developed? Taormina: Not to my knowledge. When the request was presented back in 2007, it was vacant then, I don’t think there’s been any work done on the property prior to that so I think it’s been vacant for as long as I’m aware. Bahr: How many houses did you say that they plan on building? Taormina: Three. Bahr: Three? Taormina: Three. Meakin: Madam Chair. McIntyre: Councilmember Meakin. 3 Meakin: Through the Chair to Mark, wasn’t there problem with the office building at that time, whether it was a storm drain or something that caused them not to build it? Taormina: The challenge at one point was compliance with the stormwater regulations. As I recall, the original petition did not include all eight lots, a couple of extra lots were picked up and additional land area in order to accommodate the stormwater basin which I believe was going to be on the southerly part of the site and then draining into the adjoining creek. McIntyre: Are there any more questions of Council? Would anyone in the audience like to speak on this matter? Priy: Good evening. Carolyn Priy, 18358 Filmore Street, Livonia, 48152. I’m the house directly to the left of it. I think it’s really tight there but I guess if it meets the compliance that’s fine. I would like to have a privacy fence with the three different homes coming up on my property there and some tree resolution, since they’re going to be taking out a whole of different kind of forestry and would just like to see whatever needs to be done to make sure there aren’t any water issues since there is that ravine south of my home that I don’t want water issues because of land development behind me. Other than that, I don’t have an issue with it. Meakin: Tonight we’re only looking at a zoning change, you’ll have an opportunity to look at the site plan at a later date, isn’t that correct, Mr. Taormina? Taormina: Well, unless you wanted to entertain some type of conditional rezoning where you could make these requirements in the absence of any voluntary considerations and still it would have to be voluntary on behalf of the Petitioner. Really the opportunity to take a look at this more closely would probably come from the Zoning Board of Appeals. They’ll review the site plans in connection with the request for the lot variances. Meakin: Mr. Duggan, can you put in a condition about the water drainage, to make sure that the property is graded properly. Duggan: Not a problem and I know that any development must contain its own water, so there won’t be an issue on that. Meakin: And the other issue, the Zoning Board of Appeals will take that up. Bahr: I will offer the approving resolution. 4 McIntyre: I just want it understood that this is a rezoning discussion that’s before us from Mr. Duggan and that there will be an opportunity to give further input with the Zoning Board.
