MINUTES OF THE ONE THOUSAND EIGHT HUNDRED AND THIRTY-FOURTH
REGULAR MEETING OF OCTOBER 2, 2017
On October 2, 2017 the above meeting was held at the City Hall,
33000 Civic Center Drive, Livonia, Michigan, and was called to order by
President Kathleen McIntyre at 7:00 p.m. Councilmember Scott Bahr led the
meeting in the Invocation.
Roll was called with the following result: Scott Bahr, Brian
Meakin, Maureen Miller Brosnan, Jim Jolly, Cathy White and President
Kathleen McIntyre. Absent: Brandon Kritzman.
Elected and appointed officials present: Mark Taormina,
Director of Planning and Economic Development; Todd Zilincik, City Engineer;
Don Knapp, City Attorney; Susan M. Nash, City Clerk; Judy Priebe, Director
of Legislative Affairs; Ted Davis, Superintendent of Parks and Recreation; and
Mayor Dennis Wright.
On a motion by White, supported by Jolly, it was:
#327-17 RESOLVED, that the minutes of the 1,833rd
Regular Meeting of Council held September 18, 2017 are
approved as submitted.
A roll call vote was taken on the foregoing resolution with the following
result:
AYES: Bahr, Jolly, White and McIntyre
NAYS: None
PRESENT: Meakin, Brosnan
The President declared the resolution adopted.

Councilmember Brosnan congratulated her sister-in-law on her recent
wedding.
President McIntyre announced there will be a Public Hearing being held on
Monday, October 9, 2017 at 7:00 p.m. in the Auditorium of City Hall, 33000
Civic Center Drive, Livonia, on the following item:
To consider the adoption of a resolution approving a Brownfield
Plan and Development and Reimbursement Agreement of the City of
Livonia Brownfield Redevelopment Authority for the former Farmer
Jack Supermarket property, located on the south side of Seven Mile
Road between Middlebelt Road and Melvin Avenue (29601, 29659
and 29701 Seven Mile Road) in the Northeast ¼ of Section 11, as
requested by Jared Belka of Warner, Norcross & Judd LLP, on behalf
of Livonia Market II LLC, pursuant to and in accordance with Act No.
381 of Public Acts of 1996, as amended.
She then extended belated birthday greetings to Treasurer Lynda Scheel, and
wished happy birthday to Todd Zilincik and Mark Taormina.
President McIntyre then spoke on the horrific tragedy that happened in Las
Vegas and asked everyone to keep all of those affected by it in their thoughts
and prayers and also the First Responders.
During Audience Communication Jerry Rhodes, 32329 Barclay, and business
owner of a building located at 28520 Joy Road, addressed Council about an
issue he is dealing with concerning a Conex Container box that is located on
his business property and President McIntyre indicated that they would follow
up on this item with the Inspection Department and get back with him.
Glenn Moon, 34461 Wood Street, Livonia, addressed Council concerning a
series of events and communications he had with Council and Mayor Wright
requesting that Chief Caid call him so he could clarify the comments he made
concerning deceased Officer Larry Nehasil at the September 15, 2011 Regular
Meeting of Council and that he has not yet heard from anyone from the Livonia
Police Department.
Marlon Keilman, 37642 Howell, Livonia, questioned Council on what progress
had been made about the continuation of an issue he had brought before them
prior this year concerning blight and the placement of a toilet in his neighbor’s
front yard. President McIntyre advised him that she herself, along with the
Law Department and the Inspection Department, will meet with him to try and
come to a resolution concerning this problem.

Clerk Nash reminded citizens about the upcoming November 7 election and
stated that the last day to register and be able to vote in this election is

Tuesday, October 10 and that absentee ballots are being mailed out up until
the Saturday before the election which residents can return either by U.S. mail,

depositing them in the red box outside the east side of City Hall or dropping
them off at the Clerk’s office. Any questions can be answered by calling the
City Clerk’s office at 734 466 2230 or directly to Jennifer Wagner, Elections
Systems Operator, at 734 466 2235.
City Engineer Zilincik announced that it is the time of year again where
residents can voice their concerns about Livonia’s Road Improvement
Program with the Citizens Advisory Committee at a meeting to be held
Wednesday, October 11, 2017 at 6:30 p.m. at the DPW located at 12973
Farmington Road, Building 12. He stated this is for City roads and not Wayne
County road and that all of the information can be found on the City website.
He also gave an update on the progress and near completion of the 2017
program.
On a motion by White, supported by Brosnan, it was:
#328-17 RESOLVED, that having considered the correspondence
from Kevin Murphy, Athletic Director, Clarenceville High School, dated
September 8, 2017, the Council does hereby approve and recognize
the Clarenceville High School Homecoming Parade to be held on
Friday, October 13, 2017, beginning at 5:30 p.m.; FURTHER, the
Council does hereby approve the parade route as follows:
Exit the west driveway of Botsford Elementary and travel north
on Brentwood to Pembroke, west on Pembroke to Weyher,
south on Weyher to St. Martins, west on St. Martins to Parkville,
north on Parkville to Bretton, west on Bretton to Middlebelt; and
north on Middlebelt to the Clarenceville Middle School parking
lot;
FURTHER, the Council does hereby request that the Wayne
County Department of Public Services allow the City of Livonia to close
the necessary roads between the hours of 5:00 p.m. and 8:00 p.m. or
until the roads are returned to normal traffic operation; that the City of
Livonia will assume liability for any damage claims which may arise as
a result of the road closure, as to Wayne County only; and that Senior
Police Officer Michael Arakelian is hereby designated and authorized
to sign the road closure permit on behalf of the City of Livonia upon
proof that the Board of Education of Clarenceville School District has
adopted a resolution assuming liability for any damage claims which
may arise as a result of the road closure, as to Wayne County and the
City of Livonia only.
#329-17 RESOLVED, that having considered a communication
from the Superintendent of Parks and Recreation, dated September 7,
2017, which bears the signature of the City Attorney and the Director of
Finance and is approved for submission by the Mayor, to which
attaches Intergovernmental Agreements between the Charter County

of Wayne and the City of Livonia in connection with utilizing grant funds
in the amount of $111,526.00 to be used for improvements at Rotary,
Botsford and Clements Circle Parks, the Council does hereby approve
the proposed Intergovernmental Agreements between the Charter
County of Wayne and the City of Livonia and the Mayor and City Clerk
are hereby authorized, for and on behalf of the City of Livonia, to
execute the Intergovernmental Agreements in the manner and form
herein submitted, subject to approval as to form and substance by the
Department of Law, and to do all other things necessary or incidental
to the full performance of this resolution; FURTHER, the Council does
hereby authorize an advance expenditure in an amount not to exceed
$90,471.00 from Account No. 208-720-987-000 and $21,055.00 from
Account No. 208-721-987-000 for this purpose, with the provision that
these funds be reimbursed at such time as the improvements are
completed.
#330-17 RESOLVED, that having considered the report and
recommendation of the Fire Chief, dated September 8, 2017, submitted
pursuant to Council Resolution No. 292-17, adopted on August 21,
2017, which bears the signature of the Finance Director and is
approved for submission by the Mayor, the Council does hereby accept
the bid of Cross Renovation, Inc., 34133 Schoolcraft Road, Livonia,
Michigan 48150 for the proposed addition and remodel of the interior of
Livonia Fire Station 1, for a total cost not to exceed $1,097,777.00, plus
a 10% contingency allowance in the amount of $109,777.00 for
unforeseen conditions due primarily to the poor soil conditions in the
area of construction, for a total amount not to exceed $1,207,554.00,
the same having been the lowest bid received and meets all
specifications; FURTHER, the Council does hereby authorize an
expenditure in an amount not to exceed $1,207,554.00 from funds
already budgeted in Account No. 101-336-976-000 (Capital Outlay –
Bld Imprv) for this purpose; and the Mayor and City Clerk are hereby
authorized to execute a contract, approved as to form and substance
by the Department of Law, for and on behalf of the City of Livonia with
the aforesaid bidder and to do all other things necessary or incidental
to the full performance of this resolution.

On a motion by Brosnan, supported by Jolly, and unanimously adopted,
it was:
#331-17 RESOLVED, that having considered a communication
from the Department of Law, dated September 11, 2017, approved for
submission by the Mayor, transmitting for Council acceptance a Grant
of Easement executed by Glenn Cerny, Ed.D, Vice President and Chief
Financial Officer, for a 12-foot wide public utility easement in connection
with the water main constructed at the subject location in the Southwest
1/4 of Section 7, more particularly described as:
(12-foot Wide Water Main Easement)
A 12-foot wide water main easement over part of Unit 13 of re-plat
number 1 of College Park Condominium, Wayne County Condominium
