LIVONIA CITY COUNCIL — SEPTEMBER 09, 2020
Meeting was held via Zoom and called to order at 7:00 p.m. by President McIntyre.
Present: Laura Toy, Scott Bahr, Cathy White, Brandon McCullough, Rob Donovic, Jim
Jolly, and Kathleen McIntyre. Absent: None.
#248-20 Resolution by Bahr and White, unanimously adopted, approving the
minutes of the 1,903rd Regular Meeting of the Council held August 17, 2020.
Councilmember Jolly wished his wife Katie a Happy Birthday and Happy Anniversary.
Councilmember McCullough wished good luck to the students and teachers starting back
to school.
Councilmember Jolly announced the retirement of Karen Worley, Program Supervisor in
the Engineering Department and Susan Bastian, Program Supervisor in Community
Resources.
President McIntyre announced two (2) Public Hearings to be held on September 28 2020
via Zoom remote technology on the following matters:
Petition 2020-07-01-03 submitted by Leo Soave Building Company, Inc., pursuant
to Section 23.01 of the City of Livonia Zoning Ordinance #543, as amended,
requesting to rezone the property at 37855 Lyndon Avenue (former Webster
Elementary School site), located on the south side of Lyndon Avenue between
Newburgh and Hix Road, in the Southeast '/4 of Section 19, from PL (Public Land)
to R-1, (One Family Residential — 60' x 120' Lots).
Petition 2020-07-06-01 submitted by the City Planning Commission, pursuant to
Council Resolution 170-20 and Section 23.01(a) of the Livonia Zoning Ordinance
No. 543, as amended, proposing to amend Sections 2.10 of Article II, 4.12 of
Article IV, 5.15 of Article V, and 16.02 of Article XVI, to define "caregiver grow
facility" and regulate the zoning districts where medical marijuana facilities can
operate.
And one (1) Public Hearing being held October 7, 2020 at 7:00 p.m. via Zoom:
The City of Livonia will hold a Public Hearing on Wednesday, October 7, 2020 at
7:00 P.M., via zoom, for the purpose of hearing written and oral comment from the
public concerning the proposed annual budget for the fiscal year 2020 - 2021. All
interested citizens, groups, senior citizens and organizations representing the
interests of senior citizens are encouraged to attend and submit comments.
She then stated there will be one X-Item that will be heard at the end of the Regular
Agenda and New Data on Item No. 8 and Item No. X-1.
Councilmember White reviewed the rules of order for Audience Communication.

AUDIENCE COMMUNICATION Several individuals spoke about perceived racism and
protest problems at Planned Parenthood.
The following items were received and filed:
The 2020 Assessment Data booklet from City Assessor dated June 1, 2020.
An email communication from Sonny Wilkins, VP Municipal Relations, Simple Recycling,
dated August 19, 2020.
The following resolutions were offered by Jolly and McCullough:
#250-20 Approving additional appropriation and expenditure to WT Group for ADA
Facility Audits and accepting grant from Healthy Livonia and authorizing Mayor and Clerk
to execute contract with WT Group.
#251-20 Authorizing purchase of one (1) 2021 Ford Transit Connect Van to replace
2008 Ford Escape currently used in Clerk's Office, from budgeted funds.
#252-20 Approving additional appropriation and expenditure to NTH Consultants,
LTD., for environmental engineering services related to City's landfill.
#253-20 Authorizing amendment to contract with OHM Advisors in connection with
the AWIA Risk & Resilience Assessment and Emergency Response Plan (ERP).
#254-20 Authorizing release of Entrance Markers/Landscaping and Monuments and
Marker Bonds to Leo Soave Building Company for Livonia Manor II Site Condominiums.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: Toy, Bahr, White, McCullough, Donovic, Jolly and McIntyre
NAYS: None
#255-20 Motion by Bahr and Jolly, unanimously adopted, to take no further action
regarding matter of five-year budget process for City.
#256-20 Motion by Toy and Jolly, unanimously adopted, approving lot split and
combination of property located in the Northeast '/4 of Section 35 and waive lot width
depth. (Petition 2019-09-LS-18)
#257-20 Motion by Jolly and Toy referring the City's 2020-2023 Simple Recycling
Contract to Committee of the Whole.
A roll call vote was taken on the foregoing resolution with the following result:
AYES: Toy, Bahr, White, McCollough, Donovic, and Jolly
NAYS: None
The President declared the resolution adopted.
#258-20 Motion by Jolly and White, unanimously adopted, concurring in rules and
regulations of Industrial Pretreatment Program as adopted by Great Lakes Water
Authority.

#259-20 Motion by White and Toy, unanimously adopted, authorizing settlement of
claims by Christopher Lee Murray-Bey, US District Court Case No. 14-13743, in the
amount of$260,000.00.
#260-20 Motion by Toy and Jolly, unanimously adopted, suspending rules for
procedure.
#261-20 Motion by Toy and Jolly, unanimously adopted, confirming appointment of
Michael A. Testa to the Zoning Board of Appeals, effective immediately with term ending
July 12, 2023.
#262-20 Motion by Bahr and Donovic, unanimously adopted, referring the matter of
the organizational restructuring of City Council Office to the Administration and
Department of Law.
AUDIENCE COMMUNICATION Several individuals discussed perceived racism in the
City and the subject of creating a Police Oversight Board.
By McCullough and Jolly, unanimously adopted, adjourned this 1,904th Regular Meeting
of the Council of the City of Livonia at 9:12 p.m. on September 9, 2020.
