MEMBERS PRESENT: Laura Toy, President Jim Jolly, Vice President Scott Bahr Brandon Kritzman Kathleen McIntyre Brian Meakin Cathy K. White MEMBERS ABSENT: None OTHERS PRESENT: Mark Taormina, Director of Economic Development Mike Fisher, Assistant City Attorney Marilyn Mootsey, Public Hearing Recorder The Public Hearing was called to order at 7:27 p.m. with President Laura Toy presiding. This is a Public Hearing relative to a request for a change of zoning within the City of Livonia on the following matter: Petition 2018-04-06-01, submitted by the City Planning Commission, pursuant to Council Resolution #145-18, and Section 23.01(a) of Zoning Ordinance No. 543, as amended, proposing to amend Sections 9.03(j) of Article IX and Section 10.03(d) of Article X in order to remove the requirement for the written consent of fifty-five (55) percent of the residential property owners within a four hundred (400) foot radius of the property lines of the proposed day care nursery as part of waiver use approval for day care nurseries in OS or Office Services and C-1 Zoning Districts. The public hearing is now open for comments. There were two people in the audience. Toy: Mr. Taormina? Taormina: I think the description is self-explanatory, this is actually something that was discussed in connection with a recent petition involving a child care center. This change will effect both the OS and the C-1 District regulations removing that requirement of written consent of 55 percent of the residential property owners within a 400 foot radius of any proposed child day care facility, basically making this requirement no longer necessary since we do advertise to everyone within 300 feet of the 2 property and also we publish it in the newspaper. The Planning Commission is recommending the approval of this change. Toy: Vice-President Jolly. Jolly: Madam President, I believe this came out in one of our meetings, an item that we recently reviewed in the last couple months, I think it’s appropriate and I’ll offer the approving resolution. Toy: Thank you. Council Vice-President Jolly offered an approving resolution. Councilwoman McIntyre. McIntyre: I would support Mr. Jolly in offering the approving resolution. I think anything we can do that’s reasonable and doesn’t hurt our residents or the quality of our neighborhoods, that encourages people to become licensed day car providers is in the best interest of the kids who are served here and I think overall for our community. Toy: Thank you Councilwoman McIntyre. Any others? Seeing none, anyone in the audience? We stand adjourned. As there were no further questions or comments, the Public Hearing was declared closed at 7:30 p.m. SUSAN M. NASH, CITY CLERK
