HomeMy WebLinkAboutSYNOPSIS - 2019-02-25 th SYNOPSIS OF THE MINUTES OF THE 1,867 REGULAR MEETING LIVONIA CITY COUNCIL – FEBRUARY 25, 2019 ______________________________________________________________________ Meeting was called to order at 7:00 p.m. by President Toy. Present: Brandon Kritzman, Scott Bahr, Cathy White, Kathleen McIntyre, Brian Meakin, Jim Jolly, and Laura Toy. Absent: None. #47-19 Resolution by Jolly and White, unanimously adopted, approving the minutes th of the 1,866Regular Meeting of the Council held February 11, 2019. Councilmember Bahr presented a commendation to Livonia Youth Symphony Orchestra th for their 60 Anniversary. Councilmember McIntyre indicated many individuals were honored at the Livonia Chamber of Commerce and Observer Awards Night and shared the list of honorees. President Toy indicated the Rotary Awards Night was being hosted at the Robert and Janet Bennett Civic Center Library. Treasurer Lynda Scheel reminded residents taxes can be paid through Thursday, th February 28 without interest or penalty. AUDIENCE COMMUNICATION Doris Nowicki addressed Council to express her concerns re: party hosted on St. Patrick’s Day at O’Malley’s Bar and Grill. The following items were received and filed: Communication from the Historic Preservation Commission, dated February 21, 2019, re: the Orson Everitt House located at 39040 W. Seven Mile regarding rezoning petition th submitted by 18 Street Development, L.L.C. (Petition 2018-10-01-08) Communication from Stephen R. Estey, Dykema Gossett PLLC, dated February 20, 2019, re: Conditional Rezoning Agreement as signed by Developer and Owner of the th property regarding rezoning petition submitted by 18 Street Development, L.L.C. (Petition 2018-10-01-08) Communication from Stephen R. Estey, Dykema Gossett PLLC, dated February 14, 2019, re: proposed unsigned Conditional Rezoning Agreement of the property regarding th rezoning petition submitted by 18 Street Development, L.L.C. (Petition 2018-10-01-08) Communication received from the Historic Preservation Commission, dated February 21, 2019, re: the Orson Everitt House located at 39040 W. (Petition 2019-01-08-01) Communication received from the Director of Emergency Preparedness and Homeland Security, dated February 14, 2019, re: request for authorization to purchase one federal signal emergency warning siren without competitive bidding. th SYNOPSIS OF THE MINUTES OF THE 1,867 REGULAR MEETING 2 LIVONIA CITY COUNCIL – FEBRUARY 25, 2019 The following resolutions were offered by Jolly and Bahr: #48-19 Approving appointment of James C. MCann to the Board of Ethics for a three-year term which will expire on March 1, 2022. #49-19 Approving reappointment of Richard W. McDowell to the Board of Ethics for a three-year term which will expire on March 1, 2022. #50-19 Approving final budget adjustments for fiscal year ending November 30, 2018, as requested by the Department of Finance. #51-19 Approving purchase of (15) Kenwood P25 two-way radios for Public Service Division, from budgeted funds. #52-19 Informal approval of proposed program and tentative budget for 2019-2020 Community Development Block Grant (CDBG) Program as requested by Housing Commission. #53-19 Approved purchase of (1) 2019 Ford F250 Super Cab 4X4 Pick-up truck for use by Engineering Division, to replace vehicle from that Department, from budgeted funds. #54-19 Approved waiver of formal bidding process and 2019 Concrete Road Repair Program by extending Contract 18-C unit prices with Hard Rock Concrete in the amount not to exceed $4,300,000.00 for one year. (CR 130-18) #55-19 Approved contract with MDOT for resurfacing of Ann Arbor Trail from Eckles Road easterly to Newburgh Road, with the City’s participation to be $176,200.00 from budgeted funds. #56-19 Approved vacating request for storm sewer easement within the Image First property located at 31500 Pamco Drive. #57-19 Approved one-year extension of site plan approval submitted by Tiseo Architects, Inc. re: to develop property located on east side of Merriman Road between Plymouth Road and the CSX railroad right-of-way (12350 Merriman Road). (Petition 2017-09-02-12; CR 413-17 and CR 414-17) #58-19 Approved one-year extension of site plan approval submitted by Tiseo Architects, Inc. re: to develop property located on the east side of Merriman Road between Plymouth Road and the CSX railroad right-of-way (12350 Merriman Road). (Petition 2017-09-02-13; CR 415-17 and CR 416-17) A roll call vote was taken on the foregoing resolutions with the following result: AYES: Kritzman, Bahr, White, McIntyre, Meakin, Jolly, and Toy. NAYES: None. Jolly gave First Reading to the following Ordinance: th SYNOPSIS OF THE MINUTES OF THE 1,867 REGULAR MEETING 3 LIVONIA CITY COUNCIL – FEBRUARY 25, 2019 AN ORDINANCE AMENDING SECTION 040 TO TITLE 2, CHAPTER 60 (HOUSING COMMISSION) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. Meakin gave First Reading to the following Ordinance: AN ORDINANCE VACATING THE USE OF PORTIONS OF STREET, ALLEY AND PUBLIC GROUND. (Petition 2018-09-03-01) Kritzman gave First Reading to the following Ordinance: AN ORDINANCE AMENDING SECTION 4 OF THE ZONING MAP OF THE CITY OF LIVONIA AND AMENDING ARTICLE III OF ORDINANCE NO. 543, AS AMENDED, KNOWN AND CITED AS “THE CITY OF LIVONIA ZONING ORDINANCE” BY ADDING SECTION 3._____ THERETO. (Petition 2018-08-01-05) McIntyre gave First Reading to the following Ordinance: AN ORDINANCE VACATING THE USE OF PORTIONS OF STREET, ALLEY AND PUBLIC GROUND. (Petition 2018-12-03-02) White gave First Reading to the following Ordinance: AN ORDINANCE VACATING THE USE OF PORTIONS OF STREET, ALLEY AND PUBLIC GROUND. (Petition 2018-12-03-03) Meakin gave First Reading to the following Ordinance: AN ORDINANCE VACATING THE USE OF PORTIONS OF STREET, ALLEY AND PUBLIC GROUND. (Petition 2018-12-03-04) Kritzman gave First Reading to the following Ordinance: AN ORDINANCE VACATING THE USE OF PORTIONS OF STREET, ALLEY AND PUBLIC GROUND. (Petition 2018-12-03-05) White gave Second Reading to the following Ordinance: AN ORDINANCE AMENDING SECTION 010 OF TITLE 12, CHAPTER 16 (PARKS AND PLAYGROUNDS) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. A roll call vote was taken on the foregoing Ordinance with the following result: AYES: Kritzman, Bahr, White, McIntyre, Meakin, Jolly, and Toy. NAYES: None. Meakin gave Second Reading to the following Ordinance: th SYNOPSIS OF THE MINUTES OF THE 1,867 REGULAR MEETING 4 LIVONIA CITY COUNCIL – FEBRUARY 25, 2019 AN ORDINANCE AMENDING SECTION 6 OF THE ZONING MAP OF THE CITY OF LIVONIA AND AMENDING ARTICLE III OF ORDINANCE NO. 543, AS AMENDED, KNOWN AND CITED AS “THE CITY OF LIVONIA ZONING ORDINANCE” BY ADDING SECTION 3.____ THERETO. (Petition 2018-10-01-08) A roll call vote was taken on the foregoing Ordinance with the following result: AYES: Kritzman, Bahr, White, McIntyre, Meakin, Jolly, and Toy. NAYES: None. #59-19 Motion by Meakin and Kritzman, unanimously adopted, approving site plan th petition submitted by 18 Street Development, L.L.C. to construct a professional/medical office building located at 39000 Seven Mile Road, subject to conditions. (Petition 2019- 01-08-01) #60-19 Motion by Meakin and Jolly, unanimously adopted, awarding bid for construction management services contract for the new DPW Administration Offices and Water & Sewer Building, from Unexpended Fund Balance. #61-19 Motion by Jolly and White, unanimously adopted, approving purchase of one federal emergency warning siren with electronic speaker capabilities without competitive bidding, from budgeted funds. Councilmember Meakin stepped down from the podium at 7:45 p.m. #62-19 Motion by Kritzman and McIntyre, approving waiver petition submitted by Maya Enterprises, Inc. to operate a full-service restaurant (Maya Cocina Mexicana) at 33018 Seven Mile, subject to conditions. (Petition 2018-12-02-22) A roll call vote was taken on the foregoing resolution with the following result: AYES: Kritzman, Bahr, White, McIntyre, Jolly, and Toy. NAYES: None. #63-19 Motion by Kritzman and McIntyre, approving modification of the requirement in the C-1 zoning waiver that restricts seating capacity of a restaurant re: waiver use approval of Maya Cocina Mexicana at 33018 Seven Mile. (Petition 2018-12-02-22) A roll call vote was taken on the foregoing resolution with the following result: AYES: Kritzman, Bahr, White, McIntyre, Jolly, and Toy. NAYES: None. #64-19 Motion by Kritzman and McIntyre, approving waiver use petition re: Maya Cocina Mexicana at 33018 Seven Mile to utilize a Class C liquor license. (Petition 2018- 12-02-21) A roll call vote was taken on the foregoing resolution with the following result: AYES: Kritzman, Bahr, White, McIntyre, Jolly, and Toy. NAYES: None. th SYNOPSIS OF THE MINUTES OF THE 1,867 REGULAR MEETING 5 LIVONIA CITY COUNCIL – FEBRUARY 25, 2019 #65-19 Motion by Kritzman and McIntyre, approving waiving 1,000-foot separation requirement from existing Class C licensed businesses re: waiver use petition for Maya Cocina Mexicana at 33018 Seven Mile. (Petition 2018-12-02-21) A roll call vote was taken on the foregoing resolution with the following result: AYES: Kritzman, Bahr, White, McIntyre, Jolly, and Toy. NAYES: None. #66-19 Motion by Kritzman and McIntyre, approving waiving 400-foot separation requirement from any church or school building to use Class C liquor license at Cocina Mexicana at 33018 Seven Mile. (Petition 2018-12-02-21) A roll call vote was taken on the foregoing resolution with the following result: AYES: Kritzman, Bahr, White, McIntyre, Jolly, and Toy. NAYES: None. Meakin returned to the podium at 7:50 p.m. #67-19 Motion by Kritzman and Jolly, unanimously adopted, approving sale of City- owned property for $37,000.00 located at 28024 Joy Road.
