HomeMy WebLinkAboutMinutes 10162023 (CR# 311-23 to #325-23) On October 16, 2023, the above meeting was held at the City Hall, 33000 Civic Center Drive, Livonia, Michigan, and was called to order by the President of the Council at 7:00 p.m. Councilmember Donovic led the meeting with the Pledge of Allegiance. Roll was called with the following result: Rob Donovic, Scott Morgan, Brandon McCullough, Kathleen McIntyre, Laura Toy, Scott Bahr, and Jim Jolly. Absent: None Elected and appointed officials present: Paul Bernier, City Attorney; Susan M. Nash, City Clerk; Sara Kasprowicz, Program Supervisor of Council Office; Mark Taormina, Director of Planning and Economic Development; and Todd Zilincik, City Engineer. On a motion by Councilmember McCullough, supported by Councilmember Donovic, and unanimously adopted, it was: #311-23 RESOLVED, that the Minutes of the 1,978th Regular Meeting of the Council held October 2, 2023 are approved as presented. On a motion by Vice President Toy, supported by Councilmember Donovic, and unanimously adopted it was: #312-23 Motion to revise Minutes from the 1977TH Regular Meeting of the Council Held September 18, 2023 and adopted at the 1978th Regular Meeting of the Council Held October 2, 2023, nunc pro tunc, to include verbiage that the Notice of Sale Resolution Water Supply and Wastewater System Revenue Bonds, Series 2023, attached to the Revenue Bond, is approved for certification by the Livonia City Clerk. Christopher Martin, Michigan resident, spoke about restoration of free speech at Council Meetings. He also spoke about the candidates running for City Clerk in the November election. Margaret Erle, 31545 Pembroke Street, thanked DPW for their quick response to her call for tree service. She also thanked the Greenmead employees and volunteers that worked on the Highland Tea Program. President Jolly announced that there would be an “X” item at the end of tonight’s meeting regarding the request to approve an Intergovernmental Agreement with Wayne County for partial funding of Project Catalyst: Livonia Senior Wellness Center Project. President Jolly also wished Casey O’Neil, Information Services Director, a happy birthday. Vice President Toy asked for a moment of silence in honor of the passing of Mary Galasso from the Italian American Club and former Police Chaplain Sister Ann Stamm. Councilmember McIntyre thanked Livonia Fire Department and the Cert volunteers for the fantastic Fire Safety Open House. She also congratulated Jim Davis and Dave Lumley on completing the Detroit Free Press Marathon. Councilmember Donovic thanked Lynda Scheel for her years of service and dedication to the City of Livonia. He also commended the Police Department for the recent Faith and Blue event. Councilmember Bahr congratulated the Livonia Alliance Soccer team on winning their game. He also spoke about the timing of the City of Livonia magazine’s release before the upcoming election. He requested the issue of precluding mailings within a certain period before an election without disclosures be put on the next Study meeting. Vice President Toy also spoke about mailings and elections. Councilmember McCullough invited people to attend the Kiwanis Pancake Breakfast at Greenmead next Sunday. He also congratulated the 10 U Livonia Knights girls hockey team on participating in a shoot out at the Detroit Red Wing game during intermission. Councilmember Morgan asked everyone to be careful on Halloween to allow for a happy and safe holiday for all. A communication from Jeffrey Bunker, Clarenceville School District, dated June 8, 2023, requesting the City continue to collect the district's taxes for the year 2023 was received and placed on file for the information of the Council. A communication from Brian D. Broderick, Schoolcraft College, dated May 24, 2023, requesting the City continue to collect taxes for the year 2023. A communication from the Department of Finance, dated September 29, 2023, re: forwarding Quarterly Investment Report for the City of Livonia for the quarter ending August 31, 2023. On a motion by Councilmember Morgan, supported by Councilmember McCullough it was: #313-23 RESOLVED, that having considered an application from Michael Hudzik, dated September 13, 2023, requesting permission to waive Section 8.32.070 (Noise Control) of the Livonia Code of Ordinances, as amended, in order to host a surprise birthday party with a live band at his home located at 32974 Grennada St., scheduled for Saturday, October 21, 2023, from 6:00 p.m. until 11:00 p.m., the Council does hereby determine to waive Section 8.32.070 (Noise Control) of the Livonia Code of Ordinances between the hours of 6:00 p.m. and 11:00 p.m. in connection with this event to be held on Saturday, October 21, 2023. #314-23 RESOLVED, that having considered a communication from the Fire Chief, dated September 20, 2023, which bears the signatures of the Director of Finance and the City Attorney, and is approved for submission by the Mayor, the Council does hereby authorize the purchase and installation of five (5) Unimac UYT030 commercial washer/extractors from Universal Laundry Machinery, 38700 Webb Drive, Westland, MI 48185, to include all labor for the installation, plus removal and proper disposal of existing extractors at time of delivery to five (5) Livonia Fire & Rescue Stations located at: Fire Station 1 14910 Farmington Road, Livonia, MI 48154 Fire Station 3 35500 Seven Mile Road, Livonia, MI 48152 Fire Station 4 12300 Middlebelt Road, Livonia, MI 48150 Fire Station 5 18910 Middlebelt Road, Livonia, MI 48152 Fire Station 6 37876 Plymouth Road, Livonia, MI 48150 in a total amount not to exceed $47,350.00; the same having been in fact the second lowest bid received which meets all specifications; FURTHER, the Council does hereby reject the bid submitted by A.L.L. Lakeside Laundry Service due to unacceptable exceptions listed in its bid proposal (not comparable brand); FURTHER, an amount not to exceed $47,350.00 is hereby authorized to be expended from funds budgeted in Account No. 401-000-976-000 for this purpose; and the Mayor and City Clerk are hereby authorized to execute a contract, subject to approval as to form and substance by the Department of Law, for and on behalf of the City of Livonia with the aforesaid bidder and to do all other things necessary or incidental to the full performance of this resolution. #315-23 RESOLVED, that having considered a communication from the Fire Chief, dated September 20, 2023, which bears the signatures of the Director of Finance and the City Attorney, and is approved for submission by the Mayor, the Council does hereby authorize the purchase and installation of twenty-four (24) commercial garage door openers (new-unused), Lift-Master model T-50 heavy duty trolley operators, 115 volt ½ hp external coaxial antenna, from Jan Door, 14351 W. Warren, Dearborn, MI 48126, to include all labor for the installation, plus removal and proper disposal of existing door openers at time of installation of the new equipment at five (5) Livonia Fire & Rescue Stations located at: Fire Station 1 14910 Farmington Road, Livonia, MI 48154 (six (6) openers) Fire Station 3 35500 Seven Mile Road, Livonia, MI 48152 (six (6) openers) Fire Station 4 12300 Middlebelt Road, Livonia, MI 48150 (four (4) openers) Fire Station 5 18910 Middlebelt Road, Livonia, MI 48152 (four (4) openers) Fire Station 6 37876 Plymouth Road, Livonia, MI 48150 (four (4) openers) in a total amount not to exceed $34,800.00; the same having been in fact the lowest bid received which meets all specifications; FURTHER, an amount not to exceed $34,800.00 is hereby authorized to be expended from funds budgeted in Account No. 401-000-976-000 for this purpose; and the Mayor and City Clerk are hereby authorized to execute a contract, subject to approval as to form and substance by the Department of Law, for and on behalf of the City of Livonia with the aforesaid bidder and to do all other things necessary or incidental to the full performance of this resolution. #316-23 RESOLVED, that having considered the report and recommendation of the Superintendent of Parks and Recreation, dated September 13, 2023, which bears the signatures of the Director of Finance and the City Attorney, and is approved for submission by the Mayor, the Council does hereby approve and authorize continued use of CivicRec software, a Division of CivicPlus, 302 S. 4th Street, Suite 500, Manhattan, KS 66502, for cloud based recreation management software and support, pursuant to the statement of work approved by CR 412-18, adopted on December 3, 2018, in an amount not to exceed 1.25% of estimated Client processing, up to $3,500,000 of revenue per year, through the CivicRec system (not including scholarships or donations) to be expended from funds budgeted for FY 2023-2024 in Account No: 208-755-851-020 for this purpose; FURTHER, the Statement of Work shall remain in effect for an initial term of one year from signing, and shall renew for additional one year renewal terms if neither party gives 60 days’ notice prior to the end of an initial or subsequent renewal term; FURTHER, the Council does hereby authorize such action without competitive bidding for the reasons indicated in the aforesaid communication, and such action is taken in accordance with Section 3.04.140.E.3 of the Livonia Code of Ordinances, as amended. A roll call vote was taken on the foregoing resolutions with the following result: AYES: Donovic, Morgan, McCullough, McIntyre, Toy, Bahr, and Jolly. NAYS: None Councilmember Bahr reported on Finance and Budget Committee meeting of September 20, 2023. The City of Livonia Preliminary Budget Documents for Fiscal Year 2023-2024, received on September 15, 2023, was received and placed on file for the information of the Council. The Supplement to Preliminary Budget 2023-2024 Personnel Worksheets, received on September 15, 2023, were received and placed on file for the information of the Council. Christopher Martin, Michigan resident, spoke about past budgets. On a motion by Councilmember Bahr, supported by Councilmember McIntyre and unanimously adopted it was: #317-23 RESOLVED, that the Council hereby determines that the annual budget for the fiscal year as submitted by the Mayor for the next fiscal year commencing December 1, 2023, and ending November 30, 2024, as shown below, submitted by the Mayor to the Council on September 15, 2023, pursuant to Section 3, Chapter VII of the City Charter, be and hereby is determined and adopted. Council approval is required for any modification to the amounts shown below. All proceedings on said Budget are hereby approved as being in full conformance with the City Charter, a public hearing having been held on October 4, 2023, after proper notice being published in the Detroit Legal News, the official newspaper of the City, on September 22, 2023, and provided further that the City Clerk shall publish or cause to be published this resolution together with a summary of said Budget as adopted herein, together with the minutes of this meeting. HOUSING 538 750,780 724,020 GOLF COURSE 584 2,289,051 2,496,103 WATER AND SEWER 592 45,909,967 44,645,523 TOTAL ENTERPRISE FUNDS $49,849,998 $48,967,510 #318-23 RESOLVED, that pursuant to Section 5, Chapter VII and Section 1 of Chapter VIII of the Charter of the City of Livonia, the Council does hereby establish a tax levy of 3.9709 mills, of the taxable valuation of all real and personal property subject to taxation in the City of Livonia for the next fiscal year commencing December 1, 2023, and ending November 30, 2024, and in addition to the above amount which is authorized to be levied for general purposes by the Charter of the City of Livonia: (a) The Council does hereby establish a tax levy of .7939 mills, of the Taxable Valuation of all real and personal property subject to taxation in the City of Livonia for the fiscal year set out above, pursuant to Section 1 of Chapter VIII of the Charter of the City of Livonia, for the purpose of providing additional revenues for police protection and law enforcement personnel, equipment, supplies and facilities of the City of Livonia; in addition to the amount authorized to be levied for general municipal purposes; (b) The Council does hereby establish a tax levy of 1.1911 mills, of the Taxable Valuation of all real and personal property subject to taxation in the City of Livonia for the fiscal year set out above, pursuant to Section 1 of Chapter VIII of the Charter of the City of Livonia, for the purpose of providing additional revenues for fire, police and snow removal personnel, equipment, supplies and facilities of the City of Livonia; in addition to the amount authorized to be levied for general municipal purposes; (c) The Council does hereby establish a tax levy of 1.6689 mills, of the Taxable Valuation of all real and personal property subject to taxation in the City of Livonia for the fiscal year set out above, pursuant to Section 1 of Chapter VIII of the Charter of the City of Livonia, for the purpose of providing additional revenues for police and fire personnel and support costs in the City of Livonia, in addition to the amount authorized to be levied for general municipal purposes; (d) The Council does hereby establish a tax levy of .7939 mills, of the Taxable Valuation of all real and personal property subject to taxation in the City of Livonia for the fiscal year set out above, pursuant to Section 1 of Chapter VIII of the Charter of the City of Livonia, for the purpose of providing additional revenues for library services, supplies and facilities in the City of Livonia; in addition to the amount authorized to be levied for general municipal purposes; (e) The Council does hereby establish a tax levy of .0099 mills, of the Taxable Valuation of all real and personal property subject to taxation in the City of Livonia for the fiscal year set out above, pursuant to the provisions of Act 359 of the Public Acts of 1925, for the purpose of advertising, exploiting and making known the industrial and commercial advantages of the City of Livonia and to establish projects for the purpose of encouraging immigration to, and increasing the trade, business and industries of the City of Livonia; in addition to the amount which is authorized to be levied for general municipal purposes; (f) The Council does hereby establish a tax levy of .7710 mills of the Taxable Valuation of all real and personal property subject to taxation in the City of Livonia for the fiscal year set out above, for the purpose of providing additional revenues for a community recreation center, recreation personnel, equipment, supplies, facilities and operations; in addition to the amount authorized to be levied for general municipal purposes; (g) The Council does hereby establish a tax levy of .8729 mills of the Taxable Valuation of all real and personal property subject to taxation in the City of Livonia for the fiscal year set out above, for the purpose of providing additional revenues for repairing or replacing public roads, sidewalks and trees in the City of Livonia; in addition to the amount to be levied for general municipal purposes; (h) The Council does hereby establish a tax levy of .4907 mills of the Taxable Valuation of all real and personal property subject to taxation in the City of Livonia for the fiscal year set out above, for the purpose of providing additional revenues for the City’s community transit program and capital improvements within the City of Livonia; in addition to the amount to be levied for general municipal purposes; (i) The Council does hereby establish a tax levy of .2452 mills, of the Taxable Valuation of all ready and personal property subject to taxation in the City of Livonia for the fiscal year set out above, pursuant to Section 1 of Chapter VIII of the Charter of the City of Livonia, for the purpose of providing additional revenues for staff, maintenance, and; support costs for cultural and senior services in the City, including the Livonia Senior Center and Greenmead Historical Village, in addition to the amount authorized to be levied for general municipal purposes; (j) The Council does hereby establish a tax levy of 1.8823 mills, of the Taxable Valuation of all real and personal property subject to taxation in the City of Livonia for the fiscal year commencing December 1, 2023 and ending November 30, 2024, pursuant to the provisions of Act 298 of the Public Acts of 1917, for the purpose of establishing, operating, maintaining and administering the Municipal Garbage Collection System and/or plant for the collection and disposal of garbage and refuse in the City of Livonia; in addition to the amount authorized to be levied for general municipal purposes; (k) The Council does hereby establish a tax levy of .4867 mills of the Taxable Valuation of all real and personal property subject to taxation in the City of Livonia for the fiscal year commencing December 1, 2023 and ending November 30, 2024, for the purpose of defraying City expenses and liabilities for the collection and disposal activities required for curbside recycling and yard waste composting programs; in addition to the amount authorized to be levied for general municipal purposes; (l) The Council does hereby establish a tax levy of 2.0000 mills to be due and payable on July 1, 2024, of the Taxable Valuation of all real and personal property located within the Plymouth Road Development Authority, subject to taxation in the City of Livonia for the fiscal year commencing December 1, 2023 and ending November 30, 2024, pursuant to the provisions of Act 197 of the Public Acts of 1975, for the purpose of providing revenues for obligations and operations of the Plymouth Road Development Authority, in addition to the amount to be levied for general municipal purposes. This millage shall be effective provided that all residential properties are first removed from the Plymouth Road Development Authority district; AND PROVIDED FURTHER, that the Wayne County Bureau of Taxation, City Assessor, City Treasurer and City Clerk are hereby authorized and directed to do all things necessary or incidental to the full performance of this resolution, and the City Clerk is hereby requested to immediately transmit copies of this resolution to each of the above offices. These items will remain in the Committee. President Jolly reported on the Committee of the Whole meeting held on October 4, 2023, regarding an update from the Administration on the efforts to seek grants and other funding for the new Senior Center. This item will remain in Committee. On a motion by Councilmember Bahr, supported by Vice President Toy, it was: RESOLVED, that having considered an application from Visar Gjetaj, dated September 13, 2023, requesting permission to close Mallory Drive, between Six Mile and Newburgh Roads, on Tuesday, October 31, 2023, from 4:00 p.m. until 10:00 p.m., for the purpose of hosting trick or treating, the Council does hereby grant permission as requested, the action taken herein being made subject to the approval of the Police Department. After discussion by the Council the motion was withdrawn due to the petitioner not being present. On a motion by Councilmember McIntyre, supported by Councilmember McCullough and unanimously adopted, it was: #319-23 RESOLVED, that having considered a communication from the City Planning Commission, dated August 31, 2023, approved for submission by the Mayor, which transmits its resolution #08-58-2023, adopted on August 29, 2023, with regard to Petition 2023-07-02-11 submitted by The Mannik & Smith Group, Inc., requesting waiver use approval to demolish an existing restaurant (Burger King) and construct a new automated car wash facility (Clean Express Auto Wash), at 34835 Plymouth Road, located on the south side of Plymouth Road between Stark and Wayne Roads in the Northwest ¼ of Section 33, and email communications from the City Treasurer, dated September 18, 2023 and October 2, 2023, regarding delinquent property taxes due for 34835 Plymouth Road, and a further email communication from Jake Rilett, Project Engineer, The Mannik & Smith Group, Inc., dated October 3, 2023, forwarding a receipt for payment in full of the delinquent property taxes, the Council does hereby concur in the recommendation made by the City Planning Commission and Petition 2023-07-02-11 is hereby approved and granted, subject to the following conditions: The hours of operation shall be limited to the following: Monday through Saturday from 7:00 a.m. to 8:00 p.m. and Sunday from 9:00 a.m. to 6:00 p.m.; The Landscape Plan identified as L100, and Landscape Notes & Details identified as L101, both dated August 21, 2023, prepared by Mannik Smith Group, are approved and shall be adhered to; The Plymouth Road Development Authority (PRDA) streetscape improvements (i.e., brick piers and fencing) shall be installed along Plymouth Road to the satisfaction of the Planning Director; All disturbed lawn areas, including road rights-of-way, shall be sodded instead of hydroseeding; 5.    Underground sprinklers shall be installed for all landscaped and sodded areas. All planted materials shall be installed to the satisfaction of the Inspection Department and permanently maintained in a healthy condition; The Exterior Elevations Plan, identified as A2-1, dated May 17, 2023, prepared by SBA Studios, is approved and shall be adhered to; 7.   All rooftop mechanical equipment shall be concealed from public view on all sides by screening, consisting of material compatible in color with other exterior materials on the building; 8. The three walls of the trash dumpster area shall be constructed out of building materials that complement the building, and the enclosure gates shall consist of opaque and durable steel or composite panels; 9.   All light fixtures shall not exceed a height of twenty feet (20’) and shall be aimed and shielded to minimize stray light trespassing across property lines and glaring onto adjacent roadways.  All exterior lights shall be turned off or dimmed between 8:30 p.m. and 7:30 a.m.; 10. The Inspection Department shall review the existing masonry wall along the south property line and, if needed, such wall shall be brought up to the Zoning Ordinance's current specifications; 11. Only conforming signage is approved with this petition, and any additional signage shall be separately submitted for review and approval by the Zoning Board of Appeals; 12. No LED light band or exposed neon shall be permitted on this site, including, but not limited to, the building or around the windows; 13. Unless approved by the Inspection Department, any type of exterior advertising, such as promotional flags, streamers, or sponsor vehicles designed to attract the attention of passing motorists, shall be prohibited; 14. The plans referenced in this approving resolution shall be submitted to the Inspection Department with the building permit application(s); and 15. Per Section 13.13 of the Livonia Zoning Ordinance, this approval is valid for one (1) year from the date of approval by the City Council.  Unless a building permit is obtained, this approval shall be null and void after the one (1) year period. Jake Rilett, Project Engineer, The Mannik & Smith Group, Inc., was present to answer questions. On a motion by Councilmember McCullough, supported by Vice President Toy and unanimously adopted, it was: #320-23 RESOLVED, that having considered a communication from the City Planning Commission, dated July 29, 2022, approved for submission by the Mayor, and a communication from Jonathan Hartzell, Stark Road Holdings, LLC, dated July 28, 2022, which in accordance with the provisions of Section 13.13(10) of the Livonia Zoning Ordinance, takes an appeal from a determination made on July 19, 2022, by the City Planning Commission in its resolution 07-41-2022 with regard to Petition 2022-06-02-14 submitted by Stark Road Holdings L.L.C., requesting to utilize a Class C liquor license (sale of beer, wine and spirits for consumption on the premises) in connection with the operation of a multi-purpose recreational facility (Livonia Athletic District) at 14255 Stark Road, located on the west side of Stark Road between Schoolcraft Road and Lyndon Avenue in the Southeast ¼ of Section 21, and a communication from the City Treasurer, dated September 23, 2022, regarding delinquent property taxes due for 14255 Stark Road and a further email communication from Todd E. McIntyre, MLD, General Manager, Livonia Athletic District (LAD), dated September 29, 2023, forwarding receipts for payment in full of the delinquent property taxes, and the Council having conducted a public hearing with regard to this matter on Monday, September 12, 2022, the Council does hereby refer Petition 2022-06-02-14, submitted by Stark Road Holdings L.L.C., to the Committee of the Whole for its report and recommendation. Todd McIntyre, General Manager of Livonia Athletic District, was present to explain the reason for the request and to answer questions. On a motion by Vice President Toy, supported by Councilmember Morgan and unanimously adopted, it was: #321-23 WHEREAS, the City Clerk has received an Application for Commercial Rehabilitation Exemption Certificate from Charles Knoll, President, Future Land Holdings, LLC, on behalf of Ducati Detroit, dated March 14, 2023, to facilitate the redevelopment of property located at 19265 Victor Parkway, Livonia, Michigan 48152, in the SE ¼ of Section 6; and WHEREAS, the City Council legally established Commercial Rehabilitation District #5 on January 27, 2020, pursuant to Council Resolution #25-20 after a public hearing on January 8, 2020, and WHEREAS, the City Clerk has notified in writing the Assessor of the City of Livonia as well as the legislative body of each taxing unit which levies ad valorem property taxes in the local governmental unit in which the proposed facility is to be located, i.e., the City of Livonia, and advised each of them that the said Application and request has been received; and WHEREAS, the City Council has afforded Charles Knoll, President, Future Land Holdings, LLC, on behalf of Ducati Detroit, the Assessor, and a representative of each of the affected taxing units an opportunity for a hearing on this Application and request and said hearing having in fact been conducted at 7:00 p.m., Wednesday, September 13, 2023, at the Livonia City Hall, 33000 Civic Center Drive, Livonia, Michigan; and WHEREAS, the taxable value of the property proposed to be exempt plus the aggregate taxable value of property previously exempt and currently in force under Public Act 210 of 2005 or under Public Act 198 of 1974 (IFT's) does not exceed 5% of the total taxable value of the City of Livonia; and WHEREAS, the application was approved at a public hearing as provided by Section 4(2) of Public Act 210 of 2005 on September 13, 2023; and WHEREAS, the applicant, Future Land Holdings, LLC, is not delinquent in any taxes related to the facility; and WHEREAS, the application is for commercial property as defined in Section 2(a) of Public Act 210 of 2005; and WHEREAS, the applicant, Future Land Holdings, LLC, has provided answers to all required questions under the application instructions to the City of Livonia; and WHEREAS, the City of Livonia requires that rehabilitation of the facility shall be completed by June 1, 2024; and WHEREAS, the commencement of the rehabilitation of the facility did not occur more than six months prior to the filing of the application for exemption; and WHEREAS, the application relates to a rehabilitation program that when completed constitutes a qualified facility within the meaning of Public Act 210 of 2005 and that is situated within a Commercial Rehabilitation District established under Public Act 210 of 2005; and WHEREAS, completion of the qualified facility is calculated to, and will at the time of issuance of the certificate, have the reasonable likelihood to, increase commercial activity, create employment, and revitalize a blighted urban area, in which the facility is situated; and WHEREAS, the rehabilitation includes improvements aggregating 10% or more of the true cash value of the property at commencement of the rehabilitation as provided by Section 2(j) of Public Act 210 of 2005. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LIVONIA AS FOLLOWS: That the City Council, on the basis of the information received from the applicant, Charles Knoll, President, Future Land Holdings, LLC, on behalf of Ducati Detroit, finds and determines: (a) that the granting of this Commercial Rehabilitation Exemption Certificate shall not have the effect of substantially impeding the operation of the local governmental unit or impairing the financial soundness of any taxing unit which levies an ad valorem property tax in the local governmental unit in which the facility is to be located; and (b) the applicant has fully complied with the requirements of Section 8, Act No. 210, P.A. 2005, as amended. That the City Council hereby approves the Application for Commercial Rehabilitation Exemption Certificate from Charles Knoll, President, Future Land Holdings, LLC, on behalf of Ducati Detroit, for the real property, excluding land, located in Commercial Rehabilitation District #5, for the expansion and rehabilitation of the properties located at 19265 Victor Parkway, Livonia, Michigan 48152, for ten (10) years, commencing December 31, 2023, and ending December 31, 2033, pursuant to the provisions of PA 210 of 2005, as amended. On a motion by Vice President Toy, supported by Councilmember McCullough and unanimously adopted, it was: #322-23 RESOLVED, that having considered an application from Christopher Crawford, Chairman of the Board, Livonia Jaycees, dated September 25, 2023, the Council does hereby take this means to indicate that Livonia Jaycees is recognized as a non-profit organization operating in the community, and the action herein being taken is for the purpose of affording the Livonia Jaycees the opportunity to qualify for a Charitable Gaming License or registration from the State of Michigan in accordance with provisions of State statute. Representatives from the Livonia Jaycees were present to explain the reason for the request and to answer questions. The following resolution was made and adopted:   #___-23  WHEREAS, Michigan electors adopted Proposal 2022-2 to amend the Michigan Constitution on November 8, 2022, which in part requires each municipality to have at least one early voting site for statewide and federal elections to accommodate early voting; and   WHEREAS, early voting consists of nine consecutive days of in-person voting starting the second Saturday before the election, the Sunday prior to the election, with a minimum of eight hours of in-person voting each day; and   WHEREAS, Public Act 81 of 2023 grants authority to the legislative body of a local municipality to establish an early voting site; and   WHEREAS, Public Act 81 of 2023 also requires that all early voting dates and times be posted forty-five (45) days prior to every election; and   WHEREAS, an early voting plan must include all of the items listed in MCL 168.720g as amended by PA 81 of 2023 and be filed with Wayne County by the City Clerk by October 30, 2023; and now,   NOW THEREFORE BE IT RESOLVED that the Livonia City Council concurs with the recommendation of the Livonia Election Commission and hereby establishes the early voting site for all statewide and federal elections conducted in the City of Livonia to be Livonia Housing Commission, 10800 Farmington Rd., Livonia, MI 48150.    A roll call vote was taken on the foregoing resolution with the following result:   AYES: NAYS:   The President declared the resolution adopted. On a motion by Councilmember Donovic, supported by Vice President Toy and unanimously adopted, it was: #325-23 RESOLVED, that having considered a communication from the Mayor, dated October 13, 2023, to which is attached an Intergovernmental Agreement between the County of Wayne and the City of Livonia for partial funding in the amount of $8 million to support building the new Livonia Senior Wellness Center and in connection with Project Catalyst: Launching Livonia Vision 21, the Council does hereby approve the proposed Intergovernmental Agreement between the County  of  Wayne  and  the  City  of Livonia and the Mayor and City Clerk are hereby authorized, for and on behalf of the City of Livonia, to execute the Intergovernmental Agreement in the manner and form herein submitted, subject to approval as to form and substance by the Department of Law, and to do all other things necessary or incidental to the full performance of this resolution.
