PUBLIC HEARING
Minutes of Meeting Held on Wednesday, November 15, 2017

A Public Hearing of the Council of the City of Livonia was held at the City Hall
Auditorium on Wednesday, November 15, 2017.

This is a public hearing relative to the proposed ASSESSMENT ROLL for the MYSTIC
CREEK SITE CONDOMINIUMS STREET LIGHTING PROJECT, located east of Wayne
Road and south of Curtis Road, in the Southeast ¼ of Section 9. This has been duly
filed in the Office of the City Clerk and is now open for public examination and
inspection.
The clerk has mailed notices to those persons owning land in the proposed revised
Special Assessment District and all other requirements of the Livonia Code of
Ordinances have been fulfilled. The Public Hearing was called to order at 7:04 p.m.
with President Kathleen McIntyre presiding. The Public Hearing is now open for
comments. Please state clearly your name and address before making your comments.
McIntyre: All right, we call the Public Hearing to order. And we will note that Miss
Miller-Brosnan--Council Member Miller-Brosnan is not able to be with us

this evening. This evenings Public Hearing is on subject of a proposed
special assessment street lighting project. This comes to us from the
Department of Assessment for the Mystic Creek Site Condominiums
located east of Wayne Road and south of Curtis Road in the Southeast ¼
of Section 9. And this is for the establishment of an assessment roll. Mr.
Zilincik, I understand that you are going to represent the petitioner this
evening because the petitioner had some extenuating family
circumstances and the petitioner would be Mr. Leo Soave. So I--
Zilincik: Thank you Madame President and City Council Members, that is correct.
I’ll just give you a brief background on Mystic Creek street lighting. As you
are aware, DTE recommended four street lights, 71 watt LED on 14 foot
high fiberglass posts. There’s a total of 13 lots for the subdivision and the
developer had provided $17,000.00 in contribution to aid of which the total
cost estimated by DTE would $13,965.00 of which the balance would go
back to the developer upon completion if approved. Therefore, the 13 lots
are estimating a total cost per year for the first year of $100.27 and the
subsequent years estimated at $94.77. Therefore, we’re seeking based
on that--based on the number for the hearing on roll--we’re seeking your
approval to move forward as the development right now Petitioner Leo
Soave owns all the lots for that development and it’s--I believe only one
house is currently under construction on the north-east corner of Wayne
and Milana Drive. At this time, all the lots are owned by the petitioner and
he had extenuating circumstances tonight and confirmed that he’s okay

with the numbers provided based on DTE’s estimate back on August 21,
2017. Thank you.
McIntyre: Thank you, Mr. Zilincik. Council.
Bahr: One question.
McIntyre: Mr. Bahr.
Bahr: So, when you say $107.00--$94.00 (sic) is that total for all or per house?
Zilincik: Per house would be a $100.27 for the first year and then it drops down to
$94.77 estimated.
Meakin: Move for approval.
McIntyre: Miss White.
White: Just a question. Todd, can you remind how many lights are going in?
Zilincik: Yeah, there’s a total of four 71 watt LED lights--colonial lights. I know
there’s concerns with some of the surrounding neighborhoods with the

lights that may be too bright. As you know on Wayne Road and to the
south at Nottingham Woods those lights are a little bit more wattage at
150 to 175 watts and these are 71 watt LED lights. So hopefully concerns
of the neighbors, I think the developer and with the DTE recommendation
those will be--you know--not an issue with the proposed lights that we are
doing this evening.
White: Okay, thank you.
Zilincik: You’re welcome.
McIntyre: Anything else. We have Council Member Meakin has moved an
approving resolution--offered an approving resolution, correct.
Meakin: To establish an assessment or no it’s to establishing the roll.
McIntyre: Establishing the roll. All right anyone else? Would anyone from the
audience or the public like to speak on this subject. All right, seeing none,
I would like to inform everyone this item will be on the agenda with the

next regular meeting and that is--will be held on Monday, December 4,
2017.
As there were no further questions or comments, the Public Hearing was
declared closed at 7:08 p.m.
